Consumer Complaint: Select Portfolio consistently insist that my home was foreclosed and reinstated. The fact is that no foreclosure action occurred on my home. Select Portfolio Servicing has provided a Corporate Advance History in which they claim was provided by XXXX XXXX XXXX submitted a reply to the CFPB and attached untrue and fabricated documents unprofessionally written. This counterfeit document depicts account activity from XX/XX/XXXX through XX/XX/XXXX, ( see attached ). This fraudulent document lists Property Inspection Fees, Attorney Fees, FC Fees, and FC Title Search fee and total {$2900.00}. This is not on XXXX XXXX XXXX official letter-head paper which reflects deceitful practices by Select Portfolio Servicing. These fees were enforced on a foreclosure that never existed and was ordered dismissed in the XXXX XXXX XXXX XXXX XXXX, XXXX XXXX Department XXXX XXXX. Select Portfolio Service refuses to acknowledge a court Dismissal Order No. XXXX in which the Plaintiff, XXXX XXXX filed a Motion to Dismiss without prejudice, and without further cost, and clearly says that Judgement of Foreclosure and Sale was not previously entered. However, I have a copy of the true and accurate Account History for my loan with XXXX XXXX which accurately shows that the {$2900.00} was paid by the servicer ( XXXX XXXX ) on XX/XX/XXXX, prior to transfer and that the history also shows that not only was that amount paid in full but was also listed as UNRECOVERABLE or as a Restricted Corporate Advance Adjustment ( See Attached ) For SPS record, a non-recoverable or Restricted Corporate Advance Adjustment as listed on the true and original copy of my loan history, means that : Any advance which the Servicer has determined in its good faith business judgement will not be ultimately recoverable by the servicer from late payments, insurance proceeds, liquidation proceeds, condemnation proceeds and any other collections Also, Corporate Advance History submitted by SPS on behalf of XXXX XXXX XXXX XXXX reflects history ONLY from XX/XX/XXXX through XX/XX/XXXX. The loan transferred six months later and its history indicates that the corporate Advance Adjustment was paid on XX/XX/XXXX. This information is not on the so called Corporate Advance History provided by SPS on behalf of XXXX XXXX XXXX XXXX which would show that the {$2900.00} was paid in full. XXXX XXXX faxed the account history to me on XX/XX/XXXX prior to seeking resolve from Select Portfolio Services. This document bears XXXX XXXX XXXX XXXX letterhead and list date and time the fax was sent and is true and accurate since they serviced the loan. The history that SPS has provided is untrue and should be investigated by the Illinois Attorney Generals office for fraudulently submitting false documentation. Select Portfolio Services also contends in their response that : know that additional legal fees and costs can be assessed after reinstatement, as many of these items were not billed to your account until after all services rendered related to your foreclosure were completed. Under the terms of the enclosed Mortgage, you are responsible to reimburse your servicer for these legal fees and costs to the extent allowed by applicable law. The above statement may be true for a loan that has gone into foreclosure or a reinstatement. Neither foreclosure nor reinstatement occurred with my loan, which makes these fees fraudulent. Again, there was no foreclosure or reinstatement as indicated on the DISMISSAL ORDER. Unfortunately, this has caused undue stress and hardships for me and my family. I have made attempts to refinance the loan with a better service provider, and the lender was told that the fees were foreclosure charges. Once again, I am asking that these forged fees be removed from my account since they were paid in full, unrecoverable, and listed as a Restricted Corporate Advance Adjustment. The next step, if this is not resolved will be the Consumer Fraud Bureau and a civil law suit because no foreclosure or reinstatement occurred and no fees of {$2900.00} ever transferred to Select Portfolio Servicing, and that the only fees that transferred totaled {$470.00}. Select Portfolios consumer advocate is delivering untrue and erroneous statements to not only a consumer but to the Consumer Financial Protection Bureau as well, and has blatantly ignored a court order. I hope that when future documents are submitted that information be true, accurate and not invented to protect its employer, Select Portfolio Servicing. I hope that the actual and true documents provided by XXXX XXXX XXXX XXXX, Dismissal Order No. XXXX, and a true account history from XXXX XXXX XXXX, will clear up this confusion ; and that my loan be restored and fees removed retroactively from the loan so that I can refinance with a trust-worthy lender and move on. Consumer Complaint: I was contacted by my homeowner 's insurance company about a letter they received from my debt collector/mortgage processer SPS Servicing XXXX In the letter, SPS Servicing, a debt collector, stated that they ( SPS Servicing ) have initiated a foreclosure action on our property due to a default under the terms of the security agreement. Legal action was initiated on XX/XX/XXXX. That means my home has been in foreclosure for 10 years. How is that even possible? Because there is a statute of limitations of 6 years for mortgage debt. First, there is no record within the Connecticut XXXXXXXX XXXX indicating any foreclosure proceedings whatsoever on our property. Their statement to my insurance company is patently false. Second, the collection agency sent us a letter dated XX/XX/XXXX, saying our mortgage was referred for legal action. ( NOT FORECLOSURE ) yet they told our Insurance company we were in foreclosure. They said we have alternatives to Foreclosure. We have communicated tirelessly with this company to no avail. They either disregard our requests for validation and/or refuse to discuss options that are viable to our financial situation. Furthermore, we have written to the mortgage/debt collector for validation of the debt and the name of the holder of our actual deed, and they responded with a trust company. We submitted a letter of debt validation to the trust company on XX/XX/XXXX. They did not respond. As of XX/XX/XXXX, we were contacted by another debt collection agency for the mortgage. We have since requested a validation of debt with them as well.

