Consumer Complaint: Wells Fargo/Wachovia opened a case last year but did not resolve the issue. I am entitled to seven payable on death accounts that my mother left POD to me that were wrongly closed by predatory ( former ) guardian/convicted Felon ( as of XX/XX/XXXX ) XXXX XXXX and her cohorts. This was a violation of federal banking laws and the bank remains responsible. Wells Fargo gave me a case number and contacted me by phone claiming there would be a settlement. But the bank failed to do as promised. I am still awaiting a monetary settlement, which I was promised. The bank participated in an illegal OR negligent activity by giving my inheritance money ( the seven CDs/money markets ) to the wrong person ( XXXXXXXX XXXX XXXX ) using an illegal court order. XXXX XXXX ( XXXX ) also now makes it clear that a bank can not destroy a Totten Trust . The bank either intentionally collaborated with convicted felon XXXX XXXX or erroneously paid out the seven CDs to XXXX XXXX 's Geriatric Care Management company. In either case, the Errors and Omissions of Wells Fargo/Wachovia insurance should be able to reimburse me the nearly half a million dollars that rightfully belongs to me. In a letter sent to me the end of last year, Wells Fargo claimed they could not provide information on the wrongfully closed/money taken accounts. This is a misstatement, since the money/accounts belong to me. The money is mine and has been mine ( POD ) since XX/XX/XXXX ( the day of my mother 's death ). It's time for Wells Fargo/Wachovia to give back the money that was wrongfully taken and not given to the rightful heir ( XXXX XXXX XXXX XXXX The bank has a contract with my mother, XXXX XXXX, to honor her wishes, and no predatory guardian or illegal court order can destroy a Totten Trust. I am now reaching out to the CFPB through XXXX XXXX 's office for assistance with this matter. I have extensive documentation to prove my claim and there is no statute of limitations where there has been fraud, and also for the sake of justice. For years, no one listened, but now with XXXX XXXX arrest and conviction and new legislation specifically stating that Totten Trusts can not be destroyed ( XXXX XXXX, XXXX ), the bank needs to honor my claim. Consumer Complaint: Debit card ending in XXXX Fraud Amount {$34000.00} To Whom It May Concern I am writing this letter in response to fraudulent activity on my Wells Fargo debit card ending in XXXX. I reside in the city of XXXX, Ca and work every Monday and Tuesday in the city of XXXX XXXX, Ca. On Monday XX/XX/XXXX I commuted to work at XXXX XXXX, and the last authorized transaction I made on the debit card was for an ATM withdrawal for {$1000.00} dated on XX/XX/XXXX at XXXX XXXX from a Wells Fargo located at XXXX XXXX XXXX XXXX in XXXX XXXX. On XX/XX/XXXX at XXXX XXXX I received a text message from Wells Fargo asking me to confirm an ATM transaction for {$1000.00}. I initially responded yes ; I recognized the transaction believing it was for the transaction I made at the Wells Fargo branch. On XX/XX/XXXX at XXXX XXXX I was at my work shift and attended a workers comp deposition with my attorney from XXXX XXXX to XXXX XXXX. My work shift ended at XXXX XXXX, and I commuted back home to XXXX, Ca. I have not used my Wells Fargo debit card since XX/XX/XXXX and did not receive any further text messages from Wells Fargo advising of any other large transactions. On XX/XX/XXXX at XXXX XXXX I received a voice mail from Wells Fargo fraud advising me to call and confirm some transactions on my Wells Fargo debit card ending in XXXX. On XX/XX/XXXX at XXXX XXXX I called the fraud department and was advised of several transactions that I confirmed I did not make. I initiated a debit card fraud claim at that time under reference # XXXX. I also checked my secondary wallet that I use when I commute to XXXX XXXX for work and noticed that my debit card was no longer in the wallet. I believe it may have fallen or I lost it after making the cash withdrawal from the ATM at XXXX XXXX. On XX/XX/XXXX I called Wells Fargo Fraud to get an update on my claim status and told it was denied because I confirmed on my cell phone that I recognized the ATM transaction which I explained I believed was from a valid ATM withdrawal I made and I did not receive any other text messages regarding unusual transactions totaling over {$34000.00}. I also explained to Wells Fargo that they promote a 0 liability to customers based on fraud. This is not the case and they refuse to reopen the case only stating they have no evidence fraud occurred because a PIN was used and I in error responded I recognized a {$1000.00} ATM withdrawal with no other warnings related to over {$34000.00} taken from my account. I began researching my Wells Fargo transaction history and noticed several posted and pending unauthorized transactions made to a non-WF ATM withdrawal located on XXXX XXXX XXXX XXXX, Ca and XXXX XXXX located XXXX XXXX XXXX XXXX XX/XX/XXXX to XX/XX/XXXX. I am requesting Wells Fargo follow their policy of 0 fraud liability to their customers and reimburse me for the {$34000.00} or show evidence that a fraud did not occur. I also followed procedure and reported to Wells Fargo immediately ( less than two business days ) after realizing the fraud and lost card occurred so should not be liable for more than {$50.00} of the transactions since they were not stopped. As an institution they should have had security in place to stop an unusual number of transactions in less than 2 days totaling over {$34000.00}. I have been a customer of Wells Fargo since XXXX it is not normal banking activity close to that amount.

