Consumer Complaint: There was a woman with my same name and birthdate who was hospitalized in XXXX of 2019. She ultimately XXXX in XX/XX/2019. Her hospital bills hit my credit report. I have spent months contacting the collection agency, transworld systems inc, and the hospital and sent documents proving its not me. the transworld system has opened over 50 accounts on my credit reports. This has caused and issue with the SSA and IRS. on top of destroying my credit and preventing me from acquiring credit and an auto loan.

Consumer Complaint: To whom it may concern, Im a co-signer on my sons private student loan for {$21000.00} signed on XX/XX/XXXX with XXXX XXXX XXXX. When I was contacted sometime in XXXX by as far as we know XXXX XXXX XXXX. I never received and documents as a co-signer that the loan was approved. And how can someone in my condition at the time being on medical leave and applying for XXXX and no retirement fund and filing for XXXX even be approved to be a co-signer? My son did not make any payments at some point for some years and the loan went into default at this point and with interest the new balance was {$24000.00} due at this point. Many of loans by this entity have been dropped due to false documentation that we can prove. I let them know I was not working and filing for XXXX, I asked them to stop calling me, however, the calls just got worse. I was told how they would garnish my wages or put lien on my house for refuse to make a payment and the person started pressuring me with credit cards I had. I had medical issues that they took advantage of. They stated if I get off the phone I was refusing to pay and that I have credit cards that could be used and a monthly payment was agreed upon. Why are they not collecting from our son for this loan? Our son remarried and changed his last name to XXXX to avoid paying this debt. He has a job with the state as well. We tried to make an offer to settle and it was turned down. They harassed me for 3 hours over the phone until I agreed to monthly payments of {$150.00} and made payment on XX/XX/XXXX for {$3000.00} on my credit card they said that was not acceptable. My husband then got involved as a XXXX veteran and took {$6000.00} out of his XXXX to bring the loan up to date. Then they cancelled the monthly payment agreement for {$150.00} and changed it to {$300.00} which our son could not afford. Now they are stating the last payment was in XXXX which is not true as the two payments above were made in XXXX. Then in XXXX they contacted me again to pay the balance and they were advised I was on XXXX and unemployed. Then XXXX XXXX XXXX XXXX had me served with a summons and took me to court to put a judgement against me in XXXX. Now they want {$30000.00} to complete the loan. I never received notification that loan was even approved or payment agreements. Considering the multiple agencies trying to collect this loan I just feel Im being taken advantage of as I was only working part time and my husband did not co-sign either. These types of student loans are not covered under and government assistance either. All loans for college students should be included to be equal and fair to all students. Consumer Complaint: To whom it may concern : During the Spring semester of XXXX, I received a Perkins Loan from XXXX University to assist with education costs. Due to extenuating circumstances, I was not able to pay back the loan right after graduation in XX/XX/XXXX. I was under the impression that XXXX, as advertised, would help place me with a top-tier company that would compensate me with a suitable wage that matched my education and skillsets. Due to the fact that it took me more time than anticipated to get a job, I applied for forbearance for all of my loans and was approved. I was under the impression that this particular loan would have been included with the other loans that were approved for deferment. Sadly, I was mistaken. It wasn't until I started receiving correspondence via phone and postal mail that I realized this Perkins Loan was separate from the others and not handled by XXXX like the other loans. I set up payment arrangements, however, I wasn't able to keep up with the payments. I was unemployed for quite a while and I had to prioritize other bills above this loan for my own survival. The loan went into default eventually. I was able to finish paying off the loan in XXXX XXXX, 60 months after the origination of the loan. Unfortunately, the loan was still being reported as unpaid from XX/XX/XXXX to XX/XX/XXXX. That is false information remaining on my report for 20 months after being paid in full. I disputed this with XXXX several times to no avail. Each time it was disputed online, the credit bureau allowed for this false information to remain on my report as is. The situation became so egregious that XXXX banned me from being able to dispute this account online and over the phone. I gave up on this situation for a while. On XX/XX/XXXX, I called XXXX to speak with XXXX XXXX XXXX. I left a message with one of her associates that my account status still needed to be updated. The next day, XXXX XXXX emailed me back stating the status of the account is indeed being reported correctly. I refused to respond to her. I decided to go to the XXXX website to download a form to complete a mail-in dispute. I wrote a letter explaining the situation to them and I also attached proof that my account is paid in full. This is the same proof that I was providing when I was handling my disputes online. Finally, after receiving my letter and the attachments, the payment status of the loan was updated to " paid, was a collection account, insurance claim, or government claim or was terminated for the default ''. However, while updating the payment status they also falsely reported negative payment history for XX/XX/XXXX and XX/XX/XXXX. XXXX University is in violation of the Fair Credit Reporting Act ( FCRA ). They falsely reported negative payment information and they also did not send proper notice of this negative information that was reported. ( 7 ) Negative Information ( A ) Notice to Consumer Required ( i ) In general. If any financial institution that extends credit and regularly and in the ordinary course of business furnishes information to a consumer reporting agency described in section 603 ( p ) furnishes negative information to such an agency regarding credit extended to a customer, the financial institution shall provide a notice of such furnishing of negative information, in writing, to the customer. ( ii ) Notice effective for subsequent submissions. After providing such notice, the financial institution may submit additional negative information to a consumer reporting agency described in section 603 ( p ) with respect to the same transaction, extension of credit, account, or customer without providing additional notice to the customer. ( B ) Time of Notice ( i ) In general. The notice required under subparagraph ( A ) shall be provided to the customer prior to, or no later than 30 days after, furnishing the negative information to a consumer reporting agency described in section 603 ( p ). They are also in violation of the Fair Debt Collections Practices Act ( FDCPA ). The original balance was {$1300.00} and I ended up paying {$1700.00}. There was an unfair amount of additional fees and interest. 808. Unfair practices A debt collector may not use unfair or unconscionable means to collect or attempt to collect any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section : ( 1 ) The collection of any amount ( including any interest, fee, charge, or expense incidental to the principal obligation ) unless such amount is expressly authorized by the agreement creating the debt or permitted by law. I experienced undue stress because of this situation. I lost job opportunities that required a security clearance. It has also been hard getting a home loan with this on my report. I have been trying to purchase my first home. This account was sitting on my report as UNPAID for nearly two years after it was paid. Then when it was updated they added more FALSE NEGATIVE INFORMATION.

Further I request verification of the alleged debt, including, the name and address of the original creditor, along with a copy of a signed contract with the creditor. Wheres my HIPPA release form? I am aware that you have directly violated the regulations of the HIPAA Act of 1996. I never signed a HIPAA form to authorize your company to have access to my medical records or procedures that I went through. Additionally any attempts to harm my credit history and rating by updating or changing dates after you have been informed that the debt is expired, is a direct violation of the FDCPA. Consumer Complaint: After thoroughly looking through the OPENING loan disclosure documents provided to me XX/XX/XXXX, the FAQs on the loan servicer 's website, and TILA, I have discovered that I am still missing the APPROVAL and FINAL disclosure documents required to be given to the consumer in accordance to 12 CFR 1026.47. These THREE documents are still not accessible. As I was not provided with my FINAL disclosure, I was not given my payment schedule, ultimately allowing the servicer to pick and choose my billing cycle and payment date, which violates 12 CFR 1026.47 ( b ) and 12 CFR 1026.47 ( c ). Since XX/XX/XXXX, my payment date and billing cycle have changed at least one time. As the due date has apparently changed, I have no way to verify what the actual due date should be and I am still not receiving the statements in a timely manner so I can make the payments on time.
