Consumer Complaint: I called SPS Servicing mid XXXX about the payments for XXXX and XXXX we're having trouble with on my rental property my son lives in. We've both been impacted by Covid with reduced income, but his employment and income was almost stopped because of the Covid virus impact. I told them I wanted to do a forbearance for the payments for the next 6 months as he's getting income coming in now, but will take time to catch up. I asked them to send me the paperwork to complete for the process, and they said they would. NO one told me the paperwork was on their website, I waited for it to come in the mail. When I got many letters from them, none contained the paperwork to complete, but one was the NOTICE OF DEFAULT! This is the start of the foreclosure process, which the CARES ACT was to keep lenders from starting until XX/XX/XXXX per the federal law. I was upset to say the least that I received NO paperwork on requesting help, but a NOD! Since I thought, the request maybe handled online, I went online XX/XX/XXXX, and completed the request for forbearance online. I called XX/XX/XXXX and talked to several people ( although wouldn't transfer me to my relationship manager single point of contact ), and they told me they have no application showing my request. Even though I got a confirmation email the request was received ( attached ). Apparently there is a link that says, 'having trouble due to Covid ', and I needed to fill out that request and not the one that said - need payment assistance. I was not able to complete it as it said I have an application in the system. In all the letters they sent me, I received a letter that I have a relationship manager, but they would not forward me to him. The person told me she reset the system so in 15 minutes I would be able to complete the COVID forbearance information. I tried several times, and I can not get the application I already completed with income and reasons for issue. My fear is this house has a lot of equity, {$150000.00} ; and the mortgage company is not going to cooperate with this forbearance request. If they start to add on the foreclosure costs, I will not be able to catch up the payments and their MASSIVE foreclosure fees. I can not get the relationship manager to talk to me, and I'll be bounced around until the loan is not cured and foreclosure will move to sheriff sale and all the fees involved. We are now 3 payments due and will be making one payment this month, and should be caught up by end of XXXX, worst case XXXX.

Consumer Complaint: In XXXX I called Select Portfolio Services to ask about the 90 day forbearance and was told that I could have it but that I would have to pay it back in a balloon payment and I asked her, how does that help anyone. She said it's up to the lender, and if they don't get the payment, THEY would start foreclosure proceedings. So I asked, Why would you be doing anything?, your not the owner. All I got was silence, so I requested to know who the owner was and that where the run around started. They couldn't tell me on the phone, their system was down, I'd have to call back, until I got XXXX and demanded it be sent in the mail. I finally received a letter that stated it was XXXX XXXX XXXX, as Trustee, for Park XXXX XXXX XXXX XXXX . Asset- Backed Pass Through Certificates, Series XXXX is the owner of the account. So now I call XXXX XXXX and they can find my account number but it is not me, my property or even in my state. They send me to their investigative department to open up a inquiry and give me the investigation number and tell me to retain counsel. That same day I call the local deeds office and find out that I got a Full release of Lien from the Tennessee Housing Development in XXXX and then a lien from XXXX XXXX by an attorney name XXXX XXXX XXXX sent by SPS in XXXX of the same year XXXX. So now I call XXXX XXXX back and they open up another investigation because they did not do it. So then I talk to XXXX XXXX XXXX and was told that they SOLD my loan to SPS, and I have called them twice just to be sure they said SOLD, not assigned. The reason I had to make sure is because I made a compliant with XXXX of Utah and they produced an assignment they got from XXXX and they said they were the servicer of the account, so I called XXXX back to make sure they meant SOLD and they said yes, and I asked for them to send everything they have in their system regarding my account, contracts, lien, release of lien, everything. So now I am asking myself, why if they own it, can't they just tell the truth. So I think it's because they are a collection agency and don't have the license to own mortgages, so I request information from the State of Tennessee and find out that their license has been expired since