Consumer Complaint: This letter is to provide additional explanation and proof of my valid dispute at the amount charged by the XXXX XXXX XXXX in XXXX XXXX XXXX. I visited the bar on the XX/XX/XXXX. There was a situation where I was told by the bartender he ordered {$250.00} bottle of champagne, which I contested but was still charged, and then was also double charged for an additional transaction. Some of the bartenders distributed it to their group and some of their friends and signed the receipt, even though I had said four times I did not order the drink and neither myself nor my party drank. The merchant attempted to say I signed the receipt in the dispute, even though that is very clearly not my signature, ( Ive attached two examples from my passports as proof ), as well as claimed that I didnt attempt to reach out to them, ( this is false, I emailed them the next week over and attempted to visit in-person multiple times after and the manager refused to speak with me ). This is a common scam at this bar where theyll markup or charge a drink, the bartenders will sign the receipt, and then theyll push it through. In fact its a COMMON complaint on XXXX reviews. I expect Capital One/XXXX/and XXXX XXXX to refund me my money or I am prepared to escalate this to the CFB and file a claim with the relevant authorities in XXXX XXXX. This is unacceptable. Capital One just claims I didn't provide this information about me contacting the bar when I did several times.

Consumer Complaint: Signed up for a Venture X card on XX/XX/2023, using my friend 's referral link that explicltly stated a XXXX sign-up bonus mile offer for spending {$4000.00} in 3 months. Upon signing up for the card and getting approved, I receive correspondence and terms and conditions stating I was approved for XXXX sign-up bonus miles. I call Capital One customer service on XX/XX/2023 and speak with XXXX initially ( rep ID : XXXX ), who looks into the issue for me and states that the offer for XXXX SUB with a friend 's referral link has been active since XX/XX/2023. She states she will notate my account and that as long as I meet the {$4000.00} spend in 3 months I will be receiving XXXX bonus miles. She states notating my account with this information. I call two more times in the same day to verify this information, with 2 independent customer service reps. They all state the same thing : I am eligible for XXXX SUB based on signing up with the referral link and friend referral bonus offer starting XX/XX/XXXX. I was told to receive some documentation to verify this in case I receive XXXX bonus miles as stated in my terms and conditions. They say they can not provide this to me but to call back and that all the information will be in the account. I call customer service again on XX/XX/2023 after spending the required {$4000.00} and only receiving XXXX bonus miles. I was transferred to a rewards specialist and then a senior account supervisor to help me with my issue. The supervisor, XXXX, I speak with states she has never heard of this XXXX SUB offer before and that my account has not been notated with this information, even when telling her I called XXXX separate times on XX/XX/XXXX and was reassured that the offer is active and I am eligible for it. She places a reward escalation request and that I will hear back from them with a decision. I receive a phone call on XX/XX/2023 with a decision on my issue. I miss the initial phone call but when I call back I am transferred to a senior account supervisor, XXXX, who looks at my account and states my request was denied since I can only receive what was listed on my terms and conditions. I tell her that on XX/XX/2023, multiple reps documented that I am eligible for the friend referral offer that started XX/XX/2023 and that I signed up with a referral link. She says she can not see this notated on XX/XX/2023 and that the rewards escalation team reviews this information before making a decision. I ask her if phone calls can also be reviewed since the notations are incongruous with what I was explicitly told multiple times that day. She says the rewards escalation team has access to record phone calls but can not tell me definitively if they reviewed this information. I ask her if I can be transferred or if someone from the rewards escalation team can contact me via email or phone, and she says that they tried once when I missed the phone call and that I can not reach them anymore.

