I did not recognize this account. I am a victim of identity theft. My credit report 's true and accurate creditworthiness has been damaged by Capital One Bank wrong reporting. I am hopeful that under the laws of the Fair Credit Reporting Act ( FCRA ) you will investigate and send a notification to the credit reporting agencies and original creditor to DELETE the fraudulent information from my credit report immediately.

I called them to close the credit card, but was told it's already more than 3 month, so they have to charge my annual fee, no matter I used the card or not. And the 3 month starts from the day I applied the card, not the day I activated the card. It is very unfair to customer.

Consumer Complaint: On XX/XX/2023 I initiated a balance transfer request with my Capital One Quicksilver credit card account. I was approved for my request for {$8900.00} and asked for it to be sent to pay off my credit card balance with XXXX XXXX. During this time, I was informed by XXXX XXXX that they were being acquired by XXXX XXXX and the official transition would take place on XX/XX/2023. I asked a customer service rep at XXXX XXXX prior to initiating the balance transfer with Capital One, if it would be okay to pay off my account prior to this date with a balance transfer and they said it would be fine. The balance transfer check was cut on XX/XX/2023 and according to the copy of the check, it shows that it was deposited on XX/XX/2023 ( XXXX day after the transition from XXXX XXXX XXXX XXXX XXXX ) I received my first statement from XXXX XXXX and it appeared as if no payments were ever posted to the account. This was concerning for me, so I contacted XXXX XXXX and told them what happened, and they asked for a copy of the check Capital One sent to XXXX XXXX. They had their payment investigation team and the transition team look into it further only to reply that they noticed on the back of the check it looked like it was deposited by XXXX XXXX XXXX XXXX XXXX The front of the check included my account number with XXXX XXXX and was addressed to the correct XXXX XXXX XXXX XXXX Texas provided to me by XXXX XXXX at the time. What's interesting is, the check that was issued by Capital One says " XXXX XXXX XXXXXXXX '' on the front of the check. On the back of the check it says " Pay to the order of XXXX XXXX XXXXXXXX '' and it also states " XXXX XXXX '' as well. I was told by XXXX at Capital One that Capital One banks with XXXX XXXX XXXXXXXX, so I think there's a possibility that this check was returned to Capital One and deposited back in their account. Capital One informed me they are attempting to " recall '' the funds, but there is no guarantee this will be successful. I am currently accruing interest with Capital One and XXXX XXXX while this matter gets resolved. Capital One said that this process could take 90 days, possibly longer.

In accordance with the fair credit reporting act Capital One creditor has violated my rights. Under 15USC 1681, Section 602, states I have the right to privacy. 15USC 1681, section 604A Section 2, also states that consumer reporting agency can not furnish an account without my written instructions. Under 15 USC 's 1666 B, A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose. Capital one has reported that I had a late payment of {$40.00} XX/XX/2023. The payment was not late 30 days. I have an excellent track record. I am requesting that this late payment be removed from my credit report.
