Consumer Complaint: Because I have been struggling with my mortgage payments for several years and applied for and was denied a mortgage modification in XX/XX/XXXX by my mortgage company Select Portfolio Servicing ( " SPS ), I applied for and was approved to participate in a short sale program with SPS by letter dated XX/XX/XXXX, giving me until XX/XX/XXXX to sell my property. The letter also stated that "... as part of the short sale process, we will accept... a XXXX payment.... '' It was also stated in a letter from SPS dated XX/XX/XXXX, responding to my inquiry regarding a short sale, " Under the Short Sale Agreement, you will not be required to make monthly payments. '' On or about XX/XX/XXXX, I entered into a Contract of Sale, principal amount of {$140000.00}, closing date scheduled for XX/XX/XXXX. Then in XX/XX/XXXX the delay tactics began. SPS stated to my broker 's attorney that the " numbers [ {$8000.00} ] on the RMA form '' needed to be placed in a different section of the form ; and continued to, unbeknownst to me, delay the closing for the next 50+ days. During this time, I was inundated with notices/demands for payments, threats of foreclosure, etc. from the mortgage company. I was assured ( by XXXX of SPS, XX/XX/XXXX, XXXX ) that these notices were " automated communications '' and to disregard them. I obtained affordable housing in the form of an apartment for myself, cleaned and moved out of my home of 26+ years on XX/XX/XXXX, assured that the closing would take place soon thereafter. On or about XX/XX/XXXX, I received an email from my broker 's attorney 's office that " as per my conversation with Ms. XXXX at SPS the above captioned short sale is still pending a decision. There are no documents being requested as of my call, and no foreclosure sale date has been set. '' On or about XX/XX/XXXX, I received an email from my broker 's attorney 's office that " as per my conversation with Mr. XXXX at SPS the above captioned short sale is showing as the offer for the second not being accepted however, I would like to resubmit the offer asking them to reconsider. Please advise if the Buyer would be willing to wait a little longer while we make another attempt. '' I was informed that the mortgage company was now demanding that the buyer pay the full amount of the second mortgage of approximately {$39000.00}, rather than the {$8000.00} that was agreed upon. Needless to say, the buyer withdrew his offer. My broker, the attorney, the buyer and I were shocked by SPS ' decision. We were lead to believe by SPS that this was a done deal, and just the necessary modifications to the RMA had to be made, etc. Before this short sale process, though I was struggling on a fixed income, I was up to date on ALL my expenses pertaining to the upkeep of my house -- mortgage payments ( 2 ), property taxes, quarterly expenses ( water, sewer, trash ), homeowners insurance, even the gas and electric. Before I started this process I was NOT facing foreclosure. Now, because of the delay tactics of the mortgage company in what I feel was an attempt to extract more money from the buyer, I am a XXXX year-old XXXX XXXX XXXX female facing at this time of my life foreclosure and XXXX in debt. This to me is an outrageous abuse of power. I feel as if they took my stressful situation and under the guise of being helpful and giving assistance, with delay tactics, prolonged and then denied the sale of my home and at my age made the remainder of my life even more stressful and thus detrimental to my health.

Payments were made in the amount express XX/XX/2018 {$740.00} XX/XX/2018 {$740.00} and XX/XX/2018. Payments were completed successfully on XX/XX/2018. XX/XX/2018 receive Congratulations letter from SPS Servicer on XX/XX/2018 That I was approved for a modification and the {$750.00} and if accepted must signed agreement and return by XX/XX/2018. On XX/XX/2018, I contacted the Sps to informed them I have not received the executed documents back on their end. I was told the payment was {$820.00}. I told him that payment was higher than expressed signed correspondance agreed. I was told they would check it out was a hold up on sending me the executed agreed modification papers On XX/XX/2018 XXXXps rep called me very rude trying to make me pay and oral amount instead of the Express agreed amount. I hung up and first told him he was unfair to the consumer to ask me to pay more than agreed On XX/XX/2018, I called back to speak with a supervisor. I was told that they could not help me and I also informed them my tenant has died. I asked to delay payment to give the spouse time to apply for husband benefits. Inform them because of a change in circumstances because of the death. Tenant was not able to pay. Asked Sps to delay payment. Sps said they had not sent the executed modification docs received by myself because the payment had change. So I have been misled and had to file a complaint since that was not what I was credit and approved for and could not afford. I already had to pay {$3000.00} for water Bill 's for this tenant out of my on pocket that now I cant even pay my own bills.

