Consumer Complaint: I began sending my payments to Capital One by endorsing the remittance coupon on the bottom of my billing statement. Prior to endorsing the bill, I contacted in writing, the CFO of Capital One, XXXX XXXX, as agent of behalf of the principal, accepting all rights, all titles, all interest and all guaranteed equity owed to the principal of the account and instructing XXXX XXXX XXXX to apply the principal 's balance of {$6300.00} to the principal 's account and to accept the tender of payment. In this letter, I also stated that if there were any discrepancies, that he should respond in writing within 5 business days of receipt and if there was no communication, I could assume that the aforesaid instructions had been completed. Many days later, I sent a second letter to XXXX XXXX XXXX as an opportunity to cure, expressing the same acceptance of all titles, all rights, all interest and all guaranteed equity to the principal and to apply the principal 's balance to the principal 's account and that he should respond within 5 business days or receipt if there were any discrepancies and again, that if there was no communication, that I could assume he had completed the instructions given. I had received confirmation by certified mail that the letters sent to CFO XXXX XXXX had been received. I did not receive anything in return from CFO of Capital One XXXX XXXX, so as stated in the letters sent to him, I assumed that the instructions given had been completed. On XX/XX/2023, days after sending my first endorsed bill, I tried to make a purchase using my Capital One card, which still had an available credit balance from the precious debit payment that was made on the account from the previous month and my card was declined. When I called Capital One to inquire why my card had been declined, the representative that I spoke to, told me that my account was closed on XX/XX/2023 because of the instructions that were written on the remittance coupon. Days later I received a letter in the mail from Capital One stating that my account had been closed because " activity on this or another account is not consistent with our expectations for account usage and violates the Capital One Customer Agreement '' and that I would still have to make payments on said closed account. I also received a letter from Capital One saying that they had removed my name and address from future Capital One credit offers. I asked Capital One for full disclosure of the account including a copy of the original contract for the account and the sent me a copy of their Customer Agreement which reads under subsection " Making Payments '', " Your payments must be made in U.S dollars from a U.S account in a form acceptable to us. We do not accept cash payments through the mail. You may not make payments with funds from your account or any other credit account with us or any other company in the Capital One organization. You must send mailed payments to us as instructed on your statement unless we tell you otherwise ''. I believe that Capital One is discriminating against me by not allowing me to endorse my bill using a bill of exchange, which is applicable by law under the Bill of Exchange Act as well as by removing my information prohibiting me from being able to obtain any credit through Capital One, which if a violation of the Equal Credit Opportunity Act.

Consumer Complaint: I had filed a consumer, financial protection agency complete against XXXX XXXX in XXXX XXXX Approximately XX/XX/2023. XXXXXXXX XXXX froze my account two years ago for a joint IRS tax refund that my husband signed and I signed and I put in my personal checking account. My husband and I were going through divorce and he complained to the bank that he didnt get his half of the refund, so XXXX XXXX account with the understanding that I was to bring my husband in and he signed an affidavit that he signed the check and I returned the check to them. Theres a restraining order on my husband for XXXX. He was arrested for XXXX XXXX, and I could not bring him in and he cant even be near me. The bank went ahead and hold on the check for approximately a month and then release the funds. And then place the throw it freeze on the account with those stipulations. Unfortunately, XXXX had cashed the check and I was unable to go to the IRS to have them issue to separate checks so the funds still remain in the bank account and XXXX still will not release the funds to me, I file consumer financial protection complaint and they actually released the hold on the account and I had verified it with Capital One Bank. All three of us were on the phone and XXXXXXXX XXXXXXXX is shirt capital one bank with me on the phone that there was no holds on the account and that they could transfer the funds and there would be no problem with me having the money. Well, two weeks later they reverse the funds so I attempted to transfer again to make sure that maybe there was an error and I did this probably three or four times and they reversed it every time. Well, One has no My Account and will not release hold. They said its under investigation its been 15 days now and I cant make my auto loan payment. I cant use my credit cards. They have all my money and commercial has all my other money and Im sitting here looking at no food. No gas cant pay my bills. My credit is gone down because I cant even pay the car payment that One has and I can not pay it with my own checking account. They allow me to transfer it but then they reverse it now, and basically Im sitting here looking at my electricity is going to be cut off and I have no access to any financial banking. Im very frustrated I was not allowed to have a XXXX this year because of this and my phones gon na be cut off Im trying to operate my own business and I have no access to funds. This has been the most horrific experience in banking Ive ever had I feel its very unfair. They dont care everything is computer generated and operated and I cant talk to anybody nobody ever calls me back when I do leave messages and they said they dont know when theyre gon na ever really XXXX. I have a mortgage payment is due. I have car payments thats due. I cant pay any bills.

