Consumer Complaint: I am writing this letter of hardship to explain my financial situation that caused me to fall behind on my mortgage. We have owned this home for 23 years and have always been responsible home owners but we never imagined the our financial and health would take a huge hit in 2020. We fell past due on our mortgage in XX/XX/2020 due to XXXX-XXXX, I am a correctional officer for the State of Ohio for the las 21 years and in XXXX we had a huge out break of XXXX hit our Prison, when this happen our full times shift got reduced to below half, all over time and special pay went away due to limited capacity of officers allowed in the prison to prevent the spread. In addition, I came in contact with XXXX and had to distance my self for 2 weeks without pay and was not able to go home due to my wife having a chronic illness Acute intermittent XXXX which XXXX XXXX would have killed my wife if she came in contact with the decease because of this I had to stay in a hotel away from my family which my work did not cover. With already my little income and huge reduction my net income took a huge hit and I fell past due with my mortgage, unfortunately. I am now back at work full time and have received my vaccine shot. Please help me get my mortgage back and current so I can keep a rook over my family 's head and save my piece of the American pie, my home. I have applied for a Loan Modification with SPS but they refuse to review my application, I have always submitted all items as they asked but each time they tell me they offered me a repayment plan which they never did but since they offered me this one time they are refusing to work with me. In addition the lender will not provide me with a denial letter or a single point of contact and are actively proceeding with foreclosure while I work with them for help. I feel they are more interested in my home than helping a Law Enforcement Officer and his family save their home from foreclosure.

Consumer Complaint: ( 1 ) I am an African-American citizen residing in XXXX XXXX, PA. ( 2 ) I executed a HELOC mortgage loan contract with XXXX XXXX XXXX on XX/XX/XXXX. The original HELOC contract has never been modified and the terms and conditions of the HELOC contract do not specify any " balloon payment ''. ( 3 ) I received a letter dated XX/XX/XXXX stating that the ownership of my HELOC loan had been transferred from XXXX XXXX XXXX to an organization named " Towd Point Master Funding Trust XXXX ''. The XX/XX/XXXX letter states ( in part ) : " The assignment, sale or transfer of your mortgage loan does not affect any term or condition of your Mortgage, Deed of Trust or Note. '' ( 4 ) I received a letter dated XX/XX/XXXX stating that the servicing of my HELOC loan had been transferred from XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX ( " SPS '' ) effective XX/XX/XXXX. The XX/XX/XXXX letter states ( in part ) " [ n ] othing else about your mortgage account will change '' and " [ t ] he assignment, sale or transfer of the servicing of the mortgage account does not affect any term or condition of the mortgage instrument, other than the terms directly related to the servicing of your mortgage account. '' ( 5 ) On or about XX/XX/XXXX, I received a final written monthly statement from XXXX XXXX XXXX stating the current HELOC balance due was {$79000.00}. The final XXXX XXXX XXXX XXXX statement covers the billing cycle XX/XX/XXXX thru XX/XX/XXXX. ( 6 ) On or about XX/XX/XXXX, I received an initial HELOC statement ( dated XX/XX/XXXX ) from SPS stating the current HELOC balance due was {$86000.00}, including a " balloon payment '' of {$8300.00}. This initial SPS HELOC statement characterized the new balloon payment as follows : " The Outstanding Principal balance includes the Interest Bearing Principal balance and the Deferred Principal balance. The Deferred Principal balance is not subject to the charged interest rate and will be due as a final balloon payment on the earlier of ( a ) payoff of the Interest Bearing Principal balance, or ( b ) maturity date of the mortgage loan. '' ( 7 ) Towd Point Master Funding Trust and SPS have unilaterally and unlawfully modified my original HELOC contract and added a new {$8300.00} balloon payment to my HELOC contract. I have included the preceding twenty-five ( 25 ) XXXX XXXX XXXX monthly statements as evidence that this balloon payment did not exist until after Towd Point Master Funding Trust XXXX and SPS acquired my HELOC contract. ( 8 ) I request that Towd Point Master Funding Trust and SPS ( 1 ) immediately cease and desist their efforts to collect the illegal {$8300.00} balloon payment and ( 2 ) notify the Pennsylvania Attorney General and all credit reporting agencies regarding its unlawful collection efforts in this matter.

