Consumer Complaint: Select Portfolio is not willing to resolve my mortgage issue by correcting the principle balance of my mortgage loan that was transferred by XXXX XXXX XX/XX/XXXX ( {$84000.00} ). I never agreed to a Sub Prime Mortgage of {$240000.00} with XXXX XXXX. I have lived in my home since XX/XX/XXXX in fact, it was a construction home. Select Portfolio stated recently that the Mortgage still belongs to XXXX XXXX and the Loan Modification needs to be approve by XXXX XXXX. This is a monopoly. As a consumer, I request the Federal of Investigation investigate both XXXX and Select Portfolio for Mortgage Fraud. The mortgage fraud monopoly issue with both XXXX and Select Portfolio Servicing. It is time the CFPB gets involve and sanction both these Mortgage business to the list of Lawsuit claims against them for Mortgage fraud. This scam has cost countless innocent home owners such as myself and other consumers stress and uncertainty. Congress pass a law that prevents Mortgage Companies and Servicers from Mortgage Fraud and get the HUD Department involve to insure these Mortgage Companies are honest and comply with Trust in Lending laws.

Consumer Complaint: I XXXX XXXX and my husband XXXX request through the Consumer Financial Protection Bureau a motion for my mortgage servicing company Select Portfolio Servicing , Inc. to cease and desist all calls to our home or cell phones about missed mortgage payments. All correspondence must be in written form only from this point forward. We are currently facing several financial matters that has caused a hardship for us and our family and business. Accordingly, we will be requesting a mortgage forbearance while we design a game plan to work out all of our financial difficulties. SPS should submit our cease and desist request and abide by the rules, and assign a mortgage workout specialist to notify us on how to start the forbearance/modification process. Therefore, our request should cease any threats of a foreclosure process, as we will file for bankruptcy if necessary.

Consumer Complaint: XX/XX/2018 my mortgage was transferred from a conventional bank to Select Portfolio Servicing. Since my loan was originally with XXXX XXXX and also HARP eligible it had been transferred a few time, however this time I had no reason to believe the loan was NOT being transferred to an actual bank. I have come to find our my loan is now owned by an " investor '' who has targeted me based on the type of my loan. SPS and the investor has done a " bait and switch ''. They lied to me and lead me to believe that a reduced unemployment payment plan would not be reported to the credit bureau and if I paid on time would lead to a loan modification. Every single agent I spoke with indicated this was the process for a loan modification and it would not affect my credit because we were in an agreement. I asked this a few times to a few different agents who all implied that this process would help lower my payment and any balance in excess to the new payment plan would be added to the backend of the loan. They also were clear that this would not be reported to the collection bureau because I was this special " unemployment plan ''. It turns out that they have not only fully reported it to the collection agency as delinquent and my credit, but now my loan is also not HARP eligible. My credit went from being good enough to refinance to quickly in the XXXX. It is terrible to lie and do this to someone's credit because I had been in good credit standing with the conventional bank and had looked into refinancing before SPS offered their unemployment and said modification plan. They even thanked me for reaching out and said that I was smart to reach out to them to notify them of my decrease in compensation. I just received a letter from SPS that my loan is NOT eligible for a loan modification for " business reasons '' which is not acceptable to me as a consumer. Instead they are forcing me to sign a document for a re-payment plan which also says " short sale ''. When I called to ask about it, they told me my home was technically 8 months into foreclosure and suggested I " hurry up and sell my house before they do ''. I have tried to reach the " relationship manager '' by email twice and by phone twice with no resolve. Now that they messed up my credit, I am not even able to refinance even with income and a previous positive mortgage payment credit standing and equity. SPS now has completely changed their tone, to the investor does not offer loan modifications on your loan and we are sorry we gave you the wrong information, unacceptable and intentional! It is obvious the investor and XXXX targeted me and my loan and has intentionally put me in this situation. Please know that they have given me less than 30 days to sign the short sale agreement and also have told me that the " unemployment plan '' that I was on began the foreclosure process! There was no warning of this and in fact thought I was in good standing with XXXX. Please know that I had an isolated situation that required me to go on FMLA and unemployment. I am terribly afraid to give this investor and XXXX serves any of my money out of fear of not being protected and certainly do not trust signing anything, especially it saying short sale. I hope that that Consumer Financial Protection Bureau can assist me in getting my credit back to where it was before they lied to me in effort for me to apply for a refinance and save my home with a REAL financial institution. I was told that during this process they would not report any delinquency as long as I paid the agreement, which I did. Now they are telling me something completely different. I am hopeful that you can also help in some way and please get my loan transferred to a conventional bank please that offers me protection in helping to save my home and a modification or refinance. It is impossible for me to refinance now that I trusted they were trying to help. Instead it was a bait and switch. The relationship manager has even failed to even respond to me and they also did not email back regarding the credit reporting issue. I emailed twice regarding the credit reporting issue and twice the relationship manager. No response to any emails. I had to call them and speak to a supervisor who offered to write a letter on my behalf to a loan company that I had paid their agreement, which is not going to help my credit. I want my credit fixed immediately please. They threaten to sell my home as soon as I do not make the payment on XXXX XXXX and have not given me time to rectify this. The re-payment plan is for a short sale, so this is overall not fair to me when they were aware I was trying to save my home. I also hope that you can please protect future folk in my situation and not allow this investor to XXXX people out of their homes. My home is worth over {$100000.00} of the loan value and it feels terrible to be targeted. I am sure that is why they do not offer a modification and it was " business decision ''. I just did't think this was allowed? They lie and tell you they are trying to help you in effort to ruin your credit and force you into a short sale because you and your house fit the criteria for the investor to profit from forcing foreclosure, when the entire time you actual think they are trying to help you safe your home. Thank you for your help and understanding and protecting consumers and their credit.

