Consumer Complaint: On ( XX/XX/2024 ) I sent an Identity theft letter to ( XXXX XXXX XXXX XXXX XXXX, XXXX XXXX ). I have not received a response nor has ( XXXX XXXX XXXX XXXX XXXX, XXXX XXXX ) complied with my request which has been more than 30 days and is in violation of 15 U.S.Code 1681i ( 6 ) ( A ) and 15 U.S.Code 1681i ( a ) ( 1 ). Attached are the letters that was mailed on ( XX/XX/2024 ) and an updated FTC identity theft report. To my understanding, according to FCRA, debt collectors have 30 days to respond to disputes and request made by the consumer. ( XXXX XXXX XXXX XXXX XXXX, XXXX XXXX ) have not made one call, or sent one letter in regards to disputes I've mailed to them. This is a direct violation of FCRA Section 611 ( A ) ( 1 ). Which is punishable by up to {$1000.00} in fines per violation. If any disputes per the consumer request are not met with proof or verification within the requested and lawful amount of time, this account is to be deleted from the the consumer 's report, as by lack of response and documentation requested it signifies that this account is unable to be validated or verified. This Lack of validation per the consumer request is in direct violation of FDCPA Section 809 ( b ). Attached are the letters I sent plus my updated identity theft FTC report.

I know no one is going to help my family since it is easy for the courts/bank to steal my family 's home instead of provide justice and do what's right. XX/XX/year> - The bank confirmed that they are the servicer for the account which is assigned to XXXX XXXX. The bank has no standing to foreclose. XX/XX/year> - Appellate Court Judges XXXX XXXX XXXX and XXXX XXXX XXXX XXXX denied my appeal without any explanation, bases for the denial, and without examination or finding of legal error. Appellate Court did not exercise its discretion and did not perform its duty.

When I called WF they told me I didn't qualify because my payments were upto date. My husband passed away and I called WF and was told my husband had to be alive to quialify. I called the government program back and was told to make WF do something for me. I called WF and was assigned XXXX XXXX. Was told to send worksheet, hardship lettler and proof of Income on XX/XX/XXXX. Was told by XXXX WF would refinance my loan put in any missed Payment ( she had told me stop making payments starting on XX/XX/XXXX ) into the loan. I was told to pay off my car, credit cards and medical bills.on XX/XX/XXXX I faxed XXXX check stubs, hardship letter and monthly expenses.On XX/XX/XXXX XXXX XXXX was my respresentative ( XXXX XXXX XXXX ). On XXXX XXXX XXXX I received a letter from XXXX XXXX telling me the rules had not been followed because of the time frame.. I rec 'd a letter from XXXX XXXX on XXXX XXXX XXXX stating they will not be able to find a solution.I call WF and spoke with XXXX and she told me not to worry even if I receive a foreclosure letter just keep working with them. On XXXX XXXX XXXX I rec 'd a letter from WF they had approved a short sale. Rec 'd al from XXXX, XXXX XXXX XXXX XXXX Foreclosure natice. on XXXX tried to block sale. ( Section XXXX of Real Estate Settlement ) On XX/XX/XXXX I spoke with XXXX at WF and was told they couldn't find the paperwork for the liens and IRS paperwork. If I could get that info to them they would do an emergency approval to take it out of foreclosure.. On XX/XX/XXXX WF was waiting waiting for approval from FHA. On XXXX XXXX XXXX I was told they had sold the property. On XXXX XXXX XXXX I spoke with XXXX XXXX and was told well fargo wasn't going to do anything for me, I was also told Wells Fargo made a {$23000.00} profit from the sell. I asked for that as I was told my an atty. The bank had to give me and profits and was told they didn't care they were not going to give it to me. The person XXXX who bought the house told me he was a retired builder and when my husband went into the hospital in XXXX XXXX Wells Fargo called him to ask him if he wanted to buy the house. At that time I had never missed a payment

Consumer Complaint: Now, I rarely use my Wells Fargo account, which is comprised of two credit cards and a checking account. This incident began with an annual services charge from a third-party company in the amount of XXXX got charged to a credit card # XXXX account ( XXXX XXXX ) and went unnoticed, because I forgot about the services ( note - charges got refunded due to interaction with that 3rd party ) . I do have Wells Fargo account informational communications setup to receive email correspondence and mail for certain account activity. However I did not receive any communication either email nor mail regarding an upcoming payment due for credit card account # 1, which of course was due to it carrying a balance that month. The Wells Fargo credit card # 1 account thus attempted to auto-pay, which had been setup, but due to insufficient funds, caused an overdraft to my checking account. Wells Fargo has some kind of predatory overdraft coverage service, it's innerworkings previously unbeknownst to me up to this incident. The overdraft fee of XXXX} was charged to my credit card # 2 account ( XXXX XXXX ) and also initially went unnoticed, with again no email or mail communication sent by Wells Fargo. This overdraft charge was then subject to approximately 29.24 % interest as a cash advance. The credit card # XXXX account is also set to auto-pay and is also set to have this overdraft coverage. Had I not taken corrective action of this fee scheme, it could have caused a sort of chain reaction of overdraft charges or late fees, all at 29.24 % interest. This will not come to pass, as I am paying the XXXX fee for credit card account # XXXX from a third-party checking account. The fee is from XXXX} overdraft and XXXX interest charge from the first month. This configuration of so-called protection against overdrafts is very troubling, as is the fact that Wells Fargo forbids a third-party account from being added as a funding source to prevent overdrafts, and in addition offers no remedy to simply disable drafting the account when the balance has insufficient funds. These schemes seem intentionally predatory to cause additional fees to be incurred by unsuspecting customers who may not be sent all necessary and prudent communications about account activity from Wells Fargo nor fully informed about the function of their overdraft services.

Consumer Complaint: Two different deposit amounts for {$74000.00} and $ XXXX deposits show a date of XX/XX/22 on the letter from the prevention contact center from Wells Fargo it reads the funds were held while the review was made and based on the review the funds were now made available on XXXX online access to my account that I was monitoring hourly throughout the day was suddenly blocked and my account was closed or I was not authorized to access the online banking the funds I couldnt see what was going on I was out of the country for the weekend.I found out I didnt have the authority to cash a third party check in my account thru the atm and in order to open my account back up I need to bring the third party in with me to sign or endorse the check to me in the presence of a teller case number # XXXX noticing a discrepancy in the amounts and once I was able to regain online access I tried to request statements but they were not ready and then the sudden death of the party I was just in the bank with clearing up the endorsement issue caused me to set aside the documents I still seek clarification on I would like to know what happened to the funds that were made available during the time I was unable to get any access to online banking and my debit card was deactivated so please let me know
