Then I received a letter on my email on XX/XX/XXXX saying my complaint was closed because you couldnt contact me because you need more information. Im sorry but I just came back from vacation and couldnt reply to you. I would like you to please open that complaints again because its very important to me. Imagine XXXX XXXX foreclosed on my house even though I filed for a bankruptcy protection agency in XXXX, NJ. I paid about {$77.00} first installment fee for a {$300.00} plus fee. The bank immediately informed the tenants to move away immediately because XXXX XXXX foreclosed the house. They even changed the lock right away so one of my tenants who was on vacation couldnt go inside his apartment when he came back. His belongings were stuck in his apartment. The tenants were calling me to open up the apartment so they could get some clothings and other stuffs but I couldnt do anything because I didnt know who to call then. They locked the front door of the building so nobody couldnt go inside. What a terrible bank is it! I hope you could do something to help me get back my house. If you would go back to your file previously, I did asked for your help three times to help me ask the bank to give me a lower rate or do a modification on my mortgage. But the bank just ignored me until the sad part happened. Is there any chance to file a lawsuit against this horrible bank? Please let me know because right now Im poorer than a rat. PS One of your representatives I talk to last week when I received an email on XX/XX/XXXX regarding my complaint was closed said to file again this complaint separately. Consumer Complaint: Back in XX/XX/2018 I file a complain against Select Portfolio Serving., inc. I explained the situation " Select Portfolio Servicing, Inc. ( SPS ) T is calling us saying that they are ready to send our mortage loan to a lawyer and telling us that they are going to sale our house. We refinance our home back in XXXX of XXXX with a company that closed it doors and transfered our loan to multiple companies in between. We have a current mortage company. Select Portfolio Servicing, Inc. ( SPS ) bougth a loan from XXXX that was paid in full by a company that closed it doors. We have a deed of Trust that show that was returned to us and we transferred to our current mortage company. We have multiple legal documents that show that the mortagage that they are claiming is paid in full. I keep talking to them to prove that the loan was paid in full. The loan was transferred to XXXX XXXX XXXX XXXX and they sold my property in an auction. I know in fact that I paid that loan in full. I don't have a place to go and I can get a new place since their company ruined my credit for many years. I want my house back because I have a home mortgage that I been paying for years to keep my home. This situation could be avoid if they listen and open an investigation on our case years ago.

Consumer Complaint: On XX/XX/XXXX, I made a consolidation loan and/signed a contract for {$92000.00} at 14 % with payoff on XX/XX/XXXX with XXXX XXXX XXXX XXXX ; payments {$1200.00} monthly. I failed to read the fine print that stated full amount was payable if not obtained prior to mature date, which was impossible at a 14 % interest rate. I obtained this loan while on XXXX XXXX, and was told by a VA Representative that I would be able to refinance after a year under this loan and get a VA loan. That might have been true, but not with these folks. Upon doing that, I was informed by a XXXX XXXX XXXX Loan Officer that I was not able to do that, because there was a {$15000.00} penalty in order to be released from the loan before 5 years. I didn't have the funds to complete such transaction. So I remain in the loan. I retired XX/XX/XXXX, in which I was not receiving the same income and the demographic area here does not have jobs that paid nowhere near the same income I was making in the military. So, I fell on hard times and had to submit for assistance. In XXXX, I filed CH XXXX Bankruptcy to keep my home from foreclosure. While in bankruptcy, XX/XX/XXXX, XXXX XXXX XXXX XXXX, extended the loan to another 15 years, making it a 30 year loan still at 14 % because there was still {$85000.00} balance remaining on the loan. It was when I finished bankruptcy in XX/XX/XXXX, that I called their Florida ( FL ) office that I was informed this had happened and I was not informed prior to this. It was then turned over to Select Portfolio Servicing , Inc. ( SPS ) and I did not receive notification until around XXXX of that year and my payments were initially {$490.00} and I was informed by them that I was already four months delinquent. I had been talking to the XXXX FL office and requesting a history of my payments, but I never received them. After a few months, I received a letter that my payments were being increased from {$490.00} to {$1200.00}. I spoke with a manager at SPS, and she informed me the payments were not going up, but they did. I am still paying this loan at 14 % and I just