Issue: Struggling to pay mortgage

Subissue:

Consumer Complaint: As you may be aware the year XXXX has been very challenging for myself and other homeowners with their mortgage payments, I too was unfortunate to fall behind. So i felt really relieved after i applied for a deferred payment and got an approval from my mortgage company -Select Portfolio Servicing Inc , in XXXX of XXXX. However immediately after the approved deferral my mortgage company informed me that effective the same XXXX of XXXX my loan is now subjected to a significant increase in my interest rate from an affordable 4 % to a whopping 9.54 % which effectively increased my monthly payment from {$1000.00} per month including escrow to a overwhelming {$2100.00} per month including escrow. I contacted the company regarding an affordable interest rate reduction in XXXX of XXXX and to my great disappointment and after a lengthy and drawn out process of communicating with them and providing their info requests from XX/XX/XXXX they informed me in XXXX of XXXX that my request for a reduction of the interest rate which was doubled-up and ill-timed was not approved and even suggested i give up my precious family home to a short sale. I am in the process of appealing their decision and realized i will need Help from your organization to deal with this GIANT Problem with this Giant of the industry who makes decisions about people 's lives with no regard to peoples social needs of having somewhere to call home and being able to stay in their homes especially during and after the tumultuous year of XXXX and beyond where the corona virus came and turned our lives upside down. I sincerely look forward to your Help in this feeling of helplessness situation that i am in.

Consumer Complaint: Select portfolio servicing for XXXX XXXX has {$370000.00} principal payments I made to two mortgages from XXXX XXXX XXXX XXXX XXXX. They returned {$83000.00} -apparently from my escrow account and then kept all of the {$350000.00} the buyer gave me for my house in XX/XX/XXXX. The pay history shows a new loan of {$270000.00} I did not sign and no one gave me. There is a {$230000.00} loan disbursement that I believe paid off the real mortgage that XXXX XXXX failed to release.because of this I now owe about {$30000.00} in taxes and penalties on {$120000.00} I had to take from my retirement to close on the new house. I bought the old house for {$260000.00} in XXXX. I put {$60000.00} down and mad {$620000.00} payments. I sold it for {$360000.00} and spent my retirement to buy a {$210000.00} house.

Consumer Complaint: As a result of the Covid-19 pandemic I was laid off of work on XX/XX/XXXX ... I immediately called my mortgage company ( Select Portfolio Servicing ) and alerted them to my situation ... .I called as instructed on the 10th of every month to update my status, which remained unchanged, with SPServicing as instructed ... Additionally, in my communications with them I wanted to be made aware of any potential long term solution ... .With the magnitude, complexity and unpredictability of the virus little was done for months with policy guidelines that loan services were dictated by ... .It wasn't until XXXX that I received a request to make 3 monthly pandemic related payments of {$170.00} which would enroll me into the pseudo pandemic assistance program ... .I immediately called and asked to speak with someone that could explain the guidelines and parameters that SPServicing was going to use to determine any forbearance or deferment ... .I continued to check in on a monthly basis while still not having had a single return call as to an explanation in detail of the " pandemic assistance program '' that was being offered ... .A second request was sent for {$170.00} per month to be entered into the " pandemic assistance program '' ... .I immediately called ... .Got the same vague explanation about requirements and guidelines ... Reluctantly made the 1st payment and then received a determination from SPServicing requesting 3 years worth of payments to be made at {$2300.00} per month for 36 months to make up for the deficiency and arrears on the mortgage ... .Collecting a {$120.00} per week on unemployment I am sure you can sense my alarm at their repayment plan ....!!! ... My normal payment is {$1500.00} ... .I immediately called them and explained the feasibility of being able to pay this amount as impossible and immediately appealled the payment restructuring ... XXXXI formally appealled on XX/XX/XXXX via email ... .I also called on XX/XX/XXXX to verbally verify receipt of my appeal email ... I received verbal confirmation as well as electronic confirmation that the appeal email was received ... ..As I continue to call on a weekly basis SPServicing will only state that they loss mitigation department isn't connected with the servicing department and that loss mitigate will contact me in 30 days ... .I find this situation has not been handled as it should have been ... None of my own financial criteria has been used to formulate any assistance aside from not reporting as delinquent or filling for foreclosure ... .My latest call today to SPServicing produced no changes in status with loss mitigation and my appeal ... .Very disingenuous that in my very first call in XXXX of XXXX, which was recorded, that forbearance and deferment were all that was discussed ... ..