XXXX. My son found a case on XXXX XXXX XXXX, as Trustee, for XXXX XXXX XXXX XXXX XXXX Asset-Backed Pass Through Certificates, series XXXX, but what was left off my letter was BY SELECT PORTFOLIO XXXXERVICES . Which means that they are the owners, as XXXX XXXX XXXX said they were, so now why lie? My son found a pooling agreement written in XX/XX/XXXX on sec.gov/Archives called XXXX. Which states everyone 's responsibility to the agreement and at the end prohibits involved in the agreement from owning Trust because it is against XXXX. So then I go to the U.S.Labor Department for the law, and learn that it is a conflict of interest. They must avoid conflicts of interest, in other words, they may not engage in transactions on behalf of the plan that benefits parties related to the plan, such as other fiduciaries, service providers, or the plan sponsor. If they breach this law, the courts may take action against them that carries a 10 year term in jail and a {$500000.00} fine. So if XXXX XXXX says that they don't have my account, why is their a fraudulent lien on my home from XXXX XXXX XXXX sent by SPS? Right after I received a full release of deed? If the People that said they sold it to SPS, which was XXXX? Why is there a lien from XXXX XXXX, that they know nothing about? Because SPS is the owners, they just can't tell you that cause it's against the law. That's what I believe they are afraid of, and why they can't allow anyone to know that they own Trust. Then last week I receive a letter from XXXX XXXX, XXXX XXXX in the Research and Analyst office that they found my loan in another Trust, XXXX XXXX, XXXX, as Trustee of the securitization trust. It hold legal title to my XXXX mortgage. She is forwarding my concern related to the loan to the servicer of the mortgage SPS, as the appropriate party to receive and respond to this type of request. I call XXXX XXXX later that night, to get XXXX XXXX phone number, and get on their web page as I am waiting for an operator to answer my call, and type in her name, and when the page goes back to the home page, a username and a password comes up for me. A username that I have used before, so now I am paralyzed because I was already told by one of the investigative agent name XXXX XXXX that I have never had any loan with XXXX XXXX. Not a car loan, a credit card, nothing, so how is my information in their system. An agent comes on the line. XXXX, and now the account number can't be found at all. It doesn't exist. So I tell her that I am looking at my information in their system and I have never had a loan with XXXX XXXX and she is so out done, that she say 's she would be in tears at this point. So now I am waiting to find out what XXXX XXXX finds, and still going back and forth with SPS through the BBB of Utah. But one thing I know for sure, SPS is the owner, because since XXXX, they have been the only one on everything, My interest tax statement comes from them, with their name on it, XXXX XXXX has them listed, my homeowner policy has them listed as the owners? So if it looks like a duck and quacks like a duck, It's a duck. They are breaking XXXX and hiding behind other lenders as to not take responsibility for their fraud? The ironic thing is, XXXX XXXX is being sued right this moment for giving out 90 day forbearances to people that didn't request them, so they could get the {$500.00} to {$1000.00} from the government. So I find it funny that the people that are suppose to own mine, wouldn't give me one. Ironic? I have 2 other people that are having the same problem, except one has a loan that was written by American Wholesale Lenders in XXXX. They were found to be fraudulent and all loans deemed null and void by the courts. They didn't have licenses or were they incorporated. They didn't even come to court. So if all those loans were voided, how has she been paying SPS since XXXX? But they all have one thing in common, they were written through XXXX, bought by XXXX, and sold to SPS. Consumer Complaint: Congress passed the CARES ACT in response to COVID-19 Pandemic to help consumers with issues that may arise from becoming ill or financially burdened effecting there ability to make there financial obligations on time and effecting there households adversely. I became sick due to COVID-19 during the month of XXXX and was ill for weeks, during my illness I thought I paid my mortgage payment. I went through all the steps but the payment did not go through I was in XXXX XXXX, XXXX XXXX, XXXX XXXX XXXX XXXX XXXX because of pandemic, I payed my XXXX mortgage payment and assumed I was up to date with payments, I was contacted and made aware that a past 30 day derogatory mark was made on my credit report affecting me adversely, I contacted my mortgage company SELECT