Consumer Complaint: Select Portfolio Services XXXX XXXX XXXX XXXX XXXX XXXX , Utah for 3 years has WITH HELD a payment alleging WE HAD NOT PAID IN GOOD FAITH. Wrong. Wrong it was paid on time in good faith. Select Portfolio Services alleged we did not pay!!! Then lodged 18 negative late payments on all 3 credit reporting agencies. Despite and whilst this was being disputed REPEATEDLY AND DURING BOTH A PANDEMIC REFERENDUM AGAINIST NEGATIVE REPORTING AND ALSO A NATURAL DISASTER IN MY ZIPCODE despite both a Pandemic Referendum and Natural Disaster we were and had always in good faith paid in full and they kept reporting otherwise! Finally we wrote a 2nd check very early on during this most ugly dispute in XXXX which they also cashed!!! ( even more outrageous!!! ) Meaning we are and never were one full payment behind but cashed checks by Select Portfolio Servicing proves rather we were one full payment ahead!!!! They Select Portfolio Servicing even argued my spouse was not on our Mortgage who wrote the check to put us one month ahead not behind trying to this clear up despite Select Portfolio Servicings arbitrary error! Select Portfolio Servicing still never gave correct accounting and slammed and spammed us with late fees and as stated falsely reported us to all 3 reporting agencies and Select Portfolio Services still has only current not 1 payment ahead and will NOT REMOVE THE NEGATIVE ARBITRARY FALSE REPORTING ON OUR CREDIT REPORTS WHICH HAS RUINED OUR CREDIT ERRONEOUSLY AND NON FACT. The servicer lodged 19 months of late payments ruining completely both our credit scores they ruined our credit on Falsehood! They also charge us {$15.00} a month payment fee despite being on a Hardest Hit mortgage agreement with XXXX ( XXXX XXXX XXXX XXXX ) They since acquiring our loan have never acknowledged the agreement of XXXX XXXX XXXX XXXX agreement which was no payment fees to make payments easier and timely per XXXX XXXX XXXX XXXX hardest hit program also that Mortgage could not exceed 30 percent of our yearly earnings infact they have never acknowledged we were a XXXX XXXX XXXX XXXX hardest hit client or held up the Hud agreement that they bought which landed us with Select Portfolio Services. In XX/XX/XXXX XXXX XXXX XXXX acknowledged they sent Select Portfolio Services a copy of the hardest hit agreement. In XX/XX/XXXX after 6 months of them Falsely attributing non payment to all 3 credit reporting slamming our credit we paid a 2nd check by Co borrower and they still have not credited that payment to us. For 19 continuous months they marked and reported us Delinquent and Poor to the Credit Agencies which was not Factual. Every month since the beginning of the Pandemic XX/XX/XXXX to date XX/XX/XXXX they stepped up Collections againist us further ruining our credit despite a Federal reporting referendum. Then in XX/XX/XXXX they presented and cashed ck # XXXX on # XXXX which was dated XX/XX/XXXX. Despite the check dated 2 years prior 2 yrs later the our Bank cleared the Check. No acknowledgement or why they presented and cleared a check from 2 years previous at detrement to us! 2 years later they cash a dated check from XXXX? All the whilst we had made several complaints with this agency as well as Hud, Keep your home California, XXXX and our Constituents Counsel of Rep .Congresswoman XXXX XXXX XXXX and Rep .Senator XXXX XXXX XXXX and all 3 credit agencies. Outrageous. We sent numerous copies of XXXX XXXX XXXX XXXX hardest hit documents as did the XXXX XXXX XXXX XXXX agency itself ... Select Portfolio Services has never acknowledged this agreement they bought. Select Portfolio Services has ruined our credit on Falsehood. Select Portfolio Services has us behind by 19 months and never corrected the false record to the 3 credit Reporting Agency. Select Portfolio Services does not acknowledge their false reporting error or the fact that they cashed and presented a check nearly 3 years later without explanation dated XX/XX/XXXX XXXX years later it cleared at presentation to XXXX XXXX XXXX California Despite this full payment and 1 replacement check by CO borrower and spouse. We have paid in good faith at all times even a check from 3 years prior they presented with no explanation cleared. WE ARE PAID TO FULL ON MONTHLY SERVICING INFACT ARE STILL NOT CREDITED OUR PAYMENT AHEAD BY CO BORROWER. YET THEY CONTINUE TO REPORT US DELINQUENT RUINING OUR CREDIT FURTHER.