Issue: Closing on a mortgage

Subissue:

Consumer Complaint: I requested that the mortgage servicer, Select Portfolio Servicing accept a deed in lieu of foreclosure due to the death of my husband ( we had been separated and living apart for 10 years XXXX. The loan had been XXXX through bankruptcy. My request was approved in XX/XX/XXXX. I submitted all of my documents. After a few months of not hearing anything, I inquired and the delay was blamed on COVID. After numerous phone calls and being told different " stories '' I contacted my county representative for help in XX/XX/XXXX. His office contacted Select Portfolio and a week or so later I was contacted to set up a meeting with a notary to sign the documents. I signed the deed transfer and all other closing documents on XX/XX/XXXX. After not hearing anything for weeks I began calling SPS to get an update. I was told to vacate the home, which I did. The grass still needed to be mowed. The electricity needed to be on for the sump pump, etc. I was told I was still responsible for the property until the transfer was recorded by XXXX XXXX. I kept calling for updates and was given different responses as to what the delay was caused by. Finally, months later I was told that the package was sent to XXXX Co on XX/XX/XXXX and we were waiting for XXXX XXXX to respond. I told the SPS that someone may have been vandalizing the property and I thought it was unfair that it was my responsibility. In XXXX, I was told by SPS that the property had been secured and winterized on XX/XX/XXXX. Still no word about why the delay. In XXXX, I contacted XXXX XXXX and was told that the package was received by XXXX XXXX on XX/XX/XXXX but it was most likely rejected because XXXX XXXX was not behind. I kept calling SPS and found out that the package was rejected, missing a POA and was sent out again XX/XX/XXXX. I am still waiting for this deed in lieu and transfer to be recorded so I can move on. I feel that the delay is deliberate for some unknown reason, or even if not, this is unacceptable that I am receiving no explanation. I feel I have been caused excessive stress and I deserve an explanation from SPS. As of today, XX/XX/XXXX, the deed has still not been recorded. SPS representatives have told me the property is my responsibility until the deed is recorded and they can offer no good explanation of why this is taking excessively long. It has been 1 year and 2 months since the deed in lieu was approved. I also wanted copies of the signed documents which I was told I can not get until the deed is recorded.

Consumer Complaint: Dear Sir or Madam, They say they do not refinance when I asked for it. They say that they took this loan from XXXX XXXX XXXX. A year ago, I applied for a forbearance. I was granted this. However at the end of the XXXX month reprieve, the bank demanded full payment. How is this any help? Issue: Struggling to pay mortgage

Subissue:

Consumer Complaint: I recieved notices dated XX/XX/2021 and XX/XX/2021 XXXX the Denial Letters XXXX whereby lender denied my request to subordinate my second position loan ( the XXXX XXXX XXXX ) to a new first position mortgage. I have also sent a letter dated XX/XX/2021 in response to XXXX XXXX 's initial denial letter. Within the Denial Letters, the reason given for denial is that it was based on a business decision. I am currently experiencing a financial hardship and request that that Select Portfolio Servicing and XXXX XXXX reconsider my request to subordinate my loan to reduce my monthly interest in the refinance of my property which will reduce my monthly payment without changing the XXXX XXXX loan whatsoever. On XX/XX/2021 I sent XXXX XXXX a recent notice by my employer regarding a reduction in my salary XXXX 20 % reduction ) due to the present economic environment. I am trying to amicably reduce my expenses and thus far, I have managed to keep current on my mortgage. To be clear, I am not claiming a COVID financial hardship, and I request that XXXX XXXX do not report my account as a COVID financial hardship. Hence, SPS or XXXX XXXX may not mark my account as a COVID hardship and doing so will cancel my ability to refinance my home. I have previously shown that the refinance of the property will save me more than the payment to SPS or XXXX XXXX. I have encouraged XXXX XXXX to accept the subordination agreement to avoid unnecessary action on my part. I am concerned that I will not be able to make the payment, particularly if XXXX XXXX XXXX and XXXX XXXX continue to refuse to subordinate the loan to a new first mortgage. Although XXXX XXXX has asserted that the denial of the subordination of my XXXX XXXX loan is based on a business decision, it would seem to me that the best business decision would be the one that would mitigate risk to the mortgage owner. Not only would consenting to the subordination of my mortgage facilitate a lower interest rate and lower payment, the denial of the subordination would only serve to increase the risk of affordability, especially during the current climate of economic uncertainty due to the XXXX pandemic. I have advised XXXX XXXX that time is of the essence in the refinance of my first mortgage as I do not want to lose the opportunity of closing at my current rate lock.