PORTFOLIO SERVICING and they informed that I didnt make the payment for XXXX and I still owed XXXX, I checked my bank statements and realized it wasnt paid, I quickly brung account to good standing. I explained to SELECT PORTFOLIO SERVICING what happened and asked if they could make a one time exception and remove 30 day derogatory mark from my credit report and they are currently refusing and taking GREAT pride in ruining my exceptional credit history, which is partly why the CARES ACT was drafted. I have not been over 30 days late on any of my payments for any company that I make payments to especially SELECT PORTFOLIO SERVICING, As I stated earlier they are refusing to remove the derogatory mark from credit report even though Ive never been pass 30 days late, We are in a exceptional time in history with people falling ill and some passing way due to COVID-19 and for SELECT PORTFOLIO SERVICING not taking these times into consideration is Egregious to say the least. During these times of uncertainty the CARES ACT was drafted to make accommodations for borrowers.These accommodations will help Americans and the economy because we rely on credit. The Act requires lenders to report to credit bureaus that consumers are current on their loans if consumers have sought relief from their lenders due to the pandemic. The Bureaus statement informs lenders they must comply with the CARES Act. The Bureaus statement also encourages lenders to continue to voluntarily provide payment relief to consumers.

Consumer Complaint: under previous case XXXX we attempted to seek assistance under the CARES act ( Section 4022 of the Act provides that a borrower experiencing financial hardship due to the COVID-19 pandemic can request forbearance for a federally backed mortgage loan regardless of delinquency status ) I was informed that the loan was not covered under the act see response under previous case ( attached as exhibit ) There response clearly stated that this was " not '' a federally backed loan and that a balloon payment was necessary at that time in the amount of {$5600.00}. I had to borrow the funds to bring the account current to avoid being foreclosed on, based on the response they provided myself, as well as, the oversite agency responsible for protecting me the consumer. Today, I received correspondence contrary to the previous case stating that the loan is in fact covered under the CARES act. ( Attached as exhibit ) Select Portfolio Servicing is in direct violation of the CARES Act and directives from the XXXX XXXX XXXX XXXX in the previous response and result.

Consumer Complaint: As a first time home-buyer, I purchased a house, about 15 years ago, that I was renting. As a young single mother, I was unaware of the home buying process and was a great target for a predatory loan. All of the purchasing processes were handled by the homeowner. She was a realtor and she assured me that the company she was using was one she had used in the past. The original lender was XXXX XXXX XXXX and it was a variable mortgage, whereas the interest was not suppose to exceed 6 %. Since then the mortgage was sold to another company, Select Portfolio Servicing, and the interest rate has exceeded the 6 %. I have attempted to pay more towards my principal and specifically instructed the funds to go to my principal. When I received my statement, the funds were applied to some erroneous late fees that XXXX XXXX XXXX stated were owed before the mortgage was sold to SPS. In reviewing my 1098 from SPS, I was appalled to see that I have paid {$4400.00} to interest and {$810.00} to principal. In addition, I received a 1098 from XXXX XXXX XXXX stating I, also, paid interest to them in 2019 ( {$750.00} ).XXXXI believe this sort of loan and practice should be reviewed and reversed as it has robbed me, and others like me, the real opportunity of ever actually owning a home. I have struggled over these 15 years to pay my mortgage believing I was moving closer to actually owning it and passing it down to my children. This appears to be a false reality that has been nothing less than a major scam and profit for these mortgage companies.

Consumer Complaint: After filing complaint # XXXX earlier today, I looked at my old records. With XXXXXXXX XXXX it was in fact a XXXX instrument starting in XX/XX/XXXX. I couldnt find a a way to amend the last complaint, but because SPS took over the servicing in XXXX, all contract agreements would be the same. So why is this no longer considered a XXXX, or XXXX, or XXXX XXXX instrument? For the first time, I saw a complaint response from years ago, and SPS is incorrect. A re-affirmation agreement was made, but in 1 month it isnt going to matter anymore. I believe that SPS did not do the transfer correctly.
