Issue: Trouble during payment process

Consumer Complaint: they didn't properly disclose to me that they were charging me a servicing fee. I paid it on time online and now they are trying to charge me a servicing fee for making a payment online. The amount they state on the first page is the monthly payment amount. It only gets added to the amount they are going to charge on the 2nd page. Furthermore, I tried to cancel it online and they don't have an option to cancel a payment ( it was made on a Sunday ). I tried calling on Sunday before it was processed and they were closed. When I called on Monday ( today ) they said it was already processed and they couldn't do anything about it. The loan servicer gets paid large fees to service the loan. Why do they also need to be shady about charging servicing fees to the people that pay their mortgage?

Issue: Applying for a mortgage or refinancing an existing mortgage
Subissue:
Consumer Complaint: Select Portfolio Servicing is the company that has my mortgage. I purchased this home inXX/XX/XXXX as a sole borrower. The loan was sold to SPS by XXXX XXXX. When the home was purchased I had two mortgages, XX/XX/XXXX. I was able to do a loan modification HARP with XXXX leaving me with one mortgage loan instead of two. After SPS became the services or I experienced job loss, family death, and illness and fell behind in my mortgage. During this time I reached out to SPS for assistance. SPS could never offer me anything other than a short sale as I viewed as homelessness. While I was unemployed and asking for assistance I was told there was nothing that could be done by them to provide assistance to because I was not working. When I became employed and reached out for assistance in regard to the mortgage being delinquent I was advised that they only had programs to assist unemployed borrowers. After getting married and asking for assistance with my spouse with our joined income over 100K SPS advised that my spouse and I did not have enough income to be able to afford a modification, and work out plan. I applied for assistance through other agencies and was able to get assistance. I was rescued through XXXX XXXX XXXX and they provided a XXXX payment to SPS and my mortgage was reinstated. After the mortgage was reinstated and my mortgage was current I applied for a modification again ( XXXX ). I did the application alone with my yearly income being {$61000.00} SPS stated that I was denied because my home was affordable. This was shocking because a few months prior my wife and I were denied with a combined income of XXXX for not being able to afford a workout plan. I spoke with a representative on a recorded line from SPS ombudsman department I asked her about a rate reduction plan, and HARP. She advised that SPS does not offer HARP, and I did not qualify for a rate reduction. She then stated SPS is not the bank and only the servicer, so it is not them its the bank and that I need to speak directly to them. I asked who the bank was and she stated she could not advise that information over the phone. She stated that she would mail that information to me. I have not gotten anything in the mail about this. When SPS was trying to foreclose on the property there was never any mention of any other bank. When the attorney sent mail to my home it always stated the firm represented SPS. Going through modifications with SPS I would call them and ask for status on for example the XXXX of the month, and they would say that its still pending. A few days later I would get mail dated the XXXX of the previous month advising that a decision was made and I was declined. Then after that somewhere around the XXXX I would get another letter stating that SPS is still in the process of making a decision and they are committed to homeownership, and keeping customers in their home. In previous complaints filled by me on SPS I have accused them of racial discrimination and to date this has not changed. I also accused them of neglect and not actually looking to provide the assistance that I am asking for. They don't take the account serious and only having a customer spin wheels sending documents with no intentions of providing assistance.

Consumer Complaint: Select Portfolio Servicing is the company that has my mortgage. I purchased this home in XX/XX/2005 as a sole borrower. I experienced job loss, death, and illness and fell behind in my mortgage. During the entire time SPS turned me down when I reached out for assistance. While I was unemployed and asking for assistance I was told there was nothing that could be done by them to provide assistance to because I was not working. When I became employed and reached out for assistance in regard to the mortgage being delinquent I was advised that they only had programs to assist unemployed borrowers. After getting married and asking for assistance with my spouse with our joined income over XXXX SPS advised that my spouse and I did not have enough income to be able to afford a modification, and work out plan. I was rescued through XXXX XXXX XXXX and they provided a XXXX payment to SPS and my mortgage was reinstated. After the mortgage was reinstated and applying again for assistance with a rate reduction alone with only my income of XXXX per year SPS stated that I can afford this mortgage and that there was no available options. I was quoted a reinstatement amount of XXXX in XX/XX/XXXX that would bring the mortgage current in XX/XX/XXXX. On XX/XX/XXXX SPS received a XXXX check from XXXX XXXX XXXX on my behalf and I would begin making payments in XX/XX/XXXX with a current mortgage. This has turned out to not be accurate because SPS is quoting on the mortgage statement that I owe {$1600.00} in other charges. I speak with SPS often and this amount was never mentioned and I am unsure of where it is coming from. I will attach the last two mortgage statements for your review. In previous complaints filled by me on SPS I have accused them of racial discrimination and with the last statement I am assuming it to be fraud.