can't find any relief. I had requested a modification and it was approved around XXXX and I was unable to keep those payment dates, because the pay cycle was not during the time payments were to be met. I requested again recently, XX/XX/XXXX, to save my home from foreclosure, again, and was denied. I am raising XXXX grandchildren. This is a home I was raised in, my children, and now my grandchildren. I have no other means. I can't get the interest rate lowered and after 30 years I will have paid over a half XXXX dollars for a {$92000.00} loan. This is predatory lending in the worse form. It was explained to me, the way this loan is written, I would never get out of it and would always have a balloon payment/lump sum at the end. I wish this on no one. Being delinquent, it is impossible to refinance, and I thought I was okay until I found myself in the same situation and it was explained by legal advice I will always be in this place. The current statement states, I am 380 days delinquent, this is over a 5 year period. Anyone looking at this, would assume this is a consistent, delinquency. I was advised, in XXXX, after my payment was not made due to an increase in my home insurance, I was not expecting, caused my account to be overdrawn ; that I was not make any payments, cause my account had been turned over to a lawyer for review. This added to the delinquency and my payments are now over {$1400.00}. I am a veteran who does not want to lose her home, to a bad decision in trusting lenders who were not forthcoming, but knew I would not read the fine print but trust what they were saying and selling. Bottom line my complaint is that I am still held to such a high interest rate, when the rates are low and there is no relief. This loan currently is just a conventional loan for interest only.

Consumer Complaint: I've been getting the run around with Mortgage Companies - I would of not been so worried about this issue except for the fact that I lost a house to a ILLEGAL foreclosure in which XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX XXXX previously took my property by manipulating documents, making false allegations to the Health Dept, Police Dept, Zoning Dept to gain illegal access to my home where it was trashed, items stolen, I was locked out of my attic by deadbolt ( Zoning says they don't do that ), my refrigerator was unplugged and my water line cut during this bogus scheme to force me out of my residence so XXXX, XXXX XXXX XXXX could buy my property at a super deal. This was all proven via INDEPENDENT MORTGAGE REVIEW which ruled in my favor years later after this Urban Development resource ( IMR ) gave judgement to me and ordered XXXX to pay my losses by XX/XX/XXXX ( which I received by XXXX a sum of {$8.00} as " settlement '' for the illegal foreclosure where I lost over {$170000.00} with only owed {$77000.00} balance over {$14000.00} XXXX XXXX XXXX? XXXX XXXX-stated they would be paying ( but didn't ) XXXX XXXX XXXX ( XXXX ) originally had this loan of my residence A DUPLEX - which was ALWAYS A DUPLEX and BOUGHT as a DUPLEX and FINANCED as a DUPLEX - BECAUSE IT WAS A DUPLEX. First during court proceeding to foreclose my XXXX, WI residence ( where I was illegally evicted from my own home ) as the XXXX XXXX, WI property had flooding as did the entire neighborhood by XXXX. In XXXX, wi the day of the foreclosing proceeding I was approached by a process server and summons to court for now my XXXX XXXX, Wi property at the same time- This summons was for a BOGUS claim that I owed the CITY {$8800.00} because I failed to answer orders to paint my house ( or some BS ) - which was DISMISSED by the JUDGE as I could prove the conspiracy ( and IMR agreed as well ) Then XXXX attempted to foreclosure my XXXX XXXX home WHEN I WAS 3 PAYMENTS AHEAD! - That all went through the office of XXXX XXXX - As I wrote XXXX and sent them PROOF I was payments AHEAD and not behind.Then my account was sent to XXXX XXXX for 'Collection'- I sent the $ $ $ $ payment to stop foreclosure- but XXXX, '' accidentally XXXX my money some GUYS account in TEXAS ( I'm in WI ). And did not acknowledge that payment to stop foreclosure on MY house which the money was intended for - so I mailed another $ $ $ $ - to stop the foreclosure - FINALLY XXXX acknowledged the 2nd payment and stopped the foreclosure. But, when the first payment sent to another person was finally found- NOBODY would return to the first payment to me ( even that the second check covered the lack of the first payment- and the intention was not to have BOTH payments to stop a BOGUS foreclosure while I was 3 mortgage payments AHEAD and never behind. Anyway, from my understanding the Feds shut down XXXX XXXX XXXX when they failed to pay my PROPERTY TAXES prior to the end of the year, The money was held in " ESCROW- for that misdirected money '' The mortgage contact specifies I was to be sent the escrow money to pay my property taxes prior to the end of the year ( I report the loss on my taxs! ) - I