Consumer Complaint: I am reaching out for assistance once again as CapitalOne has allowed the fraudster to close my XXXX credit card account and continuously allows the fraud person to change my profile information and grant them access online. I have done EVERYTHING I can to mitigate this and each time CapitalOne one security measures fail me. This has caused my life so much stress to the point on breakdown and tears. It is very disheartening and I'm certain I'm not the only one dealing with this. I have provided verification numerous times and time and time again they still accept the old ID. There has to be a better way. As a long time customer of CapitalOne one it male 's me very unhappy to get to a point where I need to dissolve my relationship because of security issues and the lack thereof. At this time I want to make sure any charges on ALLL card I have/had with CapitalOne one after XXXX are flagged as fraud. I have not had access to my cards or online profile since XXXX. ANY amd ALL charges on the Quicksilver and XXXX card after XXXX are fraudulent and need to be adjusted as such. I would also like for a supervisor, manager, CEO to contact me and get this matter resolved. Consumer Complaint: Capital One has been reporting and billing me credit card repayment that, I, the Beneficiary allegedly owe. However me being the beneficiary it doesn't benefits me to repay. I am writing to address the matter of the debt associated with my account. I am the beneficiary of the XXXX XXXX Living Trust, and repaying this debt is not beneficial based on a careful consideration of various factors. Firstly, I would like to draw attention to the etymology of the word " repayment, '' which implies paying again. As a beneficiary of a living trust, it is my understanding that repaying an alleged debt would mean paying twice, which does not align with the equitable principles that govern trust relationships. Everything is a trust. How? Because everything is an agreement and if anything has my name on it thats a legal title of my estate. Now lets look at the word credit which means trust. Now lets look at the word report which means property. My credit report is my trust report which is my property and estate. Furthermore, the maxim of equity states that equity does not punish. Repaying an alleged debt, particularly one that may not be legally enforceable or valid, could be perceived as a form of punishment. Equity regards the beneficiary as the true owner, and the trustee is obligated to uphold their duties in settling the account. Considering the aforementioned principles, I kindly request the following actions : Account Review : I request a thorough review of the alleged debt associated with my account in light of the trust relationship and equitable considerations. Account Settlement : If the debt is found to be valid and legally enforceable, I request clear instructions on settling the account. As the beneficiary, I trust that the trustee will uphold their duties to settle the account. Removal from Credit Reporting Agencies : I request the immediate removal of any adverse reporting related to this alleged debt from credit reporting agencies, as it is not beneficial to the beneficiary 's interests. You're furnishing this information to the credit reporting agencies which makes you the trustee. If you're not the trustee then you're a stranger. Its three parts to a trust. Trustee, settlor, and beneficiary. If you're not the trustee then you need to hand me my property back. I appreciate your attention to this matter and look forward to a fair and equitable resolution. Consumer Complaint: On XX/XX/2023 I made a payment of {$3400.00} to my credit card which lead to overpayment of {$3200.00} before traveling out, when I returned back from my travel I then found out that my card has been restricted for whatever reason which I called capital one for them to remove or resolve the restriction, and they never did, After XXXX weeks of patiently waiting I then wrote a letter to them asking them to close my capital credit card and reimburse me back my remaining funds as a check. After some days of writing to them I noticed that on XX/XX/2023 my remaining credit which was remaining in my account was taken from my credit, and when I called they said that I should wait for my check which will take XXXX to arrive, and I have waited and called severally but still they kept sending my call to XXXX support who gave me no reasonable explanation regarding on what the charge is for. Despite my efforts to ratify this matter directly with capital one, the response has been unsatisfactory, leading me to seek redress through this legal system. I believe this this wrongful depletion of funds and also constitute a violation of FCRA section 611 and has caused significant financial harm to me. Now I check to find out that they still charge me an interest which has been putting my card on negative and also messing up my credit score which seems to be the evil and worst nightmare to me. They demanded for a statement which I have submitted and yet why will they restrict my card without closure and also holding my remaining funds while still putting my card on negative that also affected my score. This is so unbearable to me. Please I need your legal assistance. And below are little attachment of what has been going on all this while
