Consumer Complaint: I have been dealing with Select Portfolio Servicing who are the so called servicer to a loan that they have yet to prove they own. I have been trying g to get a loan modification or any type of help to avoid my house being sold. They have constantly been violating my rights and are violating the dual tracking law. They are refusing to have me speak with someone who can look at my account and explain to me the questions l have. Their customer service is not helpful because will constantly tell you they cant help you. Their ombudsmans department died t get back to you. Time is running out for me and I dont seem to have any help. Please help

Consumer Complaint: This is related to my personal residence. I have owned/lived in my home XXXX years. My home is worth {$900000.00}. I have a first mortgage with XXXX XXXX XXXX outstanding of approximately {$300000.00}. I took out a second mortgage in XXXX with XXXX XXXX for {$150000.00}. I made every payment on time, electronically through my bank account. In XX/XX/XXXX, I made my payment to XXXX XXXX and it was returned. When I inquired as to " why '' they returned my payment, I was informed " your loan was a XXXX year balloon has matured and you should have made arrangements to refinance. '' I asked " why did you not notify or inform me that it was about to mature so I could refinance? '' and they had no response. They offered to consider a " modification '' of my mortgage. That began a XXXX day process where I sent them all income, credit info for them to " consider '' a modification. XXXX XXXX would not allow me to make a payment during this review period. I have all records and correspondence. I called them dozens of times for status and they kept putting me off. In XX/XX/XXXX they informed me that they were giving my mortgage over to Select Portfolio Services. Select Portfolio Services allowed me to start making payments in XX/XX/XXXX. I made the payments on time every month. In XX/XX/XXXX, they notified me that I could no longer make a payment. They told me that my loan had matured and that I needed to pay off my {$98000.00} balance. I explained that I did not have the ability to pay {$98000.00} but that I could make my normal monthly payment, which reflected on their portal as " due '' in the amount of $ XXXX. On XX/XX/XXXX, they notified me that if I did not payoff my loan by XX/XX/XXXX that I was subject to foreclosure. They offered to consider a " modification '' ( exactly like XXXX XXXX offered ) and so I sent them ALL W-2 's, tax returns, etc. to consider. I have called them dozens of times and have all correspondence. They have not given me an answer ( to date ) on the consideration of my modification. Fearing foreclosure, I began seeking a traditional refinance on my mortgage. I spoke with several mortgage companies. My home has a Loan to Value greater than 50 % ( $ XXXX value vs $ XXXX mortgages ). I have W-2 income of {$280000.00}. Every mortgage company said " you should have no problem refinancing '' ... but when they pulled my credit report ( unbeknownst to me ) XXXX XXXX had reported me XXXX days past due! This all transpired as they were " considering '' my modification and would NOT ALLOW me to make a payment on the loan during that " consideration ''. None of the mortgage companies could consider a refinance with a XXXX day past due. They told me " you have to wait until 1 year after the XXXX day notice ( XX/XX/XXXX ) before we can consider your request. Now SPS is doing the exact same thing. I have provided them ALL information to consider a modification. I explained to them that there is no way I can get a traditional refinance because of what XXXX XXXX did in reporting me delinquent. I told them to " please allow me to make the normal monthly payment '' on the loan while they considered the modification, because I don't want any further past due notices ''. I have never paid a mortgage late, I make all of my payments on time. SPS will not allow me to make a payment on the loan. Today, I received a notice from XXXX that SPS has reported me past due on my mortgage. How can mortgage companies do this? How can they hold me hostage, not allow me to make a payment that I am perfectly capable of making, a payment that shows due & payable on their portal, but they will not allow me to make the payment? I sent them numerous correspondences in XXXX explaining exactly that ... that " you won't let me make my payment, and you are going to report me past due '', and they said " yes, that is correct ''. I just do not understand how a mortgage company can do that. I have had more than ample income and credit to make my mortgage payments with both companies. I never dreamed this kind of nightmare scenario could occur. I took a XXXX year balloon loan in XXXX and made every payment on time. XXXX XXXX never emailed, sent me a statement, called me... nothing, to tell me that my balloon was approaching and to make arrangements. I remember getting a paper statement every month in the mail... nothing. Then to make " no decision '' on my modification for XXXX days and not allow me to make payments ... and then report me as a XXXX day past due. That is just not right! Now SPS is doing the exact same thing! I share this because something needs to be done NOT to allow mortgage companies to treat borrowers this way. If a borrower has the means, the capability and WANTS to make a payment to keep their account current, how can they deny them that opportunity? They can just report a borrower past due, wreck their credit, make the borrower " incapable '' of getting the exact financing they need to 'cure ' the situation. It's wrong.

Consumer Complaint: I lost my job that I had for XXXX years in during XXXX. Select Portfolio Servicing solicited me by phone offering a mortgage assistance program due to XXXX. I told them I had lost my job but I had XXXX questions : would this cause me to lose my home or cause foreclosure? No ma'am. Then I asked if my mortgage payment would go up? No ma'am, you will either get a loan modification or the past due payments will be put on the backend of the mortgage. I said putting it on the backend of the mortgage is fine with me. I did not receive either, I started making payments XXXX XXXX and I have made payments every month since that date. In XXXX they sent back a copy of my money order telling me that it had been shredded and the payment was not accepted. Then I started sending my personal checks and all of them have been shredded, XXXX, XXXX, XXXX. I just mailed my XXXX payment and I would expect it will be shredded as well. I do not have the money for an attorney. I am XXXX XXXX XXXX, I have not family, no children and no place to go if they take my home. They have lied to me and misrepresented whatever program they offered. I have requested a document showing my signature of acceptance for their fraudulent program. XXXX XXXX XXXX XXXX owns the mortgage I have sent them a letter as well. They do not respond. I am asking for help asap, I do not know what more I can do. I can not afford an attorney.