However, before missing the mortgage payment I had contacted SPS ( the loan servicer ) on XX/XX/XXXX, at XXXX, and advised them, that I would not be able to make this months payment since, my work hours were drastically reduced, and overtime income was nearly eliminated, in XX/XX/XXXX, at the onset of the Covid pandemic. Before the pandemic, I had received consistent overtime for several years. But my income was nearly split in half. The representative said, the plan was approved and that she would send me a confirmation letter. I received the confirmation/Forbearance Plan letter on XX/XX/XXXX. Once my hours increased ( back to normal ), in XX/XX/XXXX, I resumed making the full mortgage payment. I have not been more than 30 days late on my mortgage payment since then. I am asking for SPS to please defer my mortgage payment and finalize any loan modification or deferral plan. I am diligently working to provide SPS with the financial documents, BUT every single time, they're saying they did NOT receive the documents I provided. They say there is an assigned relationship manager, but I never get to speak to him. it is always someone different, and they also give me different responses. I am frustrated and scared that this situation will not be resolved. Please help me save my home.

XX/XX/XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX ( Property Owner/Land Lord/ XXXX XXXX signed a lease agreement with XXXX XXXX ( XXXX XXXX XXXX XXXX for less than 1 acre of land located at XXXX XXXX XXXX, XXXX, GA XXXX, XXXX XXXX XXXX XXXX XXXX signed their copy on XX/XX/XXXX. This agreement is for a lease, not a purchase, of less than 1 acre of land contained in a plot of 19.75 acres. The option is one year from signing and can be extended one more year, although XXXX XXXX has not extended as of XX/XX/XXXX. [ XXXX ] XXXX XXXX requires the current mortgage company or mortgage servicing company to sign Mortgage Subordination Agreement with the understanding if mortgagor defaults then the lease agreement will stand with lien holder ( Note Holder ). Phone Contact was made with Select Portfolio Servicing, Inc ( Hereafter refered to as SPS ) requesting the exact department and mailing address to send Mortgage Subordination Agreement. ( See Phone Log XX/XX/XXXX ). The Mortgage Subordination Agreement was sent to SPS on XX/XX/XXXX. [ 2 ] SPS acknowledge receipt of XX/XX/XXXX correspondence with their letter dated XX/XX/XXXX. [ 3 ] Mortgagors made several calls to SPS requesting the status of their completion of the Mortgage Subordination Agreement. SPSs reply was general in stating, it is under review, awaiting management review, or with underwriters ( Phone Log XX/XX/XXXX XXXX XX/XX/XXXX ) XX/XX/XXXX, after no contact or progress with the Mortgage Subordination Agreement, mortgagors sent a second letter of explanation requesting status. [ 4 ] SPS returned to the Mortgagor a General Acknowledgement Letter dated XX/XX/XXXX. [ 5 ] Mortgagors called SPS twice on XX/XX/XXXX. ( Phone Log ) SPS emailed mortgagors on XX/XX/XXXX requesting : [ 6 ] 1 ) Updated fully prepared consent of Mortgage Subordination Agreement. Which states Select Portfolio Servicing, Inc as attorney in fact for XXXX XXXX XXXX XXXX XXXX, as Trustee for the benefit of the XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX 2 ) An Appraisal with Impact Study stating how value of property will be affected. XXXX XXXX, mortgagors contact person for XXXX XXXX, emailed the requested Mortgage Subordination Agreement showing the exact wording on XX/XX/XXXX and again on XX/XX/XXXX as requested an editable version. XX/XX/XXXX the aforementioned mortgage was sold to XXXX XXXX XXXX XXXX XXXX, as Trustee for the benefit of the XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX2. [ 