Consumer Complaint: Hi. I am writing today regarding a Hamp Mortgage Modification that has not gone very well at all. Before getting into the details I would like to thank the CFPB for the help received in the past. I had written to the White House regarding the actions of XXXX XXXX and Select Portfolio Servicing in XX/XX/XXXX. The White House contacted the CFPB, opened up a case in my name and the CFPB stopped Select Portfolio Servicing from wrongfully selling my home on the courthouse steps for which I am grateful beyond words. I also had to call for assistance again due to Select Portfolio Servicing again wrongfully trying to force me into foreclosure claiming to have not received signed documents on time. This was also proven to be false and the CFPB actually had to step in again and deliver the documents to Select Portfolio Servicing on my behalf. Those case numbers are XXXX and XXXX if they are needed for reference. The issue I am writing about today is part of that same modification and has been an ongoing problem that I really need to be resolved once and for all. Select Portfolio Servicing has been reporting a wrongfully delinquent and highly damaging history on my credit report to all 3 CRA 's. The fact of the matter is that I have never been late a single time and have made 60 ( 5 years ) of on time or early payments on this HAMP program loan. A testament to the success of the HAMP program in my case and I am thankful to have been given the opportunity that I was given. However, even though I have a perfect payment record and have been exemplary Select Portfolio Servicing has me down as being 120-180 days late on my credit reports from the time of XX/XX/XXXX to XX/XX/XXXX and will not remove the negative history. Unfortunately this also includes XXXX XXXX XXXX wrongful reporting for the month of XX/XX/XXXX as well. I had finally reached an agreement with XXXX for a HAMP Modification. I was to make 3 trial payments and that was supposed to be my new mortgage. This was not the case at all as I made 2 of the 3 payments and XXXX sold me to Select Portfolio Servicing where in which I was to make my 3rd and final trial payment. That did not happen. Select Portfolio Servicing did not give me any modification papers at all until XX/XX/XXXX and when they did they had removed all of the Principle Reductions, all incentives and even added a hefty and absurd sum to the Balance. This was when the White House contacted the CFPB for me and the 1st case # I had. I was not until My/XX/XX/XXXX that I finally got my real and actual mortgage package. After all of that I had been frozen and stuck in that trial period for 15 months! This was forced on me, done to me against my will and without my consent. These are actually the very same months that Select Portfolio was trying to take my home and the very same months that the CFPB had to step in on two separate occasions just to even get the correct modification package. I had a very in depth and lengthy conversation on every aspect of the modification prior to entering into it. I never agreed to being in any trial period for 15 months! If anybody had been truthful with me and told me that I was going to go through all of that for 15 more months and end up w 7 to 9 late pays on my credit report for 7 more years then I would have never agreed to it. That would definitely have been a deal breaker. This has been an absolute " bait and switch ''. XXXX XXXX explained in depth that I would go into the trial period for 3 months ( XX/XX/XXXX ), that my credit report would stay derogatory for those 3 months and then on the 4th month I would get my new formal modification package and that at point my credit report would be amended to reflect all payments as current from trial payment # 1 on. She even went on to sate that 24 months from them that my credit score would rebound and all kinds of wonderful things would happen. This was actually a huge part of why I made the decision to enter into the HAMP program. This is clearly not the case. In reality I spent 15 months fending off Select Portfolio Servicing from trying to steal my home while making all of my payments early only to have up to 9 late payments ( varies by CRA ) reflected on my credit report. This is another thing I never agreed to. I agreed to enter into the HAMP program and have a NEW mortgage, not get one with 9 late payments on the history right out of the gate. Again, this is something I never agreed to and something I would never agree to. This is simply unacceptable. This also defeats one of the very purposes of the HAMP program in regards to having a chance to have a new mortgage with a new payment history. I have tried to resolve the issue numerous times since it has happened with the company and the CRA 's with no success. I need the CFPB to step in again. The newest response from Select