Consumer Complaint: ( Please note this overview was sent to XXXX XXXX ), XXXX XXXX, We consistently provide updates directly to your office due to the excessive amount of fraud we are experiencing in Georgia. We feel it is extremely vital to ensure you are aware of the excessive amount of ID Theft/Fraud which is taking place in this state. This is not an isolated incident. We have met numerous victims of Mortgage Fraud in Georgia, As stated previously, I was forced to file personal bankruptcy to obtain assistance with the investigation of approximately XXXX XXXX dollars of CONVENTIONAL RESIDENTIAL Mortgage fraud. We were utilized as targets and never received a mortgage for any of our properties. All closings were staged and our names were forged onto documents which profited others. There were no fraud investigations by the XXXX or the Creditors because it appears they were all involved, Until now XXXX ; XXXX and others are attempting POST PROACTIVE Approaches which should have been completed previously, Unfortunately, the damage has been done and there is no rectifying of the harm others have caused. We are preventative tips regarding the prevention of fraud, This is quite hilarious after the fact. The retained Attorney XXXX XXXX XXXX who was paid a retainer of XXXX has done nothing to assist us, In fact we know he is working with the Creditors and Bureaus to provide information to assist them with staying ahead of any charges which may be filed. Select Portfolio had the audacity to send information regarding Fraud Prevention and ask we complete an ID THEFT/FRAUD Affidavit for the 50th time. We have provided this information previously and now they are asking for additional items in order to cover themselves legally. well, it's too late to cover and besides SPS sent us a letter stating the second mortgage on the home located at XXXX XXXX XXXX XXXX XXXX GA which was stolen by the XXXX trustee. It's very obvious who's a part of this racket but it's too late. They are attempting to follow their given policy and procedure to cover themselves in a court of law, at this point we recommend they provide a level of compensation. The level of evidence against all involved is astronomical and can not be rectified. We will be honored to testify if and when needed. Respectfully Submitted

Consumer Complaint: My loan was transferred from XXXX XXXX to Select Portfolio Services ( SPS ) on XX/XX/XXXX. Prior to transfer I was approved for loan modification with previous servicer on XX/XX/XXXX. I accepted loan modification terms on XX/XX/XXXX. I was advised that my agreement package would be sent out by new servicer. I called new servicer SPS on XX/XX/XXXX to advised I was approved for loan modification. I was told it could take 60 days to get everything transferred over. My loan matured in XXXX with prior servicer asking for a very large lump sum that I could not pay due to me being XXXX and on fixed income. That is why I seemed assistance from previous servicer and they helped me by approving my loan modification but then I was transferred to new servicer. I thought it would be a smooth transaction. But it has not been at all. After receiving a letter XX/XX/XXXX from SPS asking for documents to start a new loan modification application and asking to send documents I had already submitted to previous servicer. I called that same day and faxed approval letter to SPS. They continued to send me correspondence requesting me to submit taxes, proof of income and bank statements so that they could start a loan modification review. I sent a notice of error advising of the same information with dates along with copy of approval letter. I received a response stating that on XX/XX/XXXX SPS reached out to XXXX XXXX in regards to my loan modification and they were advised that No documents were received for review before transfer. Which is totally not true. I sent SPS a copy of my approval letter from XXXX XXXX as well as letter that I received prior to approval letter stating that all documents were received for them to complete a review of my loan modification. In their dispute response they are still asking for my documents. I called SPS XX/XX/XXXX and spoke to a XXXX who claims that a lot of my documents came in from XXXX XXXX on XX/XX/XXXX which included my bank statements, bank statement as well as work up sheet for loan modification. She stated she would send to department that handles as well as put in a request to have the relationship manager by the name of XXXX XXXX that was handling my case. On XX/XX/XXXX XXXX XXXX called me and I went over everything with him. He was adamant that my previous loan modification could not be honored because I had not signed the actual agreement that should have been sent out after I accepted terms. I explained to him that I accepted terms on XX/XX/XXXX and was transferred XX/XX/XXXX. Per their correspondence to me about my transfer it clearly states if a customer is working on a pending loan motivation or have an approval the new servicer would handle. But, the representative is telling me because I did not sign an agreement that the prior servicer would not have had enough time to send to me before my loan was transferred which would have now made the new servicer responsible for sending. The representative was rude and pretty much continued to say I would need to provide the documents to have my loan modification reviewed by them. He mentioned a trial loan modification. Not sure why when previous servicer have a XXXX yr fixed term at the same rate and was not a trial period. I hung up with that representative because I was not getting any where with him. I decided to call XXXX XXXX and had a fantastic representative name XXXX XXXX from their loss mitigation department help me by calling SPS on conference call. XXXX verified that I was approved and that I had accepted the terms. She even states that the agreement that I would have had to sign to start my payments had started to generate in there system but I was transferred to SPS. Once we got SPS on line we spoke to young lady by the name of XXXX at SPS in the loss mitigation department. She continued to te me what I needed to send in and XXXX from XXXX XXXX tried to explain to her that I was already approved all they had to do was send the agreement. I decided to ask for a supervisor. A gentlemen by the name iof XXXX stated he was a supervisor in loss mitigation team. I explained to him what I have been explaining since XXXX. He saw the approval letter and read it. XXXX from XXXX XXXX explained that I was approved and that all they had to do was request the loan modification agreement from them by doing an inflight request. She explained to him that the only thing that was left for me to do was sign the agreement. She verified the day that I accepted the terms. The supervisor said he was gon na do a prior service review which was the same as an inflight request. Meaning this would request everything from previous servicer. He said looks like that had never been done. I have spoken to at least 6 different people between XXXX to current to get no resolution. All I wanted to do was start making my payments. This is my XXXX loan that I am trying to get the loan modification on This review could have been requested 2 months ago. I have been bombarded with calls and correspondence either telling me about the account being past due or requesting documents to review a loan modification that they state was started with them on XX/XX/XXXX. I never submitted an application to them prior to XX/XX/XXXX. So, if they didnt receive my loan modification details from prior servicer how can they say I submitted an application for review on XX/XX/XXXX for a loan modification when I didnt. This has been the most stressfull situation ever. I even explained to them that their are federal regulation codes set in place for consumers like myself about loan modifications up to even when transferred. I truly need help with this situation because I just cant understand how they could respond back to my notice of error with that response and I have supplied them with proof. I am sending copies of letter from XXXX XXXX advising all my documents were received followed by my approval letter. Also, I am sending letter from SPS which contradicts what they are saying in letter.

