Issue: Closing on a mortgage
Subissue:
Consumer Complaint: I had a conventional, and what I believe to have been a gov backed mortgage or XXXX with XXXX from XXXX, loan number XXXX. In XXXX, because of health issues, I had to file for chapter XXXX, but re-affirmed my mortgage, and my payments continued, and never missing a payment. The information and payments continued to show in my credit report. In XXXX, 7 years later, my new loan servicer was Select Portfolio Services. ( SPS ) account # XXXX, and I have been making payments to them, never missing a payment. However, these payments did not show on my credit report. I have been trying to determine if my new mortgage is still backed by the fed, or XXXX. I have contacted SPS, they said no, it wasnt in the screen as backed, but I am almost sure it was with XXXX, so if the loan terms on the conventional loan from XXXX should legally be transferred to SPS, what happened? Because of COVID-19, I am looking into this loan, and now quite nervous of its handling. Recently, I asked for a copy of the re-affirmation documents, and SPS said they didnt have them. SPS : XXXX XXXX XXXX XXXX

Consumer Complaint: This is the 9th Complaint against Select Portfolio Servicing ( SPS ) and its Principals via CFPB and Comptroller of Currency ( COC ). SPS refused ( a ) to respond to all elements in my First Qualified Written Request ( QWR ) under RESPA and ( b ) refused to mail Monthly Mortgage Statement - engaging in fraudulent misplacement of my mortgage payments, since XX/XX/2020. Now, at the end, it requies a Federal Lawsuit. There are over 10,000 internet complaints against SPS and its principals and I request that CFPB investigate and sues SPS-RICO organization for its massive criminal acts and fraud.

My original mortgage was a fixed rate mortgage and it somehow was changed to a variable rate.

Consumer Complaint: XXXX was my servicing company prior to Select Portfolio Servicing Inc., I've called them on several occasions to provide me an explanation of my amortization not amortizing correctly. My issue is that approximately XXXX cents to {$1.00} is going towards my principal. I was told at one point that everything will come together upon the end of the contract which is in XX/XX/2036. I don't see that happening based on the loan not amortizing appropriately. SPS has all documents.

Consumer Complaint: After placing a prior complaint on XX/XX/2020 regarding this matter, I received a call from the odsbudman at the corporate office of SPServicing on my home phone. I spoke with XXXX and I explained that I needed to extend the original 90 day forebearance to an additional 90 days as stated in the Cares Act. XXXX explained that I needed to take a survey to see if Im qualified. XXXX confirmed that I will need financial records on hand to qualifiy. XXXX explained that I dont fall under the Cares Act as my loan is not federally backed. I asked XXXX how did that change as all my original loan documents says the loan is federally backed. XXXX would not answer and just kept asking me to complete the survey. My loan has been trasferred several times. Since Select Portfolio Servicing is the gate keeper to the mortgage company, I had no idea who is the owner of my loan. The last correspondence I received was from XXXX XXXX just after signing an agreement to recast the loan and that SPServicing would be the service provider. All orignial terms of the original loan were still in place. XXXX would not provide me the information over the phone, XXXX said he would mail it to me. I received the document. The Loan holder is listed as XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX. Long an behold XXXX XXXX is the actual holder. The document also states that the account ownership status may change from time to time. Will I be notified or is this a behind the scenes event? The XXXX XXXX website says they are offering 180 days of forebearance. How did the federally backed loan change to a non federally back loan. I feel like Im being taken advantage of and being strong armed. SPServicing is not forth coming with information in a timely fashion nor was I ever notified that my loan was transferred from XXXX to XXXX XXXX. I am receiving emails from SPServicing claiming they have attempted to call me on XX/XX/2020. My last Call from SPServicing was on XX/XX/2020 ( XXXX ). No call, message or call ID left. Thank you for your time in this urgent matter.

Consumer Complaint: Respectfully, the purpose of this complaint is to have CFPB investigate XXXX XXXX XXXX-based Select Portfolio Servicing online mortage payment system should it be revealed that other consumers within XXXX, or nationwide were similary negatively impacted. In XXXX our family was unable to fully benefit from our CARES Act Economic Impact Payment that was directly deposited into our banking account. SPS 's online payment system automatically defaulted and deducted {$2300.00} from our account, while I was attempting a prinicipal and interest only payment of {$960.00}. This is the second time that SPS 's online system defaulted on a payment beyond my intended payment. The online payment system double charged us for two mortage payments totalling {$2600.00} on XX/XX/2019 as well. Please refer to documentation attached in Step # 3.

Subissue: Public record information inaccurate
Consumer Complaint: Hello. My husband filed for bankruptcy which was discharged on XX/XX/XXXX. This was NOT a JOINT bankruptcy and our home was not included in the bankruptcy. My name was not included in this bankruptcy in any way, shape, or form. A mortgage servicing company called SPS Select Mortgage Servicing acquired our mortgage in the fall of XXXX. We had previously been with XXXX XXXX. When checking both of our credit reports, I noticed that our mortgage was not listed. I have contacted SPS and have receieved information from then that my husband did not have a reaffirmation agreement with them so this has not only affected his credit but my credit as well. I am co-owner of this property and I was not and am not included in this bankruptcy from 11 years ago. I have spoken with my attorney who advised me to file a complaint about this as this mortgage should be on my credit report.