Consumer Complaint: Last year at the beginning of the COVID-19 crisis, was on short-term XXXX XXXX, due to problems at my office. I fell behind on the payments. Then State Department of Revenue hit me for back taxes and penalties. Now I am back working and just received my social security retirement which allows me to pay the total mortgage of {$1700.00} with taxes and insurance. The problem is I was seeking help with the Biden administration relief plan to help struggling homeowners who have fallen behind on payments due to the COVID pandemic. I have applied to the company for this program and have not heard anything back, I know that the company is threatening foreclosure. I have read that there are national concerns with how the banks, lenders, service companies and not prioritizing helping minority homeowners. I have requested from the beginning a 30-year mortgage and was told no. This would have been a huge help. I lost all the equity due to the XXXX housing crisis.

Consumer Complaint: Select Portfolio Servicing is the servicer on mortgage. We were with XXXX to XXXX XXXX XXXX ( in middle of a modification ) and flipped to SPS. Note is purportedly with XXXX XXXX XXXX XXXX. We have requested A modification from SPS thru HUD approved agencies 6 times and directly to SPS a total of 7 times. SPS always misplaces or loses documents and has refused to modify loan. They offered a trial payment a few hundred dollars less than current mortgage payment. On XX/XX/XXXX, SPS sent a letter to our homeowners insurance company - XXXX - saying SPS initiated a foreclosure on property in XXXX! This of course cancels our home insurance and will necessitate FORCE PLACED insurance thru SPS. SPS is not licensed to conduct business in PA and as I understand a servicer CAN NOT initiate a foreclosure.

I COMPLIED WITH ALL THE PAYMENTS. I MADE MY PAYMENTS ON TIME AND IN FULL. THEN SPS CAME BACK WITH AN APPROVAL, A REPAYMENT PLAN THAT IS NOT WITHIN MY MEANS.NOW THEY ARE FORECLOSING ON ME WITHOUT GIVING ME ANY OPTION TO AVOID FORECLOSURE. I COMPLIED WITH ALL OF THE TRIAL PAYMENTS. I SENT BACK THE SIGNED PERMANENT LOAN MODIFICATION DOCUMENTS. I MADE SPS AWARE THIS ENTIRE TIME THAT ONLY I THE PRIMARY BORROWER WOULD BE SIGNING THE PERMANENT LOAN MODIFICATION DOCUMENTS AND WAS TOLD THIS WOULD BE OKAY AS LONG AS I PROVIDE THE QUITCLAIM DEED, WHICH I DID. Consumer Complaint: I had a principal balance of {$160000.00} on my XX/XX/XXXX mortgage statement ( after applied principal ). On my following statement ( XX/XX/XXXX ) my balance of {$160000.00} was carried over but I was charged for 2 months ( XX/XX/XXXX, XX/XX/XXXX ) interest ( % 5.875 % ) and principal was applied as if I was making 2 payments in a row ( XXXX and XXXX ) within the month of XX/XX/XXXX. Subsequently the extra amount submitted to pay down my principle ( {$1100.00} ) was not credited in XXXX. Because I paid an extra {$1100.00} over my regular payment of {$1000.00} ( a total of {$2200.00} ) SPS policy is to treat a payment within a month as 2 payments if the amount payed is equal to 2 months of regular mortgage payments. This must be illegal as I am subject extra interest for a month that hasn't even occurred as a result of this practice Any other mortgage I have ever had has automatically applied extra payments within a month to principle. They promised to credit me the extra principle of {$1100.00} within a few days of my complaint of XX/XX/XXXX. Incidentally i had to call 3 times as the first 2 times I was hung up on after detailing my complaint. On the 3rd call I told them if they hung up one more time I would report them to CFPB. Even though they did apparently resolve my issue, I am submitting a complaint anyway as I am quite certain they are conducting illegal and unethical business practices over there.

