Consumer Complaint: My mortgage loan was purchased from XXXX XXXX XXXX by Select Portfolio Servicing XXXX Inc., out of XXXX XXXX XXXX, Utah. I was notified by mail by XXXX, but notification was sent to the wrong address. I contacted XXXX when mortgage money hadn't been taken out of my account ( automatically ) by the end of the month ( due the XXXX ). I was told by XXXX that I had a two month " grace period '' to pay the new mortgage holder. I paid SPS two month 's mortgage, before the XXXX of the month the following month, as it took a week or so to obtain SPS 's mailing address, my new account number, etc. At that time the mortgage payment was {$1500.00}. Before any type of rate hike happened by the Federal Reserve, SPS raised my payment amount to {$1600.00}. When I called SPS for an explanation, I was told it was their prerogative as I had paid my mortgage ( 2 month 's worth ) after the first of the month ( but before the payment was late on the XXXX? ). Moreover, every month upon receiving my statement, SPS indicates that what I owe is {$3200.00} XXXX charging me interest on this larger amount rather than the {$1600.00} - the amount I really owe ). This additional principal balance is what I am being charged interest on, and they add this additional {$1600.00} principal balance on the XXXX of the month - two days before the payment would actually be late. If you look at my monthly statements, although they show this {$3200.00}, there never is any late charges because I am never late paying the mortgage amount of {$1600.00} XXXX which again, should be {$1500.00}, not their arbitrary amount of {$1600.00} XXXX. SPS also attempted to charge me PMI, although this loan is a land loan ( and I also have my own private insurance on the property ). SPS simply won't remove this additional {$1600.00} XXXX for a total of {$3200.00} XXXX from my monthly principal balance owed, and again, are charging me a higher amount of interest each month for this inflated {$3200.00} balance they put on my statement each month. I would appreciate some help in getting my payment amount of {$1500.00} reinstated, and reimbursement for the additional interest amount they are charging me each month by doubling my payment amount on each statement ( again, my payment has never been late ). Further, I want reimbursement for the additional amount that SPS is charging me each month - from the {$1500.00} my payment amount is supposed to be to the arbitrary amount SPS is now charging me of {$1600.00}. Please note, again, at the time SPS raised my payment amount from {$1500.00} to {$1600.00}, there had been no rate hike by the Federal Reserve.

Consumer Complaint: XXXX XXXX XXXX ( SPS XXXX ) is in violation of the CFPB guidelines where they must review 37 days or more prior to a scheduled foreclosure sale. The bank is making up guidelines as they go and are not following the CFPB 37 day rules and regulations. Here is a summary of what happened : Short sale file was submitted with a sale date about 42 days away. After back and forth communication with SPS the short sale was closed out on and we were told the investor wanted 45 days prior to a sale date to review for a short sale. We called investor and they said if its over 37 days they will review for a short sale. SPS is making up their own rules as they go and this is unfair to me and many other customers. Currently SPS won't review for my short sale. I am doing a short sale to save my credit and leave my home with dignity and to do the right thing. The offer is 95 % of the bank 's current appraised value. There is no reason SPS should be doing this.