7 ] Mortgagors still have not received letter stating mortgage was sold. Mortgagors retrieved sell information from XXXX XXXX Clerks Office. The requested information, Appraisal/Impact Study, SPS required from mortgagors on XX/XX/XXXX was sent via regular mail on XX/XX/XXXX. Several calls from mortgagor to SPS were placed to check status of Mortgage Subordination Agreement and receipt of Appraisal/Impact Study. ( Call Log XX/XX/XXXX, XX/XX/XXXX. ) SPS General Acknowledgement Letter dated XX/XX/XXXX was issued. [ 8 ] SPS stated to mortgagors that they never received the Appraisal/Impact Study from XX/XX/XXXX. Mortgagors again sent the Appraisal/Impact Study with delivery confirmation, showing delivery on XX/XX/XXXX at XXXXXXXX XXXX. Mortgagors called SPS inquiring about receipt of Appraisal/Impact Study several times in XXXX. ( Call Log XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX. ) SPS insisted the Appraisal/Impact Study had not been delivered, which mortgagor informed SPS it was tracked through USPS and they, ( USPS ) , showed the document had arrived. [ 9 ] SPS moments later stated they found it. As seen above, the Mortgagor has made more than reasonable attempts to have SPS complete the Mortgage Subordination Agreement and return to the Mortgagor or XXXX XXXX. To date this has not occurred in what any prudent person would believe was a reasonable time frame. It is the belief of the Mortgagor that SPS and or the Underwriters, they mention but fail to identify, have engaged in procrastination and evasive practices that have disallowed the Mortgagor the full use and freedom of the property deeded to them and Identified as XXXX XXXX XXXX. XXXX, XXXX This unreasonable delay has cost mortgagors approximately {$10000.00} in rental income to date and SPS continued procrastination might possibly cause the lease to terminate. If the lease terminates the lost rental income for mortgagors and their heirs is just shy of {>= $1,000,000}. In XX/XX/XXXX, a new Strategic Plan was unveiled by the Federal Finance Housing Agency ( Hereafter referred to as FHFA ), for the conservatorships of XXXX XXXX XXXX XXXX XXXX. The Plan provides a structure for how FHFA will usher XXXX XXXX and XXXX XXXX to realize their statutory missions, center on safety and stability and prepare for a successful conclusion to the conservatorships. The three listed objectives of this XX/XX/XXXX new Strategic Plan state, XXXX XXXX and XXXX XXXX : Focus on their core mission responsibilities to foster competitive, liquid, efficient and resilient national housing finance markets that support sustainable homeownership and affordable rental housing ; Operate in a safe and sound manner appropriate for entities in conservatorship ; and Prepare for their eventual exits from the conservatorships. I sent them numerous correspondence showing payments but they are insisting that I did not make XXXX payment. I contacted the previous mortgage comany and was told that the loan was sold and I am only responsible for making XXXX payment as my first payment. Consumer Complaint: Select Portfolio Servicing this company charges you XXXXXXXX XXXX to pay your mortgage every month, i am unable to get on the website even to pay my mortgage and the company will not help. They hold your mortgage statements til the end of the month so that your mortgage will be late if you send it in, and even then they will hold your mortgage payment until the due date has passed so that the payment is made late. This is NOT random, it happens every single month. This company has got to be breaking the law, and i am at my wits end, all i want to do is pay my mortgage in a timely manner, and they truly make it impossible on purpose. PLEASE HELP!!!!!!

