Consumer Complaint: 1. ) XXXX to XXXX : HMDA-LAR Public Disclosures obtained from the National Archives show that XXXX XXXX XXXX employed by XXXX XXXX XXXX XXXX and XXXX XXXX XXXX XXXX XXXX XXXX. operated a nationwide, direct-marketing Boiler-Room in XXXX XXXX, Pennsylvania, which from XXXX to XXXX originated XXXX Subprime Mortgage Loans to financially-distressed consumers ( many, if not most, of whom were of XXXX XXXX, XXXX, and XXXX descent ). The Toxic Mortgage originated were first sold them to XXXX XXXX XXXX XXXX, XXXX XXXX who submitted them via Certified HMDA-LAR Disclosures using Respondent ID ; XXXX, This XXXX Bank then sold XXXX of these Toxic Mortgage Loans to it XXXX Bank Affiliate : XXXX XXXX XXXX, XXXX XXXX XXXX ( XXXX ) ; who then re-submitted them via certified HMDA-LAR Disclosures using Respondent ID : XXXX ( Thereafter, both XXXX XXXX XXXX claimed ownership of these Toxic Mortgage Loans mortgage loans until XXXX. ) 2. ) XXXX to XXXX : On XX/XX/XXXX, XXXX XXXX XXXX XXXX, XXXX XXXX outsourced the Servicing Rights to hundreds of these Toxic Mortgage Loans to Select Portfolio Servicing, Inc., a Utah-based Debt Collector/Portfolio Disposal Company ; and four days later, on XX/XX/XXXX, XXXX XXXX XXXX, XXXX XXXX. sold its Co-ownership in these Toxic Mortgage Loans to XXXX XXXX XXXX XXXX XXXX XXXX Both of these actions were designed to conceal the existence of these XXXX-Originated Toxic Mortgage Loans from DOJ Fraud Investigators during the Discovery Phase of the XXXX RMBS Trust Certificate Lawsuit. Serendipitously, these fraudulent acts denied many of financially-distressed owners of these Toxic Mortgage Loans ( many of whom were of XXXX XXXX, XXXX, and XXXX descent ) of their rightful shares of the Consumer Relief/Restitution XXXX XXXX XXXX XXXX, XXXX XXXX, Select Portfolio Servicing, and XXXX XXXX XXXX XXXX XXXX used the Eleventh-Hour Outsourcing Maneuver to hide the XXXX XXXX-Originated Toxic Mortgage Loans originated by XXXX XXXX XXXX at the XXXX Boiler-Room between XXXX and XXXX ; but had the guts to claimed that they were unaware of the level of toxicity of home mortgage loans they purchased from Subprime Market-Leaders XXXX XXXX XXXX, XXXX XXXX, and XXXX XXXX XXXX

Issue: Applying for a mortgage or refinancing an existing mortgage

Consumer Complaint: Back on XX/XX/XXXX I asked SPS ( Select Portfolio Service ) to provide me with Payment History from XXXX through XX/XX/XXXX. I made this request via phone. Unfortunately, SPS could only provide from XX/XX/XXXX through XX/XX/XXXX. The reason I needed this information is I was trying to refinance my home and had locked in at a very reasonable interest rate. I need this information as I had a second lien on my home through the XXXX XXXX XXXX XXXX XXXX ). They had provided financial relief for me to stay in my home in XXXX and XXXX. At that time XXXX XXXX was the mortgage holder. When it was sold to SPS in early XXXX, the history was supposed to be transferred to SPS. I request it as said in XXXX of XXXX, letting SPS know I need the information, or I would have to pay {$32000.00} to have the lien released. They kept denying they had the full data saying that was all the had received. There should be accountability to them as well as XXXX XXXX. They had part of the information as well as my load modification, but not the full history. The XXXX would not accept that, and because of time restrictions and Interest rates rising, I had no choice but to move forward and include the additional {$32000.00} in my refinance and close the deal. There should be laws that make financial institutions save history for cases such as this and penalties if they do not. I believe SPS lost the material or, if they didn't get it should pay me and then go after XXXX XXXX if they didn't supply it. See all letters to and from SPS.