Consumer Complaint: I was behind on my mortgage, and it became intensified by covid. I was a XXXX XXXX, and I lost my job. I heard about the government program for families struggling to pay their mortgages. I had done the forbearance option, but it was time to pay it back and I couldnt. I applied for and was granted the grant that covered all the arrears on my mortgage. I am so grateful. Just as I prepared to make my first payment my servicer started calling saying I had a payment due for XXXX. The paperwork I received said I was due in XXXX. I called my servicer to confirm. They told me the grant only covered up to XXXX because they had made a mistake somewhere, but they did not include it. The grant total was completed in XXXX of XXXX. I made a principal payment in XXXX and XXXX. I asked the servicer what they did with that money since they had already given the government program the total amount to cover me until the end of XX/XX/XXXX? The servicer told me that they applied it to XX/XX/XXXX. I asked how was that possible when they had already been included in the government grant payoff? I told them that they were double-dipping collecting from both the government and me for the same period and that because they had already been paid for XX/XX/XXXX, the money I paid after the grant amount was submitted should have applied to whatever they were asking for the month of XX/XX/XXXX. I am writing because they are trying to cheat me. I was prepared to pay in XXXX, they are threatening me with now damaging my credit report by showing 30 days late. I feel I am being strong-armed here and am at their mercy. They want to get paid twice for the same month of XX/XX/XXXX. I believe they are trying to set me up for failure as a punishment for receiving the grant. I am angry and afraid because I am just getting my credit back together after a long journey of arrears left from my divorce and trying to live on credit cards because of losing my job. The servicer is talking to me as if I am ignorant of the financial part of this. While the servicer acknowledged they tried to go back to the grant program to fix their error, they were unable to do so. I have no problem with them getting paid for XXXX, but I know that I have given them at least two payments of {$930.00} to equal $ XXXX that can be applied for XXXX because they have not refunded it back to me. To recap : XXXX requested the total of everything owed to my servicer. XXXX of XXXX XXXX settled on the amount of {$54000.00} to clear and bring current my account. My servicer agreed. I was not notified right away so I made ( 2 ) principal payments after that date. I received a letter stating I was paid up and my first payment would be due XX/XX/XXXX. My service came back and said I owed $ XXXX for the month of XX/XX/XXXX. I asked what was done with the money I paid after the settlement was made and I was told it was applied to XX/XX/XXXX which was also included in the settlement amount for XXXX and if I did not give it to them, they would report to the credit bureaus that I am 30 days late. Can you please help me? This isnt fair.