Consumer Complaint: Select Portfolio Servicing, Inc. is my lender. I knew I was behind on my mortgage and I have reached out to their loss mitigation department several times. Each time I called I get sent to a general voicemail and no one has returned my calls. I did receive XXXX call back on XX/XX/XXXX, @ XXXX from XXXX I returned the call, and I had to leave a voice mail, and no calls since. I was notified by my XXXX XXXX that the house was in foreclosure. I would to keep my home but at this time to not want to refinance. Seems like SPS would be interested in keeping people in their homes. XXXX Statement just arrived with an outstanding balance of {$19000.00}. I have also been working with XXXX. I received an email back in XXXX stating they were working with SPS and not sure what happened with that. My XXXX statement shows my account has been referred to an attorney for legal action. Also, back in XXXX & XXXX, SPS raised my house payment XXXX and some dollars to {$1900.00} and so dollars when they knew I have had problems paying the {$1200.00}. I would also like to know where the extra money went that I was paying.

Consumer Complaint: MORTGAGE LOAN SERVICER - SELECT PROFOLIO SERVICING ( SPS ) My loan was transferred to this company from another servicer between XX/XX/2022 - XX/XX/2022. I have major concerns on the fees this company charges to make payments online, via phone and on their website. This doesn't include the late fees that are access if a payment is not made by the XXXX - XXXX on the month. I have expressed my concerns with SPS and depending on the circumstance they have waived a few pay by phone fees. However, SPS charges all consumers for making payments via phone & online. SPS charges {$10.00} - {$15.00} dollars or so between methods of payments. I am inquiring if CFPB and regulatory agencies can explore miscellaneous fees to consumers? They are making millions in fees as consumers are struggling to make payment their payments by the second week of the month. I also need information on how all mortgage companies calculate late charges and where the money goes.

SPS disbursed taxes in the amount of {$2700.00} to XXXX XXXX XXXX XXXX XXXX XXXX XXXX Since I checked with the county assessor that you had not paid the property tax on a timely basis, to avoid penalties, I went ahead and paid {$2700.00} on XXXX. SPS was not truthful in their statement about payment on XXXX and their payment is being refunded to them as the second payment. How can I trust SPS if they continue to deceive me?

Consumer Complaint: I XXXX XXXX spoke with one of Select Portfolio Servicing employees at the end of XXXX of XXXX. She and I conversed about the plan the company had came up with for me. she offered me a modification of XXXX payments of XXXX beginning XX/XX/XXXX. I accepted the offer verbually and she also said they will send me something to sign in agreement. I have yet to receive that. I accepted because I need a place to continue to stay. Also in my mind I was saying why has the mortgage payment went up so much? I realize I am very much behind on my payments and I have been trying for years to get to this point so I can get back on track. The lady also said my interest rate was going up to XXXX percent. My normal interest rate was XXXX percent. I was really at a lost for words. I said to myself I did not ask to refinance I asked for a modification to get back on track and put all behind payments on the back end like Select Portfolio Servicing has done in the past. It seems like to me I am being discriminated against because I am behind on my mortgage payments and they are trying or is to make the payment very unaffordable for the 6 months. It also seem as though Select Portfolio Servicing want me to lose the home or move out. I am asking Select Portfolio Servicing can you please keep my mortgage at XXXX and please revise this payment plan so that I can afford it. There are repairs that are needed to the home that I will be seeking homeowners assistance programs for help in concerning these repairs or led me where I can get assistance .Select Porfolio Servicing can you please or will help me in this matter. Consumer Complaint: This is the second complaint against SPServicing, XXXX XXXX and XXXX XXXX XXXX. Loan # XXXX XXXX my duplex was flooded by XXXX XXXX. I received two checks from XXXX insurance and had to send them to SPServicing ; XXXX. SPServicing disbusted all with the exception of a little over {$9.00}, xxx.xx ; I funded the repairs from cash I had and got checks amounting to approx. {$49.00}, xxx a few weeks after I submitted the checks and SPServicing cashed them ; XXXX my homeowner insurance company sent me a check for {$18.00}, xxx again made out to me and to SPServicing on or about XXXX XXXX, 2022 ; I have not sent SPServicing the check yet because of points below : XXXX. No where in the mortgage notes does it state how SPServicing is obligated to release the funds. They seem to arbitrarily decide and to me it seems they are trying to make money out of the float and fees not disclosed on the mortgage note ; no where in their website do they disclose how funds are disbursed or the fees associated with their inspections. XXXX. I have been uploading all the information they require and have asked them on their website and by faxing to their insurance department all the documents their request ( adjuster estimate, and their required documents ) and my requests for clarification. They reject all the uploads ( adjuster estimate ) I made. XXXX. I have all of point 6 documented with PDF 's from their website and a fax to their office in XXXX XXXX XXXX. XXXX. SPServicing is making rules as they wish ; nothing is detailed in the mortgage note and/or on their website. They want consumers to send them the insurance checks so they can sit on them. XXXX. SPServicing should not be in the business to assess if my duplex can be lived in and 10. Please note, the XXXX on this loan is less than 15 % so I am unclear as to why they are so concerned about protecting their " investors. ''
