Consumer Complaint: American Express Has been on and off fruadulently reporting me as deceased. they have been opening and closing accounts in my name for over a year now. i have disputed this with the credit agencies and despite the clear misuse of my report. this is a direct violation of several laws and my consumer rights. Dear [ CFPB ], I am writing to file a complaint against American Express for multiple instances of fraudulent activity and violations of my consumer rights. Specifically, Amex has marked me as deceased multiple times and reopened accounts without my consent. This activity has resulted in unauthorized disclosure of my personal information, inaccurate credit reporting, and damage to my credit score and financial reputation. I have contacted [ name of credit card company ] to dispute the activity and demand that they cease any further illegal activity on my accounts. However, they have failed to address the issue to my satisfaction, and I am seeking your assistance in resolving this matter. The actions of [ name of credit card company ] violate several of my consumer rights, including my right to privacy, accuracy, fair credit reporting, the right to dispute errors, and the right to be free from fraudulent and illegal activity by creditors and financial institutions. I request that you investigate this matter and take appropriate action to ensure that [ name of credit card company ] is held accountable for their illegal activity. I also request that any fraudulent information related to their activity be removed from my credit report. Right to privacy : The credit card company 's actions may have resulted in the unauthorized disclosure of your personal information, which violates your right to privacy. Right to accuracy : The credit card company 's fraudulent reporting of your status as deceased and reopening of accounts without your consent violates your right to accurate and complete credit reporting. Right to fair credit reporting : The credit card company 's actions may have damaged your credit score and financial reputation, which violates your right to fair and accurate credit reporting. Right to dispute errors : The Fair Credit Reporting Act ( FCRA ) provides consumers with the right to dispute errors on their credit reports. The credit card company 's fraudulent reporting of your status as deceased and reopening of accounts without your consent may have resulted in errors on your credit report that you have the right to dispute. Right to be free from fraudulent and illegal activity : The credit card company 's actions violate your right to be free from fraudulent and illegal activity by creditors and financial institutions. i would also like to add section 623 of the fcra does not allow for credit reporting agencies to continue to report false information due to litagation or any reason.

Consumer Complaint: On XX/XX/XXXX I attempted to make a payment to American Express for the full statement balance. I accidentally made this payment out of the wrong account. My bill was due on XX/XX/XXXX, so this was an early payment. When my bank account received this request, they declined it because I didn't have enough money in that account. This is expected since I was really trying to make a payment out of a different account. Shortly thereafter, I received a notice the payment was not successful and the message indicated that I needed to correct this issue. Therefore, I made the payment out of the RIGHT account before the due date. It cleared. Even after the money cleared and I have a XXXX statement balance, American Express has attempted to withdraw the funds 2 more times. This has resulted in my bank taking the money away again and again. I have basically been overdrawn since XX/XX/XXXX because once the funds go back into my account and XXXX gives me the money back, American Express makes an attempt to take it away again. I have called American Express two times about this issue. Each time they say, it doesn't matter that the card is paid off in full, once I make an ACH request, they will continue trying to withdraw the money THREE TIMES. I said, " Please stop. You are not authorized. Why did you send me an email telling me to fix the issue if I did fix the issue and you continue trying to withdraw an account that results in an overdraft. '' They won't stop. XXXX told me this is false, that American Express can contact their bank operations and tell them to release the hold which will result in a stop on these continued attempts to withdraw, but American Express will not do it. I provided them the number, told them the process, and they did not comply. American Express is attempting to get over XXXX in payments from me even though I already paid XXXX and the account statement is now XXXX. The result of all this is I am missing XXXX in funds, other places have attempted to withdraw this account and denied because I do not have funds due to American Express, and I have been charged multiple late fees.