was assigned a better company to handle my account when XXXX was shut down- However, just before the end of this year ( XX/XX/XXXX XXXX I got a letter that now a company called XXXX XXXX XXXX XXXX XXXX out of UTAH was taking over my account. I received my property taxes this year after a huge fight with XXXX XXXX about them changing my DUPLEX into a XXXX family in XXXX ( so they could force themselves into my house at anytime under the purpose of FIRE INSPECTION of a XXXX family and charge me {$15.00}. a year for that inspection. Last year a Fire Inspector was inspecting the church across the street and advised me he had to inspect my XXXX FAMILY for the first time EVER - I chuckled and proved I had a DUPLEX ( He said not to worry and he would take care of it and have it changed ) - My house was targeted to be " inspected as a XXXX family '' - I remember the reason I went to City Hall in XXXX it was because I wasn't receiving my due LOTTO CREDIT and had not ( unknown to me ) in all the years prior to me going there in XXXX. A younger man in a suit insisted they didn't owe me past XXXX credits- because my taxes were going to a POST OFFICE BOX. I was outraged and since my mail would be taken sometimes at my house I had a mail drop address of XXXX ( so my one address was XXXX and then the second address of my duplex was along the XXXX XXXX. ( corner property ) This young guy must of BACK DATED my building and falsely represent it. Which I found out only when I went to the FIRE DEPT when this year I got another notice where they attempted force themselves in my duplex under the " false pretense of FIRE INSPECTION '' - A man at the fire house ( with a XXXX in a XXXX ) and a XXXX man fireman assisted me in finding what was going on with this bogus intrusion. He attempted to enter XXXX address at my house XXXX nothing came up XXXX - then entered the other address of my duplex ( nothing came up XXXX - then he enter the mail drop in the door and that came up as the address - and that mail box door drop ONLY. Then he looked up the CITY ORDER which falsely had an altered document that my building was always a XXXX FAMILY dated XXXXThe fire department took me off the list at that time. I went to the City Hall and had to make TWO change of address - I took off the mail drop box ( its just a slit in a door- not another apartment ) to satisfy the city - Then I received my taxes - They put back the FIRE INSPECTION FEE and added another from last year! OBVIOUSLY, I need that fraudulent paper looked into. It was made by a OLD person ( most likely dead by now ) not the young guy in a suit in XXXX that argued about giving me my lotto credit. Anyway, back to SPS- they had taken over my loan which CLEARLY stated that my taxes held in a separate account HAD TO BE SENT TO ME BEFORE THE END OF THE YEAR SO I COULD PAY MY TAXES BY THE END OF THE YEAR. I called SPS several times to make sure they were aware of this. The it was a week prior to the end of the year and I asked for a SUPERVISOR - he shouldn't EXACTLY like the supervisor from the closed down XXXX XXXX but, with a different name. He was arrogant, a bully and told me I was a new " client '' and didn't know THEIR rules. ( the law required transfer of mortgage to NOT change any terms of my mortgage ) But, he didn't budge and I had to pay $ $ $ $ for my taxes prior to the end of the year and wait for this Arrogant company to reimburse me because they were negligent in paying my property taxes in a timely manner? I called again - saying I paid my taxes so GIVE ME MY MONEY IN ESCROW NOW! and sent proof of payment via the XXXX # in wisconsin XXXX XXXX in Utah says I couldn't file with them unless i lived in UTAH XXXX The XXXX sent the notice to SPS to return my escrow - but, they didn't they sent me a " DEAR XXXX '' letter instead- mentioning my hardship ( they caused! ) NO CHECK of the escrow they held and they certainly didn't pay my taxes ( I paid two checks one for {$30.00}. to dispute the bogus Fire Inspection fee billed last year and this year ) I never had or had to have. I wrote the XXXX again appalled by the letter without a CHECK ( but I was not acknowledged. Today I received a letter XXXX NO CHECK ) from SPS again. I can't believe these mortgage companies, banks and deliberate fraud in by altering Buildings to obtain my property ( again ) can be tolerated. Being that this XXXX change to my property now is around the same time my house was illegally foreclosed in XXXX scandal