Consumer Complaint: I bank with Wells Fargo. Have two addresses on file. Paperless. Wells Fargo closed my bank account with no notice, did not notify me until four days after closing- via email. I was aware of it by then as I keep all money in one account and log in daily. Account closed XX/XX/year> - I have spoken to 5 people on the phone and gone into two branches to gain access to the funds. All have said it is not possible to issue my money to me in person. That a cashier 's check must be mailed. No one has been able to verify where the check was mailed or on what day but that this will be up to 15 business days from XX/XX/XXXX ( three days after account was closed and access to my money was removed ) before the check arrives. I travel most of the year and bank online and the check will be mailed to an address across the country that I will not have access to for three and a half more months. They said the best they could do is if I haven't not gotten the check in my possession in 15 business days, to call them. They were unable to offer information on what they could do at that time. This is all of my money. Thank you.

Consumer Complaint: There is a {$6500.00} bill that is seventeen years old attached to my title. I'm trying to refinance with another company and Wells Fargo will not release my title because of it. I don't remember this bill and they can't find the origination of it ; but is holding up my refinancing. The agent that is assigned to ( from my CFPB complaint ) is unreachable. could this be one of those fraudulent charges that Wells was accused of? I requested a payment history XXXX XXXX on XX/XX/XXXX. They had to do a work order on it. They say it was completed on XX/XX/XXXX and I still have not received it. Can someone please assist with this?

Consumer Complaint: In 2023, I filed my taxes and wrote a check to pay the IRS. I mailed the check out in the amount of {$460.00} on XX/XX/2023. On XX/XX/2023, the IRS contacted me by mail stating that I never paid my taxes. I told them I did and they replied that they will open an investigation to see if any personal stole my money. I looked up the check online and the saw that someone changed " Pay to the Order '' person from " Internal Revenue Service '' to " XXXX XXXX '' in the amount of {$2400.00} instead of the original amount of {$460.00}. I reported back to the IRS about the situation and the IRS responded that I should report to my bank, Wells Fargo Bank, about the fraud and they will reimburse me back. I scheduled the appointment on the internet on XX/XX/XXXX to meet someone from Wells Fargo at the location at XXXX XXXX XXXX, XXXX, WI XXXX for XX/XX/2023 at XXXX in the morning. That next day my wife and I went to the bank. We spoke to the manager and the manager said that they will report it as fraud. Two weeks later I received a denial letter for the reimbursement. I was then told by Wells Fargo that I needed to make a forgery report from the police department and that it was not Wells Fargo 's fault for this incident. I made the report and the manager made copies of the paperwork, our carbon copy of the original check, and a print out of the forgery check that the bank wrongly process. Two weeks later, I was denied again due to the report being submitted after 30 days from the incident. I tried multiple times afterwards to contact and receive help from Wells Fargo but have been denied multiple times in person and have been transferred multiple times over the phone to multiple departments that would not assist me. After a few months of trying, I was told they would not assist me anymore and will not get reimbursed unless I sued Wells Fargo and good luck with that. Wells Fargo lied to me into believing I would get reimbursed and have failed on multiple steps to assist me before and after the incident took place. The worst part is, I have been a loyal customer for more then 20 years with this bank and was treated unfairly.