Consumer Complaint: Couple different items occurred with Select Portfolio Services. They acquired the loan after a permanent modification and failed to notify me @ the address on file. I had to seek them out based on data from the prior lender when payments were returned. Despite my efforts they marked the first mortgage payment as late despite my proactive efforts. This has a material impact on my credit score and they refuse to address this. This is the only late payment on this or any other account on my credit report. Secondarily, after repeated attempts they continue to send pertinent mail to the property address. 1098s and things like changes to escrow. Thirdly, they had a 3rd part review the flood insurance on the property. I, within the time allotted procured flood insurance from a national carrier @ $ XXXX/year. Further I followed their process, uploaded the binder and assumed the issue was ended. Instead they are providing flood insurance @ $ XXXX/year and claim to have not received the binder. Customer service rep XXXX on XX/XX/XXXX confirmed the document had been received and I've been billed in error. Fourthly, the password reset routine on their website has been dysfunctional for at least 3 days. Requiring me to call to get a reset to access the latest data. It looks a lot like Select Portfolio Servicing is in the business of making it difficult for folks to pay the mortgage as agreed and have a larger interest in generating fees and challenges for the mortgagee.

Consumer Complaint: I have received several letters and phone calls from Select Portfolio Servicing , Inc regarding my mortgage for my property in XXXX, PA. All the correspondence that I received was in regards to my interest rate increasing in XXXX stating that I had a variable interest rate. I spoke to multiple people at SPS, who two months ago purchased my mortgage from XXXX, explaining that I entered a 5 year rate lock on my mortgage in XX/XX/2018 where I paid an additional monthly payment to process the 5 year rate lock. I spoke with XXXX XXXX a supervisor at SPS on XX/XX/18 where he looked through my documents was able to see where an agreement was sent to me in XX/XX/2018 and an additional payment of {$570.00} was processed by XXXX for the rate lock. However, since then I received two additional letters and today on XX/XX/18 I received another phone call on the same subject stating that my rate will increase in XXXX. SPS has been innodating me with letters and phone calls in regards to a rate change for my property. This is incorrect and I have asked several times to include today to rectify the situation. I have asked them to review their documents and correct their system which is incorrect. I did not agree to the servicing transfer and since the transfer I have had issues in regards to payments that were not processed because someone on their end keyed it incorrectly and now they are threatening to increase my interest rate. I have exhausted all options to rectify this with the Servicer to no avail. Based on my interactions with them I believe their servicing records are incorrect, the team is not adequately equipped to service my loan. Additionally, it appears that they have a lack of accuracy on servicing records and there were no quality checks done at time of transfer. As of XXXX SPS is indicating that they will raise my interest by over 1.25 basis points. Again, I locked my current rate of 4.25 % in XXXX for a 5 year period. Please help.

Consumer Complaint: Upon direction of Select Portfolio Servicing, Inc, XXXX Bank, XXXX XXXX, has been illegally attempting to collect a mortgage debt for the past 2.5 years and has engaged in multiple instances of fraudulent misrepresentation to both me, the state and appellate courts of Ohio, and to the United States Sixth Circuit Federal Court. Specifically, the Bank, by and through its attorneys, alleged that it is the new trustee in the case by virtue of being the successor in interest to XXXX XXXX XXXX. As a result of those false statements, the bank then stated to the courts that it was the 'real party in interest ' in my case. In addition, XXXX Bank itself wrote me a letter ( attached ) in XX/XX/XXXX stating that it was the 'trustee ' for the 'trust ' that owns my note and mortgage. None of the statements above, both made in court and made to me, were true at the time they were made, and they are still not true today. The evidence of their falsity is readily apparent by means of a fraudulent 'Corporate Assignment of Mortgage ' that was filed by Select Portfolio Servicing , INC , the servicing agent on the account. The assignment, which was prepared on XX/XX/XXXX, contains a number of contradictions that prove that the statements made prior to that date were false. In addition, further statements that were made after XX/XX/XXXX are also false since they assignment failed to transfer any 'interests ' to XXXX Bank as they alleged in court documents. XXXX Bank, in addition to committing fraud upon the Courts, is in direct violation of the Consent Decree it signed with the OCC in XXXX, XXXX. Article IV ( 1 ) ( e ) of the Compliance Program, signed by the bank on XX/XX/XXXX, requires the bank to establish and maintain : ( e ) processes to ensure that the Bank has properly documented ownership of the promissory note and mortgage ( or deed of trust ) under applicable state law, or is otherwise a proper party to the action ( as