Consumer Complaint: I have been in contact with SPS multiple times over the past 6 months to try and work out a solution. I asked about a forbearance plan to possibly move the missed payments to the end of the loan and I was told no. I asked about redoing the loan modification and was told no. They only thing they offered was an outstanding repayment plan over {$2200.00} a month. My wife had a XXXX last XX/XX/XXXX ( XX/XX/XXXX ) and missed a lot of work and we fell behind on our mortgage payment. I had talked to SPS about this and they did not seem like they wanted to try and work out anything. My wife also had to leave her job in XX/XX/XXXX and find a new job. She did find a new job but, this was 42 days later. This put us further behind. We are current {$11000.00} behind and do not want to lose our home or file for BK- no one wins in this. I would like some help working this out with SPS and understanding what they are telling us and how we should proceed. Thank you

Consumer Complaint: Since XX/XX/2017 I started submitting all requirements for Loan Modification to Select Portfolio Servicing Inc, that they are seemingly trying to modify my loan, at the same time, trying to fail my attempt to avail the government Loan Modification benefits and incentives for homeowners like us. The modification department of Select Portfolio Servicing Inc. is working on a modification for us. I complied already with all their requirements. While the modification was pending, I was advised that I needed again to send additional documents within 7 months for the modification to be approved ; they always said that it is still in the underwriter for review. I still kept on sending documents at this point with the hope that they will process my Loan Modifications. I always communicated Select Portfolio Servicing regarding the status of my Loan Modification processing and they kept on denying my Loan Modification request in which means that they are not abiding under the HAMP Program, so we can stay in our home and exercise our rights for Federal Housing Affordable Loan Modification. We are requesting their approval for remedies available by Federal law. I had complied with Select Portfolio Servicing Inc. requirements for Loan Modification processing. We are in the verge of completing all requirements to finalize our Request for Mortgage Assistance ''. Select Portfolio Servicing Inc. have not dealt to me in good faith until this moment.

Consumer Complaint: I inherited the property from my brother and the title was transferred/closed in my name. The mortgage payments were {$450.00} per month XXXX XXXX. The taxes, insurance, mortgage was in my name. I paid the mortgage without a problem. The loan was transferred to SPS servicing in my name and I continued making payments. I received a notice that my payments would be increased to {$1300.00} XX/XX/XXXX for increased property taxes. I attempted to work with SPS to resolve this issue and was told I could modify the loan. I begin the modification process, ( paid {$1300.00} XX/XX/XXXX last payment ). Suddenly in the middle of the process SPS refused to communicate with me stating I did not have own the property. All my telephone calls, emails, and a complaint letter went unanswered for months. I hired an attorneyXX/XX/XXXX and SPS would not return his calls. My ownership was never challenged with XXXX XXXX or SPS until I attempted to modify my loan. Meanwhile SPS started foreclosing. My complaint is SPS purposely refused any communication with me from XX/XX/XXXX to now to purposely foreclose on my property. I am a disabled senior living in the property. I need help to resolve this matter.

Consumer Complaint: I sent in a payment of {$31000.00} to Select Portfolio Servicing, XXXX XXXX XXXX, UT. My monthly payment is {$1100.00}. I instructed them, on their payment form, in the box that says " Apply to Principle '', to apply the additional {$30000.00} to the principle. They did not do so, as I instructed them to do on their form. I was told by them that, the money was distributed according to what their computer decided to do with it, even though I had specifically directed its distribution on their form. The payment of {$1100.00} was taken out of the funds. As far as the remaining {$30000.00} goes, the next months payment was made of {$1100.00} { for XX/XX/XXXX }, {$10000.00} was put in an unapplied balance account and the remainder of {$18000.00} was taken off the balance after the second payment { XX/XX/XXXX's } was made. They charged me interest on the {$30000.00} as if it had been paid 2 months later. They said it will take some time to straighten this out. I could call next week.

