Consumer Complaint: This is the second time I've had to file a complaint about this issue. Bank of America has wrongfully denied my disputed transaction claims. There is a claim for {$12000.00} and a claim for {$3000.00}. I have filed police reports which I provided to Bank of America, I also provided copies of the e-mails between me and XXXX support regarding me being locked out of my account and my XXXX pay being deactivated. Large amounts of the transactions were done via XXXX pay. But I had been locked out of that account as well as my e-mail account during the time that the transactions took place. After filing my claims with Bank of America and providing them with more than enough supporting evidence on my behalf, they still proceeded to deny my claims and my appeals. After I filed my first complaint with CFPB, I was contacted by a complaint resolution representative from Bank of America and was told he was going to look into my complaint. This consisted of him sending me a recap of my interactions with Bank of America, and a copy of their terms and conditions. And then his conclusion was, " as no fraud was deemed to have occurred for [ claims # XXXX ], the Zero Liability policy does not apply. '' This response was ridiculous and insufficient because all he did was tell me what happened and then state an obvious fact. I am aware that they think no fraud was committed, that was my entire issue and reason for my complaint! He did not provide me with any supporting documentation or explanation. The only time I have received copies of the information they used to come to their decision was after I contacted them in XXXX, at which time they mailed me this information. And that consisted of a piece of paper that had my old e-mail address on it and then a note about me logging in with that e-mail using a high level of authorization. That's it. That is all they used to come to their decision, and I find this unethical and a violation of their terms and conditions due to the fact that the email address they were referring to wasnt even the e-mail that I was locked out of and had nothing to do with the transactions! I didn't even use that email for my XXXX account. Also, in their terms and conditions it states that once a claim is filed, if they are not able to come to a decision with 10 days, they will credit the account on the basis that if the claims are denied and the credit is used, the money would be owed. They took much longer than 10 days to resolve my claims and my account was never credited. I have never been treated so unfairly and so poorly by a financial institution in my life, and they are refusing to return my money to me with absolutely no valid reason.

Consumer Complaint: I have a checking account and savings account with Bank of America. Starting XXXX and continuing into XXXX, I was conned out of {$1600.00} in an elaborate gift card scam. Bank of America could see large sums coming out of my checking account for XXXX gift cards and could see these purchases were draining the {$600.00} I had in my checking account and then causing the account to overdraft. Instead of its fraud unit getting alerted to the situation, and instead of letting my checking count overdraw and start rejecting purchases due to insufficient funds, without my knowledge or consent, Bank of America transferred the {$1000.00} I had in my savings account, out of that account and into my checking account where, once there, the con artists defrauded me out of that {$1000.00}. If Bank of America had NOT made that transfer, I would have only lost {$600.00} instead of {$1600.00}.

Consumer Complaint: BOA Credit card reported my account as delinquent to credit reporting agencies in XX/XX/XXXX : I have paid off the full balance every month ( with the few exception there were autopay glitches from their end ). There were never any balance owed. XXXX of XXXX, there was a duplicate payment for the full balance ( they took a phone payment and autopay in the same month ). When I found out, I requested one of the payments be posted back to my bank account. So for the months of XXXX and XX/XX/XXXX, there was an overpayment ( credit ) on the account so there was no balance due and I could not pay anything to account. I was on autopay for these months. The bank decided to credit me back for the duplicate payment in XXXX. Apparently when they did this, they reported me to credit reporting agencies as me being delinquent for the month of XX/XX/XXXX. They backdated the credit back to the original date of payment in XXXX and then said that I did not make the XXXX and XXXX payments ( despite the fact that they had my money in their possession until XXXX ). There would not be possible for me to retroactively pay for the months of XXXX and XXXX ( no balance b/c it was showing a credit to the account ). They also did not let me know that the payment back would result in this. When I call Bank of America credit card, they tell me that the situation is " unfortunate '' but the credit report is correct and nothing can be done. If nothing else, how can they take my money interest free for three months ( XXXX ) and back date the credit? They will not work with me. They tell me it is the consumer 's obligation to foresee the outcome and they have no reason for full disclosure. For the months of XXXX, I have never received any statement due. All those months, the balance was always showing a credit, so autopayment would not have been able to make any payment on the account. They RETROACTIVELY made me delinquent on my account by BACKDATING the credit from the duplicate overpayment. Had they only credited my account in a timely manner for the duplicate payment, all this would have been avoided, too. Please help me. I want them to remove the credit delinquency from my account. Thank you.

