Issue: Problem when making payments
Subissue: Problem during payment process
Consumer Complaint: On XXXX I called Capital One Visa regarding an upcoming invoice. On that invoice I was being charged for an item I had returned and for which Capital One had already received the funds returned by the store but after the invoice had been issued. I requested that the amount be removed from the invoice since they already had the money, something other credit card institutions do regularly. I was told it wasn't possible and that even though the amount had been returned and credited to my account, I would have to pay the invoice in full or be charged interest. A customer service supervisor who identified himself as XXXX ID # XXXX insisted that was part of the terms and conditions I had agreed to, but after being put on hold several times over nearly an hour while he searched and consulted others he admitted that there was nothing in those terms stating a credited amount could not be deducted from the bill, but that it was unwritten " policy ''.

Consumer Complaint: I filed three claims for fraud/unauthorized activity with Capital One 360 Checking. Claim # XXXX for account ending in XXXXClaim # XXXX for account ending in XXXXClaim # XXXX for account ending in XXXX. My name is XXXX XXXX, birthday XX/XX/, last four of social XXXX. The claims listed above filed by me on XXXX, were WRONGFULLY DENIED after only 8 days of investigation, I was not even issued provisional credit. The reasons Capital One gave for the determination is " Due to your assertion about the debit card possession and transaction information ''. This is completely inaccurate as I NEVER HAD POSSESSION OF THE DEBIT CARD, it was delivered XXXX which did not require a signature, left outsidemy door where my sister proceeded to pick up the card activate and use it for the transactions in the claims number listed above. Whomever I spoke with initially about the claim took down an inaccuratereport, which has caused me severe financial hardship. I have had this Capital One accountfor YEARS and nothing like this has even happened. Attached please find PROOF mine and of my Sisters ( the culprits ) address in the form of a XXXX bill in her name, which is where the card was sent to. I notified the representative of this on the phone, and let them know she no longer lives here and has a history of stealing from family to support her addiction. I contacted the XXXX police, told them my sister gave a VERBAL admission to taking the card and activating it by logging into my Capital One application and entering the CVV code- which makes it way too easy for someone commit fraud by the way, they should be required to call and verify. So to be clear : I NEVER had physical access of this card when it was mailed, how can an investigation into theft/fraud only take 8 days to finalize?? Did you review ATM camera footage? Apparently not, as I clearly am NOT responsible for any charges or transactions made in the claims numbers listed above. I have filed a report with the Consumer Finance Protection Bureau and I hope we can resolve this matter as I was truly a victim of theft here and this is extremely stressful. Please let me know if any further documentation is required or if you would like to speak to the Detective with XXXX, Illinois police department. Thank you XXXX XXXX