TO COMPLY WITH WHAT THE COMPLAINTS STATES AND NOT DEVIATE AND USE EXTRA TIME FOR LACK OF ANY MANNER AS THE LETTERS ARE NOT PROOF OF ANY CERTIFICATE OF EITHER FORCED PLACE POLICIES AND HOMEOWNERS INSURANCE FROM XXXX THRU XXXX BUT ONLY A COMPILATION OF LETTER AND NOT A RESPONSE TO INCLUDE THE COMPILATION OF ALL THE FORCED PLACED POLICIES AND CERTIFICATES AS WELL AS THE POLICY HOMEOWNER SIGNED CARRIER DOCUMENTS FROM XXXX THRU XX/XX/XXXX AND WITH ALL THE CARRIERS WE KNOW WE HAD FULL COVERAGE WITH BUT THE INSURANCE DEPARTMENT ADDED ADDITIONAL COVERAGE UNKNOWN AND NOT NOTIFIED WITHIN ANY DOCUMENT THAT YOU HAVE PROVIDED THUS THE REST OF THE LETTERS AS THE CARRIER OF XXXX AS TO THE RESPONSE TO THE DETERMINATION OF THE VACANT PROPERTY AS TO WHAT THEY DID AT THE TIMES AND ALL THE TIMES THAT YOUR SPS DECIDED TO ADD THE FORCED PLACED INSURANCE BASED ON FALSE AND WITH KNOWLEDGE THE HOME WAS FULLY FURNISHED AND NOT VACANT AND THUS THE FRAUD THAT YOU WILL NOW AGAIN BE WITHIN A MANNER OF WITNESS, AS TO THE CONTINUATION OF THE LACK OF DOCUMENTS THAT YOUR DEPARTMENT STILL DID NOT PROVIDE AS TO THE PHOTOS AND THE SIGN IN SHEETS AS TO THE POLICIES AND HAZARD INSURANCE THUS THE WRONG DEPARTMENT AS THE PROPER DEPARTMENT TO RESPOND TO YOUR INQUIRIES WOULD BE THE INSURANCE DEPARTMENT FOR ALL THE INFORMATION AS TO ALL THE POLICIES WITHIN THE RECORDS AND AT THE START AND END OF EACH AND WITH EACH CARRIER AS TO THE HOMEOWNER POLICIES AS WELL AS THE FORCED PLACED CERTIFICATES S THE RECORD MUST BE INCLUDED AND FROM THE POLICIES/ CARRIERS AND ALL AS TO YOUR INSURANCE DEPARTMENT OF SPS ALL THE CERTIFICATES AND ALL THE POLICIES WITHIN THE XXXX AND THROUGH XX/XX/XXXX SO SEND TO THE APPROPRIATE INSURANCE DEPARTMENT FOR ALL REQUESTED INFORMATION AS WE ARE AGAIN ASKING TO PRODUCE AND ALSO THE LETTERS AND RESPONSE FROM THE CARRIERS THAT WERE ADVISED AND FALSELY THAT THE PROPERTY WAS VACANT AND THEN NOT VACANT AND THEN FORCE PLACE INSURANCE ANDN ASK FOR NO CANCELLATION OF THE CURRENT POLICY OF THE HOMEOWNER WHICH IS A MANNER OF FRAUD WITHIN THE INSURANCE DEPARTMENT AND THE CARRIERS AS WELL AS TO THEIR DETERMINATION OF THE VACANT PROPERTY WHICH WAS NEVER VACANT AND THUS THE MANNER OF THE ENTERING IN THE PROPERTY KNOWING THAT IT WAS NOT VACANT AND THE DESTRUCTION OF THE PROPERTY AND ALL WITHIN INCLUDING TWO VEHICLES AND OUR PROPERTY MAKING IT UNLIVABLE AS TO THE LAST FORCED PLACED INSURANCE POLICY WHILE THERE WAS FULL COVERAGE ON THE HOME AS IT WAS NOT VACANT. THUS THE MANNER OF YOUR RESPONSE IS ALSO FALSE AS TO THE LETTER AS THERE WAS NO PROPER RESPONSE TO THE COMPLAINT BUT A COMPILATION OF LETTER WHICH DID NOT PROVIDE THE POLICIES NOR THE CERTIFICATES AS TO THE CARRIERS AND ALL THAT WAS WITHIN THE HOMEOWNER AT THE TIMES YOU PLACED THE HAZARD INSURANCE WHICH INCREASED THE ESCROW AND THUS CAUSE EITHER CANCELLATION OF THE POLICIES OF THE HOMEOWNER OR OTHER MAJOR ISSUES FOR LACK OF PAYMENT AS OF THE CLAIM FILED WITHIN THE LAST YEAR AND THUS THE FRAUD OF YOUR DEPARTMENT FOR THE LACK OF THE SIGN IN SHEETS FOR THE ENTERING OF THE HOME AND THE PROPER RESPONSE TO THIS COMPLAINT AND THUS WE ARE SEEKING YOUR LEGAL DEPARTMENT AND YOU AS WITNESSES TO THE DOCUMENTS THAT YOU HAVE ALSO FILED WITHIN THE CFPB AS TO THE LACK OF PROOF OF ALL THAT HAVE BEEN REQUESTED AND AS OF THIS DATE THE 15 DAYS IS TO BE HONORED AS THE DELAY FOR THE COMPILATION OF LETTERS IS UNACCEPTABLE TO US.
