It is not mine I have not benefited from nor did I authorize this account to be opened in my name. I have asked for their documentation and they have refused to provide any other information other than canned responses saying there is nothing they can do. Recently I checked my credit report and noticed a mistake. I was devastated to see a late payment show up. Surely this must be a mistake. Consumer Complaint: on XXXX I received an alert from my credit report agency, notifying me of multiple ( 13 ) credit inquiries. Right away I put a freeze on my credit and filed a police report. From what I could see on credit report I contacted and closed all accounts that were opened fraudulently. In XXXX I received an alert that I went over my credit limit on capital one credit card. I have never used capital one, never opened any checking accounts or saving account or credit cards. I contacted capital one, they opened fraud investigation. Capital one refused to give me any information for address that was used to open the credit card or any credit card transaction history. I did send Capital one a copy of my driver license and ss # and they still refuse to give me any information for the credit card that was used in my name. Capital one also refused to change the address on the account, even after I provided them with my drivers license and ss # copies. Capital one also claims they investigated and found that they did not believe the credit card was opened fraudulently, that it was me using the credit card, although credit card was opened in different city, an address where I never resided and accounts were all opened online. I have filed two police reports and froze my credit score, filed report with FTC, and all other companies, including XXXX XXXX where I went in personally and provided all the information. They closed all accounts and removed credit report inquiries. Capital One refuses to do anything and expects me to pay the bill, they refuse to change the address so at least I can get the bills and all account information.

Consumer Complaint: I was contacted by Capital One Bank 's alleged attorney 's office via USPS claiming that I owed Capital One Bank {$8300.00} on XX/XX/XXXX. However, when I asked their attorney to verify the debt/amount due, they refused. I asked for the verification because in XXXX, Capital One Bank suffered a data breach that affected me as a customer, as I was told by XXXX of their representatives that someone opened an account under my name, and I believed the debt they claimed I owed is incorrect. Instead of verifying the debt, the law firm allegedly hired by Capital One Bank or the law firm that bought the alleged debt filed a lawsuit without properly notifying me with a summons. Upon my research of the law firm and their shady business practices, I decided to check court records and that's how I knew there was a pending lawsuit against me. As I retrieved the court documents and an affidavit produced by either the law firm or Capital One Bank, I used XXXX to identify the affiant and the notary public who signed what seems to be a false and robo-signed affidavit with two different companies. Now, doing further research, I see that XXXX XXXX XXXX was fined by the CFPB for predatory robo-signing practices and Capital One Bank along with their debt buyers are practicing the same fraudulent tactics that should be investigated, immediately! Attached to this complaint is an explanation for my claims against Capital One Bank and I am seeking monetary relief for damages as a victim of their shady business practices.

Consumer Complaint: Auto loan originated on XX/XX/XXXX with Capital One Auto. Amount was for XXXX at XXXX percent rate. After closely reviewing the billing statements on XXXX. The total interest paid was XXXX. Total principal paid XXXX. At that time I requested Capital One Auto to review the balances and recalculate the correct payoff, if any amount remained. I notified that I would cease payments until rectified. The department did not respond to my letters until XX/XX/XXXX. Instead of acknowledging my formal request, I received a repossession notice. To avoid the threat of repossession I made the requested minimum payment of XXXX on XX/XX/XXXX. I contacted Capital Auto via phone center reiterating the billing issues. On XX/XX/XXXX the vehicle was towed at my work location. Capital Auto admitted to claiming the vehicle and demanding a release fee of XXXX. I informed Capital one that by repossessing my vehicle after making the requested payment was a criminal act of theft. XX/XX/XXXX i reported the matter to credit bureau After a timely delay I received notice from credit agency in XX/XX/XXXX. Capital Auto agreed to remove the balance of XXXX. Currently as of XX/XX/XXXX credit reporting. The account is worded Write off XXXX. XXXX past due. Along with derogatorily late reporting from XXXX of XXXX during the investigation.
