Consumer Complaint: FRAUD Bank of america contracted a third party to " collect '' a very old debt from a third party, instead from the borrowers. XXXX XXXX sent me an email that he wants XXXX out of my house by forcing the judge to sign an order of foreclosure to collect XXXX that the " bank of america note '' servicer agreed as payoff. XXXX XXXX wants to keep the rest in his demand letter and got some title paperwork from the servicer of our land contract mortgage and the money that was deposited there about XXXX since XXXX. Thta is a win of XXXX and XXXX as intermediary collector of an original " bank of america note '' for countrywide of XXXX. The banks get XXXX for a loan that XXXX probably paid half that or XXXX, bank makes a Security Exchange comimsion on mbs of a win of XXXX, the lawyer makes XXXX and the " borrowers '' walk for the XXXX time wiht money on their pocket instead of paying the notes they signed for, because my mother nor I signed for them. and us, we lose XXXX about XXXX in equity and we lose a roof over our heads after paying 10. years. We sent all the information we had to HUD, and they suggested filing a fraud clain wiht FTC, has been done. However this collector has used illegal technicques to ecomicaly abuse an XXXX person whose first language is other than XXXX. Her husband, my dad, is not even here to sign any reformation of mortgage which is what should have happened, because he died, like many soldiers for this country. He died after the " second mortgage '' was taken out behind our backs and we should have been notified for this my mother and leave her destitute of all her income and our primary residence through inside negotiations with the third party debtors and the institution that is legally bound to fulfill the land contract per XXXX title mortgage loan origination ( attached ) We got two emails and apparently the lawyer wants to ' '' buy us out '' of our home by skeeming our equity since XXXX in our home and keeping the cash that was put as security deposit in court, XXXX a month for almost 10 years from XXXX to present, about XXXX. The " collector '' did not disclose he is a collector and just gave my mother 2 redacted loans '' that he said if we pay the second the other will " fall like a domino '' but he was not sure that will happen however. He wanted XXXX for the second loan. He declined to give us the first and second note and currrent mortgage statement for bank of america. He said he is the " new servicer '' and wants cash now. I asked him if he in his position of " lawyer '' can pay his home cash, he said " no, are you crazy, I have a mortgage '' so I asked him do you think a military widower can pay cash now, that is why we got the land contract mortgage that bank of america bought. He then said to " not contact the banks '' to avoid " confusion '' and to deal with him and that a text sufices of what we offer. Mom and I appliedfor loans with both bank of america and XXXX, the companies involved and also ask XXXX XXXX XXXX and XXXX XXXX and XXXX to get a payoff, the title companies refused said that the XXXX policy now includes a consumer protection provisionand due to TILA and RESPA they can not close withtitle insurance, meaning we would take our good title and make it bad if we sell to somoene else that will also can not get good title or title insurance. They explained to us that the moment bank of america - or XXXX- because we did not get ANY information because we need permission of the colluding " buddies '' customers of these banks, The salcedos or the buy and bail " borrowers '' to let us know what is owed but that WE MUST PAY YTHROUGH FORECLOSURE OF OUR ASSETS because they can not collect from the XXXX. It looks like the title companies have helped liquidate an investment property for the XXXX 's that they got XXXX $ cash for which came from a XXXX compay named XXXX XXXX XXXX without any operation agreement or anyting but as a cash receivership. The XXXX said they are destitute when they left nM and that they have a " job '' the lllc in florida and they deposited cash monthly or quartelryly in that company that bougth a property in XXXX XXXX in the name of the llc and then the llc bought the house that the llc then deeded them free and clear, as only membersof the LLC. then they liquidated that, and after XXXX XXXX gave them the money the banks of america and XXXX hired the collector to collect from us because the banks could not collect an old debt that is no longer on the " borrowers debt ''. Insteaad they try to collect an ineligible fha loan, the XXXX did not live at the property, and did not have the equity position to encumber it in XXXX, XXXX or any year in between. There has been other owners since then and the bank should have and could have just paid a XXXX fee for a title binder to see that before lending irresponsibly

In XX/XX/XXXX XXXX declared bankruptcy and directed us back to our credit card company for a refund. We promptly filed a dispute that was denied due to the date of the charge which we disputed multiple times. I then decided to wait until the date of our cruise to file the next dispute due to not receiving the services that had been paid for. They acknowledged that I was entitled to a refund and credited my account {$960.00} and claimed I had already received a partial credit of {$14000.00} in XX/XX/XXXX. I filed yet another dispute letting them know that that credit was for a cruise that was booked in XXXX to take place in XX/XX/XXXX but was cancelled due to XXXX and was reservation # XXXX. I provided the documentation of that cruise and payments that were made in XXXX and XXXX of XXXX that were ultimately refunded in XX/XX/XXXX.

( 2 ) Exclusions.Except as provided in paragraph ( 3 ), the term consumer report does not include ( i ) report containing information solely as to transactions or experiences between the consumer and the person making the report ; A consumers transactions are excluded from the consumer reports. XXXX and or any other Risk score or algorithm that you use to calculate a consumers credit score is not a factor where the consumer report is concerned! Definition of what the consumer report means. consumer report ( 1 ) In general. The term consumer report means any written, oral, or other communication of any information by a consumer reporting agency bearing on a consumers credit worthiness, credit standing, credit capacity, character, general reputation, personal characteristics, or mode of living which is used or expected to be used or collected in whole or in part for the purpose of serving as a factor in establishing the consumers eligibility for ( A ) credit or insurance to be used primarily for personal, family, or household purposes ; ( B ) employment purposes ; or ( C ) any other purpose authorized under section 1681b of this title. CFPB Takes Action Against Bank of America for Illegally Charging Junk Fees, Withholding Credit Card Rewards, and Opening Fake Accounts Bank of America will pay more than {$100.00} XXXX to harmed consumers, and {$150.00} XXXX in penalties to CFPB and Office of the Comptroller of the Currency XX/XX/2023 Bank of America harmed hundreds of thousands of consumers over a period of several years and across multiple product lines and services. Specifically, Bank of America : Deployed a double-dipping scheme to harvest junk fees : Bank of America had a policy of charging customers {$35.00} after the bank declined a transaction because the customer did not have enough funds in their account. The CFPBs investigation found that Bank of America double-dipped by allowing fees to be repeatedly charged for the same transaction. Over a period of multiple years, Bank of America generated substantial additional revenue by illegally charging multiple {$35.00} fees. My account with bank of American was never late! This was clearly a billing error, and a double dipping scheme. This act is shameful it has caused severe hard to my reputation, my character, my mode of living and to my family! I notified Bank of America of this information on XX/XX/23 and provided all the required documentation to demonstrate I purchased it and returned it ; XXXX claimed they refunded it to my original payment method and never received the credit on my statement. Bank of America responded and denied that I was owed a refund on XX/XX/23. I wrote a letter to my bank demanding that they give me a refund that I'm entitled to, but they denied this and then charged me {$310.00} on my credit card for something I already paid for, returned, and never received a refund.