Consumer Complaint: I had a new loan close on XX/XX/XXXX with XXXX XXXX XXXX. The loan was transferred to Select Portfolio Servicing immediately with notice that the terms of the loan would remain the same and that payments should be made to SPS. The original terms of my loan have a higher interest rate because I chose to WAIVE escrow for Hazard Insurance and Property Taxes. The only insurance that was included in loan and required to be escrowed was Flood Insurance for {$2700.00}. At closing all Hazard Insurance, Flood Insurance and Property Taxes had been paid in full prior to closing with receipt and Flood Insurance that was required in escrow was collected for an additional 3 months. The payments of principal/interest and Flood Insurance escrow XXXX {$220.00} ) totaled {$4700.00}. On XX/XX/XXXX we received a letter from SPS requesting we notify our insurance and have Loss Payee changed to reflect SPS. We again complied and a copy of this information was uploaded to their portal. I spoke to insurance department XX/XX/XXXX and they acknowledged they had the corrected Loss Payee and nothing further needed. Then on XX/XX/XXXX we receive an Escrow Analysis for upcoming year XX/XX/XXXX thru XX/XX/XXXX that included ALL insurance and taxes in escrow ( Hazard, Flood, and Property Tax ). I immediately called and spoke to SPS and they said only way to remove it was to put it in writing ( mind you they legally could not change the terms of the loan and yet they did ) and that they would send me a form to complete and fill out. I signed the Escrow Account Closure Request on XX/XX/XXXX and uploaded that to SPS portal, along with a copy of the closing documents that showed the Escrow Waiver. SPS acknowledged receipt of said documents on XX/XX/XXXX. I called again XX/XX/XXXX to check the status and was told it was being removed and that I would receive a letter indicating such. To date, nothing has been done. I received billing statement for XX/XX/XXXX that included escrow for all hazard, flood and property tax for an increase of {$1000.00} per month to the mortgage. I called and spoke to XXXX on XX/XX/XXXX and she acknowledged they had 30 days to remove ( which would have been XX/XX/XXXX and already passed ) and then went on to say it was showing the matter to be completed no later than XX/XX/XXXX. On XX/XX/XXXX I again checked on their portal to see if any changes had been made and noted the payment had been lowered from {$5700.00} to {$4800.00}, but had not been lowered to the original amount of {$4700.00}, a difference of {$130.00} higher per month. I immediately called SPS and spoke to representative that said there was nothing she could do and that the escrow department did not have a number, nor was I able to speak with them directly, regarding this continued error. She said the difference of {$130.00} was because of a " shortage in escrow '' and said that I could find that on the escrow analysis of XX/XX/XXXX. I reminded her that the escrow analysis was based off of ALL Hazard, Flood and Taxes when the error was made and that if escrow of Hazard and Taxes were removed properly, there is not a shortage. She again stated nothing she could do. She did advise she would reach out to her supervisor and put me on hold. I waited over 30 minutes before she disconnected me and never returned the call. In closing, the escrow payment continues to be incorrect, I can not get a human being that is able to logically critically think and correct their mistake. Short of filing a suit, getting their attention has been difficult and what they are presently doing is illegal. Your help with this matter is most appreciated.

Consumer Complaint: NOTICE OF ERROR The servicer must acknowledge receipt of a Notice of Error within five days ( excluding holidays, XXXX and XXXX ) after receiving the notice, rather than the twenty-business day period under the former law. See Reg X, 12 C.F.R. 1024 35 ( d ) 9effective XXXX XXXX, XXXX ). 1 ) The mortgage servicer Select Portfolio Servicing , Inc. ( SPS ) deemed my application for loan modification complete as of XX/XX/XXXX, per the attached SPS correspondence dated XX/XX/XXXX. In said correspondence, it states that if any scheduled sale date is in place, SPS will contact the attorney to have the foreclosure sale postponed. SPS failed to reach out to their counsel XXXX XXXX XXXX to request a postponement of sale while the review of modification was taking place. 2 ) Select Portfolio Servicing, Inc, ( SPS ) kept the sale date of XX/XX/XXXX, on record and denied the loan modification within 6 calendar days of completion notice. Although the notice states they may need roughly I am not convinced my loan was probably reviewed for all options. In addition to the denial, it states I could consider a Deed in Lieu as an alternative option to foreclosure. However, because of the sale date being in place, I was not provided the opportunity to apply for Deed and Lieu. 3 ) Select Portfolio Servicing, Inc, ( SPS ) also states in the same denial the right to appeal and the protection provided during the 30-day appeal period. Such protection mention are No foreclosure sale will be conducted and you will not lose your home during the appeal period and if a date of sale is scheduled, SPS would advise attorneys to postpone the sale. SPS failed to advise their counsel XXXX XXXX XXXX to postpone the sale scheduled for XX/XX/XXXX. 4 ) The actions of Select Portfolio Servicing, XXXX are consistent with XXXX XXXX. XXXX XXXX occurs when a mortgage servicer continues to foreclose on a borrower 's home while simultaneously considering the borrower 's application for a loan modification or other foreclosure avoidance option. This practice violates federal law ( 12 C.F.R. 1 1024.41 ) which ; The Consumer Financial Protection Bureau, which was established by the Dodd-Frank Wall Street Reform and Consumer Protection Act of XXXX, issued mortgage servicing rules that, after being codified into federal law, went into effect as of XX/XX/XXXX. Among other things, the rules restrict XXXX XXXX.

