SPS is a mortgage servicer and the servicing of your account was transferred to SPS on XX/XX/XXXX. We have enclosed a copy of the Notice of Servicing Transfer evidencing this transfer. As a servicer, we service the account according to the terms of the XXXX XXXX XXXX Equity Maximizer Agreement and Disclosure Statement ( Note ) and Deed of Trust. Please find enclosed a copy of the Note and Deed of Trust that were signed by you during the origination. Please note, for additional clarification, that SPS services the second lien on the subject property. We do not service the first lien referenced in your inquiry. Consumer Complaint: My mortgage is with SPS Select Portfolio Servicing.XXXX XXXX, XXXX XXXX XXXX, UT XXXX I am set up for Bi-Monthly autopay withdrawals from my bank account. I received a statement showing no payments since XX/XX/XXXX which means I'm close to two months behind and being charged late fees. When calling SPS customer service the agent DID see I was still active on their autopay program and had no idea what the problem was. I was put on hold several times until we hit 30 minutes and still no resolve. I requested the late fee removed since this error falls on SPS and a resolution ASAP before my credit is affected. The agent, days later never got back to me and this problem should be resolved within minutes. I checked the XXXX and saw pages of complaints regarding SPS and some were exactly like mine stating some customers could not get assistance or return calls. I could send you that link if needed. I have not heard from their ombudsman either and when I called customer service minutes ago they knew nothing about my case but again I was told they would get back to me. I never wanted this mortgage company but after a recent RE-FI, the mortgage was sold my mortgage so I had no control of the situation. Until XX/XX/XXXX, at this time I owe {$2900.00} which includes penalties. I should be paying {$720.00} every two weeks but due to their error, the amount is adding quickly and also affecting the amount of interest paid. Even if or when this is rectified I fear more problems with this company in years to come if something this simple can not be resolved easily.

Consumer Complaint: I have been in my home for over 15 years and I want to keep my property. There has been a lot of confusion and miscommunication that have left me now in the edge of loosing my home. The mortgage company has made modification on my property and I have been making payments but there was a balance due that has been carry thru the years. This amount was accumulated when I lost my job and I have tried to pay it off thru payments plan but the mortgage drop me from the payment plan because I file XXXX XXXX for my Home owners association. I just need help to keep my home. I have a full time job and my mother and son also contribute towards my overall payment. I can afford to pay and I am willing to pay it just that the lender tells me we drop you we are not going to take your payment then when I stop paying they call me and say, you are behind and need to pay. I has been very confusing dealing with this Lender. Now they don't want to work with me they want me to short sell or give up my property, but I have been here for over 15 years and have been making payment. My payment history shows I have been making payments until they, the lender told me that I was no longer in the payment plan and told me to go to their website to request a new refinance and that what has made this worse now. I just want to continue paying to keep my HOME.

Consumer Complaint: I have requested mortgage assistance with my servicer Select Port Folio, my request is being processed. Received letter from foreclosure attorney dated XXXX XXXX XXXX XXXX stating a property foreclosure sale is set for XXXX. State of Tennessee requires the homeowner to receive notice of foreclosure sale 30 days prior to the sale date per Tennessee Code Annotated. Didn't receive letter until XXXX that is not the required 30 day notice. Did not received letter stating the mortgage debt is being accelerated from my mortgage company or the amount of the mortgage debt. from mortgage company or foreclosure attorney. Select Port Folio sent me correspondence stating a property foreclosure sale WOULD NOT be set for my home while they were processing my request for mortgage modification. Please Help See Attachments

And, the name OF THE NEW COMPANY MANAGEMENT MY HOME LOAN is S.P.S : Select Portfolio Servicing , INC . I paid in advance the home insurance of XXXX : I did the payment in XXXX XX/XX/XXXX : {$1200.00} to cover XXXX full home insurance year. I wait for the insurance refund and finally with the last four monthly loan payments, I wrote to S.P.S REQUESTING FOR MY REFUND OF $ XXXX, AND STILL WITHOUT RECEIVED MY REFUND. I send the refund requested via certified mails : XX/XX/XXXX : Certified mail # : XXXX XXXX XXXX XXXX XXXX XX/XX/XXXX : XXXX XXXX XXXX XXXX XXXX XX/XX/XXXX : XXXX XXXX XXXX XXXX XXXX XX/XX/XXXX : XXXX XXXX XXXX XXXX XXXX In addition in the tax information they report the payment of that amount, also the insurance company of the home : XXXX XXXX XXXX send me and sent it to S.P.S THE RECEIVED WHEN I did the payment. I have been waiting more than a year, and S.P.S STILL WITHOUT SEND ME THE REFUND.

