Consumer Complaint: I got into a car accident and filed the police report at the time of the incident, I also checked into a hospital called my insurance company mad hired XXXX attorneys the second was hired because the first hired attorney did not appoint me to any services and communication was a problem. I then hired XXXX XXXX and the problem seemed just about the same. I tried several times to describe more information on the report and incident yet got no response up until the date before the arrival of the check. When visiting my old address I saw an old letter stating a {$18000.00} check had already been written and sent out to that previous address. I also lost my car after my insurance was cut off by someone other than me. The only amount given to me was {$5000.00} yet was used and transferred out of my bank account with out my permission. I also had several letters sent to me from capital one bank the original loan, it stated I had paid for the vehicle. This year I went home to visit my family and found more mail stating my vehicle was sold by a company named XXXX

Capital One then issued additional charges on XX/XX/XXXX on a {$0.00} stating that the amount due on the statement does not include the payoff amount. I asked if the the statement states that, the senior account rep said no. I then asked if there was some documentation which has that, and the senior account rep said he could send me the Terms and Condition in the mail. I agreed to look at the terms and conditions but I will have to pay interest while I wait for the Terms and Conditions in the mail.

Consumer Complaint: This is breach of contract I informed the CFO that I, XXXX XXXX, agent on behalf of XXXX XXXX, principal hereby accept all titles, rights, interest and equity owed to XXXX XXXX, principal. I advised the CFO of the company to apply the to apply the principals balance to the principals account for each and every billing cycle for set off. I also instructed the CFO, to communicate in writing once instructions are completed. This is instructed to happen within 5 business days. I sent my Claim of Credits letter on XX/XX/23 I sent my Opportunity to Cure letter on XX/XX/23 I sent my Default Notice letter on XX/XX/23 With these documents I provided a durable power of attorney as well as references to federal reserve act sections 16 and 29 in addition to copies of multiple endorsed bills relating to the accounts.

Consumer Complaint: Last year on XX/XX/XXXX a capital one account was opened fraudulently using my information. I contacted capital one and notified them that it was fraud. After multiple disputes with capital one and the three credit bureaus every investigation they did apparently verified the information as correct. Of course the information is going to match mine because someone used it to open and use that account fraudulently! The charges happened in a nearby city that I wasnt even in at the time and the user was making minimum payments for about three months. I have no bank accounts that have been paying for it so someone else has. I have never had this card in my possession and I cant even access the online account because they use a phone number for verification. Whoever it was obviously used their number so I do not have anyway of getting any information about the account. Because I refuse to pay for a fraudulent account it got sent to a debt collection agency. I moved out of state at the time however so the court date got dropped. Now the account is showing up on my report as a charge off today! I am not sure what other steps I can take to have this account removed from my credit report permanently. I am certain that capital one is only doing a lazy investigation that does not dig far enough to uncover the information that doesnt line up. I even filed a report with my local police department at the time as well as a report with the FTC. At this point I am at a loss for what I am expected to do.