Portfolio Servicing from last week states that they will not be changing the reporting to the CRA 's. I am including it as well. They actually write in the response that because I was in the trial period that they themselves forced on me against my will for 15 months! This is the very same 15 month period that you, the CFPB had to take action against Select Portfolio Servicing twice during that time frame to even get me my mortgage package. Select Portfolio Servicing has been reporting accurately since the CFPB literally forced them to 1 ) give me my correct mortgage package and 2 ) force them to admit that they had my singed copies ( CFPB actually delivered my signed docs to SPS for me in the 15 month period! ). Long story short Select Portfolio Servicing actually caused the 15 month long issue themselves and have damaged my credit for those 15 months on top of all of other undue stress they caused. Unbelievable. Select Portfolio Servicing even states in their response that because I was in the " trial period '' for all of those months which they caused themselves is the reason why they refuse to report all 60 months as " paid as agreed '' as if a 15 moth trial period is completely normal. I would be so very appreciative if the CFPB could investigate the matter and have Select Portfolio Servicing report all 60 payments truthful as " paid as agreed ''. I never agreed to that in the first place and for Select Portfolio Servicing to use the very 15 month period against me that they spent trying to steal my home and the very same time frame that the CFPB had to step in twice against them is really quite brazen to say the least! I called the CFPB yesterday and had a pretty in depth conversation. I had read the HAMP program procedure and am familiar with it, but asked the CFPB yesterday if there was some kind of loop hole where in which Select Portfolio Serving could change a 3 month trial modification period to a 15 month trial period without any warning or me agreeing to it and his answer was " No, they can not do that ''. Please look at my payment records and see that I have lived up to my end of things 100 % and please have my credit report corrected to reflect that accordingly as I have never been late. I can not even convey how tired I am of being denied credit due to my supposed " 9 derogatory payments to Select Portfolio Servicing ''. Being asked over and over by a new potential creditors why I was late 9 times on my mortgage is mind blowing. I tell them that I wasn't, but it doesn't matter. I tell them that I'd like to know why it says that too! I get alerts on a weekly basis informing me that my derogatory payment history is affecting my score and I am constantly hounded and reminded of it. I am really just sick and tired of Select Portfolio Servicing entirely and it is honestly astounding that they are even allowed to do any business at all. I look forward to having this resolved as son as can be and thank everybody in advance for that and again for the help I have received in the past with Select Portfolio Servicing. I sincerely can not wait for the day when I never have to see their name again. I am also including the form that XXXX sent me stating that my mortgage was going to Select Portfolio Serving and that no terms of the agreement were being changed. I have sent various validation of debt the past few years and they have not provided the key proof of claim elements requested. Additionally, the validation requires SPS and XXXX and XXXX to provide evidence ( contract ) that they are working on behalf of XXXX XXXX XXXX. XXXX transfers the responsibility to XXXX XXXX XXXX and claims that its their issue but on the notice of sale issued by XXXX XXXX it states that they are working on behalf of the allege creditor ( XXXX XXXX XXXX ). After completing extensive research into the mortgage loan situation conducted by my legal research team, they have identified evidence of tax fraud, tax evasion, insurance fraud, securities fraud, insurance fraud, wrongful foreclosure, failure to disclose material facts, fraudulent assignments and a variety fraudulent assignments and a variety of other regulatory violations. SPS obtained the servicing rights from XXXX XXXX XXXX of bad debt that was predicated on massive fraud that originated from the XXXX XXXX XXXX situation. My loan was initiated in XX/XX/XXXX from XXXX and was part of the pool of home mortgages that were securitized into XXXX XXXX XXXX ( XXXX ). As a result, there was massive fraud and range of lending violations that negatively impacted the United States housing market that caused a collapse. Homeowners and the investors throughout the United States basically were damaged in the process and the Department of Justice ( DOJ ) sued XXXX XXXX XXXX for financial fraud on a variety of levels. In XXXX, XXXX XXXX XXXX ( XXXX ) sold bad