Consumer Complaint: Yesterday XX/XX/XXXX SPS called me while I was at work asking what my intentions were for the property. I informed XXXX I thought XXXX was the one who is supposed to communicate with me since she is my relationship manager. He asked me if I wanted to have XXXX call me back. I told him I thought it was the law and their policy to have relationship manager to contact me. He said it is not their policy, he said nothing about the law. So I talked to XXXX and let him know I would record the call. He said that was OK. He said the account had been referred to an attorney which I knew because they keep setting sheriff sale dates. I told him every time I try and make a payment they send it back unless it's the full amount of $ XXXX. He then told me if I could pay $ XXXX then he could look into reinstating the loan but he couldn't guarantee. This was after I told him about a letter dated XX/XX/XXXX from SPS that said if I pay $ XXXX then they could look into reinstating it. I asked him if he could put the $ XXXX arrangement in writing and he said he could not. He said because there's no guarantee that he could get it done. So honestly, I don't know how much I need to try and scrape up to pay. Is it $ XXXX, $ XXXX $ XXXX. This morning, Saturday XX/XX/XXXX I see a couple stop in front of my house to take pictures. When I went outside they sped off. I then go back and check the XXXX County website and see that their attorney has yet again filed paperwork for another sheriff sale. I asked XXXX yesterday if I happen to win the lottery or even pay off the house who would get the money since XXXX XXXX is only the trustee and they have repeatedly said they are not the owner even in writing and on a 3 way call with SPS back in XX/XX/XXXX. They have repeatedly denied being the owner. I last got a letter from XXXX XXXX stating they are merely the trustee in XX/XX/XXXX. But yet SPS still says they are the owner. And XXXX says that since XXXX XXXX is the trustee then they will distribute the funds to the owners. I asked who are the owners. He couldn't and wouldn't give that information. I said who would get the money since XXXX ( who I assigned the loan with in XXXX right before the housing crisis ) went under and is no longer operating. They keep saying it's the assist backed securities, but their is no proof or trace of my loan in those. They just lumped them and sold them. And XXXX XXXX, SPS ' parent company was in a lawsuit against XXXX XXXX for their misleading practices. XXXX wouldn't not give me the information on who would receive the money from my home. Sounds like a scam to me. He asked me why I needed to know that information and what am I trying to get at. I just told him I was curious at where my money is going. Do I not have the right to know where my money ends up as the person trying to make payments to ultimately own my home? Or is it truly a scam that you preyed on innocent people and they are doomed to lose their home and you all pocket the money? Is it a scam? Why can they not put an agreement in writing? Did SPS try and still my title? Because the assignment that is filed in the court clerks office not accurate and yes, I keep going back to this, it was filed 2 years after it was supposedly dated, 2 years after them losing payments in XXXX and XXXX and trying to foreclose. They realized they couldn't foreclose without having it assigned, so they forged the document and filed it in XX/XX/XXXX. The lady that signed it has agreed to be subpoenaed and say she was never a manager with XXXX. She signed documents and they later filled that portion in. She was a customer service representative. I have no choice at this point other than file for bankruptcy to stay in my home. I am a single mother and need my home. SPS has ruined my credit so much I have no hopes of ever renting or owning a home for several years to come. SPS only apologizes saying they are sorry I wasn't happy with their service. When is the US government going to wake up and see what this company is. They are frauds. They and their parent company XXXX XXXX are always in trouble with the US government for fraud. Their CEO just resigned for spying on people. Something SPS does when they send people to my home to " inspect it '' and then illegally charge {$75.00} for inspection fees. They know I live in the home. And when I ask for their policy they do not submit it and XXXX asked me why would I want that information. Because I have a right and they are violating my rights. Why will they not submit a policy? Why are they allowed to lie to consumers and violate their rights? I am not the only person this has happened to. Read all of the complaints. And just having them reply to these requests and complaints on here does no good. This company needs to be stopped. How many people are they allowed to kick out of their homes even when they try and make payments? Will the government not stop them until another housing crash happens? SPS and XXXX XXXX has lawsuit after lawsuit for violating consumer rights, misleading and questionable practices. They get a slap on the wrist and just like in XXXX say they are supposed to help home owners so they then offer programs but then raise the rates after about another year claiming escrow shortage to almost double the other rates. CFPB I beg you to look into this company further. Check out the Justice Department and their cases against SPS and XXXX XXXX. Consumer after consumer has the same complaints and same stories. This can not be a coincidence.

Consumer Complaint: " I am writing again to reiterate my request for assistance. I really have no where else to turn and can not believe I am being denied help on the basis that the delinquency amount is too high especially considering how many times in the past I attempted to obtain aid. Your response has proven that I am nothing but a number to you and your affiliates. Yes, I see clearly where it was outlined in XXXX and XXXX ( my initial pleas for help ) that your lifeless computers and investors used a formula to determine I was not worth the time, money and effort to assist. I don't care if it was a similar procedure to the one used by the Making Home Affordable Program. I urge you to remember that it was put in place to help people like me. People who where struggling to keep their homes through proof that there was financial hardship ( s ) AND still an ability to make the monthly payments after a potential modification. The current reason for my denial is the delinquency of my account. I understand that, however, this would not be the case had I been approved the first time years ago. I have a way to pay, I just need this chance. This home is my life and I don't want to lose either. As it stands, I already have enough battles with my XXXX. Every time I have another session for a my XXXX, it leaves me completely drained. I am not able to think straight and I can not function like I normally do. This is not an easy process for me. Never did I think in all my years that I might one day have to go through this kind of trial. Everything is being taken from me as my years and health slip by the wayside.

