In accordance with the Fair Credit Reporting Act this creditor has violated my rights under 15 USC 1681section 602 states that I have a right to privacy. 15 USC 1681 section 604 a section 2 it also states a consumer reporting agency can not furnish an account without my written instructions, under 15 USC 1666b a creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose.

Consumer Complaint: On XX/XX/XXXXXXXX XXXX XXXXXXXX an individual claiming to be from XXXX customer service had me send {$160.00} via XXXX thru capital one. This was done via my phone as they had me log into my checking account to verify it was me to settle a dispute with missing items via XXXX order. They had me download an app where they where able to take control of my mobile phone. I immediately called capital one that same day and file D a complaint with the Federal trade commission. They informed me they would investigate, which would take 10 days and I was admittedly told the funds of {$160.00} would be credited back to my account. Now they said no. I've been fighting with XXXX and capital one since XX/XX/XXXX with doors slammed in face via the phone. The same fake XXXX scammer also debited {$100.00} as they went jnto my XXXX account and placed a {$100.00} gift card using one of my credit cards on file with XXXX in my account payments. The funds that was send thru XXXX thru capital one doesn't even exist and the number they called from was disconnected immediately. Please help.Thanks

Consumer Complaint: My divorce was just recently final and I was in a very toxic, XXXX marriage. I had zero control of bills, emails or anything of importance. After I escaped and filed for divorce I started getting letters in the mail from all different credit card companies. Here to find out these were open Freudianly from my ex husband and he had all the statements coming paperless. My attorney has filed contempt charges and fraud charges are reported also. The 3 credit reports are attached that show all these credit cards in my name and they were not opened nor used by me. This is causing a major problem as I am receiving calls non stop and even to my employer. Can you please help with this?

Consumer Complaint: On XX/XX/2023 XXXX charges were made to my Capitol One credit card, while I was at work. I received a text alert by Capitol One asking if I had made the charges and I sent a text response of no and then called Capitol One to report the fraudulent charges. The fist charge was {$870.00} at an online company XXXX XXXX XXXX XXXX and the second charge was for {$180.00} at XXXX XXXX XXXX XXXX XXXX XXXX. The Representative for Capitol One reassured me and we canceled my credit card and I was issued a new credit card. I received an email also reassuring me and documenting the fraudulent report. The next day Monday XX/XX/2033, I called Capital One because both charges had posted and XX/XX/XXXX was a Sunday and I wanted to follow up. The Capitol One representative told me that credits were issued and that they would investigate the report. At no time did the representative inform me that the charges were considered legitimate. That same day of XX/XX/XXXX, my email inbox was flooded with around XXXX emails subscribing my email to numerous companies, a lot of them foreign and in languages that I could not read. This was clearly a hacking job, identity theft situation. At no time was I contacted by Capital One to inform me that they considered both charges legitimate. I found out that I was re-charged because I went online evening of XX/XX/2023 to pay my bill and discovered my balance was much higher than anticipated, I immediately called Capital One and was informed by XXXX representatives, XXXX a Supervisor, that because my email, home address and phone number associated with my account was used, tracking numbers were issued and packages have been delivered to my address, they considered the charges to be legitimate. I told the Representative that I called the day they were made XX/XX/2023 because my information was stolen and that I did not make those charges. The Representative essentially stated Capital One declared that I was lying, the Merchant held the power and that I had to now prove that the charges were false. At no time since XX/XX/XXXX was I told this. I never received any correspondence from either online Merchant ( XXXX or XXXX ) regarding order numbers, records, shipping information, accounts or any other information because they are obviously fraudulent charges and accounts made. Neither company has a phone number or address associated with the information that I obtained through Capital One. Capital One told me to email the company. Had I been made aware I might have been ably to follow up with the company. I have filed an Identity Theft Report, a claim with the XXXX and now this claim to follow up. I dont understand why Capital One XXXX did not protect me from identity theft and these fraudulent charges the very day that they were made and discovered. This is a crime and I am a victim. I will also be filing a police report with my local branch.

XXXX my insurance company XXXX sent in their payment and I paid off the remaining balance of {$370.00} twice so far. The first time I paid the {$370.00} by debt card was on XX/XX/XXXX Capital on said they didnt receive it but my bank XXXX verified the debt card payment was approve immediately because the money was there and debt card transaction is immediate. So after arguing with Capital One Auto Finance and them stating that I needed to make another payment for {$370.00} to close out the account I did so again on XXXX XXXX and this took care of the remaining balance of XXXX. However today XX/XX/XXXX Capital One Auto Finance placed an other balance again for {$370.00} preventing the pay off. Also there was a refund check sent to Capital XXXX by XXXX XXXX for gap insurance and warranty coverage. I havent received a refund from Capital One and they keep charging me {$370.00}. Please review these financial documents.

On XX/XX/2023, the check cleared but capital one sent an email that the funds will be available on XX/XX/2023. As on XX/XX/2023, the funds are not available for transactions. The bank has placed me on reaching voicemails. I can not reach any agent or customer representatives. I have tried to contact them for the past two weeks up to no avail. I do not know why they do not want me to assess my funds to be able to pay urgent bills. I hope that Cfbp will intervene so that this issue will not happen to unsuspecting customers.

Consumer Complaint: I am making this complaint because Capital One is refusing to provide me with information about unauthorized withdrawals from my checking account amounting to {$800.00}. On XX/XX/XXXX, two unauthorized transactions occurred at an ATM at a XXXX in XXXX. In each unauthorized transaction, {$400.00} was withdrawn from my checking acount, totalling {$800.00} in withdrawals. Shortly after discovering the unauthorized transactions, I informed Capital One. On XX/XX/XXXX, the company said that it had begun an investigation of my claim, which was assigned the number XXXX. The company provisionally refunded the {$800.00}, and later decided the claim in my favor on XX/XX/XXXX. However, Capital One has refused my repeated attempts to obtain information about how the unauthorized transactions occurred and what actions the company is taking to prevent future such thefts. On XX/XX/XXXX, the company responded to my first request for information about the incident by saying " this is not something we are able to provide for approved claims. '' In a subsequent phone conversation, a Capital One representative submitted on my behalf a second request for information. But on XX/XX/XXXX, the company once again denied my request using identical language, with no additional explanation. Capital One 's opacity in this regard suggests the company is attempting to conceal its inability to adequately address security vulnerabilities that are leaving consumers open to thefts like the one I experienced.