Consumer Complaint: Dear Madam or Sir : I understand that under Section 6 of RESPA you are required to acknowledge my request within 20 business days and must try to resolve the issue within 60 business days. Please treat this letter as a " qualified written request '' under the Real Estate Settlement Procedures Act, 12 U.S.C. Section 2605 ( e ). I am writing to you to complain about the accounting and servicing of my mortgage and my need for understanding and clarification of various charges, credits, debits, transactions, reversals, actions, payments, analyses and records related to the servicing of my loan from its origination to the present date. To date, the documents and information I have, that you have sent me, and the conversations with your service representatives can not answer my many questions. It is my understanding that your company has been accused as engaging in one or more predatory lending and servicing schemes. As a citizen, I am extremely concerned about such practices by anyone, let alone my own mortgage company or anyone who has held a beneficial interest in my QUALIFIED WRITTEN REQUEST COMPLAINT DISPUTE OF DEBT/ VALIDATION OF DEBT TILA REQUEST Page 2 of 8 loan. I am concerned that such abuses are targeting the uneducated and uninformed consumer and disadvantaged, poor, elderly and minorities. Needless to say, I am more concerned as an alleged borrower. I am worried that potential fraudulent and deceptive practices by unscrupulous mortgage brokers ; sales and transfers of mortgage servicing rights ; deceptive and fraudulent servicing practices to enhance balance sheets ; deceptive, abusive and fraudulent accounting tricks and practices may have negatively affected my credit rating, mortgage account and/or the debt or payments to which I am legally obligated. Because of this and other reasons that leave me to believe that I may be a victim of predatory lending, I am disputing the validity of the current debt you claim I owe. By debt I am referring to : 1. The principal balance claimed owed ; 2. My calculated monthly payment, 3. Calculated escrow payment 4. And any fees claimed to be owed by you or any trust or entity you may represent. I have reason to believe that the loan terms were misrepresented to me at the time of application and further obscured and/or modified prior to signing. I believe that my income may have been inflated on the application. I also have reason to believe that certain statements were not provided for my approval prior to closing, and that signatures may have been forged on various documents. It is also my belief that certain documents may have not been presented at all. Additionally, I believe that a notary was not physically present to witness my signatures on several pertinent documents and that I was ill advised at the time of closing. To independently validate my debt, I need to conduct a complete exam, audit, review and accounting of my mortgage loan from its inception through the present date. Upon receipt of this letter, please refrain from reporting ANY negative credit information [ if any ] to any credit-reporting agency until you respond to each of my requests. The copies should be legible and all documents shall be copied in their entirety. This information should cover the ENTIRE life of the loan. I want to insure that I have not been the victim of such predatory practices. To insure this, I will be authorizing a thorough review, examination, accounting and audit of my mortgage LOAN # XXXX by a team of mortgage auditors predatory lending experts, consumer advocates, local non-profit agencies, compliance consultants and if needed LEGAL ADVOCATES. This exam and audit will review my mortgage loan file from the date of my initial contact, application and the origination of my loan to the present date written above. As such, please treat this letter as a Qualified Written Request under the Real Estate Settlement Procedures Act, codified as Title 12 2605 ( e ) ( 1 ) ( B ) ( e ) and Reg. Consumer Complaint: I am reporting a Regulation X dual tracking violation. XXXX XXXX ; XXXX XXXX XXXX XXXX, XXXX XXXX, NJ XXXX. The mortgage is represented by XXXX XXXX XXXX ; the account # XXXX and managed by Select Portfolio Servicing ( SPS ). A loan modification was initiated in XX/XX/XXXX. SPS took so long with Loan Modification that instead it was decided that the property be sold. In XX/XX/XXXX I listed the property for sale and after several contracts my realtor was able to find an all cash buyer. SPS ordered the 1st appraisal they have been holding up the file for so long that SPS had to obtain another appraisal. I learned that the property diminished over {$200000.00} while SPS was " reviewing my file. Meantime while I am working on selling the property for close to the appraised value SPS files for foreclosure with the house to be sold a Sheriff Sale XX/XX/XXXX. I have an all cash buyer and every document requested has been submitted by me and my Realtor. Selling the property is important to me and my family as the Short Sale will have less of an impact. Since XX/XX/XXXX SPS has had all documents requested. For the month of XX/XX/XXXX they had my Realtor change things back and forth on the HUD-1 then only to have her change things back to the way it was prepared XX/XX/XXXX! It is Now XX/XX/XXXX and they are still creating what I feel is a false delay using changes to the HUD-1 to hold up the Approval so the property can be sold instead of lost to Foreclosure Sheriff Sale in XX/XX/XXXX. SPS should not be moving to Sheriff Sale while we are working on the Short Sale closing date. I wrote to the State of NJ Foreclosure division but was told there was nothing that could be done. Please advise.