Consumer Complaint: I applied for a Loan Modification with Select Portfolio Servicing, Inc. ( SPS ), which was deemed complete as of XX/XX/2022, per the attached SPS correspondence dated XX/XX/2022. In said correspondence, it states that if any scheduled sale date is in place, SPS will contact the attorney to have the foreclosure sale postponed. SPS failed to reach out to their counsel XXXX XXXX XXXX to request a postponement of sale while the review of modification was taking place. SPS kept the sale date of XX/XX/2022, and denied the loan modification within 6 calendar days of saying the loan was complete. However, stated they would need roughly 30 calendar days to review. I am not convinced my loan was probably reviewed for all options. However, in the denial, it states I could consider a Deed in Lieu as an option and that I had an appeal period of 30 days before any sale would be scheduled, or conducted. It also states in the right to appeal section that SPS would again request a postponement of any scheduled sale date with their counsel XXXX XXXX XXXX. Once again this did not happen! However, SPS kept the sale date of XX/XX/2022, in the system, which should have been postponed after the complete loan modification package was received. Also, the sale date should have also been postponed for the appeal period. SPS failed to comply with their own correspondence and furthermore failed to comply with Federal law regarding the required time period before a sale date can be scheduled during the appeal period and once the appeal period ends. In addition, did not provide a timeframe to apply for the Deed in Lieu of foreclosure which they said I was eligible for. I am looking for the CFPB to provide justice so that I don't lose my home.

Consumer Complaint: I took out a home equity back in XX/XX/XXXX for the amount of XXXX a XXXX period paying an interest rate of 10.99 % the home equity should have been paid off on XXXX I have made all my payments where they debit the money directly from the account. I was late for 3 payment and they defer those payments to the end of the loan at this time the new servicing company Select Portfolio Servicing is telling me that I still have an outstanding debt of XXXX I have try calling them to give me an amortization schedule of all the payments I have made, as well if there were any documentation that I would have signed that would have extended this loan that there should not be any since I never sign up for a refinance or modification since this is the answer they keep providing me that I had to do to still owe this money but they have not provided me with any evidence of this.

Consumer Complaint: I AM PAID IN FULL- ON XX/XX/XXXX SELECT PORTFOLIO PAID TO HAVE MY HOME VADELIZED BURGLERIZED AND HIRED A COMPANY TO KEEP ME OUT OF MY RESIDENCE TO INCLUDE FORCE ME OUT WITH PHYSICAL FORCE- I LOST OVER XXXX OF PERSONAL PROPERTY AND MY INHERITANCE AND BUSINESS - MY BUSINESS HAS A XXXX CONTRACT LOST AFTER THEY COMPLETYELY LIED TO ME REFUSED A PAYMENT AFTER THIS CRIME ON MY MARITAL HOME- THEY PAID THE JUDGE TO FRAUD AN ORDER ACCORDING TO THE CRIMINALS THEY HIRED TO VIOLATE MY RIGHTS TO ENJOY ME HOME- AS THEY GALKED AT HOW THIS WAS FOR XXXX, OOO IN LUIE OF FORECLOSURE WHEN MY MORTGAGE WAS NOT LATE AND WAS UP TO DATE- I ASKED THEM TO REPAIR MY HOME THEY LIED TO YOU AS YOUR WHY I WAS ABLE TO RETURN IN XX/XX/XXXX AND I HAVE 4 RECORDINGS OF THE RELATIONSHIP SPECIALIST SAYING WHO EVER TOLD ME I COULD ASSUME THE LOAN TELL THEM THEY ARE LYING AND TO CALL THEM - AND THEY WILL EXPLAIN I TOLD HER ITS OKAY I GOT HER RECORDED- AND SHE SAID SHE WAS SORRY THE Lawyers are XXXX and are lying to the point of criminal acts to steal my home- but they can not help me as the judge fraud and took a fordgery document to transfer a tittle to a man hired by the company named XXXX XXXX the XXXX who was also couyrt apt ? but he does this a lt he is a proffessional in mortgae fraud and breach of duty its how i learned its what they are doing to me- is there some way ypu can get FBI OR SOMEONE TO LOOK INTO THIS WHITE COLLAR CRIME AS I LOST ALL I OWN AND CONSUMER PROTECTION IS THE ONLY HELP I GET- PLEASE PLEASE PLEASE HELP ME- I PAID FOR THIS DEPT AND THEY CAN PAY ME FOR MY LOSSES OR MY HOME- AS IT A FINNACIAL CRIME AND THATS THE REMEDY.
