Consumer Complaint: Subject : Capital One Follow-Up Consumer Opt-Out Dispute - Non-Compliance with Written Instructions To Opt-Out of Furnishing Data on my Consumer report for the Following Accounts XXXXXXXX XXXX XXXX XXXX XXXXXXXX XXXX ending in XXXX XXXX XXXX XXXX XXXX XXXX ending in XXXX Dear Consumer Financial Protection Bureau, I am writing to express my deep concern and frustration regarding the lack of response from Capital One after sending opt-out letters on both XX/XX/XXXX, XX/XX/XXXX, XX/XX/2023. Since then, the company has failed to meet my written instructions, and my consumer information continues to be disclosed without my consent. As a Federally protected consumer, I have opted out of any and all authorizations, whether written or unwritten, verbal or non-verbal, that I may have given to Capital One. This request is in accordance with my explicit opt-out directive, which covers both written and unwritten, verbal and non-verbal authorizations, as per 15 U.S. Code 6802. **Compensatory Damages : ** In the event that Capital One willfully continues non-compliance with 15 U.S. Code 6802 by failing to honor my opt-out requests, I reserve the right to seek compensatory damages. Consumer Complaint: My Capital One savings account was closed due to some fraud in my account. Capital one told me that they would be mailing my savings money to me via a check. I asked the bank to change my address before sending due to our mail system being down. They sent first check without changing the address and claimed it was mailed out on XX/XX/XXXX. I waited 10 business days and the check never arrived. I called again around XXXX and thats when Capital one said they would mail another check to me since they could see that the first one had not been deposited. Then I called on XX/XX/XXXX and said I had not received the second check. The manager told me that I would receive and email to determine if an affidavit was needed or not. Then they would go through with canceling the check before sending on another. When I called a fourth time on XX/XX/XXXX, to inform them that I had not received an email, they told me the conversation with the manager had not been looked at or processed. They also made a note that I would prefer to have my funds transferred to an external account. I received an affidavit via email on XX/XX/XXXX, but my lawyer instructed me to not sign it. Together, my lawyer and I called capital one on XXXX, because they would not speak to my lawyer without my presence. The exchange lasted over two hours, we were transferred to four different people, placed on hold for a total of 45 minutes, and were told that a new check would be expedited to a new mailing address within 5 business days. After five business days, I still never received my savings check. My lawyer and I called again on XX/XX/XXXX and the employees continued to go through the same process to sending another check in the mail. After we repeatedly asked for a new plan of action for about an hour, we were transferred to a manager, who had no knowledge of recent events and hung up on us before a course of action was determined. This was the last communication I have had with anyone from Capital One banking.

Consumer Complaint: I am a XXXXXXXX XXXX XXXXXXXX XXXXXXXX XXXX who who earned XXXX reward miles with a Capital One credit card. This was equivalent to a dollar value of {$470.00} for travel purchases. Capital one advertises on its webpage that the miles never expire as long as you do not Close your account and keep it in good standing. Capital One does not indicate what it means by good standing. I live half the year in California and half the year in Vermont. Mail is forwarded between the two states. I just discovered that Capital One closed my account because of lack of activity with the card. I spoke to two members of the customer Solutions team at capital one who said they sent a letter to me in XXXX indicating there was A lack of activity on the account. That letter was sent to California at a time we were in Vermont. We never received the letter. Had we received it we certainly would have made a purchase with the card or redeemed our miles for an airline ticket to keep the account active. Capital one said this was the only Notification that was sent ; there was no other letter, email, or phone call. When I requested that the miles be reinstated, I was told I had no recourse and the miles were permanently forfeited. Both agents said an appeal or escalation was not possible. I would like a replacement of the miles or the equivalent in cash. My account Number was XXXX the expiration date was XX/XX/26 and the security code was XXXX. My name on the card was XXXX XXXX XXXX. Consumer Complaint: On XX/XX/2023 I was wrongfully billed by XXXX. I called XXXX right after the charge. They refused to credit me. I emailed them the same day and that didn't help either. I contacted Capital one for help. I called Capital one because I didn't have certain things that they asked for to progress the dispute. I told the guy that I didn't have certain things because this was a random unauthorized transaction. All I had was the email ( I still have ) I sent XXXX right after, explaining what happened and to cancel the transaction. The gentleman told me that it would do to send a letter and enclose the email proof. I did so but instead of reading the letter and helping me at all. Capital one rejected my dispute and sided with XXXX. This is so wrong I have been an XXXX customer to Capital one for many years.
