Consumer Complaint: RE : Information Request Mortgage Loan Number : XXXX My loan is Serviced by Select Portfolio Servicing. I have been doing much research on the The XXXX XXXX held XXXX XXXX XXXXXXXX XXXX XXXX Mortgage Backed Notes that I am told my mortgage is entrusted to. I can not seem to find any information on this Trust past XXXX. I have spoken with XXXX XXXX, Vice President l Team Leader XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, and he was unable to answer my enquiry other than telling me I should talk with someone at XXXX XXXX, who he says in managing the Trust. I have had no success in tracking down any information through XXXX XXXX on this Trust through many attempts made. I have also made a request to Select Portfolio Servicing to supply me with the latest financial report for the The XXXX Bank held XXXX XXXX XXXX XXXX XXXX Mortgage Backed Notes and so far have been denied. So now I am dealing with 3 entities to find out information on my one Mortgage note that seems to be lost in oblivion. Two of these entities have been charged and found guilty as well as paying out settlements for various fraud involving mortgage trusts as well as banking fraud. That being XXXX XXXX and XXXX XXXX. This worries me. What also worries me is that Select Portfolio Servicing, who services my mortgage for XXXX XXXX, is also involved in many lawsuits as far as collection issues and fraud. Even the bank that owns Select Portfolio Servicing has just been recently hit with a 5.28 Billion Dollar settlement for its hand in mortgage securities fraud. This should worry everyone involved with these financial entities. So out of concern for my finances I simply ask Show me the end of XXXX financial report for the XXXX XXXX XXXX XXXX XXXX. To me right now all its just a name youre throwing out there. Show me something real about it, show me it exists as of XX/XX/XXXX. I have a pending payment plan with Select Portfolio Servicing. I have until XX/XX/XXXX to get all my information into them for approval of said Payment plan. I have been threatened with Foreclosure multiple times and am just looking for a piece of mind to know exactly where my money is going. Unfortunately, I am stuck dealing with Banks and Collection companies, whatever Select Portfolio is, who have been proven to be untrustworthy and have been found guilty of fraud in the past and present time so I need to protect myself and my family and my home. Consumer Complaint: Select Portfolio Servicing is foreclosing on my home. Over the years I have been unable to find the Noteholder/owner of my home. Over the past few years I have hired 2 attorney companys to try to get me a modification the last being bloom law group. SPS had stated that XXXX was my noteholder/owner of my note. I applied for a modification with the help of XXXX XXXX XXXX who I paid over {$6000.00} and SPS declined my modification application saying XXXX XXXX the investor had said no. So I went to XXXX XXXX executive office and was told they did not own the loan and was asked to leave. XXXX stated XXXX XXXX owned the loan.. I contacted them and they sent me 3 letters saying they did not own the loan. They said XXXX XXXX XXXX XXXX XXXX did. I have 3 emails from XXXX XXXX XXXX stating they do not own the loan. I requested repeatedly to SPS the current deed of trust assignment and have attached what they sent me which is fraudulent. XXXX paid {$10.00} for my {$300000.00} home. they did not send me the fraudlent XX/XX/XXXX filing. The deed of trust of XX/XX/XXXX was backdated and fraudulently signed with no assignor. This forclosure says it was a Jp chase, XXXX XXXX XXXX XXXX XXXX for XXXX XXXX asset backed securities trust XX/XX/XXXX asset backed certificates series XX/XX/XXXX. I have asked repeatedly both written and verbally for the paper trail to this loan and only received these 2 fraudlent papers. The loan originated with longbeach mortgage went to wells fargo to Washington mutual to bear sterns and sold to a trust. We have hired a forensic mortgage examiner and they have documented all the fraud. We went thru the mortgage modification process and were denied saying that XXXX has said NO. They don't own it. We are currently going thru another mortgage modification process with this foreclosure hanging over our head. We Just want to save our home, The loan was sold to a trust and none of the companies involved are currently in business. XXXX XXXX XXXX has filed false foreclosures on my home in the past and continues to try to foreclose with false documents also and no offer of mediation which Oregon requires. We just want a loan modification without all the fraudulent servicing fees.