Consumer Complaint: My client is XXXX years old and has been working with SPS on a short sale for over 8 months now. When she first started she was told she would receive {$10000.00} relocation assistance ( she has this in writing from SPS ). The HAFA relocation program had already expired ( XX/XX/XXXX ) but SPS failed to update their documentation. Then they told her she would receive {$3000.00} relocation ( she has this in writing from SPS ). In XX/XX/XXXX SPS then advised my client she would not be eligible for the relocation assistance. In addition to getting bad information about the relocation assistance, my elderly client doesn't regularly use technology. SPS is frequently asking for " one more change '' or " one more item '' which has caused her short sale to be delayed. My client 's agent finally asked our firm to assist as they are concerned this woman is being taken advantage of because of her age. I contacted SPS directly and was advised that the only change needed was to remove the relocation assistance on the HUD. We did so and submitted that information XX/XX/XXXX. SPS policy is that they will review the file in 3-5 days to confirm documentation. When I spoke with the Ombudsman department on XX/XX/XXXX they indicated there were no new notes and they would send a request for an update. I called today ( XX/XX/XXXX ) and was advised that TODAY the file was reviewed, so a decision will be made within 30 days. SPS is out of compliance with their own guidelines and again, taking advantage of my client. They dangled relocation assistance in front of her, now took it away, now they are delaying reviewing her file. Once change was needed, one change was made. We need a decision ASAP.

Consumer Complaint: I'm having a problem with Select Portfolio Servicing applying mortgage payments we have made to our account correctly. My husband and I purchased our home XX/XX/XXXX and have never missed a mortgage payment nor have we been past due unpaid balance. I realized there was a problem XX/XX/XXXX after I called SPS customer service to give them permission to take our monthly mortgage payment from our checking account. They took our payment and never said anything about a past due balance. A few days later still XX/XX/XXXX I started receiving collection calls. SPS customer service rep called me and said I was past due on my mortgage payments and I informed them I had already made my monthly mortgage payment the prior week and they said that the payment I made for XX/XX/XXXX mortgage payment was applied to XX/XX/XXXX mortgage payment. I informed them that I had made that payment as well. In their research they found that our XX/XX/XXXX mortgage payment was applied incorrectly. They apologized and told me they would write extensive notes and forward them to another department to correct mortgage payments which were not applied correctly. I thought it was over but I received another collection call a few days later. I explained to them I have made all mortgage payment and told them to check the notes on our account from the prior SPS customer service rep. They put me on hold to review prior notes and also apologized and wrote more notes on our account explaining the mortgage payments were not applied correctly. Apparently the account notes were not enough because the calls kept coming and the customer service reps were not very nice. I offered to send to them proof of payments as proof but they never wanted to see my proof. I stopped answering call because I assumed they would finally find and correct the payment that was not applied correctly. I'm very concerned, it has been over 3 months with no resolution. I recently called SPS and ask they were they able to find our misapplied mortgage payments and correct our account and was informed that our account was still past due and our monthly mortgage payment were increased. We are still continuing to make our monthly mortgage payments I ask to speak to a supervisor or manager to help us correct our discrepancy and was informed by the SPS customer service rep there are no supervisors or manager to assist me. I don't know what else to do please help. Proof of payments attached. Consumer Complaint: My situation began with XXXX XXXX XXXX in XX/XX/XXXXwhen I began a loan modification just before I left the country to work in the XXXX XXXX. Over the next three years XXXX XXXX XXXX kept delaying the process by constantly requesting more and more paperwork, different forms, saying the program had changed so they needed all new paper work. While at their instructions I did not make any payments until they gave me a modification offer. This process drug out for about 3 years until in XX/XX/XXXX when I was given an offer that I considered ludicrous. It was NO modification at all. So at that time opted for a short sale. By XX/XX/XXXX I had an agent who had a buyer for the short sale. XXXX XXXX XXXX had paid my step son about {$2500.00} cash for keys because he was living in the house while I was overseas. I thought it was a done deal. I learned several months later that XXXX XXXX XXXX had cancelled the sale in XX/XX/XXXXthen foreclosed and sold the property at auction in the dark of night without any notification to myself or my agent. I later learned that it was sold to XXXX XXXX for {$110000.00} on XX/XX/XXXX. XXXX XXXX is a partner/cousin of XXXX XXXX XXXX. Sounds like a pretty shady deal to me. I spoke to the foreclosure attorneys who are listed on the court document and they assured me that the foreclosure was completed. The foreclosure was done as a service to XXXX XXXX another XXXX XXXX XXXX company who I understand has been under investigation. So again I thought the property was gone and since I was working overseas there was nothing I could do about it and just let it go. I returned home to the US at the end of XX/XX/XXXXand was looking for a new place to live. Upon checking my credit I learned that the loan had not been removed at the time of the foreclosure but remained as a big negative mark on my credit file. I also found my house pictured on a real-estate site with the caption not for sale. Why was it shown on a real-estate site but not for sale? I contacted the agent listed and was told that they were given the listing by XXXX XXXX XXXX but the bank kept refusing all offers for the property. More research I came to find out that a company called SPS was now handling the loan. Come to find out that in XX/XX/XXXX at the same time XXXX XXXX XXXX was having XXXX XXXX foreclose on the property they had also transferred servicing of the loan to SPS as a delinquent loan NOT a foreclosed loan. SPS knew NOTHING about the foreclosure. When XXXX XXXX XXXX foreclosed on the property they simply abandon it, washed their hands of the property turned it over the SPS, had NO oversite, and allowed damage and vandalism to occur. When I contacted SPS, I was asked if I wanted to begin a loan modification. They apparently had NO record that XXXX XXXX XXXX had put me through the process 5 years earlier. They were also unaware that I was not living in the house and had been overseas until XX/XX/XXXX. They told me that the property was indeed mine and I could be living in it. So after consulting a couple of law firms and the MS attorney general we moved back in in XX/XX/XXXX, and began again the modification process with SPS. Over the next couple of years I learned what a serious mess this has become. For the first couple years SPS refused to accept that the property had been foreclosed on and that issue needs to be corrected at the county level. The damage that the bank allowed needs to be repaired as well as my credit that has been ruined by the banks actions needs to be corrected. They have me in a position of not being able to not having the ability to live safely and securely in my home and not being able to buy another home. This is the main saga of the hell that I have been subjected to over the past few years. There are more details that I will fill you in on. The primary companies involved are ; XXXX XXXX XXXX XXXX XXXX XXXX XXXX Select Portfolio Servicing After going back of forth for 4 years with the bank, SPS, XXXX XXXX, I was told last year that they were going to resend the foreclosure because it was done illegally in XX/XX/XXXX, and the property would be put back in my name. They wanted me to sign off on the plan, whatever that means. Then in XX/XX/XXXX I was contacted again via my attorney, and told that the original foreclosure was now legal. Now they are offering me cash for keys again and want to evict me. The story is more complex than I was able to explain here. About 2 year ago they offered me a deal for a set price /rate. I was unable to accept at the time because of the ownership issue still being up in the air.