Consumer Complaint: The funds in our account in the amount of {$1900.00} were withdrawn on XX/XX/2023. We contacted the tax department that had levied our account. I was told by the tax department employee that she had instructed Bank of America to hold the funds until she had reviewed the file. She then informed Bank of America that they should issue a check to the tax department for {$300.00} and the balance should be deposited back into our account. This was handled within a week of our account being levied. I was assured by the tax department that Bank of America had received all information they needed to deposit the money back into our account. Bank of America did not follow the instructions they were given and mailed a check for the entire amount of {$1900.00} to the tax department. Once the tax department received the check with the incorrect amount, they returned the Bank of America check back to them on XX/XX/2023. I have contacted the bank at least 25 times to find out why our money has not been returned. I've been told mostly that it's because they can not return the funds until they receive the check back. It's a Bank of America check written by Bank of America. I've asked them why they can not issue a stop payment of their own check. I've been told they can not do that. Today is XX/XX/2023 and the funds have still not been returned to our account. Of course, every time I contact Customer Service, they have to talk to the Legal Dept and half the time the answer that comes back from the Legal Department does not make sense. How can a bank keep a customer 's money because of an error the bank made?

Consumer Complaint: After having to review my bank statements and my employment security department income earnings for XXXX and XXXX possibly even at earlier years. so far I have noticed that my income earnings for those years do not match my bank statement deposits in XXXX I made XXXX in earnings and my bank statement only show XXXX $ deposited and in XXXX I made XXXX but bank only shows XXXX $ deposited I'm wondering what happened to the rest of the money and why the bank did not notify me if there were any fraudulent transactions or why there's not even any suspicious activity reports under my account if there was red flags only someone working for the bank could have hidden this activity and keept me from finding out and my deposits make little sense I believe someone had been altering my statements and had taken funds from my bank account I also noticed a bunch of transactions that were not my own that were not corrected when I brought them to the banks attention and reported my ATM card stolen or that the bank supplied someone else with another card. To my knowlege I should have up to 6 deposits in checks and direct deposits every month but I have unexplained mixed up deposits of counter credit witch to my knowlege after googling it means cash deposits wich looks to me like someone hid the rest of my money one way or another and keept it from me I just found this out and would like to resolve this problem since bank of America was the only bank I had banked with and keept my money in to find out they weren't even responsible with my funds and even closed my account yearst later.

Consumer Complaint: Our original mortgage was with Countrywide and when the economy crashed in 2009 our mortgage was sold seems to us several times finally landing with Bank of America. We had no choice in the matter. Numerous times since they purchased our contract we have tried and tried to do a loan modification, refinance of some sort only to be told sorry we still have not received all the paperwork. We would then fax it. There was still always an excuse it was lost etc... We are over it. Also we weren't able to get into the better interest rate. Another thing that happened was me and my husband were on the Countrywide loan together and now it is only my husband on this loan. And we do not have the XXXXXXXX XXXX we had on the Countrywide loan. We have fell behind and have been able to redeem ourselves with help from Government programs. It has been a continuous cycle. Fast forward to covid we found ourselves in the same situation. And to no avail were we able to work with Bank of America. Another government program helped to bail us out but again here we are still stuck at a higher interest rate, large house payment and no one to assist us with refinancing or a loan modification. We want to stay in our home and the only solution we ever received from Bank of America was to do a short sale or let it go back to the bank and walk away.