a result of agency or other similar status ) at all stages of foreclosure and bankruptcy litigation, including appropriate transfer and delivery of endorsed notes and assigned mortgages or deeds of trust at the formation of a residential mortgage- backed security, and lawful and verifiable endorsement and successive assignment of the note and mortgage or deed of trust to reflect all changes of ownership ; ( emphasis added ) All of the above requirements imposed by the OCC detailed above have been violated. Consumer Complaint: I have concerns about my mortgage payments and why so little, over the course of nearly 15 years, has been applied to the principal. My mortgage has changed mortgage companies several times and is currently held by Select Portfolio Servicing. Im curious to see if records have been kept accurately and my payments applied to my advantage. I purchased my home around XX/XX/XXXX for {$140000.00}. In XX/XX/XXXX, records show I refinanced for {$180000.00} -- I do not remember doing this. Now, 14 years later I owe {$150000.00}. I'm curious to know why the total remains so high. Although I got behind when I was unemployed and underemployed for about 8 years, every payment was made, even if they were made late. For 18 months it was paid through Illinois Hardest Hit. Roughly calculating, over the course of these last 14 - 15 years ( with my house note fluctuating from a low of approximately {$1200.00} and to a high of nearly {$2200.00} ), my debt has been reduced by about XXXX. Estimating monthly payments at a low level : {$1200.00} x 12 months per year = {$14000.00} {$14000.00} per year x 14 years = {$200000.00} All things considered, interest rates, insurance and taxes I've paid {$200000.00} to reduce my house mortgage by {$30000.00}. {$200000.00} ( total $ paid ) - {$30000.00} ( applied to principal ) = {$170000.00} ( remainder ) Over 14 years where has this {$170000.00} been applied? Interest, insurance, fees. Again, roughly speaking since I am not working with actual numbers, about : 15 % has been applied to the principle ( some months as little as {$20.00} ) 85 % to other. Now, I'm curious to see how my payments have been applied and if the processes used have been fair and legal. Id also like to get solid answers and gain an understanding of why I continue to owe so much. Thank you.

Consumer Complaint: My loan was modified in XX/XX/XXXX, which states that every year in XXXX, my escrow account would be re-evaluated to determine my new payment for taxes and insurance payment would be over the next 12 months, which would go in affect XXXX of every year. At the end of the year if there was a shortage or an overage based on their foretasted calculations the prior year, they would adjust my payment the following year in XXXX. These are the terms and conditions from XXXX, whom modified my loan. XXXX complied with that from XX/XX/XXXX until they sold my loan to XXXX. XXXX also complied with that all the way through XX/XX/XXXX. XXXX would calculate my taxes and my mortgage payment my taxes would be applied to my escrow account, which at the end of the 12 month period would bring my escrow account current and at a XXXX balance. XXXX reassessed my escrow account in XX/XX/XXXX and increased my escrow payment to XXXX a month and my mortgage payment was about {$1400.00}. In the month of XX/XX/XXXX the loan was sold to SPS and my mortgage payment was the same amount, since XXXX already calculated my new mortgage payment from {$1300.00} ( at an interest payment amount of 2 % and the tax bill for the year of XX/XX/XXXX-XX/XX/XXXX ) to the XXXX. Keep your home California provided assistance in XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX. In XX/XX/XXXX they paid my mortgage from XX/XX/XXXX through XX/XX/XXXX. In XX/XX/XXXX they also paid about XXXX to bring my account current with their reinstatement program. In XX/XX/XXXX they also paid SPS a total amount of {$83000.00}. Select Portfolio applied those funds inappropriately because they collected over XXXX for my taxes and insurance, which would have paid my escrow account in full until the following year in XX/XX/XXXX. Whomever determined where the funds were disbursed, they concluded that my new mortgage payment would be {$1200.00} from what it was prior to funding of {$1400.00}. They took the funds for a 12 month period instead of applying only what I was supposed to pay per month, which would have required them to free me from paying into the escrow account until XX/XX/XXXX. As per my modification agreement that full amount did not have to be satisfied for a 12 month period. SPS had me at a XXXX balance per there statement as of XX/XX/XXXX. I was past due and Keep your home paid my taxes all the way through XX/XX/XXXX in the amount of XXXX, however SPS never could tell my how they showed that they collected XXXX. I didnt catch the over-payment until XX/XX/XXXX when I changed my home owners insurance and then all of sudden SPS changed my mortgage payment to over XXXX, all though nothing was supposed to change until XX/XX/XXXX. I contacted SPS and filed a complaint and they stated that my mortgage payment had always been that amount. They had no idea I had documentation and confirmation from my relationship manager when the XXXX was applied to my account. SPS asked me to send the statement that showed as of XX/XX/XXXX my mortgage payment had decreased to {$1200.00}. I was told by my