Consumer Complaint: Capital One recently experienced a data breach. Due to negligence of their company, I have seen a significant increase in fraud, ID theft, and even all my passwords compromised. It has been hard to determine what are true calls and what are fraud and this has caused issues with payments being made etc.

Consumer Complaint: I am giving authorization to this company to respond to this cfpb complaint. I have requested that this company cease the reporting of the account stated in the attached dispute letter due to federal violations. Pursuant to the IRS Publication 4681 any cancellation of debt is considered a certificate of indebtedness and its now income. Income can not be reported per the IRS publication. However, this company did NOT honor my request for removal. This violates the Fair Credit Reporting Act and both this company and the consumer reporting agencies are participating in this violation. Additionally, as a financial institution, they did not disclose to me my right to opt out of the disclosure of my nonpublic information or directions on how to exercise my right to opt out as dictated by law. I sent them a letter notifying them of my request to be opted out of my nonpublic information being furnished to consumer reporting agencies pursuant to 15 U.S. Code 6802 and 16 CFR 313.7 in which they have denied my right. Instead, they stated that they do not offer their customers the option to opt out which is a direct violation of federal law ( s ) as they are REQUIRED to give opt out disclosures. As a federally protected consumer I am now revoking any and all authorization that I, the consumer, may have given them written, non written, verbal, and nonverbal per 5 U.S. Code 552a and I am demanding that my nonpublic information cease to be furnished. If this matter does not get settled, I will pursue litigation for damages. 15 U.S. Code 1681s2 - Responsibilities of furnishers of information to consumer reporting agencies ( a ) Duty of furnishers of information to provide accurate information ( 1 ) Prohibition ( A ) Reporting information with actual knowledge of errors A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. ( B ) Reporting information after notice and confirmation of errors A person shall not furnish information relating to a consumer to any consumer reporting agency if ( i ) the person has been notified by the consumer, at the address specified by the person for such notices, that specific information is inaccurate; and ( ii ) the information is, in fact, inaccurate.

There is problem with the XXXX XXXX item as well. I got the car for my ex wife ( she was my wife at the time ), it was in my name. When we got divorced I left the car to her and she said she would continue making payments on the car. She was not able to get it refinanced into her name, nor was she able to make a payment for three months. XXXX XXXX contacted me in order to pick up the car for repossession. I picked up the car had it refinanced into my name and since have paid off the car. Those three months that the payments wasnt paid for I was unaware of. She didnt attempt to reach me at all.

Consumer Complaint: I was charged about XXXX from an eyewear store. This was not me. I was not present. I was also charged a large charge on XXXX rental car ( about XXXX ). Again this was not me. The credit card company isnt resolving the charges. Instead they have told me I must investigate this myself. I am not a detective. I was literally not present at these locations. I have had this card for years with no issues. For them to refuse to resolve these charges ( approx {$7000.00} ) and demand that I investigate on my own is not proper for a credit card company that I trust to do the bare minimum in protecting me from obvious fraud. I reported fraud last month, canceled the card and was issued a new one and they still accepted fraudulent charges only a few weeks later. I can not be expected to go investigate this myself. They say the credit card was present at these transactions. Well maybe someone stole the card from my mailbox? I have no idea - but a huge credit card company ( Capital One ) should not be telling me to do my own investigating. They should refund me and then go about retrieving the funds themselves. They are a XXXX dollar organization. I have work and responsibilities to attend to. They need to give me my money back. In the meantime, to add insult to injury theyre charging me interest etc.

I think the amount you reported and charged is incorrect. I repeatedly asked for an investigation but they did not do it, they did not take into account my condition as an elderly adult. Consumer Complaint: I am aware that I am delinquent on both of my accounts, and I have let Capital One know that I have filed for bankruptcy with an attorney. Even though they have this information, I am still being harassed with phone calls where they will call me and then hang up. I attempt to answer these calls and talk to whoever is there but they will not speak and no amount of pressing buttons will get me to an operator or customer service agent. These calls are coming at random times of the day, several times a day.. When I call about this problem, they deny that they called and they refuse to cooperate. This is a violation of US bankruptcy laws and this harassing behavior will be reported to my attorney and to the bankruptcy court.
