Consumer Complaint: I am writing to formally address a persistent issue following the closure and payment in full of my American Express Gold card in XXXX XXXX Despite the closure of the account, I have been continuously receiving unwarranted calls and encountering erroneous charges purportedly associated with usage fees on a card that was formally canceled and closed. I have diligently engaged in multiple discussions with representatives, all of whom assured me that the erroneous charges would be rectified and confirmed the closure of the aforementioned card. Regrettably, these efforts have not led to the cessation of these unwarranted communications and charges. This situation has become increasingly burdensome and has caused significant inconvenience. I am compelled to express my deep dissatisfaction with the ongoing nature of these issues, despite my repeated attempts to resolve them. I kindly request an immediate and definitive resolution to this matter. Additionally, I seek assurance that no further charges will be levied on an account that has been officially closed and settled. Please treat this matter with urgency and provide me with a comprehensive resolution within a reasonable timeframe. I appreciate your prompt attention and cooperation in addressing this issue.

I DISAGREE WITH YOU DECISIONS AND THIS IS A APEAL THAT YOU ARE REQUIRED TO INVESTIGATE & REINVESTIGATE PER FEDERAL LAW : 4 VIOLATIONS FOR REFERENCE : American Express XXXX Card : Ref : XXXXUSD American Express XXXX Card : Ref : XXXXUSD American Express XXXX XXXX Card : Ref : XXXXUSD American Express Business Gold Card : Ref : XXXXUSD I am the consumer, original creditor and natural person. AMERICAN EXPRESS NATIONAL BANK has denied my right to credit as I applied for the above credit card accounts in XX/XX/ and XXXX in consumer credit transactions. Pursuant to 15 USC 6802, I am exercising my right to privacy and hereby OPT OUT of the sharing of my nonpublic personal Information to consumer reporting agencies. Furthermore your corporation has been requiring and demanding the unlawful use of Federal Reserve Notes also known as Floating Rate Notes ( debt notes ) as payment, when in fact, the submitted application used to open the account, with access and use of my personal and private financial information ( SSN, social security card, which is an open-ended credit card pursuant to 15 U.S.C. 1602 ( l ) along with my signature ) served as a financial asset, promissory note and security which in fact satisfies each monthly obligation pursuant to 12 CFR 360.6 ( 2 ) as well the application being self-liquidating paper pursuant to 17 CFR 260.11b-6. This is considered an unauthorized use since I have received NO BENEFIT. Pursuant to 18 U.S.C. 8, all coupons, bills, certificates of indebtness, both public and private used for personal, family and household use are the obligation of the United States. This will also serve as Notice of breach of fiduciary duty ( U.C.C. 3-307 ). Consumer Complaint: American Express is in violation for denying my credit application. ref # XXXX I applied for a credit card with American Express and was denied. That is a violation of Title 15 USC subsection 1611 which states- Whoever willfully and knowingly ( 1 ) gives false or inaccurate information or fails to provide information which he is required to disclose under the provisions of this subchapter or any regulation issued thereunder, ( 2 ) uses any chart or table authorized by the Bureau under section 1606 of this title in such a manner as to consistently understate the annual percentage rate determined under section 1606 ( a ) ( 1 ) ( A ) of this title, or ( 3 ) otherwise fails to comply with any requirement imposed under this subchapter, shall be fined not more than {$5000.00} or imprisoned not more than one year, or both. The entire consumer transaction is predicated on my unlimited credit. This is false and misleading denial of my own credit. I stated that I conditionally accepted their offer upon proof of claim that American Express have the right to reject my application and I needed to see the factors that went into their decision based on LAW, PUBLIC AND PRIVATE! They stated they could not give it to me. I completed a credit application, bearing my signature, seeking an exchange of credit. However, my application was denied, and I am uncertain of the reasons behind this denial. I am FULLY aware that my credit application, with my signature, will be securitized and sold to third parties. Referring to the Indentured Agreement between American Express and XXXX XXXX XXXX XXXX XXXX, it is established that the securities are assets protected in a trust. Notably, as per the 2018 granting clause in the indentured agreement, " the security interest in the collateral is granted to secure the notes, equally and ratably without prejudice, priority, or distinction between any note by reason of difference in time of issuance or otherwise, except as otherwise expressly provided in this indenture or in the indenture supplement which establish series ... and to secure the payment of all amounts due on such notes in accordance with their terms. '' It's clear that the security interest in the collateral is granted to secure the note, and my application, bearing my signature, is a promissory note. Considering that my application was securitized, thereby establishing a security interest, I anticipated the extension of credit. A security was provided for the credit, and I respectfully request that American Express reconsider and extend the credit accordingly. According to the Third Supplemental Indentured between American Express and XXXX XXXX XXXX XXXX XXXX, XXXX XXXX, treasurer signed For American Express and XXXX XXXX XXXX signed for XXXX XXXX. The address to American Express according to the Indentured agreement is XXXX XXXX XXXX XXXX XXXX NY XXXX and the address to XXXX XXXX is XXXX XXXX XXXX XXXX XXXX NY XXXX. I will be reaching out to both the Treasurer of American Express and the Trustee bank, XXXX XXXX, that holds the assets in the trust.