Issue: Applying for a mortgage or refinancing an existing mortgage

Consumer Complaint: In XX/XX/XXXX I applied for a refinance of my home mortgage with XXXX XXXX ( XXXX ). They are not the problem, instead my second mortgage, originally with XXXX, now with Select Portfolio Services ( SPS ), has been a major problem. In order to refinance My second mortgage company had to agree to be the subordinate mortgage. That is where the problem began. It has been three ( 3 ) months and after constant contact by me and my representatives at XXXX and they still have not agreed to be subordinate. I have written letters allowing them to contact XXXX and have called to let them know I am unhappy with their incompetence. They kept saying it is in review and it may take 5 days. I spoke to a supervisor on XX/XX/XXXX and she said she would set up the process. Still no answer as of this complaint. Do to SPS 's incompetence I have lost the ability to lessen my term and take advantage of HARP. Additionally I was forced by SPS 's inaction to incur a fee of {$2000.00} to lock in the rate I applied for in June.

Consumer Complaint: XXXX is attempting to foreclose on my property with fraudulent robo signed assignments. I have asked debt validation, and sent 2 QWR. I have not received a response from either. The assignment are fraudulent and fraud can not be the basis of obtain a deed ; therefore, the notice under power of sale is fraud and cant be used to conduct a foreclosure.