Issue: Incorrect information on your report
Subissue: Account information incorrect
Consumer Complaint: Select Portfolio Servicing is not reporting correct information to the credit agencies. SPS is reporting that the mortgage is closed. They are also reporting an incorrect balance. My account is still active and has been current since XX/XX/2018. I spoke with SPS on a recorded line in XXXX they advised that it would begin to report correctly. SPS has since not updated my information with any of the credit agencies. I spoke with SPS on a recorded line again in XX/XX/XXXX and they advised they are not reporting because I have a dismissed bankruptcy, and if I wanted it corrected I would need a reaffirmation document. I reached out to the attorney the represented me in my bankruptcy filing and they advised that reaffirmations are only for chapter XXXX cases. I had chapter XXXX reorganization and they should be reporting accurate information. SPS reported my account as closed and past due inXX/XX/2018. At that time it was the plan of SPS to foreclose on my property. I was able to gain assistance and mortgage reinstatement through a state funded program that paid all of my missed payments. With this complaint I want for SPS to begin to report my mortgage on my reports as active and current dating back to XX/XX/2018. I have filled a previous complaint on SPS because I felt I was a victim of racial discrimination. I still feel this way as evident in their unwillingness to provide assistance during my hardships, and currently by reporting information that destroys my credit rating.

Consumer Complaint: The lender, Select Portfolio Servicing sent a letter out to me after I was denied a loan modification. The letter was dated XX/XX/2018 and had options in which I choose to short sale my home. The letter also stated to have the requested documents back to SPS no later then XX/XX/2018. I sent the signed documents to my agent XXXX XXXX and she sent all of signed docs and listing agreement to the lender on XX/XX/XXXX and XX/XX/2018. My agent then called SPS to make sure the docs had been received and she was told we longer were eligible for a short sale, that my only options were cash for keys or a reinstatement of the account. The letter SPS sent and it is attached, clearly states we had until XX/XX/2018 to get the requested documents in for the process of the short sale. My agent was also told by the reps that the letter is generalized and the options offered expired. How would any consumer know that? Where on this letter does it state my options would be expired before the date they gave me to have all of my documentation in? The letter states to reach out to the lender within 30 days of the date of the letter whish is dated XX/XX/2018, that's not 30 days, we just received the letter last week. I would like for upper management to review this file and letter that they sent to me and I am requesting that I would be allowed to short sale my property to avoid the set foreclosure date they have set. This is a bate and switch for sure, I have never seen any kind of trickery like this ever and it can not possibly be legal, I am seeking legal representation on this matter.

Consumer Complaint: Good evening, our home loan servicer is SPS ( Select portfolio Servicing ). Our insurance claim check was taking applied to our mortgage, without our permission. Then we received our XXXX tax form for the year XX/XX/XXXX from SPS. Box 1 Mortgage interest received from borrower showed XXXX, SPS added the XXXX insurance check to that number. On XX/XX/XXXX I went down the the IRS office in XXXX Mass and asked for a copy of what SPS reported to the IRS in XX/XX/XXXX. We found out that SPS reported XXXX as mortgage Interest received from payer ( XXXX XXXX ) to the IRS for the year of XX/XX/XXXX. This is tax fraud.SPS XXXX to me and what SPS reports to the IRS Should be the same dollar amount. I believe the reason why SPS did this is to make the mortgage securities more marketable. So they can sell the loan for more money. We have never been late on our mortgage payment to SPS. This is a Ponzi scheme. I am asking for SPS to have there licence to operate to be revoked. and no longer do business. We are not going to have a XX/XX/XXXX mortgage event again. I have copies of the XXXX they sent us for XX/XX/XXXX and the XX/XX/XXXX XXXX that was reported to the IRS from SPS. Thank you, XXXX XXXX

Consumer Complaint: This property has been under contract since XX/XX/2018. Select Portfolio Servicing is the only lien holder. SPS is dragging the process out and it appears that every 30 days they are asking for the same document over and over again to prolong the process. Can you please assist in making SPS escalate this file? As stated above, the property has been under contract since XX/XX/2018. SPS has been asking documents on a piece meal manner, deliberately prolonging the whole process. We are risking of losing the buyer with a very very good offer because of this. Thank you for your assistance with this matter.