Consumer Complaint: In process to buy this house I signed a contract with the builder and paid earnest money directly to him, one of the conditions included in the contract was that I had to go through his preferred lender to get the discounted price. I furnished his lender with all documents required, months later when it was time for closing the lender asked me if I had a cosigner, I provided my cousin XXXX XXXX name as a possible co signer. When both of us arrived at closing attorneys office we were told only XXXX is going to sign the closing documents, he started signing the paper an we were told by the closing attorney at the closing table that my name is in the Trailer Deed and I will be able to refinanced later to transfer the deed to my name. Not knowing what we know now we went through the closing. It was clearly fraud and deceptive lending practice. Throughout the financial crisis of XXXX I went through at least 8 lenders asking for loan modification in response what I got was several attempt to foreclose, as a result my cousin and I had to file several bankruptcy case to save our home, by the way most of those lenders have been shut down by the Federal Government for fraud and deceptive lending and CEO of the one those lender was prosecuted and served time in a federal prison. After long fight and two failed litigations we finally got a loan modification which raised our payment significantly, it was definitely a set up for failure, but I had no choice but to accept it to save the roof over our head. In XXXX my wife was diagnosed with XXXX XXXX after a major XXXX and XXXX she survived but lost her ability to work, this situation again created yet another financial crisis for me, not to mention current COVID 19 crisis added more trouble to my existing difficult situation.

My interest rate is 3.375 % Since I started paying an extra payment they are now charging me twice for my interest. XXXX they charged me {$1600.00}. I need help. Consumer Complaint: This issue with Select Portfolio Services, here after referred to as SPS first started in XXXX during the COVID-19 pandemic. According to written documentation the prior mortgage holder approved the request for modification XXXX and lowered the monthly payment to {$450.00} prior to transferring to SPS. SPS insisted the approval was never made. An SPS representative asked if I had been affected by the pandemic, my response was yes. The representative advised that I visit the website to indicate that I was impacted ( circa XXXX ). The SPS representative failed to mention that if I did this, this would cancel my mortgage modification review, which SPS insisted was not modified prior to transfer. SPS then moved my account under the COVID-19 Forbearance taking it out of mortgage modification review. After that ended, I expressed several times that I wanted to be considered for a permanent modification. SPS did not honor my wishes for several months. XXXX I began the process of being considered for a permanent modification. At least two representatives asked me if my spouse had payed the mortgage. My response was no, due to the account being deferred, due to COVID. I expressed my concern, as SPS know that we were impacted due to COVID and could not pay the original mortgage, due the pandemic, so I didn't understand why they were asking the question, when they knew and had documentation showing our impact. Circa XXXX another SPS representative instructed me to once again select that I was impacted by COVID-19 and was adamant that it would not have an impact on me pursuing a permanent modification. I spoke with my relationship manager who told me that the information provided was false, and that it would be the same thing that I experienced XXXX. From XXXX I complied with every SPS request, to include providing my spouse/non-customer information ( paystubs ; non-borrower credit check authorization form ). I've received circa 27 written communications from SPS from XXXX. Neither of those correspondences lists that my spouse need to make payments to me ( their words ) to prove that he/she are contributing to the mortgage. I did remind them that I am not my spouses employee, therefore, I was bewildered why they would demand that I prove that he/she pays me. I did not learn that my spouses salary would not be considered, due to him/her not making monetary deposits into my bank account to show how much they were going to contribute towards the mortgage. I reminded them that they never said monthly deposits were expected neither verbally nor written. I wasn't made aware of this until after already receiving SPS 's Demand Notice XXXX and reviewing the XXXX Dispute Resolution Letter. Despite not receiving the letter until a few days out from the date listed in the Demand Letter, SPS kept to the XXXX Demand Letter date, although my dispute letter was " seriously '' being considered and reviewed. XXXX I contacted a third party, whom I gave consent to speak with an SPS representative on a 3-way call with me. Myself and the third party both expressed that me and my spouse are married and have successfully submitted the household income. The SPS representative continued to suggest that SPS can not assume that a married couple will contribute.
