Consumer Complaint: XXXX XXXX has repeatedly communicated with me both directly and indirectly by duress and coercion. My vehicle was repossessed which they had no right to do as there is no UCC filed meaning no lien is present. Theyve sent multiple correspondence lowering the price in order for them to remove. They went as low as requesting me to pay {$2000.00} and they would delete and remove because they are aware that I truly owe them nothing. The car was paid for at the consummation of the transaction to which I had no awareness. The contract was also subject to arbitration to which XXXX XXXX failed to comply by and illegally and unlawfully repossessed my car and still trying to purchase the debt.

Consumer Complaint: XXXX XXXX XXXX XXXX XXXX XXXXXXXX XXXX MD XXXX XXXX Subject : XXXX XXXX XXXX Accounts XXXX, XXXX and XXXX XXXX XXXX XXXX Accounts XXXX and XXXX XXXX Account XXXX XXXXXXXX XXXX XXXX Account XXXX XXXX XXXX XXXX Account XXXX Dear Consumer Financial Protection Bureau I am writing to bring to your attention a matter of concern regarding the credit bureaus and their potential non-compliance with consumer protection laws. As a diligent consumer, I have observed discrepancies in the reporting practices of the credit bureaus, which appear to be inconsistent with the established regulations aimed at safeguarding consumer rights. I believe that the credit bureaus may not be adhering to the Fair Credit Reporting Act ( FCRA ) and other relevant laws that are designed to ensure accuracy, fairness, and privacy in the information they collect and disseminate. I have encountered specific instances where inaccuracies in my credit report have had adverse effects on my financial standing. I have attached supporting documents, such as Updated credit report and ALL The Laws to substantiate my claims. These documents serve as evidence that the reported information is not accurate. This is my third CFPB complaint about the inaccuracy of the three credit bureaus reporting And they are still reporting it. According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states There is a need to insure that consumer reporting agencies exercise their grave Responsibilities with fairness, impartiality, and a respect for the consumers right To privacy. I have the right to make sure my private information isnt shared which Is backed by 15 USC 6801 which states It is the policy of the Congress that each Financial institution has an affirmative and continuing obligation to respect the Privacy of its customers and to protect the security and confidentiality of those Customers nonpublic personal information. '' ( Furnisher of information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( Furnisher of information to credit agencies ) the financial institution and the Consumer reporting agencies XXXX, XXXX and TransUnion DO NOT have my consent to furnish this information and they surely DO NOT have my written consent. And I also want to bring to your attention a concerning issue regarding the credit reporting practices of the three major credit bureaus XXXX, XXXX, and TransUnion. I have discovered discrepancies in the investigation of accounts on my credit report, and I believe that they have not been properly addressed by the respective credit bureaus. These accounts have NOT been I properly investigated according to the LAW. TransUnion, XXXX and XXXX investigate accounts based off of their own policies not the LAW. Section 1681a of the Fair Credit Reporting Act defines an investigative consumer report as a consumer report or portion thereof in which information on a consumer 's character, general reputation, personal characteristics, or mode of living is obtained through personal interviews with neighbors, friends, or associates of the consumer reported on or with others with whom he is acquainted or who may have knowledge concerning any such items of information. However, such information shall not include specific factual information on a consumers credit record obtained directly from a creditor of the consumer or from a consumer reporting agency when such information was obtained directly from a creditor of the consumer or from the consumer. TransUnion, XXXX, and XXXX please provide me with the name, date or time of the people you have spoken with when you did this investigation. I am tired of going back and forth with the agents at all three credit bureaus about the LAW and they telling me that theyre following company procedures and policies. Even Though there are procedures and policies does not line up with the LAW. 15 U.S. Code 6801 ( a ) Privacy obligation policy It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. Any and all consent to XXXX XXXX and TransUnion ( Furnisher of Information to credit agencies ) whether it be verbal, non-verbal, written, implied Or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that A financial institution May not disclose nonpublic personal information to a nonaffiliated third party Unless the consumer is given an explanation of how the consumer can exercise That nondisclosure option. And lastly. All of these Accounts are being reported as charged off. When a debt is sold over to a third party debt collector or it is considered charged off that is now considered a certificate of indebtedness which goes along with the 1099c the cancellation of a debt. Which means it is now income and income is not reportable and must be REMOVED Before this complaint is close please provide me with 1. The name, date and time of the person you spoke to complete your investigation ( According to what is written in Law and not YOUR POLICY ) 2. Written consent that I gave you to furnish these accounts. 3. Explain why you are still reporting these accounts even though they are not reported accurately across all 3 credit bureaus ( This is my third CFPB complaint about the inaccuracy of the reporting ) 4. Please provide the law that states that the credit bureaus can report income. I attached all the laws that was mentioned to this complaint. If you choose to ignore the laws and continue reporting based off of your procedures and policies that is fine. I will use this when I come back to sue all three credit bureaus. Ignorance of the Law is No Excuse. I kindly request the Consumer Financial Protection Bureaus intervention to ensure a thorough and proper investigation into these matters. I believe that the credit bureaus have a responsibility to accurately reflect individuals customer report and the current situation raises questions about the integrity of the reporting process. I have attached copies of supporting documents for your reference. Your prompt attention to this matter is highly appreciated.
