Consumer Complaint: I called to close my credit card account with Bank of America on XX/XX/, shortly after my annual fee was billed. I was advised that the annual fee would be credited back as I was closing the account and that I would not have to pay it. I subsequently received a credit card statement indicating that the annual fee was never credited and that I was 2 payments late. Bank would not waive the annual fee and has asked that I pay the past due amount only to have it refunded at a later date. It makes no sense that I should have to come out of pocket to resolve a bank 's error. Furthermore, my credit score should not be negatively impacted by the bank 's error. The amount of red tape to try and resolve this issue is immense. This feels like the bank is taking advantage of a small consumer simply because they can. Please help.

Consumer Complaint: BANK OF AMERICA CORPORATION Has taken an adverse action against me. Letter I sent them : Notice to agent is notice to principal Notice to principal is notice to agent Im pursuing to 15 U.S Code 1602 ( l ) The term credit card was used to initiate the consumer credit transaction the term credit card as I mention means any card, plate, coupon book, or other credit device existing for the purpose of obtaining money, property, labor, or services on credit. I am the card holder and holder in due course. So in pursuing to 15 U.S Code 1602 ( n ) I am the one who came in with the credit card to initiate the transaction it is not possible to get denied with something that I came in with. The term adverse action never mentions anything to do with a consumer getting denied credit because it is impossible to get denied something in which I am granting to your corporation the right to extend credit. So in pursuing to 15 U.S Code 1602 ( f ) the term credit means the right granted by a creditor to a debtor to defer payments of debt or to incur debt and defer its payments. Credit is my right and i am the one who regularly extends credit in the connection with loans in pursuing to 15 U.S 1602 ( g ) I am the original creditor and I am well aware of my rights. I know that reporting to consumer reporting agencies is voluntary. This is a private transaction and this is an unfavorable situation to me for the consumer no where in the term adverse action defined within the FCRA does it mention that a natural person get can be denied credit. As an original creditor it is not lawful to be denied my right to grant credit. Further more my credit was used and I received no benefit from the use of my credit. An inquiry popped up on my consumer report which is a receivable transaction meaning someone got paid off my credit I received no benefit from it at all. In fact damages were done from the denial of my rights mentally and financially. The term authorized use, as used in section 1643 of this title means a use of a credit card by a person other than the card holder who does not have actual, implied or apparent authority or such use and from which the cardholder receives no benefit. Ive been discriminated against as there is no federal laws that state a credit score can deny me of my right to extend credit. I have in good faith exercise my right and I the natural person have been discriminated against in pursuant to 15 U.S 1691 ( a ). It shall be unlawful for any creditor to discriminate against any applicant with respect to any aspect of a credit transaction. For the damages that have been done to my mental distress and financial reputation as I take my consumer report and life seriously. I will take this to a federal level if my request to open the accounts in which adverse action has taken place. I am aware of my open end credit plan my right to contract unlimited without being denied. I demand your company reinvestigate this matter and abide by federal law and open up the accounts in which I have extended credit and correct any adverse action taken on my consumer report.

Consumer Complaint: XXXX ) XX/XX/XXXX, I discovered a fraudulent XXXX XXXX Nevada Unemployment Insurance Claim under my Social Security Number. The discovery was made during a conversation with Bank of America about my B of A EDD Debit Card Account. I was alerted to potential fraud by the fact that he had received an email at his Priority email address at work about his EDD Debit Card account, and the EDD Debit Card Account was from XXXX. This made no sense because B of A did not have my work email address, and the account would not have been tied to his current work place ( XXXX ) years later. After speaking to the fraud representative at B of A, the fraud representative decided to file a complaint with the Nevada Unemployment Agency alerting them to the fraud, and both B of A representatives suspended and blocked the fraudulent account in Nevada under my Social Security Number, and he petitioned the CA EDD to close my old EDD Debit expired Debit Card Account. The name of the party using my Social Security Number is XXXX XXXX. XXXX ) XX/XX/XXXX, I filed a Credit Freeze with all the major Credit Bureaus in the US, XXXX, XXXX, and XXXX XXXX. XXXX ) XX/XX/XXXX, I filed an Identity Theft Complaint with XXXX ( FBI ) XXXX XXXX ) XX/XX/XXXX, I filed a fraud complaint with the Nevada XXXX XXXX XXXX ( DETR ), filing said complaint and report electronically. XXXX ) XX/XX/XXXX, I filed a Police Report with XXXX XXXX Police Department, said report is filed under report number XXXX, by XXXX XXXX, Badge Number XXXX. XXXX ) XX/XX/XXXX, I filed a Fraud Alert with XXXX XXXX, which oversees US Checking and Banking. XXXX ) XX/XX/XXXX, I filed a Fraud Identity Theft Complaint with the Federal Trade Commission. XXXX ) On XX/XX/XXXX, I ordered a XXXX XXXX XXXX Report. XXXX ) XX/XX/XXXX, I filed a Fraud Alert with all the major Credit Bureaus in the XXXX, XXXX, XXXX, and XXXX XXXX. XXXX ) I did everything possible, and Bank of America did nothing, and they did not close the account after informing them of all of that, instead they started sending me USPS mail about the fraud infected B of A EDD account, alerting me to the fact that the account was still open, and after all of that stated above. This is incompetence. XXXX ) On XX/XX/XXXX, B of A sent me another letter, after 10 years of this back and forth, still claiming an active account associated with fraud. XXXX ) When I called them the XXXX time, they said they would not close the account, the person I spoke with in XX/XX/XXXX of XXXX, his name was XXXX, and the one prior to that date in XXXX of XXXX was XXXX.