Consumer Complaint: I was inquiring about a loan modification. I called the bank and was told that wasn't a option. I then started the short sale process but seem to get the run around with the company that was servicing the mortgage for XXXX XXXX. So the house went into foreclosure and the bank never served me court papers for said court date. I only was made aware of this process while doing a court search myself. I was going through the paperwork filed to the courts and realized that Select Portfolio Servicing ( SPS ) filed fraudulent paperwork to obtain this foreclosure in the first place. I filed a motion to ask the court to look at this matter but they couldn't do anything to help. I have attached a copy of the filing that I submitted and page 6 through 10 are the paperwork that Select Portfolio Servicing ( SPS ) submitted to obtain the foreclosure in the first place. If you look that the motion you can see where they cut and pasted parts of the contract to help them obtain the foreclosure. The contract on page 8 ends with paragraph 11 and then on page 9 it starts with paragraph 18. They cut out 12 through 17 in the contract.

Consumer Complaint: We have repeatedly asked for a history on our loan, and have yet to receive one. We noticed on recent statements that we are being charged interest on fees the service provider is charging that we have not been notified about. ( quarterly appraisal fees? ) We have also received correspondence in incorrect names with our mortgage loan number and address. We also have reason to believe our escrow account has not been properly managed as we are now due for two years of insurance in our latest statement.We can not get answers from the ombudsman email address or via phone. We have reason to believe they are in violation of several fair lending laws. Our home has been undervalued so we continue to pay PMI, on which the premiums keep increasing.

Consumer Complaint: Mortgage XXXX # XXXX. XXXX XXXX XXXX sold my existing mortgage to SPS Select Portfolio Servicing , Inc . I was notified by mail of this from SPS letter that I received on XXXX XXXX. I immediately mailed SPS their form to handle ACH monthly withdrawals from my checking account to pay the mortgage automatically. On Saturday evening XX/XX/XXXX, I received a confirmation by mail from SPS dated XX/XX/2018 that my recurring ACH will not begin until XX/XX/2018. I also received the monthly bill for XXXX on XX/XX/2018. That bill had a statement date of XX/XX/2018 indicating that the due date is by XX/XX/2018 and would be charged a late fee if received after XX/XX/2018. On Sunday XX/XX/XXXX, I attempted to call SPS to pay my XXXX payment due on XX/XX/XXXX by phone. They were closed on Saturday after XXXX pm EST and on Sunday. On Sunday XX/XX/2018, I went on line and made the mortgage payment so that it would be paid by the due date of XX/XX/XXXX. I was charged a {$15.00} on line fee. On Monday XX/XX/2018, I called SPS Customer Service Dept and asked if they would credit me the {$15.00} since it was no fault of my own. The refused to do so. I asked for a Supervisor. They still refused. The SPS Customer Service Rep said they could have waived the fee if I paid by phone but not for the online transaction. This is very unfair. I never missed a payment while XXXX XXXX XXXX was servicing this mortgage. I respectfully request that SPS should refund the {$15.00} on line fee to me because SPS sent billing notifications by mail several days before the due date which would not allow sufficient time for my check to get to them by mail in time for the payment due date which would cause me to pay late fees. On my recorded line to SPS on Monday XX/XX/2018, I notified SPS Select Portfolio Servicing , Inc. that I would complain to the CFPB if they did not refund my {$15.00} on line fee. Consumer Complaint: As to so many times previously, My name is XXXX XXXX XXXX and my husband XXXX XXXX. We had placed a total of 10 complaints related to Select Portfolio Servicing and their deceptive practices, but your department only send the complaint and wait for the complaint to be answer. But here we go again. I submitted a loan modification to SPS multiple times. The latest modification of mortgage that I received was in the amount of {$4500.00}, a larger amount than the one I received before, the interest rate at 7.475 % adjustable rate the same terms I had before with the same principal balance of {$530000.00}. This are the receptive practices from SPS. First I had been given five years off my debt due to Statutes of Limitations ( see final summary judgement interest rate from XX/XX/XXXX to XX/XX/XXXX that make us only 70 payments past due not 125 past due payments as they keep stating that is due. I contacted and submitted a complaint also to the Federal Trade Commission, Florida Office of the Financial Regulations for providing servicing in Florida without a license and third open a law suit related to the present charges and not giving us credit for the 5 years deduction. Consumer Complaint: I had a modification approved with XXXX ... I paid all XXXX payments ON TIME and SPS is stating that they sent me the mod package, but they sent it to the wrong address. XXXX in XXXX was researching the case and lied to the CFPB. He stated the loan mod package was sent to the address that XXXX BANK had in the file. After thorough investigation XXXX is now involved and their XXXX offices is stating the correct address was given to them, but that SPS manually entered my incorrect address into the their system and the address was wrong. They left off the XXXX XXXX which is critical. I never received the package for me to sign. SPS CLEARLY made the mistake. I spoke with SEVERAL folks in the call center. They have notated in the account that the incorrect address was used, but XXXX department continues to lie and blame the cause of the wrong address is because when XXXX sent the file over that is what they gave them. I am working directly with XXXX as they are trying to remedy this. Their internal liaison has been in touch with SPS to notify SPS of their mistake and asking them to remedy it. The file is very clear to XXXX and to, me, XXXX XXXX that SPS will not take up for their mistake. We are asking them why? Why lie and blame?

