Consumer Complaint: On XX/XX/23, I deposited a check from my childs school to reimburse us for things we purchased for the school into my CapitalOne360 account. On XX/XX/23, the deposit was reversed from XXXX ( their bank ) because ( as I later found out from the school, it was flagged as possibly fraudulent. ) On XX/XX/23 I realized both my CapitalOne savings and checking accounts were frozen. I called and the person I spoke to told me that security would have to contact me, and that they couldnt connect me to them. I called the number which went to voicemail. I left all requested info but never received a call back. I called and left another message each day. I finally called the credit card side and explained my situation. They told me Id have to speak to security and that it showed they called me that day. They did not. I verified the number they had and had XXXX missed calls. I used XXXX XXXX XXXX to try to get something done and everyone said the same. My childrens school took care of it on their side immediately and said they contacted my bank, but I never could speak to anyone who could verify this. I literally tried everything I could to get some kind of information, bit could not. I did receive a letter in the mail saying security would contact me if necessary. I had XXXX access to my checking or savings accounts from XX/XX/XXXX through XX/XX/XXXX, right before XXXX with no help from the company. No returned calls. No cooperation whatsoever. I couldnt even close my accounts so at least I could get my money. I said I wanted to file a formal complaint and they said they could file that for me. I asked to be copied on any complaint, but again, nothing. The lack of communication caused a lot of XXXX and I could not get to my money. They treated me so poorly and I felt helpless. We have no local branches so I could not go speak to anyone about it.

Consumer Complaint: According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' XXXX XXXX XXXX XXXX, Capital One and XXXX XXXX XXXX XXXX are a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' XXXX XXXX XXXX XXXX, Capital One and XXXX XXXX XXXX XXXX, the financial institutions and the Consumer reporting agencies XXXX and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, XXXX XXXX XXXX XXXX, Capital One and XXXX XXXX XXXX XXXX whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' XXXX XXXX XXXX XXXX, Capital One and XXXX XXXX XXXX XXXX never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services.

Consumer Complaint: On XX/XX/, I deposit a IRS CHECK to Capital One in the amount of {$2800.00}. I expected the money to be held u til the next business day. When I found that The check was being held, Capital One agents in the XXXX told me that an investigation was being made because the check was likely fraudulent or could be fraudulent. A person representing Capital One investigation department informed me that the check the IRS GAVE ME WAS not RIGHT and demanded that I turn over any information they have me and that I will not receive the funds u til an investigation was conducted as to why I received a check. I sent them the requested information and asked them to return the check to me and to close out my account. I told them that they have no right to dispute or dictate a check from the United States Treasury Department. The check was issued and my bank account was legitimate and everything was proper. I was told that they could hold my funds for 60 days if the IRS approved the check. I did nothing wrong. I was treated like a criminal and my money withheld. Their position is that many people have created fake IRS checks and defrauded the Governments and Capital One was taking a stand. I told them their position has nothing to do with me. But yet they indicated that they will investigate my check and withhold funds up to 60 days. They did not accuse me of submitted a fraudulent check. Consumer Complaint: Capital One offers a few ways to verify your identity. One is taking a picture of photo ID and selfie. Another is phone number, and another is tapping the card to the back of your phone. Taking a picture of my ID and doing that selfie does not work. It gives an error that the ID couldn't be verified. The phone number does not work either. I have had this phone number for 7+ years and am the only one on the bill, but are unable to use it to verify. The tapping of the card does not work either. No error given, and phone has all permissions given to app. Capital One does NOT offer manual verification, which is upsetting because they have no branches within my state. How am I supposed to verify if technology isn't working as it should? This is an issue as one of the main reasons I got the card was for it's some of its features such as XXXX XXXX and virtual card numbers, but I can't use these because they can't verify who I am with AI technology evaluating my ID. Called fraud department, called digital services and main line. None could help and just said " keep trying '' after waiting 72 hours. This has been done and still nothing is being accepted.