Consumer Complaint: This is related to Select Portfolio Servicing , Inc. and XXXX XXXX. In XXXX my wife and i took out a HE Loan with XXXX XXXX ( XXXX ). On XX/XX/XXXX and XXXX XXXX, My wife and I signed documents related to a First Lien deed of trust for the home equity loan with XXXX XXXX. I cant explain why this was done twice or for what purpose, but the fact is both were filed in XXXX County, TX. I have paid my loan as agreed, then, around XXXX of XXXX, XXXX sold my loan to SPS, Inc. There is a transfer of lien filed at the county that reflects this. The transfer references the loan #, but only references one of the instruments or liens that was filed. I paid my loan off in XXXX and received a release of lien from SPS for the lien they assumed from XXXX, the FLDT dated XX/XX/XXXX. I went to apply for a home equity about a month ago and was told there was still a lien filed with the county ; the lien filed on XX/XX/XXXX by XXXX. I am being told by SPS Servicing , Inc. that they can not release the lien dated XX/XX/XXXX as it was never transferred to their name, and they are not the lien holder. I told SPS the lien they assumed was invalid, as there was already a FLDT filed at the county, and one could argue that any payments i made to them were done so without a proper lien. I explained that I felt it would be in their best interest to help resolve this matter. They stated they had done all they could do. I can not contact XXXX XXXX other than by mail, which i have done as of today. In this day, with all the access to technology we have, it is unreasonable for them to not have a means by which a customer can contact them other than by mail. I would appreciate your help resolving of this matter.

Consumer Complaint: I had to chose something to move forward. Select portfolio does not call before XXXX XXXX. This morning they called at XXXX. Again Select Portfolio is playing games. This is not a revolving credit account. They are a debt collector for my 2nd mortgage.They have a call center in XXXX XXXX XXXX with employees that give wrong or misleading information. Their Loss mitigation department responded to you with inaccurate information. I received a letter dated XX/XX/XXXX asking for even more documents ( the list keeps growing ). In addition to their response to CFPB they now want pay stubs ( which I have none as I'm unemployed and have already sent the my bank statements and letters from the Ga. Department of labor ) ; and a letter from my homeowners association showing what I have paid and the frequency of my payments and schedule XXXX from my tax return for XX/XX/XXXX. The loss mitigation department did not address the fact that their call center employees tell me things that are inaccurate and misleading. Obviously they don't care about the CFPB otherwise they would have clearly spelled out what was needed when they responded to my prior complaint with you.

Issue: Struggling to pay mortgage

Consumer Complaint: I had been requesting a Loan Modification from my lender SPS. I have a very legit hardship to have requested this. I never had a modification in the past ever. This would had been my first one. SPS gave me a approval for a modification and when I was informed about the approval I had been just release from the hospital and I have been in and out of the hospital for some time now, thus the reason im requesting a modification. Once I spoke with SPS about my approval my payments were some what more affordable for me but since I had just been release from the hospital and being heavily medicated with drugs, I really was not on the mind to speak to anyone to have made any decision on my home. SPS told me if I font take this approval then I need to SHORT SALE my property, well I was not even able to comprehend the approval and understand this and nor was I explained the process of what a SHORT SALE IS, until I requested XXXX XXXX to help me in this process, and they explained to me what a short sale is and I would loose my property. I was very shocked o have known what this was and my lender telling me that, " if you don't take this approval you need to short sale your property ''. Before I found out what anything meant I told SPS to go through the short sale process not clearly understanding what it really was - then when XXXX XXXX wanted to help me they said no you don't need to do a short sale on your property we will get you the approval terms back. SO SPS refused to let me take the APPROVAL they gave to me, knowing that my hardship was clearly all medical issue of going in and out of the hospital. For my lender to have treated me so inconsiderate for my medical issue is not the way any lender should be to a homeowner. I want to keep my home and stay there and enjoy the rest of my life there.