Consumer Complaint: Re : Capital One Account Number XXXX acting agent and attorney-in-fact for XXXX XXXX, the true obligor/consumer/principal, I hereby dispute the billing practices associated with the current, past, and future CERTIFICATES OF INDEBTEDNESS hereinafter ( COI ) under this contract. I request that you rectify this error per The Truth in Lending Act ( 15 U.S.C. 1601 et seq. ). Capital One Financial Corporation is hereby noticed that XXXX XXXX, the consumer/principal, shall not be construed as the surety, debtor, liability, guarantor, or accommodation party concerning any relationship with Capital One et al. XXXX XXXX has not, is not, and shall never be considered to have entered into a joint business venture with Capital One Financial Corporation or its agents and agencies as an undisclosed third-party investor, commercial business partner, or otherwise for Capital One Financial Corporation Mastercard Account Number XXXX. All presumptions of assent are now rebutted and rebuked. The purported Debt is erroneous and invalid for all of the following reasons : ( 1 ) lack of consideration ; ( 2 ) lack of mutual assent between the parties ; ( 3 ) failure to fulfill any applicable statutory requirements ; and ( 4 ) any other applicable grounds. I have endorsed the coupon and mailed it to the Capital One Payment Processing XXXX XXXX XXXXXXXX, NC XXXX on XX/XX/XXXX, and again on XX/XX/XXXX. Capital One failed to credit the account from the dividend payment they made from the Treasury coupon. UCC 3-603- Tender of Payment and UCC 3-604 - Discharge by Cancellation or Renunciation. Capital One appears to be in the practice of securities fraud due to the following violations : 12 CFR 360.6 ( 2 ) Treatment of financial assets transferred in connection with a securitization or participation : The Claimant was entitled to be informed that his financial assets ( e.g., promissory note ) would be sold to the bank and that, as a result, the bank would acquire a bank asset, which would be offset by a corresponding bank liability. The Claimant was entitled to be notified that the financial institution would then exchange the promissory note for credit in the borrower 's transaction account. This indicates that the bank, or purported creditor, recorded the promissory note as a loan from the Claimant to the bank, resulting in the bank, or purported creditor, becoming the borrower. 17 CFR 260.11b ( 6 ) Self Liquidating Paper - It appears Capital One intentionally misrepresented and withheld relevant information about self-liquidating paper from the consumer to profit from the consumer 's credit card as defined in 15 USC 1602 ( l ) Credit Card-then deceiving and misleading the consumer into an unfair, unwise and uninformed loan agreement whereby the consumer would repay the money obtained from his credit card with interest, which the bank is legally obligated to return to the consumer. Per 15 USC 1602 ( l ) Credit Card ( l ) [ The term credit card means any card, plate, coupon book or other credit device existing to obtain money, property, labor, or services on credit ] - It appears that Capital One has actual, implied, or apparent authority to utilize my credit card or open-end credit plan as a consumer, as outlined in 15 U.S.C. 1602 ( l ) Credit Card. I utilized his credit card to facilitate a purchase money loan, as defined by the Truth in Lending Act ( TILA ), wherein no cash was received in exchange for the use of the credit card, and no amount was credited to the principal account. In this consumer credit transaction, Capital One has received an unjustified financial benefit from the consumer, as no consideration has been provided in exchange for the use of the consumer 's credit card. 15 U.S.C. 1666 ( b ) Billing Errpr - Capital One is in direct violation for reporting late payments on my consumer credit report under an open-ended consumer credit plan ( an installment credit plan under the Truth in Lending Act ). Such reporting of late payments is prohibited under the aforementioned statute. Capital One did not have the authority to place a negative mark on a consumer report, as they lacked the capacity to agree in the first instance. 15 USC 1666d, Treatment of credit balances- Capital One failed to credit the principal account with the dividend payment, interest, and other relevant components resulting from the consumer 's security treasury coupon as mandated by the Electronic Transfer Act. Capital One shall be liable for failing to credit a consumer 's account with the dividend payment from the securities treasury coupon, as well as the interest earned from said coupon, as per the Electronic Transfer Act. This will also serve as a notice of breach of fiduciary duty ( U.C.C. 3-307 ), as well as a violation of 17 CF 240.15c1-2 and 17 CFR 240.10b-5 The application made contained personal property in the form of estate information of the principal, which was subsequently deposited into Capital Ones account as a credit on their accounts receivable. Therefore, when Capital One Financial Corporation seemingly sold the security, promissory note, and/or credit application, and failed to distribute the funds to the consumer, in lawful money, and instead issued a coupon to me, known as checkbook money, unequivocal in amount, failed to honor the tender of payments, failed to return the unearned interest to the principal, and closed the account without authorization from the principal, Capital One Financial Corporation engaged in not only discrimination but what also appears to be a securities scheme and artifice, false advertising, false and deceptive trade practices, sabotage, a mockery of honest services misrepresentation and misappropriation of funds, breach of trust, identity theft, unlawful conversion, false advertisement, extortion, conspiracy, XXXX, false reporting on a public record, as well as several ethics violations to the detriment and loss to me, the consumer.

Copy of letter included in document attached. The check was to cover by electric, water and trash collection for the month of {$170.00} with my town of XXXX XXXX also attached. I wound up paying a agreed upon {$30.00} charge, as indicated in my document. The issue at hand is that on my call to Capital One 360 on XX/XX/2023 first by a customer service Representative that I no longer had the {$1000.00} overdraft. I explained that I had never received any notice that it had been canceled. I then asked for her supervisor. A lady by the first name of XXXX came on she said she was part of the Management team to help me. I explained once again that I had never received any notice of cancelation. She said it would have been by e mail not first-class letter. I said repeatedly I never received either to the best of my knowledge and you should reimburse me for the {$30.00}. They could not even give me date of the e mail just no transparency. Sure, my error in not having the full {$170.00} in my account. It's not fair. The only other time I have had an overdraft in my life is 9 years ago when I was in the hospital for one week and by overdraft was covered at that time. I take my bills seriously I have XXXX credit score with XXXX XXXX, I'm not a dead beat. A large banking company should at least tell me with proof I had gotten notice of this cancelation. I'm my humble opinion at least send letter of cancellationnot in an e mail which like I said I had no record of.
