Consumer Complaint: I am writing to report on various violations of the Fair Credit Reporting Act ( FCRA ) from the following organizations, XXXX XXXX XXXX, a derivative of XXXX XXXX, XXXX and Capital One ( further known as XXXX ) and XXXX, XXXX and XXXX ( further known as CREDIT REPORTING AGENCIES ). First, all companies, including BANKS, have agreed to follow the regulations to protect consumers ' information. Both BANKS listed have agreed to federal regulations within privacy ( Grimm Leach Baily Act ) and for fair credit reporting ( Fair Credit Reporting Act ). The information that is shown on the consumer report is in violation of more than these regulations and has adversely affected my life as it bears on the credit worthiness, credit standing, credit capacity, character, general reputation, personal characteristics and mode of living. The violations are as followed : Opt Out Laws - BANKS are required to give us the opportunity to opt out of any information. I have not received any notifications to date and my information is still listed with the credit reporting agencies. 15 USC 1681 section 604 ( a ) section 2 states that In general subject to subsection c, any consumer agency may furnish a consumer credit report under the following circumstances and no other : in accordance with the written instructions of the consumer to who it relates. The CREDIT REPORTING AGENCIES and BANKS do not have, nor did I ever give, my permission to and written or any other consent to furnish this information. 15 USC 6802 ( b ) ( c ) states that A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless- the consumer is given an explanation of how the consumer can exercise the non disclosure option. The BANKS never informed me of my right to exercise my nondisclosure option. Further, it is illegal to show payment history as it is in violation of all privacy policies, including the Privacy Act of 1974. To add, this account is an adverse item that is in violation of of USC 1681 ( c ) ( 5 ) which states : Except as authorized under subsection ( b ), no CONSUMER REPORTING AGENCY may make any consumer report containing any of the following items of information : Any ADVERSE item of information other than records of convictions of crimes which antedates the report by more than seven years. Further, the credit reports shows information that falsely represents the status of the account. The accounts show as charge off, which, according to the IRS rules and regulations, these are now CERTIFICATES OF INDEBTEDNESS, which means they are ultimately income and income can not appear on credit reports- another violation!! It is stated that every consumer reporting agency shall maintain reasonable procedures when there is cause for information to be inaccurate. 15 USC 1681 ( a ) states A person shall not furnish any information relating to a consumer to any consumer if the person knows or has reasonable cause to believe that the information is inaccurate. Both BANKS have inaccuracies across the board and all information listed on each agency report is not the same. All of this is also in violation of the Privacy Act of 1974. The CREDIT REPORTING AGENCIES are not maintaining reasonable procedures to avoid violations of for fair credit reporting. Per 12 CFR 1026.7, A consumer may exercise the right to opt out at any time : XXXX and Capital One BANKS, I am opting out HOW you have listed this record. For XXXX, you will see inaccuracies across all credit reports, the payment history shown and the account shown as charge-off. For Capital One, you will see inconsistencies across the credit reports in the payment history, the payment history shown and the account shown as a charge-off. I am exercising my consumer rights for the REMOVAL of all payment history and the status of these accounts updated to paid as agreed and XXXX, XXXX and XXXX, I am holding you accountable to ensure these measures are taken in honor and good faith. I have attached the credit reports that reflect some of the violations listed in this complaint.

Consumer Complaint: Im in the midst of a credit repair with my credit report due ti identity theft and opened a capital one Walmart credit card a month ago. I used the card, paid the balance in full, and then it was closed a week later. I believe this was intentional because of me being XXXX and its obvious to them on the phone, they told me I violated their cards terms and conditions. How? By shopping at Walmart. The company hates XXXX and its obvious.

Consumer Complaint: I noticed sevearl things on my credit report have been documented incorrectly by all the reporting agencies. According to the law, before any information inserted on my consumer report, it should be accurate. Pursuant to 15 USC 1681b ( a ) 2, it states that as a consumer, for anyone to get or use my consumer report, I must provide written permission as it relates to me the consumer. The law also states that the consumer reporting agencies must conduct a proper and thorough investigation. This has not been done. According to the Fair Credit Reporting Act, I have the right to challenge anything and everything that appears to be inaccurate and unclear.

Consumer Complaint: Upon turning XXXX I checked my credit for the first time as I was denied for a starter card. When checking I saw that I had a closed account with Capital One that was effecting my XXXXredit score terribly to the point where I can not even get a secured card. I've tried to reach out to credit bureaus to no avail. I did not make the account, my personal information was used and I was a XXXX when the account was made and its been months of fighting just trying to get this off of my credit. I'm just looking for sometime of help at this point. Thank You

Consumer Complaint: Capital One Credit Card Open date XX/XX/2021 Account number XXXX Amount {$1000.00} high balance of {$1200.00} Contacted Capital One in regards to this account that is reported in my XXXX XXXX and was inform that the account in question was not mine. However, they did nothing to try to assist me in removing it out my credit. I can not apply for a mortgage loan due to their negligence of reporting inaccurate information in my credit which cause my credit drop significantly. This home will not stay in the market for long. XXXX accepted information from companies without asking the companies to confirm the validity of the debt to the consumer. Neither the accounts, addresses, inquiries that were placed in my credit was actually mine. For they negligence my credit has suffered significantly. Their negligence has caused me not to be able to meet the credit criteria/standard for a mortgage loan that I was negotiating the price of a home.

Consumer Complaint: In XXXX, I had a Capital One Credit Card in XXXX XXXX. There were charges on the credit card I did not make, and I reported to Capital One. Also, I was a victim of the XXXX. XXXX Data Breach. I filed a claim with XXXX Data Breach [ their claim info ] between XX/XX/XXXX, and XX/XX/XXXX. Sometime in XXXX, XXXX XXXX XXXX reported a {$1400.00} debt to my Credit Bureau. I attempted at least twice to dispute these charges. On XX/XX/XXXX, XXXX XXXX XXXX was granted a Default Judgement against me in the XXXX XXXX, Precinct XXXX Place XXXX, XXXX XXXX, Texas, for {$1400.00}. and they have proceeded to increase these charges to {$1600.00}, as noted on my credit report. I will continue to dispute these fraudulent charges against me, and I have contacted XXXX 's Restorations Services for assistance today, XXXX XX/XX/XXXX. The check was altered and fraudulently cashed at a Capital One Bank in XXXX XXXX ( Check amount was {$8900.00} ) My checking is with XXXX but the altered check was cashed at Capital One. I have copy of the altered check along with all the account # s. I spoke to the Secret service who gave me a contact name of XXXX XXXX at Capital one fraud dept. She informed me that the funds were frozen in an account and not dispersed. I have been trying to get my money back for 2 weeks. I have the case # from XXXX if needed.
