Capital one denied the claim because the merchant stated i owed them money but the merchant processed a partial refund. When they noticed the partial refund capital one filed a rebuttal. The rebuttal was denied because now the merchant has switched they story to now they couldnt get financing for me. They have looked past all my documentation and sided with the merchant who has switched stories multiple times. This has been going on since XXXX. This has put me in a financial crisis. When i request documentation that was used to make a decision on the claim they send me a copy of my transactions.

Consumer Complaint: Every month, for the past five years, third party collections agency company, XXXX XXXX XXXX collections continues to fraudulently report two closed and paid in full accounts. Since XXXX both Capital One Bank and XXXX XXXXXXXX XXXX have been paid in full on both accounts. This reporting has been disputed numerous times with documentation to the three major bureaus that continue to report the fraud, citing FCRA compliance. These fraudulent and deceptive practices continue to adversely effect the consumer in question, XXXX XXXX XXXX. We are moving to sanction XXXX XXXX XXXX collections creditor ( and the original creditor ) for reporting fraudulent, incorrect, baseless information that are posing negligence and injury resulting in current adverse actions from other creditors at the same time causing XXXX XXXX, instability, mental health relapses, breaks in case management treatment concerning her finances and support. She continues to experience undue financial hardship concerning affordable housing as she has been homeless since XXXX due to these adverse actions. XXXX XXXX also requested correspondence of a paid in full letter from original creditor Capital One Bank in which they agreed to send in XX/XX/XXXX on a recorded call. Capital One Bank has confirmed that this account was discharged in bankruptcy and should not be reported by a third party debt buyer. This creditor is violating federal law, namely section 524 of Title 11 of the United States Code. 5 years of negligence, personal injury, private data breach, and false reporting on the consumer 's credit report. Capital One Bank is in violation of the decision made in the creditor 's meeting by the Trustee of Maryland District Bankruptcy Court proceeding in XXXX -- discharge order ( a copy was sent to Capital One Bank from the US Trustee ) and disregarded by the Bank because reporting via collections resumed in XXXX and hasn't stopped since the stay order and discharge ( according to all three consumer credit bureaus ). This year, we have claimed {$900.00} XXXX in damages via federal settlement proceedings which will have XXXX XXXX reopening her Bankruptcy filing to sanction this third party debt buyer and the original creditors. Consumer Complaint: I am writing to dispute the negative information that has been reported on my credit report. According to the Fair Credit Reporting Act ( FCRA ), I have certain rights to privacy and accuracy of the information on my credit report. I believe that the negative information that has been reported on my credit report is inaccurate and I am requesting that it be removed. Capital One XX/XX/2023 for the amount of XXXX Section 602 of the FCRA gives me the right to privacy with regards to my credit information. I believe that the negative information on my credit report is an invasion of my privacy rights. Furthermore, Section 604 A Section 2 of the FCRA states that a consumer reporting agency can not furnish information on an account without my written instructions. I have not given any such instructions, yet negative information has been reported on my credit report without my consent. Lastly, Section 1666B of the FCRA prohibits a creditor from treating a payment on a credit card account under an open end consumer credit plan as late for purpose. I have made all of my payments on time and in accordance with the terms of my credit agreement. Therefore, any negative information on my credit report related to late payments is inaccurate. I am kindly requesting that you investigate the negative information that has been reported on my credit report and remove any inaccuracies. I believe that this negative information is unfairly impacting my credit score and my ability to obtain credit in the future. Thank you for your time and attention to this matter. I have a FTC ID theft report- and whenever I file the disputes they say the same thing- as " verified by data furnisher '' - but in the description it says " consumer provided vague information. How is a Federal Report vague information? All of the other items on my report were taken care of- and yes there were several ; except for the fact that every hard inquiry except 1 on my report, was not done by me. Also, even the soft inquiries- hundreds of them- still show and affect my score! Before all of this ID Theft, my credit score was at XXXX ; now it is mid XXXX. This has ruined my life and my business! I am a sole proprietor- so the negative impact of all of this has brought my business on the verge of closing! All due to the fact I cant get any financing/credit because of this!

The Company is infringing on the rights of The Consumer by reporting erroneous bankruptcy status on The Consumers XXXX consumer report and erroneously multiple late payments and charge offs on The Consumers XXXX consumer report simultaneously. The Consumer states that he has not received a correspondence from The Company granting The Consumer the option to opt-out, as explained in 15 U.S.C. 6802b.
