Consumer Complaint: Previously applied for loan modification thru XXXX XXXX XXXX due to co owner Mothers sudden transition. Followed all XXXX XXXX XXXX instructions XXXX XXXX XXXX suddenly started foreclosure during modification and would not permit borrower to submit payments Borrower contacted Consumer complaint which forced XXXX XXXX XXXX to launch exhaustive investigation. Recordings found because borrower had dates and times names. In the interim XXXX XXXX XXXX pursued foreclosures replete with foreclosure notices on door. Result was an apology letter from XXXX XXXX XXXX removing missed payments from credit reporting agencys and one mortgage payment made by them. Next at inception of Covid cares act borrower contacted XXXX for three month deferral Cares act request on back end of loan It was approved via phone. However at this time borrower noticed maturity date was changed to a longer date. Borrower contacted XXXX XXXX XXXX executive offices. Borrower was told by representative maturity date was changed due to modification. Borrower explained to representative that a modification was never processed & agreed XXXX XXXX XXXX had no proof of signature about changed maturity date. Borrower explained to representative that an apology letter was granted. He cited he would follow up and did not. Next action that occurred was XXXX XXXX XXXX sold mortgage to SPS without informing borrower. Borrower found out when confirming payment and cares act deferral Borrower contacted SPS Told SPS about the maturity date error and the approval for cares act for deferral on back end of loan for three months Sps cited it would take months to discover and denied requests for Cares act approved by XXXX XXXX XXXX Borrower was impacted by Covid thus seeked assistance from other organisations. XXXX XXXX assisted with mortgage payments. Next incident was XX/XX/XXXX Borrower was told via call payment of over XXXX XXXX dollars was made and no mortgage was due until XX/XX/XXXX In the interim SPS sent borrower statements In XXXX & XXXX reflecting no payment due to XX/XX/XXXX. On XXXX XXXX borrower received letters from SPS citing SPS had made several attempts to contact borrower. The lettters were dated XX/XX/XXXX & XX/XX/XXXX. These letters were not true. These were first attempts The letters stated payments were past due and borrower had to XXXX XXXX to pay or foreclosure would start When borrower contacted SPS via phone was told by representative that SPS made errors and placed money on wrong account and borrower had to XXXX XXXX to pay all mortgages or foreclosure would occur This is not borrowers fault Please help

Consumer Complaint: On XX/XX/2020, the family renting my investment property moved. I prepared the property to be shown but on XX/XX/2020, we were mandated to stay home to " slow the spread. '' As a result, I was precluded from showing the house, therefore, I could not rent the house. I learned of the CARES Act and on Thursday, XX/XX/2020, I called SPS and spoke with XXXX. XXXX advised me that under the CARES Act I was entitled to a forbearance of my mortgage. I requested a 90 day forbearance for XXXX, XXXX & XXXX payments. XXXX confirmed that the three ( 3 ) mortgage payments would be moved to the end of my loan without penalty or interest. I accepted this relief in good faith and under the advice of XXXX cancelled my auto pay. I was successful in renting the property for XX/XX/2020, and called SPS to resume mortgage payments. I was told I needed to apply for a loan modification which I did. After months of submitting and resubmitting the same information I was denied the loan modification due to a " collection or charge off on my credit report. '' I believed that the " collection '' action in question was a {$290.00} disputed bill with XXXX which I offered to pay in full to resolve. I was told that was not acceptable and that I had " no home retention options. '' I was told that I was required to pay a lump sum payment or SPS would begin foreclosure on my property. I asked about repayment options, payment plan, etc. and I was again told " I had not home retention options. '' Together with a foreclosure notice I received a short sale acceptance form and a general third party authorization forms to sign over the rights to my property to SPS. I filed an appeal with SPS which was denied. In addition, to the loss of income on this property directly related to the Covid-19 pandemic, my income was reduced by 25 %. Further, since I was unable to travel for work my monthly travel reimbursement was reduced to zero, an average loss of {$350.00} a month. I am a single woman supporting my household on a single income. I accepted the relief offered by SPS to ease my financial burden while impacted by Covid-19, in good faith. I believe SPS acted in bad faith by refusing to find a way to make the loan modification successful after offering and promising to move three ( 3 ) mortgage payments ( XXXX ) to the end of the loan. I have never been late on a mortgage payment. I feel as if I have been a victim of a predatory lending practice.

Consumer Complaint: I applied for loan help in XX/XX/XXXX with SPS. Due to the COVID pandemic and state lockdowns, I had a reduction in income and could not afford to pay all loans attached the house without help. The house is not my primary residence since I moved out of state for work and the real estate market did not allow for the sale of the house. I called the mortgage company, SPS, daily. I did everything they said to do, and requested to speak to a manager, but was denied. At the beginning of XXXX the agent said I would qualify for relief of at least {$10000.00} and that it would be finalized the next week. To stop incurring additional debt, I had to sell the house. In XX/XX/XXXX, SPS stated that I would still receive mortgage relief to pay off additional loans, even if the house sold. SPS received the pay off amount on XX/XX/XXXX and dropped my claim. They stated that since they got their money, the request was no longer valid. And thus, I am negative in paying off loans related to the home, even though I no longer own it. SPS intentionally gave me false information and delayed approval of the requested assistance to further their own financial gain at the expense of my family.