debt and servicing rights to SPS with both parties knowing that the old XXXX debt that originated between XX/XX/XXXX was predicated on fraudulent transactions and lending violations. I repeatedly asked both XXXX XXXX XXXX and SPS to verify my alleged debt multiple times and they consistently provided conflicting information or lack of to this point. XXXX ended up settling the law suit for {$16.00} XXXX dollars with the DOJ and acknowledged their fraudulent conduct. There is massive fraud involved with my loan including chain of title issues, XXXX XXXX XXXX violations, fraudulent assignments and a range of other lending violations. SPS has never satisfied the proof of claim. I have enclosed a verified complaint ( short version without the evidence exhibits ) for all parties to review. If some type of solution or settlement is not provided upon receipt of this notice I will file the full complaint with all the collected evidence over the past ( 5 ) years in the US District Court. In summary, SPS is trying to illegally defraud my family out of our property as a third party debt collector that lacks standing and the ability to verify the debt. They were aware of XXXX and XXXX past conduct and the debt that they purchased in XX/XX/XXXX. I have attached with this dispute the debt verification request and default notices that I sent to SPS and XXXX XXXX. Additionally, I am prepared to begin litigating against all parties that are associated with this fraudulent matter unless the attempted debt collection is resolved. I disagreed with the addition payment of XXXX on XX/XX/XXXX in a recorded conversation with XXXX XXXX XXXX which she wavied. who worked at XXXX ( Modification unit ). I never agreed or signed any document to paid this Addition amount of {$16000.00} but I did disagreed. XXXX filed a Judgment of Foreclosure and sale against me and my husband it was ORDERED vacated on XX/XX/XXXX without cost to any party. so, I don't owe any court or attorney fees {$3200.00}. I have paid my owned XXXX XXXX and XXXX XXXX XXXX sent XXXX. Select Portfolio Serving Inc. or XXXX did not pay {$7700.00} in any XXXX Account for us. Consumer Complaint: I was approved for a loan modification which I was thrilled with and could easily afford, My husband was incarcerated which left me alone to pay my bills by myself. When I got the papers to sign that I accepted the modification they wanted it notarized, which I did. I sent them back and they said they weren't done right!!! I asked for another form to sign and they NEVER sent it to me., Finally I got someone on the phone who actually knew what they were talking about and faxed the papers to me.. I signed them and faxed right back within minutes and they refused it because I forgot to put the date on the paper!!!!! They have done nothing but cause me stress throughout this process. No one gives you the same answer and I have had nothing but a run around with them for over a YEAR!!! I have also been hung up on by the reps and refused to be transferred to a supervisor. Is this good customer service???? The ones that knew their job were very good and talked to me in a professional way. So bottom line is that because I didn't date the acceptance but did sign it, they are making me do this all over again, Nothing is straight forward with SPS and they set you up for failure. They have all my details from before and put me thru XXXX again ... ..just for a date????? I never asked for them to be my mortgage company..they were assigned to me thru XXXX who was very easy to deal with and I got the same person all the time who helped me tremendously when needed. SPS has very poor reviews and lots of them., Now I can see why.,

( SPS ), is that as the servicing Mortgage Company they have yet to provide me with Written Proof ( Copy of Title Deed, Sale or Property Transfer ), of the Property at XXXX XXXX XXXX, XXXX, GA XXXX ; SPS Account Number : XXXX. SPS disclosed the Name of a Bank to me in a letter dated XX/XX/XXXX, yet the XXXX XXXX County Tax Records, and the XXXX County Tax Assessors Office, records reflect as of today, XX/XX/XXXX, Parcel Number : XXXX XXXX XXXX, lists that property in my name with a " Fair Market Value '', of {$95000.00}. SPS has sent me more than thirty ( 30 ) letters since XX/XX/XXXX, first stating that they are/will be the Mortgage Servicing Company, and beginning XX/XX/XXXX, that I can/should began making Mortgage Payments to them instead of XXXX XXXX? I believe that the Law allows me to question a Creditor/Debt Collector, as to the Validity of any Debt? The home in question was transferred to XXXX XXXX on XX/XX/XXXX, by participating in an On-Site Appraisal, arranged by XXXX XXXX, and after Joint Photos/Pictures were taken, the Keys were taken by the XXXX XXXX Appraiser, and the Locks were changed, afterwards XXXX XXXX issued me an IRS Transfer/Abandonment