Consumer Complaint: I have a letter from Select Portfolio Servicing stating that they are working on my file which indicate I have submitted paperwork for the short sale. My realtor has called several times as have I and they have not documented all calls. They were not really trying to work with us on this short sale. All request have been sent over. For them to verify that they rec 'd my paperwork and now say its not complete is ludicrous. I just wanted my investor to buy the home so I won't have a foreclosure on my record and the lender not have a property on hand both of us happy. I really need to move in some apartments that require I don't have a foreclosure on record. I have submitted all paperwork. The balance that they are saying I owe is XXXX more than over the balance. The balance is now XXXX and some and my balance was XXXX when I got behind. It does not take a scientist to know that whatever was added to my balance could not be this amount. When asked for an audit on my file I receive nothing because they said I have not paid Select Portfolio anything. They are correct with Select Portfolio. But I paid when it was with XXXX XXXX, XXXX XXXX and XXXX XXXX. So I was still suppose to this accounting information because it was TRANSFERRED TO THEM. I KNOW THAT XXXX XXXX INSURANCE HAVE PAID THEM FUNDS -- -- -- -- -- -- -- -- -- -- -THEREFORE THE BALANCE THAT THEY ARE STATING IS INCORRECT. THAT MAKES THIS LOAN A FRAUD -- -- -- -- -. What can be done to stop this foreclosure because that's the reason they are not working with me. The balances are wrong and I can't be approved if the totals that they are working with are not correct, the system will keep kicking them out. I have asked for an itemized statement in which I have not rec 'd will you help postphone this sale and get this information to me since they have not returned phonecalls or called the realtor since this process

Consumer Complaint: Issue number ( 1 ) Select Portfolio is continuing to harass me on my mortgage loan stating that there is a lien on the property and possible foreclosure if no resolution is met by XX/XX/XXXX. I applied for a loan modification XX/XX/XXXX with Select Portfolio Servicing, and was told that the Lender ( XXXX XXXX ) will have to review and approve my loan modification. Issue number ( 2 ) XXXX XXXX coerced me into their in house loan modification in XX/XX/XXXX, when in fact, I qualified for the HARP Loan Modification since XXXX is a bank. XXXX was fully aware of this since the Federal government gave them " Bail out '' money for distress loan such as my mortgage. Issue number ( 3 ) Bankruptcy Court showed a balance of {$220000.00}, when I got my notice from Select Portfolio it showed {$240000.00}. When I contacted SPS, they stated that all the arrears was added in the back of the loan, but still SPS relationship manager said there's a Lien on my property and has to be resolved by XX/XX/XXXX or they will contact an Attorney to seek possible forecloser.