relationship manager, that handled my account that SPS had many problems and they had originally mis-applied my funds towards my deferred amount, instead my Interest Bearing Principal amount, that was based on my modification agreement and also how Keep Your Home California was requiring them to pay so that my mortgage payment would decrease. I was also told that all though my payment was {$1200.00} that in one system it showed that they never changed my mortgage payment and then in another system it showed that my mortgage payment was approximately {$1500.00}. I never saw the change and mistake that SPS made until I got a letter in XX/XX/XXXX stating they had decreased my payment by XXXX and that my payment was at about {$1500.00} as if SPS never even reduced my mortgage payment. The statements showed my mortgage statements, all the customer service reps I spoke to, the automated system, and my on line account also showed my mortgage payment being {$1200.00}. When I filed the complaint I had to ask them to correct and provide them all the documentation because they said that they had no record of my payment being {$1200.00}. I also had been passed due and not only were they asking me to pay about {$1500.00} as of XXXX, they also backdated my payments to reflect the higher amount of what they said I owed instead of what I actually owed. They not only calculated incorrectly, but was now taking advantage of me not being current and increasing my payments for about four months of payments I had not made yet of the {$1200.00}. As I started talking the manager, XXXX, in the ombudsman department she was so confused and she was under the impression that my escrow account needed to be calculated based on what and when they paid for my taxes and I had already paid my taxes for a 12 month rolling calendar year and plus an additional XXXX that they have never been able to explain to me. I advised them that they added their own Insurance as of XX/XX/XXXX and backdated it for an entire year that I never even had Insurance. I have documentation as to when they added their Insurance. In the process of dealing with XXXX and the time that she spent from XXXX until XXXX she had changed my mortgage payment at least 5 times. She initially said I was short on my escrow account in the amount of XXXX, then XXXX then over XXXX, and then finally over XXXX ( holding me responsible for 2 years of taxes all the way through XX/XX/XXXX because SPS made a tax payment in XXXX in the amount of XXXX and then another one in XXXX of XXXX, which totaled to be the XXXX. She attempted to tell me that I was past due for the previous year in XX/XX/XXXX of XXXX and the difference of what XXXX ( my previous mortgage company before SPS ) calculated of XXXX and the additionally I owed another XXXX. She was basing my shortage on when they paid my taxes. I advised her that her calculations were incorrect because as of XX/XX/XXXX I was at a XXXX balance based on their statement sent to me on how they disbursed the funds of XXXX from Keep Your Home California and not only SPS take too much money I should have never had to pay for taxes until the following year. After months and hours of talking, emailing, and sending all of my documentation.she said that my mortgage payment would be XXXX and that would include XXXX payment which was part of the shortage, even though there was not shortage. Then I got a bill showing that my payment was XXXX and I called SPS and they told me there was no shortage after an escrow analysis and my payment would be XXXX without the shortage payment for 99 months. I have all the emails from XXXX, who is the manager in the Ombudsman department, that reflect all her inconsistencies and misinformation. When I spoke with the relationship managers over that two month period they continued to tell me there was not shortage after my payment from keep your home California and that they needed to adjust it. I continued to make my payment per my statements of {$1200.00} until my XXXX payment was required because they are not legally supposed to change my mortgage payment whenever they want and they also can not backdate it just because I missed payments. My mortgage payment should have remained at the {$1200.00} until XX/XX/XXXX but they were premature in increasing it because they decided to re-evaluate my payment when they received notification to change my Homeowner Insurance in XXXX. I did file a complaint previously with the Department of Oversight and when I did that is when I received a letter in XXXX that showed my new mortgage payment of {$1300.00}. They refused to honor the original agreement of my payment of {$1200.00} until XX/XX/XXXX because whenever I would ask them to fix it, they would make things worse. Here we are again in XX/XX/XXXX and I changed my homeowners insurance in XX/XX/XXXX and then in XXXX they increased it again to XXXX. I called again and the relationship manager told me that they made a mistake and they should have never changed my payment until XX/XX/XXXX and said they would do a full analysis. I got a piece of paper in the mail from SPS that was not legible and they had no basis for changing my mortgage payment again prior to the date that they were supposed to. I contacted the escrow department directly and she said that they can change it as many times as they like and they can also collect an additional amount in taxes. I advised her that she was