Consumer Complaint: I have attempted several times through register mail filed XXXX forms to collect my principal and security interest from WELLS FARGO BANK ( formerly WACHOVIA ) with no response. I am requesting my principal, security interest and overdraft fees, be redeemed to me. As well as my FEDERAL RESERVE NOTES redeemable to me made through my several Wells Fargo accounts. My credits and debits are not matching/nor add up. PER WELLS FARGO & COMPANY PROSPECTUS, Indentured agreement, Terms and Conditions, Customer account agreement Neither the Securities and Exchange Commission nor any state securities commission or other regulatory body has approved or disapproved of these securities or passed upon the accuracy or adequacy of this prospectus. Any representation to the contrary is a criminal offense. These securities are the unsecured obligations of Wells Fargo & Company or Wells Fargo Finance LLC, as applicable, and, accordingly, all payments are subject to credit risk. If Wells Fargo & Company or Wells Fargo Finance LLC, as issuer, and Wells Fargo & Company, as guarantor, if applicable, default on their obligations, you could lose some or all of your investment. Wells Fargo & Company have also denied me an extension of my own credit. 12 CFR - PART 1016PRIVACY OF CONSUMER FINANCIAL INFORMATION ( REGULATION P ) Providing my personal information without my consent. 1016.4 Initial privacy notice to consumers required. ( a ) Initial notice requirement. You must provide a clear and conspicuous notice that accurately reflects your privacy policies and practices to : ( 1 ) Customer. An individual who becomes your customer, not later than when you establish a customer relationship, except as provided in paragraph ( e ) of this section; and ( 2 ) Consumer. A consumer, before you disclose any nonpublic personal information about the consumer to any nonaffiliated third party, if you make such a disclosure other than as authorized by 1016.14 and 1016.15 of this part. All of 15 USC 1602 Definitions Rules of Construction clearly defines the roles between the two parties involved and who is extending the line of credit! 12 CFR 1002.2 DEFINITIONS ( a ) Account means an extension of credit. When employed in relation to an account, the word use refers only to open-end credit. ( b ) Act means the Equal Credit Opportunity Act ( Title VII of the Consumer Credit Protection Act ) ( e ) Applicant means any person who requests or who has received an extension of credit from a creditor and includes any person who is or may become contractually liable regarding an extension of credit. For purposes of 1002.7 ( d ), the term includes guarantors, sureties, endorsers, and similar parties. ( i ) Contractually liable means expressly obligated to repay all debts arising on an account by reason of an agreement to that effect. Just as Wells Fargo & Company Indentured Agreement states and prospectus states who is obligated. 12 CFR 1002.2 ( h ) Consumer credit means credit extended to a natural person primarily for personal, family, or household purposes. ( k ) Credit card means any card, plate, coupon book, or other single credit device that may be used from time to time to obtain money, property, or services on credit.12 CFR 1002.2 ( q ) Extend credit and extension of credit mean the granting of credit in any form ( including, but not limited to, credit granted in addition to any existing credit or credit limit ; credit granted pursuant to an open-end credit plan ; the refinancing or other renewal of credit, including the issuance of a new credit card in place of an expiring credit card or in substitution for an existing credit card ; the consolidation of two or more obligations ; or the continuance of existing credit without any special effort to collect at or after maturity ). ( 2 ) The term does not include : ( i ) A change in the terms of an account expressly agreed to by an applicant ; make any. ( p ) Empirically derived and other credit scoring systems ( 1 ) A credit scoring system is a system that evaluates an applicant 's creditworthiness mechanically, based on key attributes of the applicant and aspects of the transaction, and that determines, alone or in conjunction with an evaluation of additional information about the applicant, whether an applicant is deemed creditworthy. Which has caused erroneous harm to me, my family and my ability to properly provide for my household. Causing me to have to relocate in order to maintain my employment and lose of personal items. Also, the language of the terms and agreement is very unclear as to what my rights are as a consumer. I have found several violations within the agreement between I and Wells Fargo & Company there to in excess. Based upon the language. NOWHERE DOES THE CONTRACTUAL AGREEMENT, INDENTURED AGREEMENT OR PROSPECTUS ask, demand or request payments in the form of FEDERAL RESERVE NOTES. PLEASE REFUND ALL OF MY FEDERAL RESERVE NOTES FROM any and all accounts starting date XXXX ( Some are with Wachovia now Wells Fargo & Company ) 12 CFR 226.10 - PaymentsXXXX XXXX Payments. ( a ) General rule. A creditor shall credit a payment to the consumer 's account as of the date of receipt, except when a delay in crediting does not result in a finance or other charge or except as provided in paragraph ( b ) of this section. ( b ) Specific requirements for payment ( 1 ) General rule. A creditor may specify reasonable requirements for payments that enable most consumers to make conforming payments. ( 2 ) Examples of reasonable requirements for payments. Reasonable requirements for making payment may include : ( i ) Requiring that payments be accompanied by the account number or payment stub ; ( ii ) Setting reasonable cut-off times for payments to be received by mail, by electronic means, by telephone, and in person ( except as provided in paragraph ( b ) ( 3 ) of this section ), provided that such cut-off times shall be no earlier than XXXX XXXX on the payment due date at the location specified by the creditor for the receipt of such payments ; ( iii ) Specifying that only checks or money orders should be sent by mail ; ( iv ) Specifying that payment is to be made in U.S. dollars; or Another thing, TILA was never explained nor followed. The Truth in Lending Act ( TILA ) is a consumer protection law enacted in 1968 in response to exceedingly predatory loan practices. Prior to the TILA, lenders would use a variety of terminology and forms of lending that manipulated uninformed borrowers. The TILA changed this by requiring a uniform system of disclosures and terminology to be used for lending like credit cards or mortgages. Creditors were required to disclose details like the annual percentage rate and repayments details in a clear way to borrowers or else the borrower may be able to rescind the debt. TILA also limits the amount of late fees creditors can charge. Overall, the TILA since its signing has been updated to respond to changing lending practices to ensure borrowers clearly understand the terms and conditions they agree to. GAAP stands for Generally Accepted Accounting Principles and refers to the standard accounting rules regarding the preparation, presentation, and reporting of financial statements in the United States. This definitely wasn't explained nor indicated. 12 CFR Part 226 - PART 226TRUTH IN LENDING ( REGULATION Z ) 226.1 Authority, purpose, coverage, organization, enforcement, and liability. ( c ) Coverage. ( 1 ) In general, this regulation applies to each individual or business that offers or extends credit when four conditions are met : ( i ) The credit is offered or extended to consumers ; ( ii ) The offering or extension of credit is done regularly ; In conclusion, if the debt can be validated, I have no issue remedying the situation. As I have been a loyal customer of Wells Fargo & Company ( and formerly Wachovia ) for several years. ( a ) In general The Bureau may take any action authorized under part E to prevent a covered person or service provider from committing or engaging in an unfair, deceptive, or abusive act or practice under Federal law in connection with any transaction with a consumer for a consumer financial product or service, or the offering of a consumer financial product or service. In conclusion, if the debt can be validated, per the credit extensions I have no issue remedying the situation.

Consumer Complaint: My wells fargo cashwise credit for used during identiy theft to make two purchases. I called wells fargo to file fraud dispute they only took down one item, reissued me new credit card while transfered the balance from the 1 fraud charge to my new card. I called in again wells fargo this time took care of it. However now i found out my credit report is showing deratogry reporting because wells fargo charged off the card that had fraudulent charges and left the balance on there.

Consumer Complaint: XXXX XXXX has been appointed a 3rd party service provider for the refund of unauthorized add-on products ( Identity theft ) from Wells Fargo XXXX I called XXXX XXXX after receiving a letter from Wells Fargo regarding add on fees I incurred from Wells Fargo unauthorized. I was informed I would be mailed a check in the amount of {$460.00} plus an additional {$250.00} for fees I had incurred. Unfortunately, I have not been compensated as promised. I was only mailed a customer satisfaction check for {$250.00} and not the {$460.00} in fees I had incurred. I was initially told I would be reimbursed within 20 days. I was then told 30 days, then 45, and finally 60 days. I was also, told my case would be escalated yet still nothing. I requested a mediation form to be mailed so I could fill that out while I awaited payment and unfortunately XXXX has refused to adhere to the timeframe to reimburse. This is not acceptable & even more frustrating because Wells Fargo has caused financial hardship to me due to overdraft fees, add on product fees, etc. This has resulted in account bank account closures and a tarnish on my banking report. My reference number is XXXX.