XXXX Form, which has also been provided to SPS. SPS is fully aware that I am under Federal Bankruptcy Protection, and am not personally liable for the property, additionally, the Property Transfer back to XXXX XXXX is documented by the XXXX. SPS is outright attempting to intimidate me into making Mortgage Payments, which I believe to be in violation of the Law, therefore, I contacted the Bankruptcy Attorney that handled the bankruptcy and asked SPS to contact him, which they have not done. SPS 's latest attempt to punish me, came on yesterday, XX/XX/XXXX, when I was contacted by Text and Phone Call from XXXX XXXX XXXX in XXXX, GA. I contacted the Office of the Comptroller of the Currency, and received a letter from them dated, XX/XX/XXXX, and they told me to Submit a Complaint to CFPB, as you have jurisdiction for these matters, and to also contact the Georgia Department of Banking and Finance for assistance. I contacted the Georgia Department of Banking and Finance, and was told that the only way that they could/will assist is if my Complaint is referred from the CFPB to them. How could they offer a loan modification without documentation. Also I sent a demand letter asking to see the note. They told me to feel free to go to their office in XXXX XXXX XXXX Utah and see it there. They are legally required to allow me to see it locally. I have resubmitted the paperwork to do the loan modification. I called the mortgage servicer they told me its too late, too close to the auction date. They told me if I can have the auction date postponed by two or more months, then they can do a review. I called everyone and I was told that they can have the auction postponed.

Please treat this letter as a " qualified written request '' under the Real Estate Settlement Procedures Act, 12 U.S.C. Section 2605 ( e ). I am writing to you to complain about the accounting and servicing of my mortgage and my need for understanding and clarification of various charges, credits, debits, transactions, reversals, actions, payments, analyses and records related to the servicing of my loan from its origination to the present date. To date, the documents and information I have, that you have sent me, and the conversations with your service representatives can not answer my many questions. It is my understanding that your company has been accused as engaging in one or more predatory lending and servicing schemes. As a citizen, I am extremely concerned about such practices by anyone, let alone my own mortgage company or anyone who has held a beneficial interest in my QUALIFIED WRITTEN REQUEST COMPLAINT DISPUTE OF DEBT/ VALIDATION OF DEBT TILA REQUEST Page 2 of 8 loan. I am concerned that such abuses are targeting the uneducated and uninformed consumer and disadvantaged, poor, elderly and minorities. Needless to say, I am more concerned as an alleged borrower. I am worried that potential fraudulent and deceptive practices by unscrupulous mortgage brokers ; sales and transfers of mortgage servicing rights ; deceptive and fraudulent servicing practices to enhance balance sheets ; deceptive, abusive and fraudulent accounting tricks and practices may have negatively affected my credit rating, mortgage account and/or the debt or payments to which I am legally obligated. Because of this and other reasons that leave me to believe that I may be a victim of predatory lending, I am disputing the validity of the current debt you claim I owe. By debt I am referring to : 1. The principal balance claimed owed ; 2. My calculated monthly payment, 3. Calculated escrow payment 4. And any fees claimed to be owed by you or any trust or entity you may represent. I have reason to believe that the loan terms were misrepresented to me at the time of application and further obscured and/or modified prior to signing. I believe that my income may have been inflated on the application. I also have reason to believe that certain statements were not provided for my approval prior to closing, and that signatures may have been forged on various documents. It is also my belief that certain documents may have not been presented at all. Additionally, I believe that a notary was not physically present to witness my signatures on several pertinent documents and that I was ill advised at the time of closing. To independently validate my debt, I need to conduct a complete exam, audit, review and accounting of my mortgage loan from its inception through the present date. Upon receipt of this letter, please refrain from reporting ANY negative credit information [ if any ] to any credit-reporting agency until you respond to each of my requests. QUALIFIED WRITTEN REQUEST COMPLAINT DISPUTE OF DEBT/ VALIDATION OF DEBT TILA REQUEST Page 3 of 8 I also request that you kindly conduct your own investigation and audit of my account since its inception to validate