Consumer Complaint: Select Portfolio Services is charging excessive fees for a foreclosure that was dismissed XXXX year prior to my lloan being transfered from XXXX XXXX XXXX, who was sued by CFPB. My loan was transfered to SPS instead of being properly serviced. Select Portfolio Services has also misapplied payments made to my loan and has taken over {$150.00} interest monthly from the mortgage payment as attorney fees instead of servicing the loan with the payment. Select Portfolio has co-mingled my mortgage loan payment with these bogus fees... According to XXXX XXXX the fees only totaled {$470.00}. Why is my mortgage payment being used to pay off fees that acure {$150.00} interest monthly. This means that neither the mortgage nor the " attorney fees '' will ever be paid off. These fees should not be comingled with my mortgage and should be billed and collectedseparately. When I asked to pay off the fees they took the payment and instead reapplied it to montlhly payments and took feee from the payment instead of applying to these bogus fees. SPS obviously is unfair in its practicies and i HOPE AND PRAY that government will intervene in ensuring that SPS is fair in its trade practices.

Consumer Complaint: This Complaint is about Select Portfolio Servicing who is a mortgage servicing company and not the mortgage holder. I became completely unemployed due to COVID. I filed and collect Social Security as my only income as I am XXXX years old. I first defaulted in XX/XX/XXXX. I have tried and resolve this issue since by trying a short sale and currently am under review for a surrender deed in lieu when I received notice that my account was referred to an attorney for foreclosure. I have not received any further information about the foreclosure since. The final attempt for a short sale was denied due to a business decision even though offer matched the sale amount that was previously approved by mortgage holder via SPS Servicing. I am not aloud to speak to any representatives from mortgage holder so my case is in limbo as no one is managing my particular account. I have filled out countless applications and reapplications for short sale, deed in lieu and other financial assistance programs with no final solution offer. In addition, there was an insurance claim due to flood damage in XX/XX/XXXX. That claim is closed and SPS Servicing is holding on to the over {$27000.00} in settlement funds while the escrow charges including interest, real estate taxes, property insurance and utility costs continue to mount.

Consumer Complaint: I have not owned the property that this mortgage was attached to in XXXX of 2019. The property with the mortgage in question was sold at a judicial tax sale. The tax sale was held and administered by the XXXX XXXX XXXX XXXX XXXX. Once the property sold at the tax sale, the lienholder continued to pursue me for the debt. I have spoken with them countless times on this matter. I have made no progress. They have continued to report negatively to the major credit bureaus. I do not know what else to do. The Mortgage company is SPS Loan Servicing.

Consumer Complaint: good afternoon. first i would like by starting to advise that I have been trying to get assistance and answers since XXXX my sister bought a home in XXXX XXXXl fl, where i am on title as well as 1/2 owner, but i was never added to the mortgage. my sister is a bit iliarate when it comes to the regular everyday english language, so nevermind the mortgage lingo. we have a XXXX loan mortgage. i paid the large and she paid the small one. when i asked my sister for a copy of the mortgage as i was trying to figure out what so call program qualified her for the mortgages alone, i started going through the documents with a fine tooth comb. i noticed that the XXXX has by sister earning $ XXXX as a monthly salary. I have been asking the mortgage broker back then how they came up with that information, but they would not speak to me. it does not seem possible since my sister had just started a job as a XXXX XXXX XXXX 6 months prior and even though she had been a XXXX for a few years in other companies, as far as i know, she has never made more than {$400.00} a wk. when i started running out of money as her tenant at the house paying the higher mortgage, i did a 3 way call with my sister to speak to the bank because again, no one would speak to me, we were looking for assistance to do either a forbearance or deferment or even a modification. XXXX XXXX, XXXX and XXXX XXXX XXXX all said we did not qualify because we were still paying the smaller mortgage. When my sisters hours got cut and she could not pay the smaller mortgage any longer, we were after the bank for a modification for years, and all they did was keep asking for updated documents. We asked for a shortpay, at one point it was papersverbally, but we never received anything on paper to follow through, then it was dropped. I again started asking about the supporting documents to proof where they got that income for my sister. I have been told, those documents can not be provided, then i was told, they were lost, and now, just no response. I have had to try to stop foreclosures on our home a various times. no one ever said to me, that because my sister put me in title in case anything ever happened to her, that i could refinance, or shortpay it, or do anything. all they did was tell me, my sister had to do bankruptcy as i had to as well. now, not only did they ruin my sisters credit, but mine as well when all this time, all we asked for was help to make a reasonable payment. the bank sent over a bpo agent, and he advise the house is worth nothing because of all the work that needs to be done, but he advised, the bank is only going to go by the outside pictures. they gave me a ridiculous payment plan that is just not feasible. I asked if instead of the 12 month plan, i could have a 24 month plan and not even speaking with the investor, the agent from sps said, no it can not be done. till this day, i am still asking how they got the income for my sister as $ XXXX a month. on top of that, they put that my sister has property in NY. that property, is my mom and dads house only. i even advised of this from the beginning when i called the mortgage broker for an update on what else my sister needed. please help, we do not want to loose our little broken home in florida and we do not want for these mortgage company to keep ruining our credit more than they have by telling us they could not help. even the attorneys in florida say they can not help as soon as they hear the house is going to go into foreclosure.

