I have sent a payment of {$310.00}, that they recieved on XX/XX/21. and they have applied it to my XX/XX/XXXX payment. Eventhough, I wrote on the money order that it was sent to be applied to my unpaid mortgage. I have called thm several times about this. I am getting no results.

Consumer Complaint: For over ten years XXXX XXXX and XXXX XXXX of XXXX XXXX , XXXX have illegally tried to foreclose on my home. How it works. Select Portfolio Services , Inc ( SPS, Inc a mortgage servicers ) claims to work on behalf of XXXX XXXX. ( the alleged owner of my loan ) SPS, Inc then hires XXXX and XXXX as the foreclosing attorneys on behalf of XXXX XXXX. XXXX and XXXX then claim to work on behalf of XXXX. XXXX. in order to act as if they are running legal public notices and perfecting the steps to perform a non-judicial foreclosure. The only problem is that XXXX XXXX. DOES NOT OWN MY LOAN. XXXX XXXX. has written letters and have verified verbally over the phone on several occasions that XXXX XXXX. does not have an interest in the loan or home. I have even contacted XXXX XXXX. certificate holder for the alleged loan ( XXXX XXXX ) and they also have verified that they do not house or furnish any certificates on behalf XXXX XXXX. for my home or loan. I have documents and emails to prove my stance. The main problems are XXXX and XXXX perform illegal foreclosure every month. XXXX and XXXX have been asked to Validate the Debt as a XXXX party debt collector. When they can not legally validate the debt or the relationship between myself and XXXX XXXX. they still attempt to foreclose. XXXX and XXXX also go as far as submitting themselves into state, federal and bankruptcies proceedings claiming to represent XXXX XXXX, in which XXXX XXXX. has no knowledge of. They are regularly performing fraud before the courts, act as imposters before the courts and are clouding titles knowing they do not have a right to foreclose upon. The State of Georgia should not allow these individuals to practice law or have a business entity registered in the state of Georgia. I am reaching out to you because I have filed complaints with the Georgia Bar and the FTC but no one seems to care that legally barred professionals are performing illegal foreclosure knowingly. The Supreme Court of Georgia made it clear that only a Secured Creditor can foreclose in that state of Georgia. You vs. XXXX XXXX It seems to be clear that XXXX and XXXX do not respect their oaths, state law, federal law or state supreme court rulings. They STEAL PEOPLES HOMES and just get away with it.

Consumer Complaint: My loan was transferred from XXXX XXXX XXXX to Select Portfolio on XX/XX/XXXX. I am in the process of refinancing my first loan therefore am on a timeline to close escrow. On XX/XX/XXXX, I called Select Portfolio and requested a copy of my Note per the refinancing lender 's request. I was told I would be faxed the note but I did not receive it. When I called back a few days later, I was told that they couldn't locate the Note and were looking for it and they would have to reach out to XXXX XXXX. I was told that it would take a few days. Last week, I called to check on the status and they still hadn't located it and told me that they would put a " rush '' on it. I called back today XXXX XX/XX/XXXX XXXX and Select Portfolio is still telling me that they have not received anything from XXXX XXXX. It has been 2 weeks since my initial request and there has been no progress. This loan was transferred 7 months ago. If I am late on a payment, I receive calls daily asking for payment yet when the table is turned there seems to be very little effort as it doesn't seem as impactful or important to the lender. This Note is needed as part of my loan refinance. I am requesting assistance so that the Note be located and I be sent a copy ASAP. Thank you.

Consumer Complaint: My loan was sold to select portfolio servicing ( SPS ), from XXXX. When it was sold my loan was in forbearance. My husband who is self employed lost his consulting job. Im trying to get out of forbearance and the only way I can do that via sps is to do a loan modification or pay the balloon payment. When I stared the process with XXXX they said I would be able to defer my payments. SPS would not honor that. They keep asking me to either do a loan modification that I may or may not qualify for due to my husband being out of work, or I must extend the forbearance. I have now extended the forbearance for a year. I told them numerous times I would like to just start paying my mortgage with the payments deferred and have been denied. Now I have to go through a loan modification, or pay a balloon payment there are no other options. I do not believe this was the intent of the covid relief program. They told me if I do not do the loan modification, or pay the full past due amount in Full that the past payments I missed will go on my credit as lates. Destroying my credit! I have put in for the loan modification and if it is denied they said I will either have to pay the balloon payment or have all the lates report on my credit and they will foreclose on my home. I saw in the covid relief information that a balloon payment was not supposed to be the only option and feel they are not following the intent of the law.

Consumer Complaint: Did an adjustable mortgage in XX/XX/XXXX with XXXX XXXX XXXX XXXX who apparently wasnt licensed at the time to do business. They were not licensed until XX/XX/XXXX 5 months later. ( without my knowledge ) IN XXXX i refinanced with XXXX which should have paid off XXXX XXXX XXXX XXXX ( Until a few years ago I assumed they had been paid ) However apparently XXXX went out of business and never paid off XXXX XXXXt. XXXX seems to tell me they bought lenders direct loans that XXXX was apparently servicing. ( I dont believe that chase bought lenders direct mortgages at all ) even though my mortgage was with XXXX only because of my refinancing. XXXX was fined for trying to say they bought XXXX loans in XXXX. I dont have my HUD records as they were destroyed in a flood at my home. Now XXXX keeps telling me they were only the servicer and XXXX XXXX was the owner of the XXXX XXXX XXXX. Is there a way to find out who really bought XXXX XXXX XXXX XXXX loans even though my loan was done fraudulently without a mortgage license. Im tryng to get to the bottom of this fraudulent mortgage fiasco.

Consumer Complaint: The reason I have this complaint against Select Portfolio Servicing- hereafter referred to as SPS- is because, they made my loan in forbearance without me asking. This has put me in a legal bind. Though I have made all my payments as agreed I am now not able to refinance my home due to the Forbearance that I did not ask for. I need to refinance my house due to a commitment in divorce agreement. During the divorce proceedings the judge told us that if I wanted to keep my house, I needed to refinance and pay my ex-husband the amount of {$50000.00} from the proceeds. Last XXXX I received a letter from SPS advising me that I could do a program that was approved by the Government where there was no need for me to make mortgage payments on my mortgage. Curious about the letter I inquired to what this program was all about I called, but I never got more paperwork explaining the way this program was going to work for me and my balance, so I continued making my regular payments on my mortgage as agreed. Consumer Complaint: I have reached out to mortgage company several times by telephone. I also have been told multiple times to reach out using relationship manager email address. Please see attachment of monthly contact and my receiving zero response beyond youre still on forbearance. We will update you as new information becomes available. In the interim Ive been told to submit my bank account statement which I have done. Ive asked multiple times for reduced payment, refinance to lower payment as well as place all arrears to end of my loan and please remove the late fees. My requests have been ignored multiple times. When I submitted a report, SPS Inc remitted partial information to you and acted as though Ive provided no addl update, banning additional remedies of help on their part. I have been and continue to be impacted by COVID. I have not been able to work for almost a year. Ive been looking for work and opportunities have either froze halfway through interviews or have been halted until we are past pandemic.