Consumer Complaint: Hello. When Covid struck back in XX/XX/XXXX, many of us within the Local lost our jobs including myself. While I continued to pay my mortgage, in XX/XX/XXXX I received a letter from my mortgage provider, Select Portfolio Servicing , Inc., Which stated, if you have been experiencing a hardship due to COVID-19 to call the XXXX number. Upon doing so, Select Portfolio Services offered me a three month hiatus. Then, in XX/XX/XXXX, I was given another three month hiatus extension. This happened again in XX/XX/XXXX, whereby, I was following their own rules. I was asked to check in once a month which I did. As we came in to XXXX, Select Portfolio Services says they were going to work with me. As a matter of fact onXXXX XXXX I spoke with one of the representatives, XXXX, whom stated they were looking into a forbearance plan which involved a possible loan modification. She to asked me to check in weekly after I provided my paystubs and tax returns. After providing tax returns and paystub s, and following up with them, I was told several times, that they did not receive the documentation and to resubmit. Depending upon whom I spoke to, the information provided was always different. Now, a month later, I just received a letter on XXXX XXXX, stating they are unable to offer any assistance and they attached a letter of foreclosure which stated if {$36000.00} was not paid then their intention is to foreclose on the property.

Consumer Complaint: I'm trying to work out a short pay offer on my loan with the " mortgage owner '' and the mortgage servicer will not supply me with the name and contact information of the " mortgage owner. The servicing company send me the original note when I ask for the information and they know that the original note holder filed bankruptcy over 20 years ago and is no longer a company. All of the mortgages were bought out by investors but the servicing company that services my loan will not give me the correct information. However, when I apply for mortgage assistance through them they have to contact the investor to get this approved so therefore that tells me they know exactly who holds the lien.

Consumer Complaint: My home received substantial flood and windstorm damage XX/XX/XXXX, yes I said XXXX. As of today XX/XX/XXXX Select Portfolio Servicing has refused to release all of the insurance funds they are holding despite over sixty pages of repair documentation from contractors, my attorney and myself. I gave up trying to deal with SPS directly and hired an attorney. SPS lied to the attorney several times and still refuses to release MY insurance proceeds. My attorney has had no luck trying to deal with this issue despite calls and emails. SPS is still calling me direct concerning the issue when they are suppose to talk to my attorney not me. They told me today that my issue is being reviewed by management. ( What!! Really!! ) My attorney suggest we may have to go to the next step which would be litigation as the only option. All is want is my insurance funds as I haven't been able to complete the repairs to my home almost four years later due the actions of SPS. I have been clearly damaged by the actions of SPS.

Consumer Complaint: In XXXX, XXXX, I applied for a mortgage modification with Select Portfolio Servicing due the Winter Freeze in XXXX, XXXX, recent health issues to where I got behind on my mortgage. I was told at the time that I qualified for a modification so I proceeded with the application process. I went online to check the status of the loan modification and was given a repayment plan for a year in the amount {$1200.00} which is way beyond what I can afford. I clear only {$2100.00} but I have a car payment at {$450.00}, car insurance at {$160.00}, high utility bill which we are getting gouged from the Winter Storm and there is no money left for transportation to work and food. I feel that they made this payment plan unaffordable with the intention to take my home away. It's beyond unconscionable for them to do this. I was willing to continue paying the {$950.00} or the original {$860.00} payment if they would defer the arrears to the end of the term. I am not trying to not pay for what I owe but I need help! Due to the Coronavirus, my employment is on a pay freeze and I am unable to increase my income due a back injury from a car accident back in XXXX. SPS is a such a shady mortgage company, they charge all kinds of fees and act like they will help but when it comes down to it, they are always threatening to foreclose. I fight them every time and I am stuck with them holding my mortgage. I am working on my credit but it's a long process since I am still trying to clean up old debt from my job layoff in XXXX and XXXX. I am hoping once I get my credit good, I can refinance with my bank to get my home away from SPS. Can you help and maybe get them to put the arrears at the end of my term or modify my loan.