incorrect because in the state of California they can only collect for a 12 month period. XXXX ( previous mortgage company ) specifically told me that there was no shortage on my account when it was transferred my account to SPS had been in compliance until XX/XX/XXXX. I overpaid in XX/XX/XXXX for 6 months of {$630.00} which is the difference of the XXXX to the XXXX. If they felt there was a shortage, which there was not, it should had been re-evaluated as of XX/XX/XXXX. SPS is not asking me to pay {$1400.00} from XX/XX/XXXX until XX/XX/XXXX and that is not supposed go in effect until XX/XX/XXXX. I have continued to ask SPS how much money of the XXXX that Keep Your Home California was disbursed. I was given a escrow analysis that did not tell me exactly the total amount of how much was applied towards my principal, interest, and my escrow account. I saw that they misapplied my funds and was told they did by my relationship manager in XX/XX/XXXX and. I got a statement that showed mis-applied payments towards the deferred balance and then applied towards my actual principal payment. It appears they applied XXXX toward my principal. It also showed that it looked like they applied {$4000.00} towards Insurance that took me all the way until XX/XX/XXXX. They were only allowed to pay all of my past due balance. XX/XX/XXXX it showed everything at a XXXX balance. In XX/XX/XXXX I changed my homeowners Insurance and then I got a letter in XX/XX/XXXX showing that they reducing my mortgage payment from {$1500.00} to {$1500.00} as if my mortgage payment never even changed to the {$1200.00} that they sent me documentation that reflected my new payment as of XX/XX/XXXX after receiving the XXXX I was asked in XX/XX/XXXX if I wanted to get assistance with a repayment plan and went a program called mortgage assistance program and it dragged on all the way through XX/XX/XXXX. I had emailed a department to help me find out why this underwriting department kept asking me for the same information I provided them and I could not get it resolved. I also told them they changed my mortgage payment before they were supposed to in XX/XX/XXXX to {$1500.00} again and were trying to back date the increased amount for all my past due payments that were XXXX from XX/XX/XXXX until XX/XX/XXXX. They already adjusted to {$1300.00} that was not supposed to reevaluated until XX/XX/XXXX per my modification agreement. As a result of this email in XX/XX/XXXX SPS they took it upon themselves and did another escrow analysis and I specifcally told them not to change anything but just to have a supervisor call me. I then get a statement that I had a shortage of {$12000.00} because they were now charging my escrow payment of the projected tax amount of the XXXX and the payment they made again for my taxes going to the following year holding me responsible for a year and a half of taxes and insurance and increasing my mortgage payment to {$1800.00}. They changed my mortgage payment 3 times between XX/XX/XXXX through XX/XX/XXXX, again changing my payment prior to when my analysis was stipulated in my modification every year in XXXX to going into effect as of XXXX. SPS and every mortgage company complied with this until they received my XXXX in XX/XX/XXXX and has continued to be problem and out of compliance with the Federal guidelines and also what guidlines that are stipulated on SPS portal. I have been told by a number of SPS reps that they showed that they increased my mortgage payment too early and that they had one system that showed the correct amount and another system that showed the incorrect payment. There has been so much conflicting information and their escrow department seems to think that eveytime they make a payment to pay my taxes for the following year that I am short instead of reeavaluating it yearly to reflect my escrow account for a 12 month calandar year. This is spiriling out of control and to make a change in my payments for XXXX to XXXX in just in 12 months is unethical practices. They tried to tell me from XX/XX/XXXX until XX/XX/XXXX that my mortgage payment was never XXXX. They were asking me to send them documentation to them of what sent to me showing my mortgage payment. Everything I told them they said they had no record and I had to keep emailing these documents to them to correct it. Now there mortgage assistance program said I am not eligible for a repayment plan because of the incorrect mortgage payment of {$1800.00} as of XX/XX/XXXX because they said my income does not reflect that I am able to afford it.

Consumer Complaint: Basically, my mortgage company, Select Portfolio Services, continues to stretch out these loan modification programs, then offer me a payback amount that I clearly can not afford to pay back. They keep saying they're referred my account to an attorney, but are still claiming to help me. They charge all these fees for their " review board '' which makes my payments even higher, they offer me something like {$3000.00} payments, when I couldn't afford the initial payments of {$1500.00}. I explained to them that I had been unemployed for over a year. I really think this company is just a scam. Then they keep offering programs like Short Sales and Foreclosures because their investors will not accept any offers and they're investors are not willing to accept not one payment. It's bad enough the mortgage interest, which they say is normal, is .8 %