Consumer Complaint: My mortgage was sold to SPS Select Portfolio Servicing ( SPS ), from XXXX. XXXX did alot of unscrupulous things to make my mortgage look more appealing to sell, and give a picture of higher return on the sale of the packages of loans they sold to SPS. Like applying flood insurance to my mortgage, and my mortgage went up by almost {$1500.00}. So I filed a complaint with the Federal Reserve ( Atch A ). When SPS got my mortgage, they saw that I wasn't in a flood plain, and made all the corrected changes, and my mortgage when down to where is was suppose to be. However, by that time, I was over charged by {$9400.00}. SPS sent me a check for {$5300.00}, which was way under what they should have sent me. In response to me filing a complaint with the Federal Reserve ( case # XXXX ), XXXX responded, that they made a " mistake '', and they sent {$1600.00}, to SPS, and I should get the {$1600.00}, from SPS. So when I got my 1098 from SPS, it shows on the 1098 as FHA/MIP, which is fraud because I do not have a FHA loan, and so I don't have FHA MIP. Even before the 1098, every correspondence shows the {$1600.00}. It is my believe that SPS got this money and either wasn't give an explanation for it, or didn't know what it was for and just fraudulently claimed it to be FHA/MIP. Even if I did have a loan that had MIP or PMI, that is not what those funds were for. Therefore, today I called SPS to get my funds and they refused to give them to me, and the person I spoke to would only give me his first name and extension number, and refuse to give me his employee number. I have not missed a payment even though struggling with the almost {$1500.00}, increase imposed by XXXX and carried on by SPS until they finally sent me the for {$5300.00}. I have to admit, I have been late on several occasions but never 30 days of more. One document they have the {$1600.00}, as partial payment, ( of which I have NEVER made a partial payment ), and now on my 1098, it's FHA MIP ( Atch B ). I feel that I have been treated very unfairly, and want my money back. I stated in one of your earlier questions that my loan is conventional. I started out with a Conventional loan, and when the mortgage market crashed in XXXX XXXX time frame, I we almost lost our home, and had to get a modification. This is when our mortgage was with XXXX. So I am not sure how that works for a modification. Please help me to recover my funds. I am attaching several docs that I have from both the Federal reserve and SPS. See Attachments A, B, C

Consumer Complaint: I have repeatedly tried to resolve a negative escrow account problem and all the company has done is raise the monthly payments from ~ {$1200.00} to over ~ {$2800.00}. I can afford to pay my own taxes and insurance as my income has grown from ~ {$75000.00} to ~ {$150000.00}. The company made a modification during the last economic downturn to convert the loan to fixed interest rate and create a note at the end to include past due payments and late payments and fees and negative escrow. My payment went up {$400.00} and then 30 days later went up another {$500.00} and its been going up and up and up since. I have asked repeatedly to contact the services and ask for an exception to allow me to pay my taxes and insurance and remove the escrow they forcibly added through forgery and duress, during my last modification. As I was very insistent on not having an escrow added, because my original loan did not have that. Even though, I was once behind, a Lien for property taxes has never been placed on my property to my knowledge. However, because an employee, whom I spoke to at SPS the loan servicer, thought my taxes were too low, she called the County I live in and influenced them to raise my taxes and subsequently the escrow was raised and became even more out of control, with SPS even charging and adding 3x the actual taxes and insurance to the escrow that was already negative. These manipulative unfair business practices should not be allowed and are a root cause of his {$30000.00} negative escrow. Recently, although my certified housing counselor who has worked with SPS and the current lender have verified that my income is more than sufficient for a modification, SPS repeatedly miscalculates my gross and net income and does not clarify what information they are missing, specifically that will clarify my income properly. Ive asked them to settle the negative escrow amount with me directly in a variety of ways but instead they want to force us into a short sale because I now have equity in my home versus before when it was upside down. However, they are willing to take a shortage from a sale but they would not offer me a settlement directly, as I believe I could reached a settlement amount that was lower on the negative escrow and reinstate the note that was due at the end of my loan. SPS could even sell that note to someone else or sell my loan to someone who buys distressed notes. They do not have to foreclose on me and my children. From XX/XX/XXXX to present I have paid over {$20000.00} and according to Georgia Law, during mitigation attempts especially all payments should go to principal and interest. SPS has misapplied {$13000.00} to fees and negative escrow, knowing this will not mitigate the past due payments as the law directs. SPS has incorrectly reported my loan and note that was added during modification as one account when the note was a sepArate instrument due at the end of my loan modification for over 7 years to credit bureaus and continued to report my account as foreclosed from XX/XX/XXXX when I was not in foreclosure. XXXX and XXXX in particular did not correct this situation and remove the in accurate reports and SPS continues this wrongful act. SPS has dual tracked my loan and modification in numerous ways including putting up for sale and accelerating my note to become due while in modification after my file was completed and during appeal periods.