The master servicer who has the legal rights to the loan has reconveyed the home back to us. Select Portfolio Servicing has ignored the fact that the loan was legally reconveyed. They Hired XXXXXXXX XXXX XXXXXXXX says they represent XXXX XXXX XXXX XXXX Says the don't get involved in these things yet they have no problem letting XXXX us their name on the foreclosure. XXXX XXXX is involved in an Illegal foreclosure and they have buried their head 's in the Sand. They are aiding and abetting SPS and XXXX in the theft of our home. As part of the Settlement XXXX will not allow any fraudster or promoter to look into my credit without my permission. XXXX violated the Terms of the Settlement in 2021. ( 1 ) XXXX allowed the following fraudster to look into my credit without my permission. Consumer Complaint: I am XXXX yrs old and have paid Select Portfolio for a second mortgage since XXXX in the amount of $ XXXX with a maturity date of XXXX. Had them on auto payment and paid they XXXX and when I realized it and stopped payment, they are trying to foreclose on me saying I still owe $ XXXX. Plus I made two payments a month paying extra. My original complaint I was told by the manager the only way this would go away is if I submitted and identity theft report, I told him that is fraud and he said that was the easiest way out of this and they sent me procedures for doing it. Consumer Complaint: I made a payment of {$1700.00} on Select Portfolio Servicing 's customer dashboard on XX/XX/2022. XXXX deducted those funds from my checking account on XX/XX/2022. On XX/XX/2022 Select Portfolio Servicing says the payment was returned NSF, and they reversed the payment from my mortgage payment history. I contacted XXXX immediately, and they did NOT issue a NSF, I was not charged a NSF fee for a returned item, and I had over {$18000.00} in the account at that time, so no item would have been returned for NSF anyway. I contacted Select Portfolio Servicing on XX/XX/2022, and told them this was an error. They opened a " cashiering ticket '' to investigate the issue. At the same time, I opened a dispute and trace at XXXX. XXXX sent me proof, see attached, of the funds being sent to Select Portfolio Servicing. This document is irrefutable, un-mitigatable, down to the second the funds were received by the Select Portfolio Servicing proof. There is also the fact that the funds were withdrawn from my checking account on XX/XX/2022, and since XXXX XXXX dispute department traced the funds to the merchant, in this case Select Portfolio Servicing, they are not able to recover the funds to my account via provisional credit. This is XXXX Fraud liaison department 's findings, ( see attached also ) : Select Portfolio Servicing was sent {$1700.00} payment by XXXX on XX/XX/2022 at XXXX XXXX through distribution window XXXX distribution file XXXX distribution batch XXXX, XXXX number XXXX, receiving institution XXXX XXXX, trace number XXXX, and was received XXXX sec code XXXX by SELECT PORTFOLIO SERVICING company ID XXXX originating XXXX ID XXXX, XXXX amount {$1700.00} I have sent this proof from XXXX to Select Portfolio Servicing, and have also sent them about 100 other documents that prove that the {$1700.00} payment was not returned for NSF, and that the money is at Select Portfolio Servicing, somewhere, but they have closed the matter, saying that their records show that the money is not there. A rep named XXXX told me one time that the funds WERE there, on Friday, XX/XX/2022 at XXXX I spoke with him and he asked if he could call me back after he looked into the matter. He called me back at XXXX XXXX on Friday, XX/XX/2022, and told me he was " opening a missing payment dispute, and it would take a week or so to get it cleared up on our end. '' He also told me the " FUNDS ARE HERE '' and gave me ID reference # XXXX a missing payment/account dispute. He said he was escalating the issue. He instructed me to check the customer dashboard online on or about XX/XX/2022 and by then the missing payment issue would be corrected by the " cashiering department '' and the correct due date would be showing on my account dashboard. He told me to go ahead and " do my regular XXXX payment, it will be fine. '' It was