Consumer Complaint: on XX/XX/26 i contacted Capital One about 4 charges from XXXX XXXX XXXX that i was not aware of what they were. Cap 1 informed me they would contact XXXX XXXX XXXX and inform me of the result of the inquiry. I did not receive an email or phone call. This week i received from XXXX XXXX XXXX a past due notice for 2 of the 4 charges. I contacted Cap1 to see what their inquiry found and was told i was sent messages, but did not respond to them, so they closed the case. For some reason they paid XXXX XXXX XXXX XXXX of the disputed charges but not the others. i stated i had not received any communication. The customer service agent told me it would be online where i log into my account. She directed me and it took her over 5 minutes to find out where messages are placed. and she was very competent. no on ever told me i would constantly need to check online to see if they were communicating with me. this is deceptive and could be damaging. no one just places ( in this case hides ) messages on their site without telling the customer that a message has been sent and how to access it. othe companies either send an email detailing the situation, or one telling you to check your messages on the company site. Capital One should make sure customers are aware of communications and make it easy for them to be accessed.

Consumer Complaint: I discovered unauthorized charges on my account in XXXX, reported them promptly, and while I appreciate the initial efforts made by the bank, I am still facing a significant loss of approximately {$1000.00}. I understand that an investigation was conducted, and some funds were reimbursed. However, my subsequent claim, followed by an appeal, was denied, citing that the charges were not considered fraudulent as the card was in my possession during the period of unauthorized transactions. This reasoning seems perplexing to me, as the mere possession of the card does not negate the fact that these charges were unauthorized and unknown to me until XXXX. It challenges the essence of security and trust that customers place in their banking institutions. I am struggling to comprehend how, despite acknowledging the charges are not mine, they are not being treated as fraudulent. Additionally, I would like to draw your attention to the nature of the charges themselves. The names associated with these transactions, such as " XXXX '' and " XXXX '' appear highly suspicious and do not resemble legitimate businesses. It is evident that these entities are not genuine, and the frequency and magnitude of the charges further underscore their fraudulent nature. As a responsible account holder, I assure you that I would never knowingly engage in transactions with such obscure entities, and it is disheartening to see these charges dismissed as legitimate. Your reconsideration of this aspect would greatly contribute to a fair resolution of this matter. As a college student, every dollar is crucial to my ability to afford education. The financial strain resulting from these unauthorized charges is impacting my academic pursuits. I urge you to consider the gravity of my situation and the vital role these funds play in my ability to continue my education seamlessly. I have exhausted all internal avenues with the bank, and regrettably, my appeals for a fair resolution have been unsuccessful. At this point, I am left with no choice but to inform you that if my funds are not fully restored promptly, I will be compelled to file a police report regarding this matter. It is disheartening to resort to such measures, but I believe it is my only option to seek justice and recover the funds rightfully mine. I kindly request your urgent attention and a thorough reconsideration of my case. Consumer Complaint: I recently made a payment on XX/XX/XXXX. Prior to that I made XXXX payments. XXXX in XXXX and had a problem with insufficient funds. Second payment I got the account number wrong so it bounced back. I agree to these payments. Lastly I was told by capital one I made a payment from a XXXX account which is not mines. I let them know this is a fraudulent payment. This has happened to me across all of my cards due to the fact I was not able to use my cards. I had a personal problem thats put me out of life for the last 3 months. I am trying to get myself back together now and made a payment only for my account to be closed. I need access to credit all of this has destroyed my life. I need assistance with this.