Issue: Struggling to pay mortgage

Consumer Complaint: The homeowner has been trying to get a loan modification since XX/XX/XXXX. During this time from XX/XX/XXXX XXXX. Mr. XXXX from the origination of XXXX XXXX in XXXX to previous current XXXX XXXX XXXX XX/XX/XXXX to currently XXXX XXXX XXXX XXXX applied to modify this mortgage, all lenders never followed through. There have been 5 lender companies starting with XXXX XXXX, XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX XXXX to XXXX XXXX XXXX currently. Each of these five lenders was convicted of mortgage fraud violations. Each lender put the homeowner into an imminent failure scenario, failed to process the loss mitigation application in a timely manner. Each lender is obligated to continue the loss mitigation process when the mortgage assets are acquired from a previous lender. The continued loan mitigation process did not happen and discriminated against homeowner 's mortgage. These failures favored the lenders and denied the owner just process under federal law. On XX/XX/XXXX XXXX XXXX XXXX was convicted of Diversion of loan proceeds, Negligent Entrustment, Deceptive Trade practices and fraud deceptive practices in violation of the RICO Act. Shortly afterward starting in XX/XX/XXXX to XX/XX/XXXX XXXX XXXX XXXX acquired the loan and in one year time, nine principles of the company were convicted of mortgage fraud violations. During this time the homeowner was in the process of a loan modification that never was completed by the lender ceasing operations. Currently, XXXX XXXX XXXX acquired the mortgage XX/XX/XXXX to current. The homeowner was to continue the loan modification process. The owner XXXX XXXX repeatedly contacted the lender to complete the loan modification under federal HAMP program loss mitigation. The owner provided various times copies of the application with supporting documents only to be told the document was lost, resubmit. XXXX resubmitted several times with no results. The homeowner now finds himself in a foreclosure proceeding from the new processor SPS Servicing. I have tried many times to call SPS, was put on hold for extended periods : then hung up : I was never able to talk to anyone. A new Statement of Foreclosure was sent to a homeowner of XX/XX/XXXX. The homeowner is seeking a loss mitigation workout solution and options. The homeowner has ordered a XXXX XXXX XXXX that will show evidence that the following possible violations exist : 1. Broken chain of title. 2. No just standing 3. Gross fragmentation of the note to XXXX XXXX. 4. Failure to process the requested Loan Mitigation application. The homeowners will produce a XXXX audit in process in XXXX, XXXX. The homeowner is seeking a Loss Mitigation process workout solution. The Homeowner alleges the following investor, Master Trustee, and servicers ; most likely know of the broken title and no just standing : but started the foreclosure process without just standing. This CFPB complaint includes : 1. LACK OF STANDING TO FORECLOSE ; 2. FRAUD IN THE CONCEALMENT ; 3. FRAUD IN THE INDUCEMENT ; 4. INTENTIONAL INFLICTION OF EMOTIONAL DISTRESS ; 5. QUIET TITLE ; 6. SLANDER OF TITLE ; 7. DECLARATORY RELIEF ; 8. VIOLATIONS OF TILA ; 9. VIOLATIONS OF RESPA ; 10. RESCISSION. 11. Violation of the RICO ACT. 12. I tried to contact the loss mitigation, no answer lines busy.

Issue: Problem with a credit reporting company's investigation into an existing problem

Consumer Complaint: I bought a building lot in XX/XX/XXXX-XX/XX/XXXXand financed through XXXX XXXX. After XXXX, XXXX XXXX XXXXXXXX took over the loan as they took over XXXX XXXX. In XXXX, XXXX XXXX XXXXXXXX reached out to me and asked if I wanted to change my loan to an adjustable with a cap and a 30 year loan. I said yes as long as it didn't impair my credit. I was up to date on payments, actually made greater than minimum payments and early. XXXX XXXX XXXXXXXX processed the interest rate modification and everything was fine. In XXXX of XXXX, SPS, an incompetent and horrible group, took over servicing of the account. After trying to charge me homeowners for a vacant building lot and 10 plus phone calls and that being resolved, I got a copy of my credit report and it showed that SPS was now reporting that I had a loan modification, not a loan rate adjustment and which did NOT involve a compromise. I've called SPS 20 plus times. I called XXXX multiple times to correct this. They reached out to SPS who refuses to adjust their reporting even though there has been supporting documents from XXXX stating there wasn't compromise and they are solely reporting this on my credit incorrectly. This is a horrible company, SPS, and shouldn't have a license as incompetent as they are. XXXX XXXX XXXXXXXX has cost me incredible amounts of aggravation, stress and loss of valuable time by out sourcing my loan and this should be illegal or people like myself should be compensated for this type of issue. I am a financial advisor and protection of my license is foremost, something like this endangers my livelihood.

Consumer Complaint: First, I am again for the 11th time ( 1st complaint # XXXX XX/XX/XXXX, 2nd complaint # XXXX XX/XX/XXXX, 3rd complaint # XXXX XX/XX/XXXX, 4th complaint # XXXX XX/XX/XXXX, 5th complaint # XXXX XX/XX/XXXX, 6th complaint # XXXX XX/XX/XXXX, 7th complaint # XXXX XX/XX/XXXX, 8th complaint # XXXX XX/XX/XXXX, 9th complaint # XXXX XX/XX/XXXX, 10th complaint # XXXX XX/XX/XXXX ), writing CFPB because of the BULLYING tactics of Select Portfolio Servicing , inc . In the last writing to CFPB I wrote about the ERRONEOUS AND INTENTIONAL MULTIPLE POSTINGS OF NONPAYMENTS to my account. I have not missed a payment since the beginning of a forced into and account transfer of my account to Select Portfolio Servicing , inc . THE RESULT, THROUGH CFPB, OF THE LAST SET OF HARASSMENT WERE SELECT PORTFOLIO SERVICING, INC. CORRECTIONS MADE TO MY ACCOUNT. Again, I have not missed one payment since Select Portfolio Servicing, inc. corrected my account ( NOT COMPLETELY CORRECTED ), and I have continued and consistent proof. With that noted, Select Portfolio Servicing, from the date of said corrections, has added erroneous multiple months of no payments to my account, as I pay each month. Select Portfolio Servicing is again for the 11th time using the same bullying and harassing tactics, with a letter of default and placing blatant notes on the door of my property. They have ignored the corrections and are again threatening me with these same bullying tactics to FORCE me to refinance with them or sell my home! Second, my interest rate has not decreased since I began this loan .... I am called constantly and asked the question, " Why my interest rate is so high when the current interest rate is lower and/or why has this company not offered me the current or a reduced rate. ''