Consumer Complaint: In XXXX of XXXX, I was contacted by the credit card company and offered a financial relief program which was required to be done on a recorded statement with the companys representative to memorialize the agreement which included requirement for paperless/electronic statements and correspondence as well as automatic electronic payments. In the agreement, I was advised that the agreed upon amount for the settlement would be {$9300.00} and that I was able to make payments electronically at least 48 hours prior to the scheduled date if I wished to make payments greater than the minimum required payment of {$340.00} per month. During the first few months of the agreement, I was able to make payments in the amounts of {$800.00}, {$410.00}, {$500.00}, {$400.00}, and {$350.00}. After the {$350.00} payment in XXXX of XXXX, the company failed to process the automatic payments in XXXX, XXXX, and XXXX. In XXXX of XXXX, I was contacted again by the company and there had been an error on their end that caused the payments to not be processed as agreed in XXXX of XXXX. Again, a recorded statement was completed regarding the resumption of the payment agreement. Payments wer processed for {$340.00} each month from XX/XX/XXXX until XX/XX/XXXX when the company again stopped processing the automatic payments. In XX/XX/XXXX, a representative contacted me again and an additional recorded statement was completed by the representative to resume the automatic payments that had been agreed upon in XX/XX/XXXX. On the recording, it was required that I authorize an immediate payment of {$340.00} and a post dated payment of {$1000.00} ( which violates the FDCPA ) in order to resume the agreement due to the companys failure to follow the agreement to process automatic payments for XXXX consecutive months. Payments of {$340.00} resumed until XX/XX/XXXX per the agreement as the amount agreed upon in XX/XX/XXXX had been wholly satisfied. In XX/XX/XXXX, I contacted the company due to receiving notice that the account had been charged off on my credit report and receiving notice from a collections agency for an amount of excess of {$12000.00} on behalf of the company without any prior written notice regarding this matter by electronic communication or certified mail. The company retrieved the account from the collections agency but never addressed my request regarding the resolution of the account discrepancy that was not in accordance with the agreement reached that was recorded by the company in XX/XX/XXXX. I reached out again in XX/XX/XXXX to follow up regarding resolution of the discrepancy and was advised that there was no one who could provide me written confirmation of any account changes, the financial relief agreement that had been recorded three separate times due to issues with the company not processing payments as agreed, or the debt resolution that had been successfully completed in XX/XX/XXXX. In XX/XX/XXXX, the company filed suit for debt in excess of {$12000.00} and breach of contract. I filed an answer and denied the amount as well as the breach of contract as the company had breached the terms of the contract by not processing payments over two separate periods of three months each time which delayed the resolution of the debt. The company produced statements that had never been provided to me prior to the filing of the law suit and had a custodian of records from the company sign two affidavits stating that the records were correct and that I had been mailed the documents. A separate custodian of records testified in a motions hearing that he was unaware of the recording of the agreement over the three calls made by the company to myself regarding the financial relief for settling the debt and that the company does not save their recordings. The financial institution would be required to save said recorded information for no less than seven years as the recordings are considered financial records. The custodian of records also testified that documents presented in the case were mailed to me that were never mailed. At no time, since XXXX of XXXX have I received any of the correspondence by electronic communication or by certified mail as required in the recorded agreements that the company has failed to produce. The company also never addressed the recorded agreements in their filings. The custodian made false testimony that I had contacted the company requesting the relief program in XXXX of XXXX when at no time prior to XXXX of XXXX had I made contact with the company to discuss any issues regarding the account. The company first contacted me in XX/XX/XXXX and we reached an agreement that was recorded by the company as the representative stated was required to have a verbal agreement. At no time since XX/XX/XXXX, had the company provided any of the documents that they have presented in court prior to the filing of their complaint in Suoerior Court.

Consumer Complaint: On XX/XX/23 I called American Express at XXXXXXXX XXXX Call duration was XXXX, XXXX minutes and XXXX seconds. Please look up the call transcript, and listen to it. Why did the agent say that they would call me back after reaching out to the right department about reinstatement of the account? Why was I never called? Why do I have no missed calls or voicemails? Why when I called the following day to request the call records be looked at and find out the agent I spoke to, I was not informed of the agent? Was it the same agent XXXX days in a row? I was misled into closing my account. I requested not closing it/re-opening it within XXXX minutes of the agent closing it earlier through live chat.

Consumer Complaint: I got my XXXX tax refund on a serve/ American Express XXXX XXXX XXXX I lost the card and trying to get replacement card because I live in Alabama and my rebate has been added to that card. I have called multiple times could not speak to someone who could understand me and was told they had to have the last 4 digits of the old card before issuing a new card I gave them my birthday old phone number and social but was told they needed the last 4 of card and the 3 digit security code. I asked how could I give them that if I didn't have the card had to repeat myself over and over asked to speak to there manager was told they didn't have one was laughed at and hung up on! This happened 4 times today on XXXX XXXX XXXX starting around XXXX XXXX Alabama

Consumer Complaint: XXXX XXXX claim XXXX I stated the item was lost. My policy covers me for lost items up to {$1000.00}. This was reported within 90 days and my claim requests a technician 's evaluation of the item. The item is lost, and can not be evaluated by a technician. The representative I spoke to on XX/XX/2023 would not let me file the claim as " lost '' stating my policy did not cover lost items. He said only theft was covered. I am not certain the item was stolen. Therefore the claim is reported lost under section i. of the " Mysterious Disappearance '' section of my purchase protection card policy. I spoke to XXXX different representatives, and both initially stated I could not file for a lost claim. Associates are not properly trained and are giving misinformation resulting in denial of claims of card members.

Consumer Complaint: American Express received the full payment 2 days after the due date XXXX, XXXX. The full amount was {$140.00} and American Express sent me a statement Fee Late {$40.00} + interest {$2.00} I didn't receive the mail to my home. that is why the payment went 2 days behind. I have been a loyal customer for 15 years. I always paid in full. In the past American Express removed the late fee. Since the customer service is out of the country notice they don't have empathy with citizens. I asked them to remove the late fee of {$40.00} and the interest of {$2.00} and they denied my request. It is not fair. I always paid in full. I'm a hard worker and any pennies count. I want to submit this complaints.