the debt you currently claim I owe. I would like you to validate this debt so that it is accurate to the penny! Please do not rely on previous or current servicers or originators records, assurances or indemnity agreements and refuse to conduct a full audit and investigation of my account. I understand that potential abuses by you or a previous servicer could have deceptively, wrongfully, unlawfully and/or illegally : 1. Increased the amounts of my monthly payments 2. Increased the principal balance I owe ; 3. Increased my escrow payments ; 4. Increased the amounts applied and attributed toward interest on my account ; 5. Decreased the proper amounts applied and attributed toward principal on my account ; and/or 6. Assessed, charged and/or collected fees, expenses and misc. charges I am not legally obligated to pay under my mortgage, note and/or deed of trust. 7. I am thinking about contracting the Home Owners Foreclosure Hotline and/or one of their affiliates to perform a forensic document review of your investigation and audit of my account. To help me decide if I am going to move forward with a third party auditing company, I need : ( 1 ) copies of all documents pertaining to the origination of the alleged mortgage and note including my loan application ( s ), Right to cancel, deed of trust, note, adjustable rate note, addendum to the note for the interest only payment period, truth in lending statements, good faith estimate ( GFE ), HUD 1, appraisal, and all required disclosures and rate sheets QUALIFIED WRITTEN REQUEST COMPLAINT DISPUTE OF DEBT/ VALIDATION OF DEBT TILA REQUEST Page 4 of 8 associated with this transaction for the above referenced loan. The copies should be legible and all documents shall be copied in their entirety. ( 2 ) A copy of the loan history including all payments made, all fees incurred, what has been paid out of the escrow account, and how all payments were applied. This information should cover the ENTIRE life of the loan. I want to insure that I have not been the victim of such predatory practices. To insure this, I will be authorizing a thorough review, examination, accounting and audit of my mortgage LOAN # XXXX by a team of mortgage auditors predatory lending experts, consumer advocates, local non-profit agencies, compliance consultants and if needed LEGAL ADVOCATES. This exam and audit will review my mortgage loan file from the date of my initial contact, application and the origination of my loan to the present date written above. As such, please treat this letter as a Qualified Written Request under the Real Estate Settlement Procedures Act, codified as Title 12 2605 ( e ) ( 1 ) ( B ) ( e ) and Reg. X 3500.21 ( f ) 2 of the United States Code as well as a request under Truth In Lending Act [ TILA ] 15 U.S.C. 1601, et seq. RESPA provides substantial penalties and fines for non-compliance or failure to answer my questions provided in this letter within sixty ( 60 ) days of its receipt! In order to conduct the examination and audit of my loan, I need to have full and immediate disclosure including copies of all pertinent information regarding my loan. The documents requested and answers to my questions are needed by myself and my experts to insure that my loan : 1. That each servicer and/or sub-servicer of my mortgage has serviced my mortgage in accordance with the terms of my mortgage, promissory note and/or deed of trust ; 6. That each servicer and sub-servicer of my mortgage has serviced my mortgage in compliance with local, state and federal statutes, laws and regulations ; 7. That my mortgage loan has properly been credited, debited, adjusted, amortized and charged correctly ; 8. That interest and principal have been properly calculated and applied to my loan ; 9. That my principal balance has been properly calculated, amortized and accounted for ; 10. Consumer Complaint: I have submitted numerous Complaints on the Servicing Mortgage Company, and notified the Bank that they claim is the Owner, and asked the Servicing Mortgage Company ( Select Portfolio Servicing , Inc. ( SPS ) to contact my Attorney, as I am under Federal Bankruptcy Protection, thus far they ( SPS ) have not done so. Today, I received Phone Calls and Texts from a man that identified himself as XXXX XXXX XXXX ( XXXX ) XXXX-XXXX, of XXXX XXXX XXXX, informing me that he had an Order to do something to the Property at XXXX XXXX XXXX, XXXX, Georgia XXXX, he stated that the property had a Lock box on it? I Texted him the information for XXXX XXXX XXXX @ SPS ( XXXX ) XXXX-XXXX, XXXX. XXXX, and asked him to never, ever contact me again, as the Mortgage Company took possession of that property XX/XX/2017, and the keys were surrendered, and Locks changed, the property belongs to the mortgage company. This seems to be an on-going pattern of harrassment by ( SPS ), and this is not a mistake.
