Issue: Struggling to pay mortgage

Consumer Complaint: XXXX XXXX XXXX transferred my loan to Select Portfolio Servicing , Inc. while on a loan modification trial period, which is against the terms of the attached contract. I entered into a loan modification contract with XXXX XXXX XXXX on or before XXXX, which was the due date of the 1st trial payment ( see Offer/Acceptance Letter attached ). I made all 3-month trial payments on time ( see attached payments confirmations and copies of checks ). On XXXX XXXX XXXX XXXX sent me a letter notifying me of their transfer of the loan to Select Portfolio Servicing , Inc. ( see attached ). I had to cancel my 3rd trial payment because XXXX XXXXXXXX XXXX wouldn't take the payment. I suffered great monetary loss and struggled for a refinance of the mortgage that was transferred to a servicing company that did not have my account set up in their system and that changed the terms of the loan modification contract agreement and added more fees and costs such as late fees, attorneys fees, loan level advance fees, ect ..., to my account and sent my account to foreclosure.

Consumer Complaint: InXX/XX/2020 Due to COVID-19, I requested a Mortgage forbearance to SPS ( select portfolio Servicing ), it was accepted and mortgage payments were extended to XX/XX/2020. Because my job has been affected by Covid 19. OnXX/XX/2020 I contacted SPS and requested to add the 4 months to the principal, the representative told me that I didn't have this option, my only option was a 24 month repayment plan beginningXX/XX/2020. I didn't received any documentation, my wife called the lender in XX/XX/XXXX and she was told that I was not approved yet for the repayment plan. We decided to sold one of our cars to bring the house current, we were in a lot of stress due to this situation. I paid the 4 months inXX/XX/2020, for several days I enter to SPS website and the payment was not applied. My wife called SPS in XX/XX/XXXX and the representative told her that now I was approved for the repayment plan and the payment was applied this way : 2 months for the behind balance and 2 months for the repayment plan. If I paid the full amount behind WHY the lender didn't bring my mortgage payment current???? repayment plan??? We were told I was not approved. why I was not approved??? base on what?? I checked the website today XX/XX/20 and I do not have any new mortgage statement showing how they applied my payment of {$14000.00}, because they need to apply this amount to : principal, interest and escrow and send me my XXXX mortgage statement. I felt that I didn't have any help from them at all and I am still waiting that they applied my payment, this is causing us a lot of stress. Selling a car was not a good option for us, now we will need to buy another one in the future just because our lender didn't help us.

Consumer Complaint: THIS IS THE SECOND TIME I HAVE HAD TO FILE A COMPLAINT AGNIST SELECT PORTFOLIO SERVICING. I HAVE BEEN TRYING TO DO A MORTAGE ASSUMPTION FOR 2 YEARS AFTER THE LAST COMPLAINT THEY DENIED THE MORTGAGE ASSUMPTION SAYING THE PROPERTY WAS NOT MY PRIMARY RESIDENCE, I APPEALED THAT DECISION AND SENT DOCEMENTATION THAT IT WAS MY PRIMARY RESIDENCE. NOW THEY ARE SAYING THAT I HAVE TO BE A SECCESSOR IN INTEREST I ALREADY OWN THE DEED BY QUIT CLAIM DEED AND I HAVE LIVED ON THE PROPERTY FOR 13 YEARS AND DO ALL UPKEEP ON THE PROPERTY. I GOT THE PROPERTY AS A TRANSFER RESULTING FROM THE DEATH OF A BORROWER .I CANT GET MY OWN INSURANCE BECAUSE THE MORGATAGE IS NOT IN MY NAME AND I HAVE ESCROW PAYMENT CHECKS JUST SITTING HERE CANT GET THEM TO PUT THEM TOWARDS THE BALANCE OF THE MORGTAGE BECAUSE THE MORTAGE IS NOT IN MY NAME I CANT DO ANYTHING BE ITS NOT IN MY NAME THEY SAY I CANT BE AN SUCCESSOR IN INSTREST HOW IS THAT POSSIBLE IAM THE ONLY PERSON IN INSTREST ON THIS PROPERTY PLEASE HELP STRAIGHTEN OUT THIS MESS THIS IS THE WORST MORTAGE COMPANY EVER.