Consumer Complaint: Due to technical issues related with the electronic system of my mortgage company select portfolio servicing, the payments corresponding to the months of XX/XX/XXXX and XX/XX/XXXX were not processed or did not go through and it was when I called to make the payment corresponding to the month of XX/XX/XXXX when I learned about this inconvenient and I was able to mail the payments for those months. Due to these technical issues, payments on my loan number XXXX corresponding to the months of XX/XX/XXXX and XX/XX/XXXX are reflected on my credit report as 60 days late and is affecting my ability to buy a single family home to move with my family

I then submitted proof that I had insurance, but they force placed insurance for the time that I was unable to prove. They stated that I signed a document that they still have failed to show me where I signed for this. Select Portfolio Sevicing sent me a notice and an amount of XXXX for insurance that was back dated. They charged my account XXXX. How is a company allowed to charge for insurance on dates that have already past with no claims? Also, I have paid out of pocket for claims that I could have submitted. In conclusion, I am still waiting for my proof of signature that would even allow to back date insurance. If this is legal, then I would like to take out life insurance on family that past away!

It states in the 15USC 1681 ( a ) ( 4 ) and ( b ) that consumer reporting agencies should exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy, ( b ) and other information in a manner which is fair and equitable to the consumer, with regard to the confidentiality, accuracy, relevancy, and proper utilization of such information. The credit bureaus should not be allowed to add my private payment information to any report sent by a creditor who is also violating my privacy rights by sharing my information without my consent. Therefore I demand that this account be removed immediately from my credit report.

This mortgage was taken out 15 years ago ( XX/XX/XXXX ) at which time the original amount was {$52000.00}. The above mentioned ( {$44000.00} ) balloon payment matured on XX/XX/XXXX. Back in XXXX of XXXX we started negotiating with SPS ( Select Portfolio Servicing ) XXXX XXXX XXXX XXXX XXXX XXXX, Utah, XXXX to have this loan refinanced due to COVID and other situations we could not afford the balloon payment. Our goal was to renegotiate with the lender for an extension on this loan so we would be able to stay in our home. After several interactions and production of documents requested such as, tax returns and proof of income we were under the impression that we would be getting a modification. We were also told to withhold our XX/XX/XXXX payment until we receive the new mortgage. But to our amazement on XX/XX/XXXX we received a disturbing letter suggesting that we should sell our home in order to satisfy this debt and we were given a short sale deadline of XX/XX/XXXX which was even more shocking since it only allows us 11 days to make a lifetime decision. I am the major breadwinner in my home and I sent proof that our total family income is approximately {$12000.00} per month. I work as a XXXX XXXX and have a young son in college whom Im supporting. I would think that due to the hardship that we are all under due to COVID-19 that this lender would understand my situation and would work with me to resolve this issue instead of trying to push me into selling my home which is the most harsh situation Ive ever expected. Please note that over the last 15 years Ive paid this mortgage twice over which I understand is business but now a new person has bought the mortgage and it seems they are just trying to make money. As of now, the servicer would not tell us who the lender is and I was never given an explanation as to why we were denied a modification. Please look into this situation and let us know what the end result is.

Consumer Complaint: We were in a bankruptcy in XXXX, we paid off in XXXX, XXXX failed to pay 6 months of payments to SPS so we have tried to work with them to modify the loan for the past two years. The only modification they would offer to catch up the {$2400.00} was to double the amount of payments owed and take the amount we owed from {$18000.00} to {$34000.00}, doubling what we owe. They have held us XXXX with the preditory lending by only offering this modification ( 3 times ), in order to catch up these payments was to agree to double what we owed them. We have spoken with several of our relation ship managers who have told us to just offer them something since they wrote off this loan when it was dismissed in the Chapter XXXX. Is it legal for them to collect on a loan that they have written off to the IRS? We were in the process of trying to refinance and SPS told me that they wo9uold never let us out of the loan and that is what they did. Our refi was denied in underwriting due to SPS.

Spoke to XXXX, Select Port Folio ext XXXX XX/XX/XXXX she stated that they were working on the modification assumption and a property foreclosure sale date should have not been set for my property. XXXX filed a dispute because of the foreclosure date of XXXX XXXX XXXX should not have been set while my modification request was in review. She then transferred me to XXXX a Manager. ext XXXX he stated they're still waiting for transactions from her SSI XXXX card that can be pulled from their website located on the back of the card. Also they received new documents today XX/XX/XXXX will review them as soon as they receive them. They have my Social Security Award letters, I'm elderly I receive my benefits on a card. I don't know any thing about computers and I don't own a computer. I'm Elderly, someone I didn't know knocked at my door asked to look at my house because it was IN foreclosure. I have not received a letter form the mortgage company or the foreclosure attorney saying my house is in foreclosure. I read there is l a hold on property foreclosures until XX/XX/XXXX because of Covid-19 Why does my have a foreclosure sale Date???????????????
