Consumer Complaint: I bought my home in 2019. It was a fixer upper. It appraised for {$240000.00}, and I took out a loan for {$200000.00}. I put over {$60000.00} into the home and had it re-appraised at {$320000.00}. I submitted my appraisal and a request to remove my escrow account to my loan servicer, SP Servicing. They are denying my request because they are calculating my Loan to Value from my original loan amount ( XXXX ) vs. my current loan amount ( XXXX ) and NOT using the paid appraisal that I ordered out of my own pocket. They are trying to say that my loan is over 80 % because XXXX/XXXX is more than 80 %. It should be {$200000.00} ( current loan amount ) / {$320000.00} ( current proven appraisal ). I've been fighting with them for over a month to get this done, and all they do is give me the run around and no answers, or a denial. They are using false data to create numbers that are not accurate on my account. Also, they applied an escrow only payment to my principal balance forcing me into an escrow shortage. I had to fight them to re-apply funds correctly - and I'm still paying the escrow shortage. I've also been told by their customer service team that I can " Just pay my principal and interest only '' on my loan a not my full amount every month. This would cause me to have a monthly shortage and cause me to go into default. This is BAD information to be giving out to the general public when it's FALSE information!!

Consumer Complaint: I own a 2 Family Home in New York XXXX. This is my Primary residence and the only home I own. There is a Mortgage Loan on the house, being serviced by SPS - Select Portfolio Servicing. I have been a very regular customer since the beginning. However due to COVID 19 my XXXX Business had to be closed down, from XX/XX/2020, as the whole City was shut down by the NY Governor for a few months. As there is no business I was not able to even cover the Rent for my XXXX. So my Business is still not open. I am waiting for Govt. Loan so that I can reopen the business again. And my tenants also stopped paying rent from XX/XX/2020. Despite all these severe hardships, I kept on paying my Mortgage from my Savings until XXXX last year. Since I exhausted my Savings and many of my friends were already taking Forbearance from XX/XX/2020 itself, I also applied for Forbearance. SPS gave me 3 Months ' Forbearance from XX/XX/2020 till XX/XX/2020. Since they were pressing me for starting the payments, I somehow managed to pay for 2 months. Then again I requested them for Forbearance. But they refused for the strange reason that I did not want Forbearance. How can I say that I do not want further Forbearance, when I am suffering such severe financial hardships? And now they are saying I have no Loss Mitigation offers on my account, which is very very strange. I am given to understand that under the CARES Act, it allowed a total of 12 Months ' Forbearance. And now with the new Federal Govt., I heard it is extended by another 6 months for a Total of 1 Year and 6 months. So how come, SPS gave me only 3 Months ' Forbearance, and then telling me that I have no other Loss Mitigation Offers.

Consumer Complaint: We fell behind on our mortgage and sps servicing made a trial loan modification. I have a letter from them accepting agreement. Dated XXXX. I made the 3 payments for XXXX, XXXX and XXXX. SPS is holding my XXXX payment hostage. Which they cashed the check. I made it every third of the month. There making it look like we did not make the 3rd payment! There holding the payment until my husband signs agreement saying they can pull the payment on the XXXX of the month. Mind you our S.S.does not hit the account till theXX/XX/XXXX I don't trust them since they keep changing the payment amounts. Constantly harassment, XXXX XXXX XXXX

Issue: Struggling to pay mortgage

Consumer Complaint: I have been trying to work with my lender for several months now and every week they continue to ask me the same questions over and over again. Today, my counselor XXXX XXXX who is helping us through this difficult time spoke to a supposed supervisor by the name of XXXX who just wasted more time. XXXX was advised that for weeks now we have advised SPS that I ( XXXX ) started working on XX/XX/2021 and my wife never stopped working. On their XXXX there was two sections where you advise what is the start date of employment. I don't understand how inept their underwriters are in getting my review completed. I am losing my home because these people don't care and are poorly handling my request for help! For over 30 days now we keep going back and forth on my income, this is ridiculous of them.

Consumer Complaint: Hello I am resubmitting my complaint since I didnt get a resolution and my complaint was closed due to a pending loan modification but my loan modification has been denied : I have tried to apply for loan modifications in order to avoid losing my home and to afford making payments and the loan modifications have been rejected. Now Im trying to refinance but my 2nd lien, also SPS, had a 15 year balloon payment which ended XX/XX/2020 so they stopped accepting my payments. I need to get SPS to accept my payments from XXXX thru today in order for me to be able to refinance. I can not refinance without having payments up to date. I can only afford my house with lower payments which can be done through the refinance which will payoff both loans. If not Im stuck and need to prevent losing my home to a foreclosure.

Consumer Complaint: Wish to file a formal complaint against XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX for alledge [ Mortgage fraud, and Identity theft ] Please refer to File XXXX, XXXX, XXXX The bank knowingly filed a Document number XXXX based on a Fraud Mortgage that was submitted to CFPB by SPS. I XXXX 's supposedly signature on the Mortgage is ( Fraud ) and this Fraud was reported to SPS who services this mortgage on XX/XX/XXXX among other Notarized Fraud signatures of XXXX discovered on the loan process. Debt Collector XXXX XXXX XXXX XXXX who repeatedly filed Foreclosure lawsuits on behalf of Plaintiff XXXX XXXX XXXX XXXX was also Notified of the Fraud Signature on the Mortgage back on XX/XX/XXXX and they still filed foreclosure lawsuits and repeatedly ask the court for six months extension to prepare their ( Pretrial statement ) year after years. I don't understand why they threaten me like this and how long more years does this bank ask for more extentions if they believe the mortgage is Valid. I notified them of the Frauds and those are the same Frauds I intent to use in Court, based on their recorded XXXX XXXX which is also Fraud. Please see attachments on File number XXXX of attachments to support this complaint.My mortgage was recorded as Document number XXXX, so therefore if any other mortgage was recorded based on the Mortgage submitted to CFPB by XXXXelective Portfolio Services Inc. it is a Fraud and an attempt to defraud an innocent consumer.

Consumer Complaint: I've been sending in documents to the servicing company of my loan to help with a short pay so I wont lose my home. Apparently the servicer decided to withdraw my application. stating it was incomplete with no activity for 30 days. That is a lie, I have been sending documents daily to this company and if there was some thing that needed to be completed then I never received a notice stating it was incomplete. Failure on their part to notify me put me at further risk of losing my home. Since I will not be making the payments they want because of lack of funds to do so. I can however obtain a loan for the appraisal value and pay this company off but they would rather see me lose the home than help me retain my home.