Consumer Complaint: In Complaint # XXXX I explained that I was a victim of an Internet Fraud activity in which my bank, XXXX XXXX XXXX XXXX US {$9000.00} to a Bank Of America XXXX BOA ) account which BOA had XXXX for the scammer or an agent thereof. I provided their account holder information including name, payment reference, account number, routing number and date in order to fully identify the perpetrator and the event. Also, I provided the XXXX Case ID ( # XXXX ) and the BOA Incident Report ( # XXXX ). In this prior claim I put forth XXXX questions to BOA : XXXX. Does BOA have procedures in place to properly vet their customers? XXXX. If so, were these procedures properly followed regarding the recipient of the wired scam funds, BIG EQP LLC? XXXX. Why has BOA not communicated with the XXXX XXXX with meaningful information? XXXX. If no recovery has been made, does BOA carry insurance or self insurance to protect victims of this increasingly prevalent occurrence and if so how could I, as victim, access these funds? In their response to the prior complaint, dated XX/XX/23, BOA answered NONE of these questions! Instead the response references privacy policies which do not allow them to to disclose any detailds about accounts. Although the responder wrote that she reviewed the correspondence carefully, even a simple reading would confirm that none of the questions in the original complaint inquire about details of their customer! Why couldn't the questions be answered? Furthermore, in telephone conversations with BOA personnel since the prior complaint was filed, I learned that XXXX the subject account had been frozen., XXXX there had been close to {$300000.00} of complaints against this account, XXXX initially that the account holder had " pushed back '' against the claim, XXXX more recently, that the account was permitted to be closed because the account holder DID NOT RESPOND! XXXX despite having properly filed a recall request form and " hold harmless '' letter in XXXX, XXXX XXXX asked to do both of those submittals again in XXXX. What did BOA do with the original complaint? Miscommunication and inaction on the part of BOA seems to be the only consistency. By not properly vetting their customer and not seriously considering a victims 's recall request and complaint relating to it, is BOA complicit in email fraud and wire fraud?

Consumer Complaint: Unfortunately, this is my second time complaining about this issue. I have been trying to rectify this problem for XXXX weeks now. On XX/XX/2023, I made a mobile deposit into my savings account using my paycheck number XXXX and the amount was {$440.00}. The funds were deposited into my account the next business day. This XX/XX/XXXX, I check my bank account and notice that Bank of America debited my savings account that exact paycheck amount of {$440.00} claiming that I made a duplicate deposit. Naturally, alarm bells rang inside my head because I did not deposit that check twice. So I contact my bank and get nowhere. I had to call them at least 5 times before they tell me that my SAME paycheck was deposited at another bank ( XXXX & XXXX ) which I am not affiliated with. They then proceed to tell me to contact my employer. I contact my employer and he shows me that my check was taken out of his business account when I deposited it in XXXX. It only came out of his account one time. After contacting my bank and getting nowhere, I decide to file my first complaint with the CFPB. After their first time investigating this issue, they determined that my exact paycheck that I deposited in XXXX was also somehow deposited XXXX month later in XXXX to the account at XXXX & XXXX bank ending in XXXX. CFPB told me to contact my employer again and then denied resolving my complaint. After my first complaint was closed, I discovered that the account number in which MY paycheck got deposited to DID NOT MATCH my employers business account number. So what I am getting at here is : Someone committed check fraud using XXXX of my paychecks. I contacted XXXX & XXXX bank and they told me there was nothing they could do or share because I do not have an account with them. My question is : How in the world is it policy at Bank of America to take away my money that I deposited first in XXXX because someone else fraudulently cashed my paycheck XXXX month later in XXXX? I don't understand how it is possible to get away with that when banks should be checking for identification when depositing a paper check in person. I genuinely am so bewildered and concerned that the banks are just brushing this off. Meanwhile, I somehow am getting penalized for someone who somehow got a hold of my check and cashed it ( not even sure how this is possible to begin with ). I would really hope that this raises some red flags to someone, because this just is not right. I deserve to have that paycheck funded back into my account. The reason that this has nothing to do with my employer is because the XXXX account numbers are different. There is no way that my employer deposited my paycheck because his account number does not match the initial CFPB findings. I would really appreciate if someone could help me out and give me reasonable explanation for all of this and help me get this money back because I work very hard for my money. There is no reason for it to take me this long to get back the money that is rightfully mine. Thank you.

Consumer Complaint: I am an XXXX XXXX XXXX college student, and I am on a joint account with my father. About XXXX months ago, my dads bank account was hacked and he filed a claim with the merchant and they put the money back into his account. A month later Bank of America said that his account shouldnt have been credited so then they put his account in the negatives, even though the merchants refunded him. Then XX/XX/XXXX, they took over {$270.00} out of my account to fix his overdraft fees although he was clearly hacked and the merchants fixed the problem. So now Im out of {$270.00} and my account is literally at XXXX dollars. Another problem with bank, about XXXX months ago I was scammed through my XXXX, and the bank told me that it will be investigated in XXXX business days, then it was XXXX, then it was XXXX, then it was XXXX. After waiting over a month they came back to tell me that they cant do anything and that I can have the info faxed so I can sue the person. It wasnt ideal, but reasonable. Now Ive been waiting over a week which was longer than what I was told, and still nothing. Now they are back tracking telling me that they cant give any information about the person when this has happened in the past and Ive gotten their information.