not, of course, and I never heard from XXXX again. In the meantime, I went 1 day past the grace period on XXXX 's mortgage, and Select Portfolio Servicing sent me a notice of default dated XX/XX/2022. This default would not have occurred if they had correctly credited the {$1700.00} payment they have stolen. This default occurred ONLY because a month 's mortgage payment is NOT showing up because of their mistake. They suggested I pay an additional month 's mortgage to bring it current ( another almost {$2000.00}!, who has that EXTRA lying around?, effectively paying them twice for the same month, or do a repayment plan ( to pay what they are claiming is a missed payment, but IS NOT ) over 6 months, dividing the ALREADY PAID XX/XX/2022 payment into XXXX installments to be repaid as an addition to my regular monthly XXXX mortgage payment. To give me time to contact your organization and the Kentucky Attorney General 's office, I chose that option. This made my mortgage come out of default. They are, as of yesterday, still unable to locate the {$1700.00} that was sent to them on XX/XX/2022 from my XXXX account. I have spent countless hours on the phone with both Select Portfolio Servicing and XXXX trying to get this issue resolved. At Select Portfolio Servicing I am assigned a Relationship Manager, XXXX XXXX, XXXX XXXX XXXX ext XXXX, but since XX/XX/2022 I have not gotten to speak to him once. I have not spoken to him once in the last 3 years, and suspect he does not exist. I have never spoken to the same person at Select Portfolio Servicing twice, and am forced to explain the situation over and over again to each new person, am put on hold for 30 minutes at a time, am often hung up on, and, still, not one customer service rep has been able to do anything proactive for resolution of this issue. I have pages and pages of notes, each with times, dates, every person I have spoken with, how long I was on hold, and every page of correspondence from both Select Portfolio Servicing and XXXX. I am only attaching enough pages to provide a synopsis of the events, and a timeline. These pages include the bank investigation and proof that Select Portfolio Servicing was sent {$1700.00} on XX/XX/2022 and that the funds were deducted from my checking account. All I want is for Select Portfolio Servicing to credit my account with the payment that was made. They blatantly refuse to do this. As you can see from the attached documents, they have the {$1700.00} sent on XX/XX/2022, but refuse to credit my account with the payment that was made. It is my hypothesis that the customer service reps at Select Portfolio Servicing are obtuse on purpose, perhaps even trained to be this way as a method of dissuading the distraught consumers calling in for help from doing anything other than capitulating, and either making a duplicate payment or going into default. I have spent untold hours conversing with Select Portfolio Servicing customer service reps, and I am convinced the company 's aim to amass a collection of defaulted upon properties. I think they are stealing from many people in this exact way they are attempting to steal from me, but most people give up, or don't have the resources or skill set or time to advocate for themselves in matters like this. I am not most people. If my tenacity resolves this issue for me, that will be wonderful. If I can prevent it from happening to someone else, or help someone currently being mistreated in this same way by Select Portfolio Servicing, but unable to advocate for themselves, then that is even better.

Consumer Complaint: XXXX XXXX had a substantial loss of income due to XXXX and his current monthly expenses increased, exponentially. As a result of this, he fell behind on his mortgage and it became a snowball effect that he could not manage nor control. He has since then re-assessed and corrected his financial situation and wants to save his home that he resides in, desperately. He is hoping that with the assistance of this formal complaint, that he can have an assistance file reviewed by someone in the Office of the President, or at least an Executive Response Team Member at SPS, to have his assistance request reviewed fairly and in a timely manner.
