Subissue: Account status incorrect
Consumer Complaint: I noticed that there were Chargeoffs on my credit report which are not mine. These accounts are not mine and I don't want to report identity theft on my credit report so I wanted these companies to verify this information which is incorrect which is required under FDCPA and FCRA laws. These companies have not responded at all and one company sent me a letter which had no verification whatsoever.

Issue: Managing an account
Subissue: Fee problem
Consumer Complaint: I have a Capital One 360 Performance Savings account. I am attempting to wire a large sum of money to a business. ( approximately $ XXXX ) Capital One has turned this into an opportunity to harvest fees from me. They claim that they have a $ XXXX limit per wire, per day, in order to protect me from fraud. I was also led to believe based on the information provided to me online when attempting to initiate a wire, that this limit could be worked around if I visited a Capital One Retail Branch or XXXX. I took time off from work to visit a branch, only to be told from the Capital One employee at the branch, that they could not assist me because I have a 360 Performance Savings account, and all transactions must be done online. ( This is counter to how Capital One markets these accounts. Even today if you review their site for this product it explicitly states you can open and service this type of an account in a branch. https : //www.capitalone.com/bank/savings-accounts/online-performance-savings-account/ ) The guidance I got from the teller at the branch was that I should call and speak to Capital One. I did this yesterday. I got the same runaround. I was not able to speak to a supervisor as a part of this call. I called again today, and again asked to speak to a supervisor. This time I was able to speak to a supervisor, but XXXX was of no help to me. I opened up a complaint, and was told I would receive a call back. That has not happened yet. Bottom line is that Capital One is charging {$30.00} per online wire transaction for my account. They are doing this in the name of security, even though I went to a branch and presented proof of identity to them. I can only assume that their strategy is optimized to harvest {$120.00} in fees over 4 separate wire transactions instead of executing this in one transaction for a single {$30.00} fee. I now understand how Capital One can afford to pay such high interest rates on these deposits. Not only are they using it to fund their predatory subprime lending activities, but the also make it impossible for you to access the money without paying punishing fees.

Consumer Complaint: Please read attached letter and evidence to support my claim that Capital One severely overcharged interest on Capital One 's Identity theft ( XXXX ) and Capital One 's fraudulent credit card take over on both # XXXX & # XXXX Capital One credit cards this 2023 year. Capital One charged interest on fake false billing line entries, increased limit to 30 % illegal and predatory. Capital One moved payments back and forth between cards fraudulently, place fake payments back and forth between XXXX cards and charged huge amounts of fake interest and late fees all this 2023 year. I won disputes and promised interest credit and got XXXX by Capital One. I want a BLOCK AND DELETE for # XXXX & # XXXX credit cards OFF ALL CREDIT BUREAUS FOR THIS SCAM from Capital One. Issue: Closing your account
Subissue: Company closed your account
Consumer Complaint: I am writing to file a formal complaint against Capital One concerning the unwarranted closure of my credit account and the subsequent allegations of First Party Fraud, as detailed in their correspondence dated XX/XX/XXXX. This matter involves a concerning misinterpretation of the terms within Capital One 's cardholder agreement and raises questions about the legality of their actions. On XX/XX/XXXX, I tendered payment for the bill sent to me by Capital One, adhering meticulously to the provisions outlined in the bill of exchange and the accompanying instructions. The payment, intended to be applied as a positive value to my principal credit account, was, however, deemed by Capital One as illegal and constituting fraudulent activity. This conclusion was reached despite my strict adherence to the guidelines set forth in their cardholder agreement. The cardholder agreement explicitly directs that items bearing restrictive words, conditions, limitations, or special instructions, including those marked " Paid in Full '' or similar language, should be exclusively mailed to the specified address : Capital One XXXX XXXX XXXX XXXX, NC XXXX It is worth noting that all accompanying communications are also subject to this requirement. Despite my compliance with these stipulations, Capital One has deemed my payment and its associated communications as violative of their agreement. Subsequent to their receipt of my payment, Capital One proceeded to close my credit account. Notably, they assert that the closure is attributed to my failure to remit federal reserve notes, a condition not explicitly stipulated in the cardholder agreement. As the original cardholder and holder in due course, I communicated to Capital One that they lack the authority to close my credit account without my explicit permission and, concurrently, retain the tender payment. This action, in my view, constitutes an unauthorized use of my credit, as delineated in 15 USC Sec. 1602 ( p ).

Issue: Problem with a purchase shown on your statement
Subissue: Overcharged for something you did purchase with the card
Consumer Complaint: I was overcharged by a restaurant merchant. I used my Capital One credit card. I did not collect/keep the copy of my credit card receipt. When I realized the ( new ) restaurant employee overcharged me, I visited the bar to attempt to resolve. The attendant took all of my information, took responsibility for the overcharge and stated the employee was new and learning. The attendant said I would hear from the manager within 5 days. After two weeks passed, I disputed the charge with Capital One. Unlike XXXX ( which is a good company ), they made the complaint/grievance process long and difficult. The rep told me it was online fillable form, it was not. I printed and filled out the form as requested. I mailed a copy of the dispute information I had and called again to receive a secure form/link to upload it. I uploaded the form and within 5 minutes I received a response that I was denied and the charge would be re-applied to my account. Why?? The rep on the phone told me my dispute letter would start the process of an investigation on Capital One 's part. They did NOTHING- meanwhile the receipt is sitting at the restaurant with the CORRECT amount I authorized my card be charged for.. And no one did anything. This is not right.
