Consumer Complaint: On XX/XX/2023, I called Capital One auto to enter into a single case agreement for my monthly auto payments that at the time was only 8 days late. The representative I spoke with informed me I could put my next 3 months payments into a payment plan to bring my car note current and avoid any further collections efforts. I agreed to the terms outlined in the 4 Single Case Agreements ( SCA ) that where email to me by the Capital One Rep. I have made 2 of the 4 schedule payments on time as agreed. However, Capital One never updated my account to include the schedule payments. Even after I called them on XX/XX/XXXX when they sent me an repossession notice and on XX/XX/XXXX when online it showed my account as 30 days late. Both reps told me as long as I had a payment plan I was fine. For the past 7 years I have made all my payments on time and had a 100 % on-time payments history on my credit report. I then received alerts from XXXX, XXXX and XXXX stating that I had a late payment and my credit score dropped XXXX points after Capital One reported me 30 days late on XX/XX/XXXXwhen I made the agreed upon SCA in the amout of XXXX on XX/XX/XXXX.

Consumer Complaint: I needed to get a new card from Capital One because someone else tried to charge something on my card. To get the new card, they needed to authenticate it was me. So they sent a one-time code in a text. Then the representative read off terms ( I never saw a written version ) that I would agree to give the credit card company permission to have my cell phone carrier give complete access to all my cell phone data from that point on. I am an attorney, so I recognized exactly what they were asking me to give them. I doubt most people would know since it was legal jargon that was quickly rattled off. Only when I said no numerous times ( over a dozen times ) and said this would end my relationship with this company did they provide a different method to authenticate myself. From my perspective, this is a blatant attempt to violate my privacy and a clear UDAP violation.

Consumer Complaint: XXXX XXXX ADVERTISES AS FREE BUT IS NOT FREE. This is a result of misleading advertisement for a FREE XXXX XXXX account. I set up a new XXXX address and used a Company Capital One credit card because I was called by a XXXX Recruiter Rep requiring a CC to use the free service to be canceled at any time. I said to cancel after 3 days on the XXXX recorded line. My staff paid the CC for months before I realized. A Capital One Rep called a XXXX Representative with me, and the XXXX rep acknowledged that I did not use the XXXX service except for that one day but would not adjust the monthly charges. I would not pay. I asked to listen my conversation on the XXXX recorded line with the Capital One Rep but the XXXX rep said I would need a subpoena. Truly FALSE advertisement.

Consumer Complaint: On XXXX XXXX, 2023, I applied for a credit card through Capital One and I was denied access to my credit. My suspicions of Securities Fraud were confirmed when I received a subsequent email outlining their adverse action against my application which details their violations of the Consumer Credit Protection Act, Fair Access to Credit Act, and The Truth In Lending Act by discriminating against me based on my previous good faith exercise of my rights under the Consumer Credit Protection Act. I contacted Capital One customer service about the email and questioned the discrimination and was informed I would receive a letter explaining the adverse action, which was only sent as the previously mentioned email. I then requested that if the final decision is a denial which I was informed was the status, Capital One return my application for credit to me as it amounted to an invalid contract due to their failure to return value to me for the security provided to them in the form of the application that provides them access to my credit for which they will receive the face value in XXXX 's upon delivery to a Federal Reserve Agent. This request was denied and I was informed they intended to maintain control of this instrument as well as report to the credit report agencies for a minimum of 24 months after their having accessed my credit history.

Consumer Complaint: Notice to agent is notice to principal, notice to principal is notice to agent I have been deceived and misled about the use of my credit they have misinformed me and after checking the fictitious contract they created I have spotted and seen that it states very clearly that the security originally is more as the credit card has been paid in full the moment I gave them access to my credit to my credit 15 usc 1602 ( I ) credit card means any card, plate, coupon book or other credit device existing for the purpose of obtaining money, property, labor, or services on credit. I gave them my credit card and it entered me into a consumer credit transaction and that created a finance charge in pursuant to 15 usc 1605 ( a ) Except as otherwise provided in this section, the amount of the finance charge in connection with any consumer credit transaction shall be determined as the sum of all charges, payable directly or indirectly by the person to whom the credit is extended, and imposed directly or indirectly by the creditor as an incident to the extension of credit. The finance charge does not include charges of a type payable in a comparable cash transaction. In Pursuant to 15 USC 1681a ( 2 ) ( B ) Anything with my credit card which defined in TILA is my SSN should be excluded from my consumer report. In Pursuant to 15 usc 1681a ( 2 ) Exclusions. Consumer Complaint: I have been determined to be XXXX by Social Security and the courts. So my student loans have been forgiven after having them for more than XXXX yrs and paying back them when I was working and other times being on deferment due to my XXXX. About a year ago they told me they would be forgiven and that all the principal amounts I made into the payments would be refunded back to me along with me being under a 3 year monitoring in case I went back to work, which would reinstate them. Fast XXXX to XX/XX/XXXX... The Department of Education issued a refund check in the amount of {$1100.00} and I received it on or about the XXXX of XXXX. SO I did a deposit through my XXXX XXXX banking app where you scan both sides of the check and deposit it. The app told me the check would be on hold for 2 days while they get the funds payable into my account. At the time, I even had more than that amount in my checking account to cover it because I was just paid my SSDI check of XXXX on that Monday the XXXX, XXXX. I even received an email ( form letter ) saying the funds were on hold until the XXXX and would be released at that time. I didn't think anything of it and went on about my life until the XXXX ... the funds were never released and to this day, they are still holding my check while threatening me that if I take it somewhere else, they will charge me with FRAUD! They literally said that to me on the phone multiple times. I have called no less than XXXX times trying to do anything I can to resolve this issue. I have spoken to managers, front line people, and even drove XXXX miles round trip and took the physical check into the bank in XXXX, and everyone there said there is NOTHING they can do to help me. They even told me if I deposit it into the ATM, it is AGAIN fraud because I would be trying to cash the check twice. So I am stuck with NO MONEY, a hold that their FRAUD department says will NOT be released until XX/XX/XXXX, and a USELESS check that no matter what I do, I can go to jail for even trying to cash or deposit it. I DON'T UNDERSTAND... I AM NOT A CRIMINAL, I HAVE NEVER SEEN A HOLD THAT IS 60 DAYS LONG FOR A TREASURY ISSUED REFUND CHECK OF LESS THAN XXXX! I live PAYCHECK TO PAYCHECK .... ( MY XXXX DIED IN THE XXXX ON XXXX XXXX AND HIS WIFE IS SUFFERING!!! ) MY VA XXXX CHECK COMES ON THE XXXX OF {$1500.00} AND MY RENT IS XXXX AND IT'S NOT A NICE PLACE.. I have XXXX left after my rent for gas, food, bills, etc My SSDI is XXXX IN THE MIDDLE OF THE MONTH AND THAT IS SUPPOSED TO PAY EVERY OTHER BILL I HAVE, IT NEVER DOES.
