Consumer Complaint: Attached is the company 's attempt to avoid complying with my ( Certified Letter ), asking for verification in writing. They avoided my instructions by denying that any copies exist because, " an application was completed '' ( possibly because they don't know via ), " phone or internet '' as per their response ( s ) to me in the attached LETTERS below. In another response to me they are saying if I need anything else refer back to the credit agencies for more information. Totally disregarding their responsibility to me the consumer and violating consumer laws of fair treatment to consumers exposing the culture of the companies predatory practices.

Consumer Complaint: On Friday XX/XX/XXXX at XXXX XXXX. C.S.T. My wife, XXXX XXXX, who is on the account, deposted {$950.00} Cash at an ATM located at XXXX XXXX XXXX XXXX, XXXX, TX XXXX, United States. The ATM had just gotten repaired by a repair tech. She was in the other line, and he flagged her to come over. She asked if it was good to go and he said yes. He watched as she deposted {$950.00} Cash. There were FOUR {$100.00} bills, and the rest was {$20.00} and one {$10.00} bill. During the deposit, the ATM machined malfunctioned and the repair tech said, " that's not supposed to happen ''. The cash did not deposit to our account. The ATM did not produce a receipt or any paper document stating what happened. The repair tech said he will put the money aside to a separate area inside the ATM room so it can be deposited/ returned by a Capital One employee. My wife called me, XXXX XXXX, the husband and I left work early to come assist with the situation. The repair was locked inside the room and would not come out to talk. I could see he had the ATM pulled open from the back and was on the phone with someone. A short time after, another repair tech came up and spoke to us. He said he can not return the money, or take our information because he works for capital one, not me. While there, I called capital one and made a claim. The number is XXXX. Since then the only correspondence I have received is an email stating they are working on the claim. This is the most unprofessional experience I have ever gone through. Capital one is not helping resolve the issue. Someone should have already gone to that ATM and gotten our money out. It has been 4 days since the incident and not one person has reached out to us. At this point, I consider it stolen.

The negative balance {$150.00} caused my account to XXXX on with balance owing- {$150.00}. Moreover, it reflected in my XXXX report balance owed to Capital One - {$150.00} On XX/XX/XXXX Capital One agreed with me and informed me that {$160.00} would be put back into my account. I check my XXXX consumer report and it inaccurately stated that I paid in full {$160.00} on XX/XX/XXXX. I never paid any money to Capital One to have my XXXX report state {$150.00} paid in full. Furthermore, {$160.00} was debited back into my account by Capital One. The entry by Capital One stating that I paid {$150.00} on my XXXX report has to get deleted.

Consumer Complaint: My debit card stopped working on XX/XX/2023. I called Capital One to ask why the card was not working. They said it had been locked as part of an investigation. I went home and did some research and noticed that maybe it was because I was still getting checks from my new job out of NY ( I work remote ). I continued to call for a week straight. I finally went up to the bank on XX/XX/2023. The banker told me that Capital One had decided to terminate their relationship with me. I asked what had happened and they told me they could not tell me. They told me to call a XXXX XXXX XXXX and leave a message. So I have done that everyday since. In the interim I continued to try and speak with anybody that would give me answers and I was finally put through to the XXXX XXXX XXXX '. I asked the following questions with the following answers- Can you tell me why my account has been frozen? No- Can you tell me when my account will be unfrozen? No- Can you help me figure out what the timeline is for this process? No we don't have a timeline - Can you send me a policy that outlines the justification for this asset XXXX? We don't have a policy. - So I just wait until XXXX day hoping this investigation wraps up and in the meantime hope it actually gets done? Yes it will happen eventually.

I have been a Capital One customer since XXXX of XXXX and during that time, I have enjoyed my experience greatly. I am writing this letter because I noticed that my most recent credit report contains a late payment reported on XX/XX/XXXX on my CAPITAL ONE BANK USA account. I want you to know that I understand my financial obligations, and if it wasnt for me forgetting to update my account with my new card. I would have never missed the payment.
