Consumer Complaint: I was told that " XXXX '' was used on my debit card in XXXXXXXX XXXX XXXX. I never did this! BUT, Capital1 never sent me paper statements or emailed statements. I got none! Their app does not show where purchases came from on the app when you download the XXXX. It only says " Purchases '' not where said purchase was made. Interest for credit card fee, interest for cash advance. It does NOT show where purchases were made from. I was told the purchase was for {$28.00} in XXXX XXXX XXXX. It is now XXXX XXXX XXXX. Capital1 is saying that that {$28.00} has not been paid off, that I never made. I make my monthly payments religiously & on time. I never made the so called " XXXX '' purchase but better yet, how would {$28.00} NOT have been paid off in the course of 1 year and 5 months? This is not possible. I was told my payments are allocated how they deem fit, per their contract, but 1 year and 5 months they have been charging the normal interest rate PLUS the 31.4 % interest rate for the " XXXX '' I never made. So I'm paying for 2 SEPARATE interest rates? How is this legal? How is this possible to charge for that length of time for the amount of {$28.00}, every month at 31.4 % interest rate as a " cash withdrawal in XXXX XXXX XXXX '' on top of the 29.99 % monthly interest rate? This is not possible that that specific amount has not been paid off! And once again, I didn't make that charge. Credit card companies should not be allowed to double dip in the interest pool.

Consumer Complaint: On or about XX/XX/XXXX I filed a complaint with the Office of the Comptroller of the Currency ( XXXX ) against Capital One, NA. The complaint, see attachment, was concerning an auto loan Capital One continues to report, as of XX/XX/XXXX, to XXXX CREDIT BUREAU as a delinquent auto loan. In a letter dated XX/XX/XXXX, the OCC informed me that it contacted Capital One, NA regarding this matter and that Capital One had responded. The OCC further explained that if I " wish to dispute the bank 's position '' that I would need to follow up with this agency, which is what I am doing now. Capital One, despite its response letter, see attachment, can still collect on its purported loan although no title has been issued by the New Jersey Motor Vehicle Commission under my name. An assignment of title is required to show the purchase of the car. I stopped making payments on the purported loan in XX/XX/XXXX. Therefore, the 5 year limitation allotted to Capital One to dispose of such asset connected with a debt previously contracted that was established through OCC regulations has expired, see OCC complaint. Apparently, the car does not serve as proper collateral for the purported loan because of the numerous dangerous nationwide recalls, including leaking gasoline pipes in the engine. Capital One can still file suit against me because Capital One was allowed by the US District Court of New Jersey to collect the purported auto loan debt in a federal lawsuit I filed because Capital One is a National Bank. The Third Circuit Court of Appeals judges also affirmed Capital One 's counterclaim against me and even ordered me to pay Capital Ones litigation costs for the appeal, see attached Petition for Panel Rehearing and Rehearing En banc. The chief judge 's denial of my Petition was limited to panel rehearing only, " XXXX XXXXXXXX XXXX vote is limited to Panel rehearing only. ( TMM ) '' see attached email from the clerk of the court. I am afraid that Capital One can still collect on the debt through the courts in New Jersey as it did in the US District Court and Third Circuit Court of Appeals, except for the chief judge.

All three accounts opened, two used daily and the third never able to use, and to this day I still have no resolution, so I requested a refund and closure of all accounts. Back in XX/XX/XXXX, I was surprised to find out that my card ending in XXXX was restricted due to additional information needed to verify my accountwhich I provided. They opened the business account ending in XXXX, sent me welcome letters, pin verification, then all of a sudden they restricted all my cards! Upon contacting Capital One, they gave me the run around stated the could not verify the account was tied to me personally. After several documents sent, bank statements sent, calls, hours wasted and monthly phone conversations with different members and no resolution, I explained to them to close all my accounts. Their response was they were protecting me as a consumer when I have provided all documentation, in addition to several prior years as a customer. Im very upset about the credit balances not being refunded on my accounts due to overpayment, which I am due, only to see they added a line adjustment XXXX out my accounts back in XX/XX/XXXX, and never issuing me a refund. The accounts are still shown on my account as restricted which I should have never had this status, not to mention a great deal of inconveniences with my monthly purchases. This was very unprofessional, uncalled for and unethical.

Consumer Complaint: I have had 3 incidents recently of people trying to open either savings on checking accounts w/ 3 different banks using my name, email address & i assume my SSN. On XX/XX/2023 I received email from Capital One claiming they needed my ID for application XXXX & another one claiming my phone # was updated. I have never opened an account with them. I'm not trying to open one either. I called Capital One fraud line and was told they couldn't even check to see if something was opened w/o giving my SSN over the phone even though i gave them the application # that was in the email. I did not see an email address that i could forward the emails to for Capital One to report the fraud to. In XX/XX/2023 I received emails from XXXX XXXX XXXX and XXXX saying applications were declined. I forwarded the email from XXXX XXXX XXXX to their security/abuse email address & i called one of their locations to report the matter. I never got a response to the emails but was told over the phone that the account would be closed. I called XXXX too & supposedly the account was declined & would be flagged. I have never applied for any type of bank or credit account with these banks. I'm pretty sure my information has been exposed multiple times during various breaches ( i.e. XXXX, XXXX, IRS, etc ). I do have fraud alerts on my credit reports and it appears the banks are using something else other than credit reports to start applications for checking & savings accounts. I have also added an alert to the XXXX XXXX site. But that does not appear to stop folks from trying to open stuff in my name.

They have not supplied this information and they must remove the late payments from my credit report. Per Federal Law, credit reporting companies must complete their investigation in 30 days. By failing to do so, they must delete the late payments from my credit report.