Consumer Complaint: There is no contract between SELECT PORTFOLIO SERVICING, INC. or XXXX XXXX XXXX, XXXX. and me. I have been writing them informing them of this fact, but it has been ignored. I have written over 50 letters and sent them certified mail. The company has not addressed this issue. I sent a payoff of the account on XX/XX/XXXX. The company SELECT PORTFOLIO SERVICING , INC. accelerated the loan and added additional fines and fees. I submitted the accelerated amount of payment as well on XX/XX/XXXX. SELECT PORTFOLIO SERVICING, INC. received copies of the payment receipts, but is ignoring them. SELECT PORTFOLIO SERVICING, INCXXXX and XXXX XXXX XXXX XXXX XXXX XXXX XXXX . is criminally attempting to sell my private homestead. I had to file Bankruptcy on XX/XX/XXXX in order to stop their criminal attempts. The Bankruptcy case number is XXXX. In addition, I have reviewed information sent to me by SELECT PORTFOLIO SERVICING , INC., and it appears that they have committed forgery in some of the documentation. I have filed a lawsuit, Case XXXX XXXX, on XX/XX/XXXX. These are the statements of claim listed : All Defendants involved are attempting to steal the Property and Assets using Deed Theft. They are currently benefiting from the so-called " Mortgage '' via servicing and pooling agreements amounting to billions/trillions of dollarsfollow the money. What all defendants are calling a " Mortgage '' is in fact a future lease purchase tenancy agreement under conditions of non-disclosure and usury. See attached Declaration of Flag Document Page 16. Fraud on the Court for the use of invalid instruments. There is no valid contract in place and there is not a wet-ink signature of the original note that anyone has been able to produce. If there is no note - there is no contract. There is no original note because some PERSON destroyed the note along the way. This is typically done by the title company. See attached flowchart show the current mortgage process. The so-called " Mortgage '' or " Loan '' was paid in full from the Cestui Que Vie Estate Trust at the point of origination. This was never disclosed to me. SELECT PORTFOLIO SERVICING , INC . DEED FRAUD/SIGNATURE FRAUD/NOTARY FRAUD - Continual tampering with the so-called deed and so-called note with each notice : addition of a notary fraudulent notary signature, removal of a notary signature, addition of a copy of the allonge, removal of the copy of an allonge, etc. No original wet ink document was provided only copies of copies. XXXX XXXX XXXX XXXX. inserted an Allonge at some point that was not in previous versions of their copies of the so-called Deed and so-called Note. It does not match the integrity of the copy and appears to be a stand-alone document, not attached in any way or even in the same format. There is also no date on the signature of the Allonge. No original wet ink document was provided only copies of copies. XXXX XXXX XXXX, XXXX tampering with the so-called deed and so-called note : presenting different versions of the copies never an original wet ink document. XXXX XXXX XXXX, through the use of semantic deceit and CORPORATE name changes, was paid from the CQV Trust on multiple occasions for each CORPORATE name change. Semantic Deceit and violation of copyright in the use of my Names : XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX XXXX and XXXX XXXX ; and NAMES : XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX. Violation of the Fair Debt Collection Act for ignoring relevant information and responding with boiler plate responses in some cases repeatedly to the point of harassment. Constructive Fraud. Failure to acknowledge a valid payment. XXXX never admit it or made any effort to correct their mistake by doing the right thing and fixing my monthly mortgage payment did the amount that I am legally supposed to pay. I have evidence of registered letter and making phone calls to XXXX XXXX and filing a complaint regarding my case with the consumer Financial Protection Bureau asking XXXX to please make correction to my monthly mortgage. All my phone calls were ignored and my letters that I send certified mail was not acknowledged. ( Responding back to Consumer Financial Protection Bureau XXXX XXXX clearly stated that my property value is XXXX dollar or more and I am legally obligated to pay {$4300.00} XXXX and they are not willing to make any correction in what there are reporting to Consumer reporting agency is also correct. ) I am providing XXXX XXXX and Select Portfolio Services with the documents that I have from XXXX County and the statements that I printed from the website of Select Portfolio Services and XXXX XXXX servicer as evidence the XXXX was dealing with me unfairly and I was right all along I had a document from XXXX County saying that my property value is only {$800000.00} in my exemption is {$7000.00} so that brings down the value of my property not up.

Consumer Complaint: I received undated Annual PMI Mortgage Notice to Mortgagor ( copy enclosed ) from my mortgage company Select Portfolio Servicing Inc. and called them whether my PMI can be cancelled. After my call, the company sent letter dated XX/XX/2019 ( copy enclosed ) that my LTOV dropped down to 64.60 %. As per annual PMI Notice my PMI should have been cancelled automatically when my loan reached 78 %. The company did not cancell till I submitted complain to CFPB on XX/XX/2019. At the same complain I wanted to refund the PMI I paid from the month loan reached 78 % as the PMI was not cancelled automatically. The company only cancelled the PMI.