Consumer Complaint: On XX/XX/XXXX we have made an online payment of {$4100.00} from our primary bank 's ( XXXX ) bill pay service to an American Express charge card that we use for business expenses. Later that weekend we have discovered that our payment did not go through and upon further investigation found out that we had accidentally sent the money to the wrong account number which was from American Express but not the correct card. The money went to an American Express card that we had a long time ago but which is has not been active for a more than 4 years. That following week we had made a number of calls to customer service centers. We began by contacting American Express, no matter how many times we tried to say that we have the proof of payment they would always state that the account number that we sent the money to has been transferred to XXXX XXXX and we should contact them instead. Upon contacting XXXX XXXX with the same account number and proof of payment multiple times and speaking to multiple people each one of them told us that they can not locate an account with that number and they can not locate a transaction using the trace ID from the proof of payment. At this point we were sure that the only way to return our money was to go to our bank directly ( XXXX ) and ask the claims department to get it back. However, even there we were told that there was nothing they could do since we were the ones that initiated the payment. After calling in a circle atleast one more time we decided to speak to a banker at our local branch to try to find a solution to the problem. Unfortunately when our appointment time came, the only information they could provide us is to call back American Express with the proof of payment since on XXXX 's side there is nothing they could do. We are exhausted and no longer know what to do as each one of the three banks that are involved are sending us in a circle. We hope that bringing attention to this issue can resolve the situation.

Upon selecting a flight, day and time, an offer for a {$200.00} statement credit appeared from American Express on the XXXX XXXX website. On XX/XX/, spoke to XXXX XXXX representative confirming the American Express offer was legitimate. XX/XX/ XXXX called American Express and applied for the American Express XXXX XXXX XXXX XXXX credit card to use to purchase the airline tickets through XXXX XXXX to receive the {$200.00} statement credit and was approved for the credit card. XX/XX/ booked the flight through XXXX XXXX using the American Express XXXX XXXX XXXX XXXX credit card as required in the American Express " Terms and Conditions ''. XXXX XXXX XXXX received the statement from American Express which did not reflect the {$200.00} statement credit. XX/XX/XXXX called American Express who issued a claim number, and they stated the matter would be reviewed within 7-10 days. XX/XX/XXXX called American Express to check the status of the claim and was informed it would take until XX/XX/XXXX for a determination. The American Express payment is due XX/XX/XXXX The payment will be made to American Express by XX/XX/ to avoid any late payment or interest charges.

Consumer Complaint: My problem with American Express is that they gave me a {$22000.00} loan WITHOUT ME APPLYING FOR IT, and their Fraud department keeps concluding that I did it because it is indeed my checking account that the money was deposited into. I DID NOT APPLY FOR THIS LOAN but American Express IS NOT INVESTIGATING HOW OR WHY THIS HAPPENED. Further, they are calling me daily for repayment, assessing interest, and have cancelled my regular Amex credit card. I fear this will go to a collection agency and ruin my outstanding credit. This all started in XX/XX/XXXX. I can not get resolution. XX/XX/XXXX, I received a letter from AMEX stating " there was an attempt to open XXXX or more deposit accounts in your name at AMEX National Bank, and we believe it was without your authorization. '' I called ( XXXX ) XXXX to inform that I did not apply for any account. XXXX, I received a letter from Amex stating, " we need to speak with you regarding a security concern on your account '' XXXX Personal Loans. XX/XX/XXXX invoice date, first bill arrives for a {$22000.00} loan that I had not applied for! XXXX Account ending in XXXX. The invoice details " AMEX Loan DISBURSEMENT XX/XX/XXXX of {$22000.00}. '' I called AMEX, spoke to " XXXX '', who confirmed my identity, said he would look into cancelling my loan account and opening a fraud inquiry. He changed my account password and security pin. He said the investigation could take up to 45 days. XXXX XXXX, I received a letter from AMEX Fraud Operations stating that my inquiry is currently under investigation by the US Fraud Department. Then, XXXX XXXX, I received a letter from AMEX Fraud Operations stating " we've reviewed your dispute and are unable to accept your claim as your name is listed on the bank account in which the loan funds were deposited '', dispute reference number XXXX. I am shocked and furious ; we all knew that it was my checking account, but HOW DID THE MONEY GET INTO MY ACCOUNT?!!!! For months now, I have called AMEX explaining that this is fraud, that I didn't take out this loan. I have spoke to XXXX, XXXX, XXXX, and Fraud supervisor XXXX in XXXX. XXXX ( XXXX ) XXXX, XXXX ) finally cancelled my autopay and XXXX refunded me for XXXX ( case # XXXX ) and for XXXX ( case # XXXX ). But since then I keep getting billed, getting called to collect payment, and have had my AMEX credit card cancelled. Now, I'm being threatened with collections agency! I've called, spoken to XXXX, XXXX, XXXX, XXXX, XXXX... all promising to look into my case # XXXX. Still no resolution.