Consumer Complaint: Just spoke with a customer care person approximate a XXXX XXXX today Select Portfolio Servicing XXXX XXXX she read to me the letter they sent to me on yesterday stating that my mortgage was always a Conventional mortgage loan XX/XX/XXXX which is false It was always a FHA mortgage loan and only can be sold as a FHA mortgage loan.Some one refinance my FHA mortgage loan to a Conventional mortgage loan. I was not in default Of the loan which was current and was current with mortgage insurance with FHA. The Florida Housing Administration paid on my mortgage XXXX to XX/XX/XXXX therefore I always had an FHA mortgage loan never changed it. How did my FHA mortgage mortgage loan get refinance to an Conventional Real estate mortgage loan In XX/XX/XXXX when Florida Housing Administration ( FHA ) was paying on my mortgage loan? And the Appraiser property office staff person stated to me that the folio number and instrument number was alter/changed from the original number thats in the court docket thats under confidential for the XXXX property taxes. and personal do not make mistakes to those numbers, Its in the court location docket where the public can not review it, only staff personnel has access to those confidential documents. Also when I first spoke with the customer care person she said that my loan was set up for attorney review to take action for payment I take this as a threat or retaliation because Im only XXXX days past due for XXXX XXXX. And she continued to ask me when will I get this caught up and I explain to her I am still in a dispute and this is still not resolved. And furthermore I read on your website that you have be at least 120 days late before they can take any action and while there is a dispute they are not to be harassing you or threatening you about payments.

Consumer Complaint: I received a letter from SPS ( Select Portfolio Servicing ) dated XX/XX/XXXX stated that my property taxes were delinquent. However, I had paid the tax bill that was due on XX/XX/XXXX on time. I sent proof of the paid tax bill provided by the XXXX XXXX County Tax Collector which they received on XX/XX/XXXX. I also received confirmation that the file I uploaded had been uploaded successfully and thought the matter was resolved. Then I received a second letter stated the taxes were still delinquent and that a lien could be put on our home but to no fault of our own but rather to their dysfunctional service. In light of the difficulties we are facing as a nation it boggles my mind to think a organization whose purpose is to help people who unnecessarily create this hardship for me and my family. It makes me wonder how many other law abiding customers they manage have been treated the same way.

Consumer Complaint: In XXXX, we purchased a townhome in XXXX, VA for {$500000.00}, with {$99000.00} down payment. We had financed {$400000.00} at XXXX year ARM of interest-only loan at 5.00 % interest per year. In XXXX this loan was modified under Obama administration to Step-Modification. XX/XX/XXXX - the Loan was refinanced @ 4:00 % for 1 year XX/XX/XXXX - &@ 4.980 % for rest of 29 years, till Maturity date of XX/XX/XXXX. Making it a Conventional 30 years mortgage at 4.980 %. Loan modification documents say that the interest + principle to be paid for amount of {$1600.00} per month. we have been making payments without missing a single payment for the life of this loan. The Issue We believe that the mortgage companies have NOT applied proper distribution of interest & principal over the life of the loan. In XX/XX/XXXX, the mortgage distribution had applied {$22.00} and {$1300.00} and the balance of the mortgage left on the home was XXXX After 10 Years of paying Principal in XX/XX/XXXX, the mortgage distribution had applied {$77.00} towards the principal and {$1500.00} for interest and the balance of the mortgage left on the home was XXXX If this is a 30 year conventional fixed loan 4.980 % & all the documents that i have say it is, my principal should have reduced significantly more in past 10 years than just {$11000.00}. The question to mortgage company is why isn't my principal payment applied correctly. When i call the company they say : Trust us, in few years you should see more towards principal but they are NOT willing to provide " Truth in Lending '' statement for modified loan, or any Amortization schedule for any future payments. I have already paid approx. {$190000.00} in interest over past 10 years. Even after paying 10 years, we have no equity built in our home. It seems that that interest portion of the mortgage is withheld at a lot higher percentage than it should be.

Consumer Complaint: As I was getting ready to refinance the loan with another lender, I made a huge payment to get the balance of the existing loan reduced. They did not give me credit for the payment in a timely manner. They continued to charged interest for the higher balance. I have an attached spreadsheet that calculates the interest base on how they applied the funds on one tab. The other tab has the interest calculation based on the correct applied date, which is the date that I made the payment. Please see the attached documents for more information regarding calculation of interest, correspondence to and from the company. They sent the same answer to me and then to an attorney.

Consumer Complaint: I inherited my parents home after the death of my father and step-mother. My goal is to keep my home and avoid foreclosure. The mortgage on the home is in my father 's name, and is serviced by SPS, owned by XXXX XXXX. The property has transferred into my name with a Quit Deed, and I have a letter of authority & success in interest from the estate. I would like to assume the loan, and receive a modification to help the loan remain affordable, as I have a had a loss of income. The current servicer, SPS, has denied my request for a modification and assumption of the mortgage on my home mortgage. I have applied multiple times for a modification. I most recently applied starting in XXXX. Between XXXX and XX/XX/XXXX, SPS requested duplicate documents several times, and each time I submitted the documents requested. On XX/XX/XXXX, SPS sent me a letter that they were reviewing my complete modification application. On XX/XX/XXXX, I received a letter stating that my modification application had been denied due to " investor/guarantor Not Participating. '' This is the second time I have received a denial with the same reason given. The first denial was received XX/XX/XXXX. During the time between XX/XX/XXXX and XX/XX/XXXX I was being asked to repeatedly submit documents and applications.