Consumer Complaint: I want cfpb & XXXX XXXX to get involved with this immediately Answers from SPS IS JUST A SPIN.They have with their attorneys among other things DUAL TRACKED and i have application in for assistance from state IHAF and have confirmed appt for certificate XXXX XXXX. I was told by the ombudsman department several time in XXXX they had got me a loan mod telling me payment would go up too {$2400.00} asking me if i would accept that I SAID yes The last call i got was XX/XX/XXXX XXXX FROM XXXX again ( ombudsman ) saying please be patient he was just calling to let me know he was on top of everything and as soon as he see final papers he would get back to me.Have not heard from him or anyone else since. Their attorneys tell judge no loss mitigation is pending. I dispute all numbers and want a real investigation of everything .I WANT you AND ILLINOIS ATTY GENERAL TO FILE INJUNCTION AGAINST THEM as they will not put file on hold on their own!! We have a hearing XX/XX/XXXX AT XXXX THEIR ATTORNEYS KEEP PUSHING IN COURT

Consumer Complaint: In summary, when we closed the refinanced deal with another lender and SPS charged us XXXX for the payout which was originally {$460000.00} before I made XXXX payments from XX/XX/XXXX XX/XX/XXXX equal to {$33000.00}. In addition, SPS did not report all the mortgage payments that I made during the pandemic but SPS somehow decided to charge me {$31000.00} in delinquent payments during the pandemic. In addition, SPS charged me {$42000.00} in interest for XXXX which is very concerning since I dont even pay {$42000.00} in mortgage payments each year. Also, SPS added an XXXX debt on my credit as debt and recouped it at the closing of the refinance in XX/XX/XXXX. I strongly believe Select Portfolio Servicing is guilty of UNFAIR BUSINESS PRACTICES, IN VIOLATION OF BUSINESS AND PROFESSIONS CODE SECTIONS 17200, ET SEQ, Fraud For Profit and more

Issue: Struggling to pay mortgage

Consumer Complaint: Select Portfolio Servicing has continually blocked and denied us the opportunity to be reviewed or considered for government and internal loan modification and forbearance programs and has scheduled a sale date on our home for XX/XX/XXXX. There has been a significant change in our household finances, and we want SPS to review the current and correct financial circumstances but they are telling us it is too late. We tried to get help through the government CARES program because our family was affected by Covid but SPS did not provide this help. We applied multiple times for government modification programs with SPS but would always get stuck in an endless cycle of missing documents and no positive resolution. On XX/XX/XXXX we were finally approved for a trial loan modification and with great joy made our first payment. ( paperwork attached ) A month later when we tried to call in the second payment we were told the modification was cancelled ( no reason provided ). Since that time we have been in an endless cycle of submitting and re-submitting documents in hopes of getting approved again but no progress has been made. We have major concerns regarding the origination, recording, title and legal description of our property. We bought the home with 100 % one loan financing through XXXX in XXXX for an adjustable loan. As we have been going through the process of trying to get modified we have learned some disturbing news. We had found a lender to pay off SPS but they told us that there was a cloud on our title, and that a second mortgage had been originated as well for {$52000.00}, closing on the same day as our first mortgage XX/XX/XXXX. We did not know about the second mortgage, we never received a bill or a statement, no payments were ever made, so this was some type of secret arrangement that we were not a party to by XXXX and now guilty by association SPS. We have requested that they provide all original loan documents and explain how this happened, and how this unknown second loan appears on our title. After purchasing the home our family was hit hard by the recession in XXXX and soon our nest egg was gone and my husband and I both lost our jobs in XXXX. At that time we began missing the mortgage payments and tried to get SPS to put us into some type of unemployment forbearance program or any type of HAMP modification, but we were denied on multiple occasions. We would submit paperwork over and over again, we wanted to resume making payments, we wanted to save our home but their staff would continually push us off. My husband finally found a new job and we tried to resume making mortgage payments but SPS told us we could not make payments, we had to cure the entire late payment amount, and would have to go through the modification process, until we finally got approved in XX/XX/XXXX, only to have the offer pulled a month later which we believe was illegal for SPS to offer us a deal that we complied with, then rescind it. We continued trying to apply for modification help and then the pandemic hit and negatively impacted our family. We asked SPS for help and they failed to offer any type of forbearance as directed by the government or provide access to the CARES Act. Instead they pushed the case forward into foreclosure. My husband has a good job as a XXXX XXXX and his finances and our financial circumstances have changed. We have sufficient income to make a fair and reasonable mortgage payment to Select Portfolio Servicing if they were to conduct a full and thorough review of the actual current financial information. Instead, SPS has been trying to push us into foreclosure or short sale. We had given up on SPS and sought out third party financing to pay off our mortgage and had a loan approved and it looked like we could pay this off and get SPS out of our life -- -then Covid hit and the lender pulled all financing and the deal fell through. We don't want to lose our home and need help.

Consumer Complaint: Select Portfolio Servicing Inc. is the worst mortgage servicer I have ever dealt with by far. Not even close. They do what they want and when they want. Never in 29 years have I dealt with a company that is so incompetent and un-ethical in any industry. Report these XXXX immediately to government agencies so hopefully they are put out of business or fined into oblivion. Keep in mind they will do what they can to foreclose on your house. They have canceled my payments twice in 2022. Not my choice but theirs.