Consumer Complaint: I have been working with Select Servicing Portfolio sinceXX/XX/XXXX to get a loan modification written. I am paying a interest rate of 8+ % on a loan issued by XXXX XXXX XXXX ( closed by the Federal government ). My husband and I have been separated and he is XXXX. I have been honest with the Mortgage Servicer and was given a " loan modification trial '' in XX/XX/XXXX. My payments were adjusted from $ 3700+ monthly to about $ 2300/monthly ( which I am able to make ). the trial ended in XX/XX/XXXX and we received a loan modification packet to be signed by both of us. I contacted our family attorney and he suggested I complete a title search and request new signature pages ... with each signed separate as the modification should be signed and notarized. SPS suggested I sign my husbands name which the attorney refuses. Yesterday I contacted SPS and they said my modification has been withdrawn. I waited for many months for the modification to happen and they are taking it away because of the advise I have taken of our attorney. PLEASE HELP!

We request that Select Portfolio take responsibility for thier vendor 's error in foreclosing on our property based off the wrong sale date given on thier recorded automated system. We request Select Portfolio rescind the sale date of XX/XX/XXXX and honor the sale date of XX/XX/XXXX as given on the vendors recorded messages as follows : XXXX XXXX XXXX has unlawfully foreclosed on our property on XX/XX/XXXX. There were recorded messages on the automated system 's phone numberXXXX givenon thier letter dated XX/XX/XXXX ( attached ) to call for information about postponements. We called this number on XX/XX/XXXX XXXX XXXX & XX/XX/XXXX XXXX XXXX using trustee # XXXX, which hada sale date of XX/XX/XXXX ( attached copy of call log ). We relied on these recorded messages as a time frame in avoiding foreclosure with Select Portfolio and planned to take necessary steps to avoid foreclosure according to the XX/XX/XXXX sales date. Instead XXXX XXXX XXXX has foreclosed on our home on XX/XX/XXXX giving us false information over thier automated system not allowing us to take the necessary actions to avoid foreclosure. We request that XXXX XXXX accept thier error and rescind the foreclosure sale immediately and allow us the proper opportunities needed to take as a consumer by law in order to avoid foreclosure. We request 100 % transparency in these recorded messages with these dates and times given, we request a copy of all the recorded messages from the automated system with these dates and request a copy of all the messages and system data entries from this time frame and around this time frame in order to verify the truth. We called XXXX XXXX on XX/XX/XXXX and spoke with XXXX whom stated there are no records of the XX/XX/XXXX sale date in thier system and that he would look into thier IT department to look for the recorded messages and asked we call back the next business day. We are now relying on thier complete honesty and utmost due diligence in correcting this unlawful foreclosure sale. On XX/XX/XXXX we called XXXX XXXX XXXX back and spoke with XXXX who stated the file is with the sales company/auctioneer and that they have stated they do not have a sale date of XX/XX/XXXX but was not very clear on the findings of the recorded messages in question, she stated there is nothing she can do at this time to rescind the foreclosure. She transferred me to her legal department to see if they can help in anyway. We spoke with XXXX XXXX. Explained the concern and she requested we email the complaint with details to XXXX and she will speak with management to look into this. In addition, in speaking withXXXX and XXXX they both stated that sale dates are only conducted on Tuesday 's and Thursday 's and that XX/XX/XXXX is not on these days ; therefore, question if the recordings reflected such date. To reiterate we called on XX/XX/XXXX XXXX XXXX then we called again to reverify on XX/XX/XXXX XXXX XXXX and confirmed the sale date was XX/XX/XXXX. These dates we called on and listened to thier recorded messages are after XXXX XXXX XXXX last correspondence received by mail dated XX/XX/XXXX ( attached ) which reflects a sale date of XX/XX/XXXX ; therefore, we relied on these recordings as the most recent updated information on the postponement because according to thier letter dated XX/XX/XXXX, which states we can obtain information about postponements by calling the number listed above, it would be giving the most updated information ; hence, we followed thier instructions on thier letter and XX/XX/XXXX was the updated postponement date given. Since the question arises that XX/XX/XXXX is not on thier conducted sale days of Tuesday 's and Thursday 's we would like to mention it is not our fault if thier system had a gliche or human error in entering a date which did not fall on such days, they must honor the date given. Furthermore, when speaking toXXXX at XXXX XXXX she stated that the recorded messages are not from XXXX XXXX XXXX and stated they are handled through the sale company/auctioneer company and that there is nothing she can do as they are not responsible for those recodings. In return we would like to state that XXXX XXXX is liable for any errors thier vendors make ; therefore, XXXX XXXX is responsiblefor giving us this false information and allowing this foreclosure to go through after thier vendor who they directed us to call on thier letter head gave us a date of XX/XX/XXXX and that is the date they should honor by law.