Consumer Complaint: This complaint is in regard to the frivolous response last presented by XXXX XXXX XXXX ( SPS ) on Complaint # XXXX. SPS in their response failed to mentioned that on XX/XX/XXXX on a conference call with XXXX officer XXXX XXXX. SPS admitted that the account in question was First delinquent on XX/XX/XXXX. The fact that I filed bankruptcy in XX/XX/XXXX can not have any impact on the original delinquency date of XX/XX/XXXX. Therefore this XXXX credit repoing practices by SPS PROLONGED the automatic removal date of this derogatory account which should have occurred on XX/XX/XXXX. Because of SPS credit reporting practices my credit was damaged for almost an additional year since they refused in multiple occasions to remove this account from CRAs. Additionally, XXXX XXXX XXXX Bankruptcy Case is not longer active and SPS was granted a lift of stay in XXXX so they could continue with the forclusure Case. In spite of the granting of lift of stay, SPS never continued with the foreclosure case. I dont know from where SPS can changed the original delinquency date when a debtor files Bankruptcy, that is ilegal and in violation of the 15 USC section 605 ( 4 ) This account was removed from XXXX CRA on XX/XX/XXXX because it was overly reported by almost a year. Not because XXXX XXXX XXXX Bankruptcy Case still active. I am bringing this information to CFPB so they can further investigate SPS credit reporting practices.

Consumer Complaint: I filed a complaint against Select Portfolio Servicing a few months ago. As a result of this complaint SPS agreed to work with me and to allow me access to homeowner programs that they had blocked me from in the past. I have had a change in financial circumstance and am in a better position to qualify for these programs. We did as they requested and submitted a full package for review to SPS 30 days prior to our upcoming sale date. However, SPS is stating that they refuse to even look at the package because it was received less than 37 days before the scheduled sale date of XX/XX/XXXX. We feel that SPS has not been straight or forthcoming with us. We had not been given a deadline prior to the submission of the updated documents and had been told that they would work with us. We suffered a true hardship a few years ago but have slowly rebuilt ourselves financially and have applied for help over and over with SPS. When we finally got them to respond we were offered a repayment plan that raised our payment significantly. We dont know how they came up with these figures, or what type of financial information SPS was looking at, but there is no way that we could enter into that agreement. After months ( that dragged into years ) of attempts to get their attention we were finally able to get reviewed for assistance last summer. However, we were denied due to " not being able to create an affordable payment. '' Through repeated phone calls we found that this meant that we did not have sufficient income. We tried to get information as to exactly what type of income calculations were used and what inputs were used for this evaluation. We never received any of this information. Our property is a three-unit triplex, and we have renters in the other two units, and my husband and I live in our unit along with our XXXX grown sons. We have owned this property for 20 years. After the denial in XX/XX/XXXX and the failure to provide us with the income and input information we wrote SPS a letter and also contacted several regulatory agencies ( including the CFPB ). We explained that our financial circumstances had changed and that we want a new review to be conducted based our current and correct income. I am self employed in XXXX and my business is continuing to grow. My wife has worked as a XXXX XXXX XXXX for 7 years. We receive rental income from the additional units and my XXXX adult children are starting to contribute. We have the financial means and income to afford a reasonable payment and deserve a new review. In fact, when SPS responded to us they encouraged such a review, and a new package was submitted on XX/XX/XXXX. However, their agents told us that they would not even LOOK at our package, because it was received less than 37 days before our scheduled sale date ofXX/XX/XXXX. We have been playing these games and dealing with obstruction by SPS for far too long!