Consumer Complaint: SPS purchased my mortgage from XXXX mortgage a little more than a year ago. Every month I pay more than double the amount do to apply it to my principal. On two occasions ( XX/XX/2019 and XX/XX/2019 ) they have taken the payment as a prepay for the next month and not deducted it from my principal. When I made the next months payment they would accept it as that months payment like normal. They owe me {$500.00} in additional principal reduction for these actions. Additionally they wait until way after my payment is received to process the payment to collect more interest. If I could fire them I would but I am stuck with these thief 's!

Consumer Complaint: I filed a Chap. XXXX Bankruptcy in XXXX and it was discharged in XXXX of XXXX. I then modified a delinquent mortgage with Select Portfolio Services of XXXX XXXX XXXX, Utah. I completed the 3 years of on timely payments and was given a permanent mortgage that I reaffirmed the debt on for this mortgage. The reaffirmation was required by Select Portfolio Servicing in order to obtain the permanent mortgage financing. I have been asking Select Portfolio Servicing to start reporting my mortgage payment to the credit bureaus. Select Portfolio Servicing refuses to honor the Fair Credit Reporting Act and will not report the total of over 4 years of flawless payments to the credit bureaus. This is hurting my credit score and I am trying to get a home loan at this time. The loan number for mortgage is XXXX Phone XXXX. Before filing this complaint I called SPS one last time and I got the same run-a-round as they still ask me to reconfirm the debt which I have done over a year ago. I was put on hold then they hung up without getting back to me. I also have an account with XXXX and their credit card company XXXX XXXX that was kept current. In XXXX I had a bill of {$87.00} and made the {$10.00} payment that they asked. They then reported me as a 30 day late in XXXX XXXX. I called both XXXX and XXXX XXXX. The bank laughed at me as said it was my mistake. When I call XXXX they said I was a good customer and they say the error was theirs and they would send me a letter verifying that they would remove the 30 day late they reported. I called back after a week and was given the run around with no results and no longer do they agree to send the letter or correct my credit report. I find both credit problems to be a violation of the Consumer Protection Act and the Fair Credit Reporting Act. Please help me before my construction loan is stopped and I lose thousands of dollars in money already spent on the property I am trying to build on. Included in this document is the Right to Appeal, in which an error by SPS on the Comps of the XXXX XXXX Subdivision versus the Village of the XXXX Subdivision. There is a {$700.00} per month to {$800.00} per month increase difference in property value. That is a XXXX-XXXX upgrade property difference between The Village of XXXX Sub division and The XXXX XXXX Sub division. SPS Hardships forms were submitted on XX/XX/XXXX. The Trial Modification Plan amount was XXXX. The currents payment was XXXX. That was a Payment increase of {$190.00} per Month on the Loan Modification amount. The Modification is intended to help American but the payment increased. Corrected Comps and a Right to Appeal in The XXXX XXXX Subdivision and Arkansas XXXX County City Property Card for XXXX XXXX Loan # XXXX were submitted again on XX/XX/XXXX. The Error is Comps on a higher price Subdivision like The Village of the XXXX Subdivision versus the XXXX XXXX Subdivision in which SPS took.
